Realizing Diversity, Sustainability, And Stakeholder Capitalism, Peter H. Huang
Realizing Diversity, Sustainability, And Stakeholder Capitalism, Peter H. Huang
Emory Business Law Review
Stakeholder capitalism conceives of capitalism with companies maximizing their long-term value, while considering in addition to the interests of their shareholders, also the interests of all their other stakeholders. Examples of such additional stakeholders include customers, employees, communities, creditors, competitors, society at large, and our planet. America today does not have stakeholder capitalism. Instead, America presently has shareholder capitalism, in which publicly held corporations only maximize their stock value to shareholders.

Emory Business Law Review
The term “Big Tech” is referred to: Amazon, Apple, Facebook (Meta), Google and Microsoft. These companies are the five largest multinational online service or computer hardware and software companies and have the top position in the stock market by market share. Data indicated that these five firms have made over 700 acquisitions from 1987 to 2019. (Google 32%, Microsoft 31%, Apple 15%, Amazon 11%, and Facebook 11%). After 2001, The DOJ and FTC began to use NAICS codes to report HSR (Hart-Scott-Rodino) transactions. The code name is NAICS 518 for data processing, hosting, and related services (mainly including Google, Amazon, …
An Ocean Apart: The Mandatory Takeover Rule In Brazil And In Europe, Jorge Brito Pereira
An Ocean Apart: The Mandatory Takeover Rule In Brazil And In Europe, Jorge Brito Pereira
Emory Business Law Review
The common statement that there are two different regulatory systems concerning the mandatory takeover rule – the market rule system and the equal opportunity system – is, in practice, overly simplistic: facing the choice between freedom and strict regulation on whether the control premium should be proportionally shared with all non-controlling shareholders, some jurisdictions have adopted a hybrid solution. The Brazilian mandatory takeover rule (re)approved in 2001 is a good example. This paper will comprehensively analyse the Brazilian and European rules on mandatory takeover bids, using empirical data about the Brazilian markets and details of various cases that tested the …
Why Antitrust, Not Unionization, Is The Answer To Underpayment Of Student-Athletes, Evan Nelson
Why Antitrust, Not Unionization, Is The Answer To Underpayment Of Student-Athletes, Evan Nelson
Emory Business Law Review
This Comment examines whether student-athletes should be allowed to unionize and collectively bargain for their rights and will present a legal argument against the unionization of student-athletes. The reasoning behind this argument is that student-athletes are not employees, and therefore, are not able to unionize. Even if student-athletes were categorized as employees, they would struggle to collectively bargain for their rights due to various states’ laws that prohibit public employees from unionizing. Rather, this Comment argues that the answer to solving college athlete underpayment is through the remedies that can be provided in antitrust law. The reasoning behind this argument …

Big Data Processing: A Review, Taufik Gusman, Mohammad Naeemullah, Adeeb Mansoor Qasim
Mesopotamian Journal of Big Data
The processing of "big data," which consists of very vast and complicated datasets, is a fast expanding area. It has been employed in a wide variety of industries and applications, from e-commerce to financial services to transportation, and it has the potential to revolutionise the way organisations functionand make decisions. In this work, we discuss the definitions, characteristics, and challenges of large data processing. We also talk about the ethics of using this technology and the prevalent tools and technologies used for processing large amounts of data. Finally, we consider how big data processing is expected to evolve in the …

Mesopotamian Journal of Big Data
Big data refers to the large volumes of structured and unstructured data that are generated by businesses, organizations, and individuals on a daily basis. Deep learning is a type of machine learning that involves the use of artificial neural networks to learn patterns and relationships in data. In this paper, we discuss the applications of deep learning in the field of big data analysis. We provide an overview of deep learning and big data, and then delve into specific examples of how deep learning has been used in various domains to extract value from big data. These domains include predictive …

“You Don’T Belong In Nashville!”: Politics, Country Music, And The Reception Of Robert Altman’S Nashville, Dan Blim
Faculty Publications
Robert Altman’s film Nashville (1975) generated a prodigious amount of press commentary following its release. Early on, critics praised the film, but a disappointing box office led many to assume a split between big-city liberal audiences and small-town conservative audiences. Subsequent press coverage connected this divide to both the film’s politics and its use and portrayal of country music, as political pundits, music critics, country music stars, and general audiences weighed in. This essay situates the reception of the film within a shifting country music industry, which was growing increasingly aligned with the Republican Party and increasingly suspicious of new …

Radical Social Innovations And The Spatialities Of Grassroots Activism: Navigating Pathways For Tackling Inequality And Reinventing The Commons, Noura Wahby, Elia Apostolopoulou, Dimitrios Bormpoudakis, Alexandros Chatzipavlidis
Faculty Journal Articles
In this article, by drawing on empirical evidence from twelve case studies from nine countries from across the Global South and North, we ask how radical grassroots social innovations that are part of social movements and struggles can offer pathways for tackling socio-spatial and socio-environmental inequality and for reinventing the commons. We define radical grassroots social innovations as a set of practices initiated by formal or informal community-led initiatives or/and social movements which aim to generate novel, democratic, socially, spatially and environmentally just solutions to address social needs that are otherwise ignored or marginalised. To address our research questions, we …

Violent disciplinary practices against children are in itself a juxtaposition since violence comes from a place of safety and from those children trust the most; their parents. Parents and caregivers violently discipline their children thinking they are helping them be better. More than 1 billion children around the world, aged 4-17 years old, experience violence (Hillis et al., 2016) from those considered their source of love and safety. In Egypt, 40% of the population is made of children, and 90% of those children have experienced some sort of domestic violence from their caregivers. Using physical, verbal, and sexual violence as …

Since the start of the COVID-19 pandemic, the Egyptian government has been following protocol as best as possible when it comes to responding to the needs of the health and economic sectors amid difficult times. From lockdown measures to the WHO’s recommended practices in terms of isolation of cases and treatments, Egypt has been lauded as one of the fastest and most effective countries in terms of COVID-19 emergency response. Authorities have implemented several awareness campaigns directed at citizens to inform them about the pandemic, how to prevent infection, what to do if infected and how to act accordingly. Authorities …

‘I Went To The One Game In Town’: Obstetric And Maternity Unit Closures, Dwindling Birth Choices, And Resilience In Rural Appalachia, Sia Beasley
Theses and Dissertations--Anthropology
Obstetric and maternity health services are being rapidly eliminated in the rural United States, making maternal care more difficult to access and causing negative birth outcomes. Service closures have a magnified impact in Appalachia due to histories of systemic regional and state policy practices which devalue the lives of people living rural areas, local economic marginalization, geographic barriers, and insufficient health infrastructures. This research investigates how women living in rural Appalachia navigate pregnancy and birth amidst constant care closures. The Sunflower Mountain Region is a seven-county area in rural Southern Appalachia. The region has experienced ongoing obstetric closures over the …

The Catholic Church Abuse Scandal In Ireland: Two Steps Forward, One Step Back By Pope Francis?, Augustine Pang, Eada Hogan, Igor Andrasevic
Research Collection Lee Kong Chian School Of Business
Purpose: Ireland is viewed as the shining base for Catholicism. That image is shattered as survivors revealed the abuse in the Magdalene Laundries and Mother and Baby Homes, and sexual abuse by priests. This study aims to examine image repair efforts by the Pope during his August 2018 visit. Design/methodology/approach: Examined against the Letter of His Holiness released days earlier, this study evaluates all the Pope's speeches during his visit to Ireland using the image repair theory (Benoit and Pang, 2008) as its theoretical lens. Findings: Pope Francis used the evasion of responsibility strategy to address the Magdalene Laundries and …

Land, Legacy, And Law: Amending Cercla To Account For Environmental Contamination Of Tribal Cultural Resources, Alexander Toke
Land, Legacy, And Law: Amending Cercla To Account For Environmental Contamination Of Tribal Cultural Resources, Alexander Toke
Cardozo Journal of Equal Rights & Social Justice
The note advocates for amending the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) to enable Native American Tribes to recover damages for injuries to cultural resources. It argues that Tribal lands are disproportionately affected by environmental contamination and that current legal frameworks fail to address the unique cultural and spiritual significance of these resources.
The Monetization Of Childhood: How Child Social Media Stars Are Unprotected From Exploitation In The United States, Jessica Pacht-Friedman
The Monetization Of Childhood: How Child Social Media Stars Are Unprotected From Exploitation In The United States, Jessica Pacht-Friedman
Cardozo Journal of Equal Rights & Social Justice
The note highlights the legal vulnerabilities of child social media influencers, or "kidfluencers," who are increasingly exploited due to inadequate protections under U.S. labor laws. The Fair Labor Standards Act (FLSA) exempts child performers, and while some states have Coogan Laws, these are insufficient to address the unique challenges posed by digital platforms like YouTube. The author advocates for expanding these protections to include social media stars and adopting a "Right to be Forgotten" to safeguard children's privacy and financial interests.
Equal Education Means Equal Education: Confronting Education Access Disparities For New York Students Amid The Covid-19 Pandemic During The 2020-2021 School Year, Sara Gruber
Cardozo Journal of Equal Rights & Social Justice
The COVID-19 pandemic exacerbated existing educational disparities, particularly affecting low-income and minority students in New York due to the shift to online learning. The state's current legislation, such as the Dignity for All Students Act, fails to address these off-campus digital divide issues, necessitating legal reform to ensure equal educational opportunities.
The British Government's Continued Failure To Deal With Deaths Resulting From The Troubles In Northern Ireland Is A Violation Of Human Rights, Marie Simpson
Cardozo Journal of Equal Rights & Social Justice
The note argues that the British government's failure to adequately investigate and address the 3,000 unsolved murders from the Troubles in Northern Ireland constitutes a violation of human rights. It critiques the government's proposed Historical Investigations Unit for being insufficient and not meeting the procedural standards required by Article 2 of the European Convention on Human Rights. The note proposes a restructured unit to ensure impartial and effective investigations, emphasizing the need for accountability and closure for victims' families.
Corporate Capital & Legal Personality: A Marxist Account Of Citizens United Ten Years Later, Hayden E. Pendergrass
Corporate Capital & Legal Personality: A Marxist Account Of Citizens United Ten Years Later, Hayden E. Pendergrass
Cardozo Journal of Equal Rights & Social Justice
The article presents a Marxist critique of the Citizens United decision, arguing that it embodies the dominant capitalist ideology by granting corporations extensive First Amendment rights. This decision reflects the legal system's role in reinforcing corporate power and control over the political process, aligning with Marxist theories of law as a tool of class domination.

The Other Bar Hurdle: An Examination Of The Character And Fitness Requirement For Bar Admission, David L. Hudson Jr., Andrea Gemignani
Law Faculty Scholarship
In The Other Bar Hurdle, published in the Mitchell Hamline Law Review, the authors examine the character and fitness requirement as a critical yet under-scrutinized component of attorney licensing. The Article surveys the historical foundations, purposes, and contemporary administration of character and fitness investigations, highlighting their dual aims of protecting the public and safeguarding the integrity of the courts. It then synthesizes extensive scholarly criticism, focusing on concerns about discriminatory origins, lack of transparency, inconsistent application, deterrent effects on prospective applicants, and the disproportionate impact on individuals with criminal records, financial hardship, or mental health histories. While acknowledging …
