Life In Mossville, Louisiana: Policy Implications Of Toxic Waste Exposure And Environmental Racism, Clare Kelsey Jan 2022

Life In Mossville, Louisiana: Policy Implications Of Toxic Waste Exposure And Environmental Racism, Clare Kelsey

Theses

Environmental damage disproportionately affects communities of color. Understanding how environmental racism uniquely affects marginalized communities is crucial to effectively develop public policies that will address the systematic racism that is rooted in many existing policies and practices. The town of Mossville, Louisiana provides a case study of a Black town that experienced devastating environmental pollution as well as displacement from the oil and petrochemical industries in the region (Rogers, 2015), with few residents still in the area. This thesis presents a qualitative study utilizing peer-reviewed literature, secondary sources, and life narratives of Mossville residents. These oral histories serve to amplify …

The Role Of Experts In Policymaking: An Assessment Of Witness Educational Backgrounds In Congressional Testimony, Benedicte Adair Jan 2022

The Role Of Experts In Policymaking: An Assessment Of Witness Educational Backgrounds In Congressional Testimony, Benedicte Adair

Theses

This thesis provides a first-of-its kind benchmark on the extent to which academically-trained professionals in the United States are availed of opportunities to directly deliver evidence to the United States Congress, as well as how contemporary party politics shapes this system. We randomly sample and manually code the educational backgrounds of 2,147 witnesses from 32 Congressional Committee Hearings that occurred between 2001 and 2020. This study reveals three key findings. The first is that academically-trained professionals have extensive access to the halls of Congress. Second, that all types of degrees have at least some representation amongst witness calls. The third …

The Role Of Digital Channels In Predicting Objective And Subjective Negotiation Outcomes, Roshni Raveendhran, Tami Kim, Ji Woon Ryu Jan 2022

The Role Of Digital Channels In Predicting Objective And Subjective Negotiation Outcomes, Roshni Raveendhran, Tami Kim, Ji Woon Ryu

Business Faculty Publications and Presentations

Today’s hiring and workplace communications are increasingly occurring in the digital space, a trend accelerated by the coronavirus disease (COVID-19) pandemic. In two preregistered experiments and an internal meta-analysis, we test the subjective and objective impact of two digital channels—video and synchronous text—that are popularly used in today’s workplace contexts. In doing so, we isolate the role that richness of digital channels plays in influencing negotiation outcomes while holding synchrony constant. Specifically, we predicted that negotiating via video (vs. synchronous text) will foster better integrative outcomes and improve negotiators’ subjective outcomes. Results indicated that negotiating via video, compared to synchronous …

The Art Of Sim-Making: What To Learn From Film-Making, Fatimah Lateef, Brad Peckler, Eric Saindon, Shruti Chandra, Indrani Sardesai, Mohamed Alwi Abdul Rahman, S Vimal Krishnan, Afrah Abdul Wahid Ali, Rose V Goncalves, Sagar Galwankar Jan 2022

Department of Emergency Medicine Faculty Papers

The components of each stage have similarities as well as differences, which make each unique in its own right. As the film-making and the movie industry may have much we can learn from, some of these will be covered under the different sections of the paper, for example, "Writing Powerful Narratives," depiction of emotional elements, specific industry-driven developments as well as the "cultural considerations" in both. For medical simulation and simulation-based education, the corresponding stages are as follows: DevelopmentPreproductionProductionPostproduction andDistribution. The art of sim-making has many similarities to that of film-making. In fact, there is potentially much to be learnt …

Competition And Congestion In Trademark Law, Christopher Buccafusco, Jonathan S. Masur, Mark P. Mckenna Jan 2022

Competition And Congestion In Trademark Law, Christopher Buccafusco, Jonathan S. Masur, Mark P. Mckenna

Coase-Sandor Institute for Law & Economics Research Paper Series

Trademark law exists to promote competition. If consumers know which companies make which products, they can more easily find the products they actually want to purchase. Trademark law has long treated “source significance”—the fact that a particular trademark is identified with a particular producer—as both necessary and sufficient for establishing a valid trademark. That is, trademark law has traditionally viewed source significance as the only necessary precondition for a trademark being pro-competitive. In this paper, we argue that this equation of source significance and pro-competitiveness is misguided. Some marks use words that are so closely connected with the product being …

A Phenomenological Study Exploring The Client And Stylist Interaction As A Culturally Specific Form Of Coping With Stress For Black Women In The United States, Nicole Michelle Holden Jan 2022

A Phenomenological Study Exploring The Client And Stylist Interaction As A Culturally Specific Form Of Coping With Stress For Black Women In The United States, Nicole Michelle Holden

Doctoral Dissertations and Projects

The purpose of this study is to describe the experience of Black women who visit the salon regularly in the United States. This study is constructed around the culturally intimate relationship of the stylist-client interaction in the Black community as a historical coping mechanism in which Black women utilize for stress and life challenges rather than seek professional mental health services. Although COVID-19 continues to mount a significant mortality rate and financial hardships, its disproportionate effects on communities of color will have lasting implications on their mental health. The need for mental health services has increased due to the mental …

Racial Capitalism In The Civil Courts, Tonya L. Brito, Kathryn A. Sabbeth, Jessica K. Steinberg, Lauren Sudeall Jan 2022

Racial Capitalism In The Civil Courts, Tonya L. Brito, Kathryn A. Sabbeth, Jessica K. Steinberg, Lauren Sudeall

Faculty Publications

This Essay explores how civil courts function as sites of racial capitalism. The racial capitalism conceptual framework posits that capitalism requires racial inequality and relies on racialized systems of expropriation to produce capital. While often associated with traditional economic systems, racial capitalism applies equally to nonmarket settings, including civil courts.

The lens of racial capitalism enriches access to justice scholarship by explaining how and why state civil courts subordinate racialized groups and individuals. Civil cases are often framed as voluntary disputes among private parties, yet many racially and economically marginalized litigants enter the civil legal system involuntarily, and the state …

Eviction Courts, Kathryn A. Sabbeth Jan 2022

Eviction Courts, Kathryn A. Sabbeth

Faculty Publications

This Article examines the legal mechanics of the courts that issue eviction orders. It analyzes these courts in the context of the COVID-19 pandemic and the federal eviction moratoria. The eviction phenomenon preceded the pandemic, but the pandemic exaggerated many of its features. How the eviction courts responded to the eviction moratoria reveals a great deal about how these fora have been functioning all along. While the eviction moratoria were important, the design of eviction courts limited their impact.

The Article identifies ten groups of laws that structure critical design features of eviction courts: (1) filing fee statutes that make …

Automated Legal Guidance At Federal Agencies, Joshua D. Blank, Leigh Z. Osofsky Jan 2022

Automated Legal Guidance At Federal Agencies, Joshua D. Blank, Leigh Z. Osofsky

Faculty Publications

When individuals have questions about Federal benefits, services, and legal rules, they are increasingly seeking help from government chatbots, virtual assistants, and other automated tools. Current forms of automated legal guidance platforms include the U.S. Citizenship and Immigration Services’s “Emma,” the U.S. Department of Education’s “Aidan,” and the Internal Revenue Service’s “Interactive Tax Assistant.” Most scholars who have studied artificial intelligence and Federal government agencies have not focused on the government’s use of technology to offer guidance to the public. The absence of scholarly attention to automation as a means of communicating government guidance is an important gap in the …

Beyond The Marketplace Of Ideas: Bridging Theory And Doctrine To Promote Self-Governance, David S. Ardia Jan 2022

Beyond The Marketplace Of Ideas: Bridging Theory And Doctrine To Promote Self-Governance, David S. Ardia

Faculty Publications

This article proceeds in three parts. Part I examines the longstanding debate over the First Amendment’s purpose and explains why the marketplace of ideas theory has come to dominate both judicial and public understanding of the First Amendment’s speech and press clauses. The marketplace theory’s ascendancy, however, has proven to be problematic. It rests on an overly simplified account of public discourse, treating speech as merely a commodity that can be allocated through market-style transactions, and it has come to embody an extreme version of libertarian economic thinking that is undermining the very democratic processes the First Amendment was intended …

Restoring Faith In Military Justice, Eleanor T. Morales, John W. Brooker Jan 2022

Restoring Faith In Military Justice, Eleanor T. Morales, John W. Brooker

Faculty Publications

The military justice system was designed to maintain good order and discipline, strengthen national security, and achieve justice. After military leaders failed to effectively address the sexual assault crisis within the armed forces, Congress lost faith in this system. In response, Congress enacted sweeping legislative reform, transferring prosecutorial discretion for the most serious offenses from commanders to military lawyers. Unlike civilian prosecutions, most decisions within the military justice system have overwhelmingly favored one consideration: maintaining good order and discipline in the unit. While Congress’s reforms change who makes the decisions in many cases, they will have little effect unless military …

“Contractually Valid” Forum Selection Clauses, John F. Coyle Jan 2022

“Contractually Valid” Forum Selection Clauses, John F. Coyle

Faculty Publications

In Atlantic Marine Construction Company v. United States District Court, the Supreme Court held that a “contractually valid” forum selection clause should be enforced by federal courts absent extraordinary circumstances. Unfortunately, the Court provided no guidance on how to assess whether a clause is “contractually valid.” This Article fills the gap. It argues that the answer to this question turns on three separate inquiries. First, a court should determine whether the forum selection clause is valid. Second, the court should interpret the forum selection clause to determine whether it is exclusive and applies to the claims asserted. Third, the …

Covid-19 And The Perils Of Free-Market Parenting, Maxine Eichner Jan 2022

Covid-19 And The Perils Of Free-Market Parenting, Maxine Eichner

Faculty Publications

U.S. public policy has for decades rested on the expectation that parents will privately provide the cash and conditions their children need. This expectation is exceptional: most other wealthy countries’ public policies support children through a mix of public and private funds. The COVID-19 pandemic, however, radically changed U.S. policy. The severe economic dislocation that resulted led Congress to pass a series of measures that funneled trillions of public dollars to families and parents. Whether these measures should represent a temporary deviation from the nation’s free-market expectations during an unprecedented emergency or the first step in a long-term shift toward …

White Injury And Innocence: On The Legal Future Of Antiracism Education, Osamudia James Jan 2022

White Injury And Innocence: On The Legal Future Of Antiracism Education, Osamudia James

Faculty Publications

In the wake of the “racial reckoning” of 2020, antiracism education attracted intense attention and prompted renewed educator commitments to teach more explicitly about the function, operation, and harm of racism in the United States. The increased visibility of antiracism education engendered sustained critique and opposition, resulting in executive orders prohibiting its adoption in the federal government, the introduction or adoption of over sixty state-level bills attempting to control how race is taught in schools, and a round of lawsuits challenging antiracism education as racially discriminatory. Because antiracism so directly runs afoul of norms underlying American antidiscrimination law, including anticlassification, …

Database Of Marginal Notation In The Psu 1490 Codex: Objectives, Organization, And Continuation, Andi Johnson

Extra-Textual Elements

Portland State University Library's combined 1490 editions of the Fasciculus temporum and Malleus maleficarum contain over 150 individual marginal markings and notations. These marks have been made by numerous readers throughout the monograph's five-century lifespan.

This report accounts for efforts to construct a tool that would allow future students and scholars to visually compare and organize marks was needed before any in-depth analysis of readership could be made, describing the objectives, processes and applications that have defined its development. The tool that was needed was a visual database that enables the visual comparison of markings within the two texts. This …

Review, Introduction, And Preliminary Documentation Of Marginalia In Portland State University’S Fasciculus Temporum/Malleus Maleficarum Sammelband, Samuel Barnack Jan 2022

Review, Introduction, And Preliminary Documentation Of Marginalia In Portland State University’S Fasciculus Temporum/Malleus Maleficarum Sammelband, Samuel Barnack

Extra-Textual Elements

This paper presents an overview of the contents of the new database of written marginal notations in Portland State University’s fifteenth-century printed codex, and some of the research threads that can be taken up from a study of those notations.

The motive for this project was an interest in readership usage of the codex and the two books contained within it. It begins by discussing terms that Andi Johnson and I elected to use to tag and name different categories of features, then I discuss some of the findings and possible future research avenues that can expand on them.

Finally, …

The Color Of Local Government: Observations Of A Brown Buffalo On Racial Impact Statements In The Movement For Water Justice, Tom I. Romero Ii Jan 2022

The Color Of Local Government: Observations Of A Brown Buffalo On Racial Impact Statements In The Movement For Water Justice, Tom I. Romero Ii

Scholarly Works

This Article advocates for the adoption of racial impact statements ("RIS") in local government decision making, particularly among water utilities. Situated in the larger history of water and climate injustice in Colorado and the arid American West, this Article examines ways that racially minoritized communities engage and contest legal and political water regimes. The Article then explores how water utilities could use RISs in the acquisition, treatment, and delivery of drinking water. If made a part of the everyday work of water utilities, RISs provide a useful tool to center the history and lived experiences of racially minoritized communities battling …

Scholarly Works

In section II, this paper will begin with an analysis of the development of AI, noting famous examples and establishing a baseline definition as a lens for the rest of this discussion. This paper will assess aspects of AI and machine learning to the extent it furthers our understanding of AI’s ability to collect data and make decisions. Some popular culture references will be brought into focus here to recognize storytelling’s ability to inspire and influence real-world scientific pursuits. Of preliminary importance, the AI we have both dreamed of and feared are certainly kept in mind as technology advances through …

Misogyny And Murder, Ann C. Mcginley Jan 2022

Misogyny And Murder, Ann C. Mcginley

Scholarly Works

The Atlanta-area shootings of six Asian women in massage parlors in March 2021 raised awareness about anti-Asian discrimination and violence in the United States. When the perpetrator, Robert Aaron Long, shot the Atlanta-area spa victims, public speculation arose about whether he was motivated by hatred for the Asian victims because of their race. Many wondered whether the shooter would be charged and convicted of hate crimes against the victims. When asked by police about his motives, the perpetrator stated that he had a "sex addiction," meaning that the spas created intolerable sexual temptations that he was unable to resist. Considering …

Carrie Menkel-Meadow: Leading Us Toward Justice And Peace, Jean R. Sternlight Jan 2022

Carrie Menkel-Meadow: Leading Us Toward Justice And Peace, Jean R. Sternlight

Scholarly Works

This Essay explores how Carrie Menkel-Meadow's life and work have both highlighted the path of "And"-showing and explaining that it is not only possible but also desirable to seek justice as well as peace, to be both activist and neutral. Of course, tensions will remain. Regarding particular issues in specific moments we all must decide which path we can and should take. Which activism is best, and which goes too far? With whom can we or should we negotiate, and when should we instead say, "I can't negotiate with this person or group"? When should we talk and listen, and …

Unauthorized And Unwise: The Lawful Use Requirement In Trademark Law, Robert A. Mikos Jan 2022

Unauthorized And Unwise: The Lawful Use Requirement In Trademark Law, Robert A. Mikos

Vanderbilt Law Review

For decades, the United States Patent and Trademark Office (“PTO”) has required trademark owners to comply with sundry nontrademark laws governing the sale of their trademarked goods and services. Pursuant to this “lawful use requirement,” the Agency has refused or even cancelled registration of thousands of marks used on everything from Schedule I controlled substances to mislabeled soap. This Article subjects the Agency’s lawful use requirement to long-overdue scrutiny. It suggests that in requiring compliance with other laws for registration, the PTO has lost sight of the one statute it is supposed to administer. In the process, the Agency has …

Engagement Et Jeunes De Banlieue : Quand Le Roman Policier Rejoint Le Rap Pour Dire ¨Je Suis Français¨, Iziar De Miguel Jan 2022

Engagement Et Jeunes De Banlieue : Quand Le Roman Policier Rejoint Le Rap Pour Dire ¨Je Suis Français¨, Iziar De Miguel

Publications and Research

Black Feminist Citational Praxis And Disciplinary Belonging, Bianca C. Williams Jan 2022

Black Feminist Citational Praxis And Disciplinary Belonging, Bianca C. Williams

Publications and Research

What does a Black feminist citational practice look and feel like? This contribution to the #CiteBlackWomen colloquy focuses on two arguments: First, that Black feminist citational praxis is one of the major interventions Black women scholars contribute to the academy; and second, that anthropology’s neglect and erasure of Black feminist anthropologists relates to disciplinary (un)belonging. I explore how citation and “disciplinary belonging” influence hiring practices, doctoral training, intellectual genealogies, and what is valued as anthropological knowledge.

Additive Manufacturing Design For Affordable Housing Development, Courtney Wright, Lani Nguyen, Jordan Wearing

Engineering and Technology Management Student Projects

Recently, there has been an increasing lack of affordable homes. Since rent, prices, gas, and other utilities continue to rise, wages (especially for low-income individuals) have stayed constant throughout the country. This has caused numerous citizens to not be able to afford a home or even pay rent. This situation has caused a large surge in the homeless community, and it is estimated that approximately 37,500 individuals per day are in need of housing throughout the Pacific Northwest as of January 2020. [1] In response to this issue, our team has provided a goal to provide trendy and affordable homes …

Operating Strategy For Semiconductor Industry During Covid 19: Pandemic Working Model, Anurag Yaddanapudi, Evan Ide, John Matthew, Breault Plummer, Kaushik Chaudhary, Liliana Fitzpatrick, Nader Morgan, Nisha Hemantha Raju, Preston Khiev

Engineering and Technology Management Student Projects

The impacts of the COVID-19 pandemic have been felt across various industries around the world, including the semiconductor industry. The semiconductor industry was boosted by pandemic restrictions as changing consumer habits—driven by the rise in remote work, distance learning, gaming, entertainment, and internet shopping—significantly increased demand for consumer electronic devices to the point that demand for semiconductors far outpaced production. Given the globality and complexity of the semiconductor supply chain, many companies are exploring ways to permanently change workplace collaboration for their employees. In this paper, the Hierarchical Decision Modeling (HDM) method is used to evaluate four possible pandemic semiconductor …

La Musique Dans Les Cultures Tech. La Synthèse Modulaire En Temps De Covid-19, Eliot Bates Jan 2022

La Musique Dans Les Cultures Tech. La Synthèse Modulaire En Temps De Covid-19, Eliot Bates

Publications and Research
