Brief For The Navajo Nation, Ute Mountain Ute Tribe, Southern Ute Tribe, The Crow Nation, And Cheyenne River Sioux Tribe As Amici Curiae Supporting Respondent, Paul Spruhan
Faculty Scholarship
The Navajo Nation, the Ute Mountain Ute Tribe, the Southern Ute Tribe, the Crow Nation, and the Cheyenne River Sioux Tribe submit this amicus brief in support of Respondent Castro-Huerta.1 The signatory tribes do so to contest the State of Oklahoma’s argument that states have inherent criminal jurisdiction over crimes committed by non-Indians against Indians in Indian Country. Amici curiae are signatories to “Peace Commission” treaties with the United States that affirm tribal sovereignty over their territory to the exclusion of the states, with the federal government assuming the responsibility to arrest and prosecute non-Indian “bad men” who commit offenses …

Essays On Marginal Treatment Effects, Vitor Augusto Possebom
Essays On Marginal Treatment Effects, Vitor Augusto Possebom
Yale Graduate School of Arts and Sciences Dissertations
In this dissertation, I discuss identification problems with two sources of endogeneity. In both chapters, one source of endogeneity is self-selection into treatment. To address this problem, I use the Marginal Treatment Effect framework developed by Heckman and Vytlacil (2009). In the first chapter, I partially identify the marginal treatment effect (MTE) function when the treatment variable is misclassified. To do so, I explore three sets of restrictions on the relationship between the instrument, the misclassified treatment and the correctly measured treatment, allowing for dependence between the instrument and the misclassification decision. If the signs of the derivatives of the …
System Abstractions For Scalable Application Development At The Edge, Bo Hu
System Abstractions For Scalable Application Development At The Edge, Bo Hu
Yale Graduate School of Arts and Sciences Dissertations
Recent years have witnessed an explosive growth of Internet of Things (IoT) devices, which collect or generate huge amounts of data. Given diverse device capabilities and application requirements, data processing takes place across a range of settings, from on-device to a nearby edge server/cloud and remote cloud. Consequently, edge-cloud coordination has been studied extensively from the perspectives of job placement, scheduling and joint optimization. Typical approaches focus on performance optimization for individual applications. This often requires domain knowledge of the applications, but also leads to application-specific solutions. Application development and deployment over diverse scenarios thus incur repetitive manual efforts. There …
Religion Vs. Politics: Which Wins At A Christian Liberal Arts University?, Amanda Williams
Religion Vs. Politics: Which Wins At A Christian Liberal Arts University?, Amanda Williams
Political Studies Student Projects
Scholars have studied the effects of framing on different groups of people for decades. There has also been research on the relationship between religious beliefs and politics. This article takes the unique population of a Christian college campus to combine the test of faith against politics through subtle framing. When faced with a political frame, will these Christians ultimately side with their political beliefs or their religious beliefs? I found through a questionnaire experiment run in November 2021 on Taylor University students and some faculty that religious beliefs prevailed. This result is somewhat surprising giving the current political climate, but …

Flood Risk Prediction In Southern Louisiana Using Support Vector Machines, Claire Dorsett
Flood Risk Prediction In Southern Louisiana Using Support Vector Machines, Claire Dorsett
Mathematics Senior Capstone Papers
Flooding in Southern Louisiana is a growing concern as violent weather becomes more frequent. According to the Environmental Protection Agency (EPA), Louisiana soils have become drier and annual rainfall trends have increased, which may lead to more severe flooding in the coming years. In light of this change in weather trends, flood prediction has become increasingly important for the public’s safety. The focus of this paper is to apply the Support Vector Machine (SVM), a machine learning technique, to classify flood risks based on water gage height, wind speed and direction, and time of the year. In this paper, the …

This Fence Makes No Sense: Developing A Community Engagement Curriculum For Swampscott, Ma, Elana Zabar
Community Engagement Student Work
This project sought to understand the best way to integrate non-exclusionary community engagement into Swampscott, Massachusetts. A curriculum that would encourage municipal officials of Swampscott, MA to develop a more inclusive community engagement process was built and presented to local community engagement practitioners, both affiliated and not affiliated with the municipality, for their feedback. The curriculum suggests creative engagement solutions the town can offer to community members throughout a project's timeline, from idea generation to problem definition, to project development, to post-implementation feedback. These methods of engagement, written under the lens of the Transformative Paradigm, were specifically designed to reduce …

Substance Use Awareness: A Unique Look At Social Policy For Children And Families, Malik Hamm
Community Engagement Student Work
This work is a collection of substance use and addiction research gathered in order to assess substance abuse treatment and services in regard to equity and inclusion. The history of the U.S. government’s approach to substance use policy has led to stigma, criminality, and marginalization between groups in our community. Youth and families of all demographics are looking for ethical, informed mental health and substance use services to provide the best outcomes. Stigmatizing language, overly marketed tobacco and alcohol products, restrictive policy, and rigid law-enforcement tactics promoting the criminality of both adults and juveniles for possession, trafficking, and operating under …
Destruction, Reconstruction, & Migration In The Wake Of Wildfires, Kathryn Mcconnell
Destruction, Reconstruction, & Migration In The Wake Of Wildfires, Kathryn Mcconnell
Yale Graduate School of Arts and Sciences Dissertations
The scale of wildfire destruction has grown rapidly in recent years, destroying nearly 25,000 buildings in the U.S. during 2018 alone. Recently, scientists have developed nationwide wildfire event data, making it possible to model wildfire effects on human migration. In Chapter 1, quarterly data on residential mobility from the Federal Reserve Bank of New York/Equifax Consumer Credit Panel are paired with building destruction counts from the U.S. National Incident Management System/Incident Command System database of wildfire events to evaluate the effects of wildfire destruction on migration probabilities in the U.S. between 1999 and 2018. Findings indicate that only the most …

Faculty Scholarship
This Article comprehensively reviews the law of stated culpability requirements in Model Penal Code (MPC) jurisdictions. Part I provides an overview of section 2.02(4), explaining how the provision works and its role in the MPC’s culpability scheme. Part II then identifies section 2.02(4)’s main weaknesses, drawing on both the provision itself and the Code’s commentary. Next, Part III reviews the law in the twenty-five states with culpability provisions influenced by the MPC, identifying specific problems that section 2.02(4) has created in the case law. Finally, Part IV recommends new stated-culpability rules that improve section 2.02(4) and more rigorously enforce the …

Preventing And Responding To Juvenile Crime: Importance Of Intervention And Rehabilitation, Michaela Noviello
Criminology Student Work
With about 2.1 million juveniles arrested per year, it is important for researchers and juvenile justice employees to consider, protect and maximize the full potential of juveniles from their early adolescence up until release from detention centers or foster care. This paper highlights early traits and behaviors consistent in juveniles who commit crime as well as factors that may contribute to crime. While focusing on early indicators that may lead to juvenile crime, the paper also discusses rehabilitation and intervention after juvenile crime has been committed. After discussing the research on preventing and responding to juvenile crime, the paper outlines …

Regulating Police Chokeholds, Trevor George Gardner, Esam Al-Shareffi
JCLC Online
This Article presents findings from an analysis of police chokehold policies enacted at the federal, state, and municipal levels of government. In addition to identifying the jurisdictions that restricted police chokeholds in the wake of George Floyd’s death on May 25, 2020, the Article conveys (via analysis of an original dataset) the considerable variance in the quality of police chokehold regulation. While many jurisdictions regulate the police chokehold, the strength of such regulations should not be taken for granted. Police chokehold policies vary by the type of chokehold barred (“air choke” and/or carotid choke), the degree of the chokehold restriction, …
Losing Someone Then Losing Yourself: Helping Juveniles In The Justice System Experiencing Grief With A Trauma-Informed Pretrial Diversion Program, Sydney Ford
JCLC Online
Grief is something we all experience at some point in our lives. When a child experiences grief and loss, those emotions, if not addressed, can cause adverse effects. Many of our country’s detained youth have fallen victim to these effects because they have been unable to address the underlying grief that causes their behaviors. Because of this, this Article advocates for creating a trauma-informed pretrial diversion program focused on helping grieving youth. First, this Article examines the overwhelming number of grieving children in our juvenile justice system, and how their grief has led them to where they are today. Second, …
