Articles

Surface-enhanced Raman spectroscopy (SERS) is regarded as a versatile tool for studying the composition and structure of matter. This work has studied the preparation of a SERS substrate based on a self-assembling plasmonic nanoparticle film (SPF) in a polymer matrix. Several synthesis parameters for the SPF are investigated, including the size of the particles making up the film and the concentration and type of the self-assembling agent. The result of testing systems with different characteristics is discussed using a model substance (pseudo isocyaniniodide). These models can be useful in the study of biology and chemistry. Research results contain the optimal …

Taxing Sports, John T. Holden, Kathryn Kisska-Schulze Jan 2022

Taxing Sports, John T. Holden, Kathryn Kisska-Schulze

American University Law Review

Sports are no longer mere games. In today’s money-driven culture, they have cultivated into a lucrative business enterprise where everyone—whether professional or amateur; owner or player; coach or spectator—stands to make significant money. Modern sports have also morphed into a landscape encompassing both the traditional athletic events and the more novel esports and daily fantasy sports (DFS) arenas. Across all these physical, digital, and biological spheres, sports revenues are being measured in terms of billions. It thus stands to reason why taxes have become a progressively critical discussion point within U.S. professional and collegiate sports, the video gaming world, and …

Solving The Procedural Puzzles Of The Texas Heartbeat Act And Its Imitators: The Limits And Opportunities Of Offensive Litigation, Howard M. Wasserman, Charles W. Rhodes Jan 2022

Solving The Procedural Puzzles Of The Texas Heartbeat Act And Its Imitators: The Limits And Opportunities Of Offensive Litigation, Howard M. Wasserman, Charles W. Rhodes

American University Law Review

The Texas Heartbeat Act, enacted in 2021 as Senate Bill 8 (S.B. 8), prohibits abortions following detection of a fetal heartbeat, a constitutionally invalid ban under current Supreme Court precedent. But the method of enforcement in the Texas law is unique—it prohibits enforcement by government officials in favor of private civil actions brought by “any person,” regardless of injury. Texas sought to burden reproductive-health providers and rights advocates with costly litigation and potentially crippling liability.

In a series of articles, we explore how S.B. 8's reliance on exclusive private enforcement at the expense of public enforcement creates procedural and jurisdictional …

The Truth About Design Patents, Sarah Burstein, Saurabh Vishnubhakat Jan 2022

The Truth About Design Patents, Sarah Burstein, Saurabh Vishnubhakat

American University Law Review

Design patents are hot. Scholars and policymakers are increasingly focusing on this once-niche area of law. However, many of the empirical studies in this area— including old ones that still get cited—were methodologically questionable from the start, have become outdated, or both. In this Article, we make two sets of contributions to this important and underdeveloped literature. First, we review the empirical studies of design patents thus far, including those that pre- and post-date the creation of the U.S. Court of Appeals for the Federal Circuit, and we update the findings of those studies. Second, we consider a set of …

Unjustly Vilified Trips-Plus:? Intellectual Property Law In Free Trade Agreements, Marketa Trimble Jan 2022

Unjustly Vilified Trips-Plus:? Intellectual Property Law In Free Trade Agreements, Marketa Trimble

American University Law Review

Intellectual property (IP) law provisions of free trade agreements (FTAs) have attracted much criticism. Critics have argued that FTA negotiators, succumbing to the lobbying of various stakeholders, have eliminated or significantly limited many of the flexibilities that multilateral treaties had created, forced stronger IP protection onto developing countries, and fragmented international IP law. While agreeing with a great deal of the criticism expressed by others, this Article departs from the typical vilification of FTAs by identifying and analyzing the positive features of FTA IP provisions that are worth replicating and expanding in future FTAs. These positive features include provisions concerning …

The Good, The Bad, And The Ugly: Black Lives Matter Protests, The January 6th Insurrection, And Facial Recognition Technology As Admissible Evidence, Laura C. Powell Jan 2022

The Good, The Bad, And The Ugly: Black Lives Matter Protests, The January 6th Insurrection, And Facial Recognition Technology As Admissible Evidence, Laura C. Powell

American University Law Review

The debate surrounding law enforcement’s use of facial recognition technology (FRT) continues to raise concerns about accuracy, reliability, and equity. Nonetheless, law enforcement agencies continue to purchase, implement, and use FRT as an investigative tool to identify suspects and make arrests. Yet, its ability to enter the courtroom remains untested. Consequently, this Comment seeks to answer the question if FRT was presented as evidence, would it be admissible? To answer that question, this Comment uses the arrests following Black Lives Matter (BLM) protests and the January 6th insurrection. These two events provide contrasting FRT software algorithms, racial compositions, and law …

Judicial Review Of Emergency Administration, Desiree Leclercq Jan 2022

Judicial Review Of Emergency Administration, Desiree Leclercq

American University Law Review

This Article seeks to describe and defend the judicial review of federal agencies’ responses to national emergencies - what I refer to as “emergency administration.” That may prove difficult. Agencies are experts in their respective fields. During emergencies, scholars and policymakers assume that judges will defer to that expertise under the Administrative Procedure Act (APA ). On January 13, 2022, the Supreme Court defied that assumption when it blocked the Biden Administration s workplace vaccine and masking rules. Critics now assume that judges are reviewing emergency administration to constrain regulation. Both assumptions conclude that judicial review is neither sincere nor …

Spider-Man: Work From Home And Retain No Copyright Under The Instance And Expense Test, Shahnoor Kamal Khan Jan 2022

Spider-Man: Work From Home And Retain No Copyright Under The Instance And Expense Test, Shahnoor Kamal Khan

American University Law Review

From Spider-Man to Ms. Marvel, superheroes are beloved by many, but owned by the few. Marvel Entertainment retains the copyright to iconic characters such as these, despite the fact that Marvel’s employees did not create them. These characters were created by freelance artists Jack Kirby, Steve Ditko, and Lawrence Lieber, among others. Yet, the Second Circuit ruled in Marvel Characters v. Kirby that these freelance artists have no claim of copyright over their own masterful works. The Second Circuit relied on the instance and expense test for copyright, as opposed to the Supreme Court’s leading copyright decision, Community for Creative …

Human Trafficking Of People With A Disability: An Analysis Of State And Federal Cases, Andrea Nichols, Erin Heil Jan 2022

Human Trafficking Of People With A Disability: An Analysis Of State And Federal Cases, Andrea Nichols, Erin Heil

Dignity: A Journal of Analysis of Exploitation and Violence

The current academic discourse examining human trafficking is lacking in focus on survivors with a disability. The increased likelihood of abuse experienced by people with a disability is well documented in the research literature, and a small body of research indicates heightened sex trafficking victimization of minor girls with a disability. Yet, very little research specifically examines sex and/or labor trafficking of people with a disability, and no systematic research analyzes prosecuted cases of trafficking with disability as the focal point of analysis. Drawing from a content analysis of 18 federal and 17 state cases of human trafficking, the current …

Neo-Emancipatory Sex Education In Germany: Sexual Abuse And Gender Confusion, Bernd Ahrbeck, Karla Etschenberg, Marion Felder Jan 2022

Neo-Emancipatory Sex Education In Germany: Sexual Abuse And Gender Confusion, Bernd Ahrbeck, Karla Etschenberg, Marion Felder

Dignity: A Journal of Analysis of Exploitation and Violence

This article focuses on two related areas of concern with regard to sex education and implications for children and youth in Germany. The first one is the history of the currently dominant neo-emancipatory sexual education and its implications for today. This direction of sex education is highly influenced by theories of Helmut Kentler who with the help of the German city of Berlin youth protection services department sent homeless and troubled boys to known pedophiles for care. This experiment went on for 30 years, ending in 2001. Only now has the extend of this horrific practice been fully discovered. The …

Sudden unexpected death of epilepsy (SUDEP) is a catastrophic and fatal complication of epilepsy and is the primary cause of mortality in those who have uncontrolled seizures. While several multifactorial processes have been implicated including cardiac, respiratory, autonomic dysfunction leading to arrhythmia, hypoxia, and cessation of cerebral and brainstem function, the mechanisms underlying SUDEP are not completely understood. Postictal generalized electroencephalogram (EEG) suppression (PGES) is a potential risk marker for SUDEP, as studies have shown that prolonged PGES was significantly associated with a higher risk of SUDEP. Automated PGES detection techniques have been developed to efficiently obtain PGES durations for …

Counterstories Of High School Black Males And Their Experiences Of The Mainstream Curricula, Kayla Turner Jan 2022

Counterstories Of High School Black Males And Their Experiences Of The Mainstream Curricula, Kayla Turner

College of Graduate Studies: Theses & Dissertations

This is an inquiry into the experiences Black males have with the current high school curricula. Theoretically drawing on critical race theory (Bell, 1992; Delgado, 1995; Dixson & Rousseau, 2006; Ladson-Billings, 2009; Solórzano & Yosso, 2001, 2004), I explore how high school Black males’ suggestions and ideas can be used to shift the current curricula to a curricula that is more culturally sustaining. I challenge deficit research on Black male learners by focusing on the educational successes of Black males. Methodologically, I utilize counterstorytelling (Delgado, 2017; Solórzano & Yosso, 2002) to illustrate the experiences of three academically successful high school …

American Performance: Artistic Experience And The American Dream, Savannah M. Barrow Jan 2022

American Performance: Artistic Experience And The American Dream, Savannah M. Barrow

College of Graduate Studies: Theses & Dissertations

The American Dream was first epitomized by Benjamin Franklin in his Autobiography (1791), in which he instructs his fellow citizens on how to procure the American promises of social mobility and economic prosperity. However, the moral and social performances reinforced by Franklin’s recipe-for-success promote an ideological system that prevents marginalized communities such as women, immigrants, and people of color, from procuring the Dream’s most foundational features. Inequitable access to the Dream is a theme revisited throughout American literature, wherein disenfranchised characters consume the aspirational narrative of American social mobility through art, media, and propaganda. This essay tracks the representation of …

The Perspective Of Riverkeepers And Environmental Groups On Poor Water Quality In Georgia, Jacob A. Crawford Jan 2022

The Perspective Of Riverkeepers And Environmental Groups On Poor Water Quality In Georgia, Jacob A. Crawford

Campus sexual assault has been recognized as one of the most pressing issues on college campuses and an epidemic across the U.S. The purpose of this study is to explore perceived prosocial behavior change of one bystander intervention training in two different modalities: synchronous virtual via Zoom and asynchronous online training via a learning management system (LMS). To date, there is no research study that evaluates the same bystander intervention program across different intervention delivery modalities. This research is the first of its kind to examine the relationship between intervention delivery modality and post-evaluation questions and serves as a pilot …

Perplexions: Perceptions, Plexi And Prose, Amy B. Nelson Jan 2022

Perplexions: Perceptions, Plexi And Prose, Amy B. Nelson

College of Graduate Studies: Theses & Dissertations

An understanding of our world is unique to each individual and their experiences. While experiences are often shared, we all process them according to our own schema. Through exploration into the multiple facets of plexiglass, my work examines trauma, loss and its lasting effect on a person's memory of the past, present and perception of the future. These experiences can cause an abrupt shift in personal schema and reshape one’s perception of the world. Through the combination of visual and linguistic stimuli, my trauma-informed work can be a catalyst for my viewers to discuss what they are experiencing and why. …

A Different World: The Experiences Of Black Women At A Southern Predominantly White Institution, Latoya Stackhouse

College of Graduate Studies: Theses & Dissertations

The present study investigated the lived experiences of Black women on a predominantly White institution (PWI) campus in the South as they relate to the core themes of Patricia Hill Collins’ Black Feminist Thought (BFT). The core themes of BFT that were the focus of the research were Self-Definition/Empowerment, Safe Space, Controlling Images, Invisibility/Sense of Belonging. Sista circle methodology was used as the form of inquiry with two 60-minute sessions over a two-month span. This methodology was chosen because its focus centers the lived narratives of Black women within a safe space unlike traditional focus groups. Findings from the sista …

Economic Aesthetics, Ashrafi Sultana Jan 2022

Economic Aesthetics, Ashrafi Sultana

College of Graduate Studies: Theses & Dissertations

Contemporary socio-economic reality is like a robbery, where the wealthy people have all the money, and the workers live from hand to mouth. These systematic inequalities are happening through capitalist consumerism and creating a growing economic contrast globally. Rather than considering imitative freedom promoted by the mainstream media that drives us to power, greed, or ego-centric mentality, I believe human rights can direct us to real freedom. In current society, basic rights are being taken away from many, while a great number of us are trapped in our utopian reality without recognizing the truth. We are stimulated by our socio-economic …

Examining Practitioners’ Perspectives On Access To Professional Psychological Help For Division I Male Athletes, Nicole Vana Jan 2022

Examining Practitioners’ Perspectives On Access To Professional Psychological Help For Division I Male Athletes, Nicole Vana

College of Graduate Studies: Theses & Dissertations

Male athletes are less likely than female athletes to seek out support services (Barnard, 2016) despite experiencing a myriad of clinical and subclinical concerns including depression (Davoren & Hwang, 2014; Wolanin et al., 2016), anxiety (Davoren & Hwang, 2014), eating disorders (Joy et al., 2016; Sundgot-Borgen & Torstveit, 2004), and substance use (NCAA, 2018). To combat the increasing rates of mental health concerns, support services are becoming more readily available for collegiate athletes (Moore, 2016). However, despite the recent effort in increasing athlete mental health support, many male athletes in particular remain reluctant to seek out such services (Barnard, 2016). …

The Influence Of Faculty Peer Network Communication In The Diffusion Of A Centralized Cure, Nicole L. Scheuermann Jan 2022

The Influence Of Faculty Peer Network Communication In The Diffusion Of A Centralized Cure, Nicole L. Scheuermann

College of Graduate Studies: Theses & Dissertations

Course-based undergraduate research experiences (CUREs) provide students the benefits of undergraduate research participation by incorporating authentic scientific research into laboratory courses. CUREs are a relatively young pedagogy and are therefore innovative. Roger’s (2003) diffusion of innovations (DOI) framework posits that the diffusion of innovations, such as CUREs, is a highly social process. Most existing CURE research has focused on the impacts to students and the critical elements of CURE design. Investigation into instructor peer network communication is largely absent from the existing CURE literature. This study investigates the structure and function of a CURE community – the Malate Dehydrogenase CURE …

Culture For Sale, Jessica L. Cartwright Jan 2022

Culture For Sale, Jessica L. Cartwright

College of Graduate Studies: Theses & Dissertations

In a post-colonial world, one would expect much of the servitude of the past to have ended, but this is not the case. In places such as the Bahamas new forms of or neo- colonialism has come to exist specifically under the guise of tourism. Writing amidst the end of colonialism in the twentieth century, Franz Fanon argues that sblack person exists in a liminal state. They must assimilate to the white society in order to be accepted, but not so much so thatbecause that it threatens whiteness. It is through Fanon’s writing on race that I have developed a …

Toward Novel Optical Functionalities Through Intelligent Photonic Structure Design, Robert J. Williamson Jan 2022

Toward Novel Optical Functionalities Through Intelligent Photonic Structure Design, Robert J. Williamson

College of Graduate Studies: Theses & Dissertations

Photonic Metamaterials is a branch of electromagnetism that has been of great interest in recent years. This is further enhanced by the introduction of micro- and nanofabrication methods capable of producing metamaterial structures with which it is possible to create specific optical phenomena. The study of iso-frequency k-surfaces is of importance when discussing optical interactions with media. Previous research found evidence of materials exhibiting k-surfaces of bi-hyperbolic nature, though they failed to find any further hyperboloid dispersions. In this thesis we describe the k-surface topologies and including tri- and tetra-hyperbolic as well as analyze the polariton-interactions that cause these hyperbolic …

The Synthesis And Biocatalytic Reduction Of Beta-Keto Alkynes, Rhema M. Francis Jan 2022

The Synthesis And Biocatalytic Reduction Of Beta-Keto Alkynes, Rhema M. Francis

College of Graduate Studies: Theses & Dissertations

The preparation of enantiopure homopropargyl alcohols (but-3-yn-ols) is of high importance to the scientific community. They are employed as valuable pharmaceutical intermediates and are opportune to generate antiviral nucleoside analogues. Chiral inducement of these molecules thus far has been poor (low ee) and has constituted a key challenge for asymmetric synthesis in the last few decades. Enzyme-catalyzed enantioselective reductions of ketones have become popular to produce thus-prepared synthons on an industrial scale. Among them, biocatalysts (dehydrogenases, reductases) emerge as a biodegradable option for chemical transformations, in comparison to chiral catalysts that employ highly toxic metals. This research investigates the catalytic …
