Heirs Of An Administration: Unlawful Executive Actions, Jerome Perez
Heirs Of An Administration: Unlawful Executive Actions, Jerome Perez
Catholic University Law Review
The Supreme Court of the United States in DHS v. Regents on June 18, 2020, decided to stall the Trump administration from rescinding the Deferred Action for Childhood Arrivals (DACA) policy that the Obama administration created contrary to the Administrative Procedures Act (APA)––even though in 2016 the Supreme Court affirmed a preliminary injunction on the Deferred Action for Parents of Americans (DAPA) policy, which mirrors DACA. This blunder offhandedly sacrifices the Supreme Court’s reputation as nonpartisan by enlisting itself as the future arbiter of administrative issues with self-evident resolutions and deciding contrary to those resolutions to endorse a political agenda. …

The Case Against Florida Statute §98.0751, Lyndsey Gallwitz
The Case Against Florida Statute §98.0751, Lyndsey Gallwitz
Akron Law Review
Felony disenfranchisement laws prevent millions of American citizens from voting. While the recent legal trend has been to eradicate felony disenfranchisement, each state currently has a unique framework, and the issue remains unsettled nationwide. In 2018, the state of Florida passed a constitutional amendment that allowed felons to regain their right to vote once their sentence was finished. Soon after, the Governor DeSantis signed Fla. Stat. Ann. § 98.0751 into law, which required felons to pay off all court cost before their right to vote will be restored. This new law prevented thousands of otherwise eligible felons from voting in …
You Have The Duty To Remain Silent: How Workplace Gag Rules Frustrate Police Accountability, Frank D. Lomonte, Jessica Terkovich
You Have The Duty To Remain Silent: How Workplace Gag Rules Frustrate Police Accountability, Frank D. Lomonte, Jessica Terkovich
Akron Law Review
This Article traces the First Amendment caselaw that, for more than half a century, has sided with speakers facially challenging overbroad workplace policies that forbid sharing information with the press and public. The Article then reports on the results of a nationwide survey of police and sheriff’s department policies by the Brechner Center for Freedom of Information, concluding that well over half of the nation’s biggest law enforcement agencies have rules on the books that resemble—or are identical to—those struck down as unconstitutional when challenged, at times in defiance of binding circuit-level precedent. The Article examines why these legally dubious …
Psilocybin Psychotherapy With Acceptance And Commitment Therapy: A Potential Treatment For Social Anxiety Disorder, Elliot Sandberg
Psilocybin Psychotherapy With Acceptance And Commitment Therapy: A Potential Treatment For Social Anxiety Disorder, Elliot Sandberg
Honors Scholars Collaborative Projects
Individuals diagnosed with social anxiety disorder (SAD) require effective therapeutic interventions. Due to the nature of SAD, individuals tend to not seek care for their treatment, leading to the continuation of avoidance behaviors that significantly impact their daily existence. Psilocybin psychotherapy has the potential to lead to significant changes in the personality structure of individuals as well as reducing anxious responses to their environment in a relatively short period of time. Acceptance and commitment therapy (ACT) can serve as the ideal therapeutic backing to psilocybin as it emphasizes mindfulness and psychological flexibility, both of which aid in the therapeutic mechanisms …

Department of Supply Chain Management and Analytics: Faculty Publications
The dire state of the COVID-19 pandemic crisis symbolized the urgency for efficient distribution and administration of vaccines to combat the virus as the most urgent public health service. This paper presents a prototype multi-criteria decision support model based on goal programming that can effectively support vaccination plans for the greater good of society. The optimization goals of the model include minimizing the number of fatalities and risk of spreading the disease, while complying with government health agency’s priority guidelines for vaccination. This study applied the model to a real-world dataset to demonstrate how it can be effectively applied as …
Restoration Of Second Amendment Rights From A Lifetime Ban Imposed By 18 U.S.C. § 922(G)(4): The Sixth Circuit Provides A Path Forward, Bennett E. Kuhar
Restoration Of Second Amendment Rights From A Lifetime Ban Imposed By 18 U.S.C. § 922(G)(4): The Sixth Circuit Provides A Path Forward, Bennett E. Kuhar
Cleveland State Law Review
Title 18 U.S.C. § 922(g)(4) imposes a disability prohibiting the ownership and possession of firearms on individuals who have been previously involuntarily committed. Because of an inconsistent patchwork of state and federal laws, relief from this disability, or restoration of an individual’s fundamental right to own or possess firearms, is not available to all people. In effect, some individuals who have been previously involuntarily committed face a lifetime ban, while other similarly situated people can own or possess firearms once again. This issue has created a circuit split between the Third, Sixth, and Ninth Circuits. Despite applying the same constitutional …

High-Mountain Hazards In The Indian Himalaya: An Assessment Of The Causes And Effects Of The Chamoli Flood In 2021, Christina Maria Salzmann
University of Montana Conference on Undergraduate Research (UMCUR)
On 7 February 2021, a cascade of events severely impacted the mountainous river valleys in India’s northwestern District of Chamoli. A bedrock failure beneath a hanging glacier on Ronti Peak released an ice rock avalanche, which in turn resulted in a flood. Widespread devastation, complete destruction of two hydropower projects and more than 200 fatalities were the outcome. The purpose of this study was to assess some of the causes and effects of the flood. I used Planet© satellite imagery to assess potential causes and visualize the extent of the disaster. Using two high-resolution Digital Elevation Models (DEMs), I created …

Mental Health Focus As A Deterrent For Justice Involved Youth, Miyah Seckinger
Mental Health Focus As A Deterrent For Justice Involved Youth, Miyah Seckinger
Honors Projects
Tough-on-crime policies regarding youthful offending have resulted in a pendulum swing in which the juvenile justice system has shifted from a rehabilitative focus to one of punishment. The current paper evaluates different mental health program alternatives, as an option to return to a rehabilitative focus for juveniles, with a major focus on the Juvenile Treatment and Support Court in Kent County, Michigan. Through a qualitative analysis, there were findings of initial success with the youthful offenders presented in the court. Recommendations and limitations from the study are presented to aid further policy change and research.

Canada’S Emergencies Act: Responding To The Blockade Of An International Border, Justin Zarka
Cardozo International & Comparative Law Review (CICLR) Blog
On February 14, 2022, Canadian Prime Minster Justin Trudeau invoked the Emergencies Act in response to civil unrest in the country. The Emergencies Act is a federal law of Canada which provides the government substantial powers in the event of a national emergency. The Emergencies Act cannot be invoked unless there exists a national emergency as defined in the statute. The statute defines a national emergency as “an urgent and critical situation of a temporary nature that (a) seriously endangers the lives, health, or safety of Canadians” or “(b) seriously threatens the ability of the Government of Canada to preserve …

Safety Evaluation Of Amusement Rides Using Accumulated Accident Data: Accident Data Framework, Kathryn Woodcock
Safety Evaluation Of Amusement Rides Using Accumulated Accident Data: Accident Data Framework, Kathryn Woodcock
Journal of Themed Experience and Attractions Studies
Amusement rides and devices are a popular form of recreation and important component of the tourism industry. Injury-producing accidents are rare, and the viability of the industry relies on perceived safety of the activity. Some existing metrics use accumulated accident reports. Several metrics tabulate the number of injuries, but none collect enough information about the context of accidents to analyse the accumulated data to deduce patterns. This paper describes an Accident Data Framework for a minimal set of variables from reports of amusement device accident, and the structure for a useful narrative to aid reporters and recorders to avoid introducing …
