How Favored, Exactly? An Analysis Of The Most Favored Nation Theory Of Religious Exemptions From Calvary Chapel To Tandon, Luray Buckner May 2022

How Favored, Exactly? An Analysis Of The Most Favored Nation Theory Of Religious Exemptions From Calvary Chapel To Tandon, Luray Buckner

Notre Dame Law Review

In this Note, I argue that Justice Kavanaugh’s most favored nation test for religious exemptions actually differs from the one employed by the majority of the Court in Tandon. The majority’s formulation of the test is vague and explicitly requires courts to engage in a fact-intensive comparability analysis. Practically, lower courts applying Tandon to religious exemption questions have exploited this comparability step to rule against religious claimants generally, but more specifically to deny them strict scrutiny. Because the Tandon test was formulated to apply to all free exercise claims, the test is necessarily framed in more general terms and …

The Vigilante Identity And Organizations, Fan Xuan Chen, Maja Graso, Karl Aquino, Lily Lin, Joey T. Cheng, Katherine Decelles, Abhijeet K. Vadera May 2022

The Vigilante Identity And Organizations, Fan Xuan Chen, Maja Graso, Karl Aquino, Lily Lin, Joey T. Cheng, Katherine Decelles, Abhijeet K. Vadera

Research Collection Lee Kong Chian School Of Business

We test the theoretical and practical utility of the vigilante identity, a self-perception of being the kind of person who monitors their environment for signs of norm violations, and who punishes the perceived norm violator, without formal authority. We develop and validate a measure of the vigilante identity scale (VIS) and demonstrate the scale’s incremental predictive validity above and beyond seemingly related constructs (Studies 1 – 2e). We show that the VIS predicts hypervigilance towards organizational wrongdoing (Studies 2 and 4), punishment intentions and behavior in and of organizations (Studies 3 and 4) as well as in the wider community …

Print News Media And Prisoner Reentry: An Exploratory Study Of Local Newspapers In 2018, Sydney Gaughan

Sociology and Criminology Undergraduate Honors Theses

In hopes to fill gaps on this subject, the current study uses ethnographic content analysis on newspaper articles while investigating the following research questions: (1) How does local news media portray recidivism by reentering prisoners? and in turn, (2) What are some characteristics of those news articles associated with the likelihood of local media using specific portrayals or “frames”?

There are several reasons to examine these research questions. First, this research aims to convey how local news media might use their positions to create narratives for public consumption that foster worry and panic. This study can shed light on the …

Divided We Fall: Gender-Based Occupational Segregation In Kentucky’S Executive Branch 2012-2020., Hillary Mcgoodwin Abbott

Electronic Theses and Dissertations

Fifty-eight years have passed since the Title VII of the Civil Rights Bill of 1964 was signed into law, yet discrimination in employment still occurs; the Kentucky Executive Branch is no exception. This paper will use Theodore Lowi’s agency typology and EEOC categorical data from the 2012 and 2020 Kentucky Office of Diversity and Employment Training Semi-Annual Report on Female and Minority Employment (SAR) to identify gendered occupational segregation in three distinct Executive Branch agencies, address potential contributing factors and areas of change (Alkadry & Tower, 2006; Lowi, 1985; Newman, 1994; Escriche, 2007). Addressing any underlying discriminatory practices that may …

A Dangerous Pursuit Of Safety: The Value Of Freedom Of Expression And The Folly Of Trading It Away, Nina Katarina Štular '22 May 2022

A Dangerous Pursuit Of Safety: The Value Of Freedom Of Expression And The Folly Of Trading It Away, Nina Katarina Štular '22

Honor Scholar Theses

Freedom of expression has always been weighed against other values. Like all freedoms, it brings with it a degree of risk that it will be misused to do ill. In the work ahead, I hope to offer a reminder of the value of free expression and a warning against the folly of over-restricting it. Those in favor of censoring and regulating expression too often feign to act as protectors of the much desired public or community safety. What censorship really produces, however, is at best a mere illusion of safety. Only an environment in which all ideas, no matter how …

The Frames And Tactics Of The Women's Representation Movement, Desiree Alvarez

Sociology & Anthropology Theses - Archive

Studies of social movements have yet to examine the modern women’s political representation movement, a social movement industry made up of nonprofit organizations, foundations, activist groups, and political action committees aiming to create gender parity within U.S. political systems. Using in-depth interviews with fifteen leaders of organizations within the women’s representation movement, this study reveals multi-faceted dynamics at play when tactics and frames are developed within organizations of this social movement industry. Findings reveal that frame and tactical development are influenced by several key factors, such as: cohort collaboration, funders, an established hierarchy of old versus new social movement organizations …

School Funding - Essential Programs and Services (EPS)

Background

The Career and Technical Education (CTE) funding model was implemented in FY2019 after a lengthy period of development. The component was scheduled for a review in FY2020 and FY2021 as part of the ongoing cycle of analysis of all major components of Maine’s Essential Programs and Services (EPS) education cost model. Due to the breadth and complexity of the CTE funding model, and the fact that this is the first time it has been reviewed to see how it is being implemented in actual practice, the findings have been broken into several sections. Appendix A provides the overall plan …

References To Babe Ruth In Advocacy And Judicial Opinions, Douglas E. Abrams

Faculty Publications

The common theme of these “Writing It Right” articles is that the courts’ use of well-known cultural references in their opinions invites advocates to enhance their briefs and other submissions with references to similar well-known cultural markers. Advocates’ appropriate references to Babe Ruth, a true cultural icon, fit the bill.

However, we are still seeing concerning staff shortages in healthcare, and it is being attributed to burnout caused by the effect COVID has had on work environments. This study measured rates of shared trauma, perceived organizational support, and burnout among rural healthcare workers in …

The Effect Of Post-Traumatic Stress Disorder On First Responders Following A Disaster: A Literature Review, Briar Butner

Capstone Experience: Master of Public Health

First responders work in a high-stress environment that can potentially produce traumatic situations. This includes aiding in the recovery and response efforts of critical events such as a disaster. A significant risk factor for developing post-traumatic stress disorder symptoms is people who have been through a disaster (National Institute of Mental Health, 2019). This literature review aims to search for evidence on PTSD in first responders following a disaster, identify the factors associated with the development of PTSD, and make recommendations on best practices to reduce or mitigate the incidences of PTSD. The search was conducted in three academic databases: …

An Iterative Theory Of The Legislative Process : A Case Study Of The New York State Commission On Prosecutorial Conduct, Kimberly M. Bernstein May 2022

An Iterative Theory Of The Legislative Process : A Case Study Of The New York State Commission On Prosecutorial Conduct, Kimberly M. Bernstein

Legacy Theses & Dissertations (2009 - 2024)

Prosecutors wield the power of the criminal justice system (Medwed, 2014) and the ability to deprive a person of their constitutional rights (Imbler v. Pachtman, 1976). With such power, it is unsurprising that a leading cause of miscarriages of justice is prosecutorial misconduct (e.g., Joy, 2006; Ridolfi & Possley, 2010). New York State became the first state in the country to respond to this issue with a specialized Commission on Prosecutorial Conduct (CPC). The goal of the CPC is to serve as an official mechanism for holding District Attorneys and Assistant District Attorneys accountable by challenging convictions and handing down …

The First Amendment Weaponized: When Guns Become Public Discourse, Danny Li

William & Mary Bill of Rights Journal

This Article discusses First Amendment challenges asserted against gun control measures—inside and outside our courts. It explains at length why existing doctrinal approaches to resolving these challenges fail, providing an alternative account of why the First Amendment should not be construed liberally to protect the open carry of firearms. As guns in public spaces and protests become commonplace, we can expect not only continual First Amendment challenges to gun control measures, but also the growing prevalence of First Amendment claims asserted in the public by advocates and gun owners to justify open carry—and the forging of new constitutional meanings and …

Federal Income Taxation, Andrew Todd May 2022

Federal Income Taxation, Andrew Todd

Mercer Law Review

In 2021, the United States Court of Appeals for the Eleventh Circuit handed down several opinions involving U.S. federal income tax issues. Two of the court’s published opinions address federal income taxation of conservation easements. Conservation easements have been under significant scrutiny by the Internal Revenue Service (IRS), having earned a spot on the “Dirty Dozen” list of tax scams in 2019. This Article surveys the two published opinions issued in 2021 involving the U.S. federal income taxation of conservation easements.
