Denying The Violence: The Missing Constitutional Law Of Conquest, Juan F. Perea Jan 2022

Denying The Violence: The Missing Constitutional Law Of Conquest, Juan F. Perea

Faculty Publications & Other Works

If against these Indians, the end proposed should be their extermination, or their removal beyond the lakes or Illinois [R]iver. The same world will scarcely do for them and us. —Thomas Jefferson to George Rogers Clark, 1780

The United States committed at least two original sins. The one, slavery, is well known. The other, conquest, is both obvious and unknown at the same time.

The fact of conquest is proven by the sheer magnitude of the land transfer from indigenous people to white Americans. Before the conquest, native Americans possessed all 1.9 billion acres of the continental United States. After …

Learning And Advancement: Insights From Research Partners, 21cleo Research Team

21CLEO Research Project Blog Posts

Part of our research process has been to engage the voices of individuals involved in employer-supported education and training initiatives or otherwise impacted by the issues we have been investigating. To this end, we hosted a series of convenings to discuss our findings and invited a group of 12 interested parties who represented a range of backgrounds and experience in the workforce development system to respond to our initial observations, to make sure that we are doing things that were relevant and useful, and to identify things that we had missed or that we didn't get right.

Participants in the …

Plastics, Birds, And Humans: Awakening And Quickening Ecological Minds In Young Children And Their Teachers, William A. Parnell, Julianne Cullen, Michelle A. Domingues

Education Faculty Publications and Presentations

Working with educators, artists, young children, and materials to make meaning with place affected by human environmental impacts, this study zooms in on a documentary of dying birds who’ve swallowed plastics. The birds’ habitat is an eye-opening 2,000 miles from the nearest continent and is infested with trash and plastic. The birds ingest many shiny plastic bits and slowly die. This research paper focuses in on experiences of sharing this documentary with teacher educators at an international conference, then educators in our own context, and then with early childhood artists working in reuse materials. The research captures a series of …

Vesting, Jed H. Shugerman Jan 2022

Vesting, Jed H. Shugerman

Faculty Scholarship

The executive Power shall be vested in a President of the United States of America.” The Executive Vesting Clause is one of three originalist pillars for the unitary executive theory, the idea that the President possesses executive powers like removal without congressional limitations (that is, the powers are indefeasible). An underlying assumption is that “vest” connotes a formalist approach to separation of powers rather than a more functional system of Madisonian checks and balances. Assumptions about “vesting” for official powers are likely the result of semantic drift from property rights and ahistoric projections back from the later Marshall Court doctrine …

The Reflective Age: Nostalgia At The End Of History, Zachary Griffith Jan 2022

The Reflective Age: Nostalgia At The End Of History, Zachary Griffith

Theses and Dissertations--English

This project investigates the ways in which nostalgic American media of the last decade reflects the sociopolitical conditions of the end of history. It begins with the assertion that the end of history represents a confounded, contradictory moment in which large-scale political change is relatively scarce, and belief in a progressive future has largely been abandoned, while cultural change has also accelerated at a pace never before seen––spurred on, in particular, by the constant return of dead styles and dormant IP. In other words, it seems as if nothing is changing and everything is changing simultaneously. The recent boom in …

Gender And Remittances: Lived Experiences Of Women In Oaxaca, Mexico, Araby Smyth Jan 2022

Gender And Remittances: Lived Experiences Of Women In Oaxaca, Mexico, Araby Smyth

Theses and Dissertations--Geography

This dissertation project analyzes the ways that migration and remittances, the money that migrants send to people in their place of origin, intersect with the political and social dynamics in an Indigenous community in the Isthmus of Tehuantepec region of Oaxaca, Mexico. Drawing on 16 months of ethnographic fieldwork, which included semi-structured interviews and participant observation alongside historical archival investigation, this dissertation examines the following questions: What international organizations, national government, and private sector policies govern remittances? How does Indigenous collective work and communal governance shape remittance management? How do the responsibilities of family members shift with migration and how …

Affective Registers Of Displacement: Eviction And Gentrification In Post-Earthquake Mexico City, Jess Linz Jan 2022

Affective Registers Of Displacement: Eviction And Gentrification In Post-Earthquake Mexico City, Jess Linz

Theses and Dissertations--Geography

This dissertation contributes to understandings of the affective and emotional register of urban politics by analyzing how affective dynamics influence struggles over displacement in Mexico City amid rapid gentrification and in the wake of the 2017 earthquake. Drawing primarily on feminist and queer/cuir theory and trauma studies, I aim to show the relevance of an often-overlooked dimension of urban political struggles. This dissertation is based on data collected through ethnographic methods over the course of 2018-2021. The primary source of data is long-form semi-structured interviews, supported by participant observation in meetings, protests, and WhatsApp groups. The dissertation studies the following …

Speaking Of Home Here And There: Everyday Experiences Of Belonging Among Highly Educated Immigrants, Katherine Feske-Kirby Jan 2022

Speaking Of Home Here And There: Everyday Experiences Of Belonging Among Highly Educated Immigrants, Katherine Feske-Kirby

Theses and Dissertations--Geography

This thesis explores how highly educated immigrants articulate a sense of belonging upon relocating to the United States, more specifically to the Lexington, KY area. Engaging with feminist political geography as well as migration and cultural studies, I argue that articulations of belonging are framed through transnational attachments, which respectively expand individuals’ ability to employ everyday forms of belonging. Expressions and understandings of transnational belonging are framed through in-depth interviews on participants’ workplace, relational dynamics, and engagement with the geopolitical discourse on migration. Through these interviews, a broader representation belonging is presented, while questions on highly educated immigrants’ privilege and …

Reading Comprehension Constrains Word Reading: A Tongue Twister Study By Moderating Attentional Control, Xueying Wang Jan 2022

Reading Comprehension Constrains Word Reading: A Tongue Twister Study By Moderating Attentional Control, Xueying Wang

Theses and Dissertations--Linguistics

Numerous research studies show word reading performance influences reading comprehension. Few studies investigate how reading comprehension influences word reading. The current study explores whether alleviating the attention required for reading comprehension correlates with a better word reading performance. Three types of tongue twister reading tasks that involve recall (RR), semantic priming (PP), and instructional focus on the phonological information (PF) all have a high demand for attention on word reading. Differently, the attention demanded by PP tasks on reading comprehension is smaller than RR and RF tasks. Numbers of speech errors are used to manifest the variability of these three …

A Corpus Study Of The Development Of The Adjective Phrase In French Children, Avery Elizabeth Baggett Jan 2022

A Corpus Study Of The Development Of The Adjective Phrase In French Children, Avery Elizabeth Baggett

Theses and Dissertations--Linguistics

In this thesis I attempt to answer three questions:

H1) Do children use proportionally more prenominal or post-nominal placement of adjectives than adults?

H2) Are children more conservative or more creative in their behavior in alternating prenominal and post-nominal placement of adjectives?

H3) If colored terms are more frequent in child speech will they pattern more like prenominal adjectives or more like post nominal adjectives, as in adult speech?

To do this, I examine two general semantic viewpoints, opting to use Scontras & Goodman (2017) subjectivity hypothesis. Next, I provide a general overview of First Language Acquisition research and then …

Fighting 'Stance': The Role Of Conversational Positioning In League Of Legends (Multiplayer Online Battle Arena) Discourse, William Breslove Jan 2022

Fighting 'Stance': The Role Of Conversational Positioning In League Of Legends (Multiplayer Online Battle Arena) Discourse, William Breslove

Theses and Dissertations--Linguistics

For researchers, the study of video game players - how they behave, interact, and cooperate in a virtual world – presents a challenge: what methodologies are best suited to approaching these interactions? From a sociolinguistic approach, how do gamers converse, and what do these conversations reveal about epistemic, affective, and political relationships? This study uses John DuBois’ Stance Theory (2007) and recent modifications of it (Kiesling 2022), to analyze data gathered from the popular multiplayer online battle-arena (MOBA) game League of Legends. It focuses on in-game interlocutors’ conversation samples to show their positioning, intersubjective alignment, and evaluation of a …

Mapping Memory: Locational Memory In The First-Person Narrative Of Three Latinx Writers, Stephanie R. Beasley Jan 2022

Mapping Memory: Locational Memory In The First-Person Narrative Of Three Latinx Writers, Stephanie R. Beasley

Theses and Dissertations--Hispanic Studies

Locational memory, which relies upon our natural inclination to store and recall images, adds spatial orientation to a narrative, and provides an accessible framework for the recreation of the past in first-person narrative. The power of locational imagery as a device of memory is both historically and scientifically supported. It is essential to the system of artificial memory that the ancient Greeks called a memory palace, described by both Mary Carruthers and Paul Ricouer. Scientifically, studies show that the strongest autobiographical memories are based on visual imagery and that recall of specific locations provides a cognitive basis for the recreation …

Propuestas De Autoría Y Datación En El Teatro De Lope De Vega A La Luz De La Inteligencia Artificial, Álvaro Cuéllar

Theses and Dissertations--Hispanic Studies

The purpose of this thesis is to shed light on the numerous authorship and dating problems presented by the Spanish Golden Age theatre. Specifically, it focuses on Lope de Vega (1562-1635), a notable and highly successful playwright of this period. Through the compilation of a wide set of texts and the application of Artificial Intelligence techniques (machine learning), a control corpus is evaluated to find the best systems and parameters. Once this evaluation has been undertaken, a large group of plays is analyzed to try to obtain results that can illuminate some real problems of authorship and dating in relation …

Out Of Sight, Out Of Mind: An Evaluation Of Secondary Agricultural Textbooks, Tara Elizabeth Rojas Jan 2022

Out Of Sight, Out Of Mind: An Evaluation Of Secondary Agricultural Textbooks, Tara Elizabeth Rojas

Theses and Dissertations--Community & Leadership Development

Students are impacted by representation present within their lives in the media they consume, organizations in which they participate, and school interactions. Among school interactions with primarily White school staff, students interact with textbooks to learn about industry norms and concepts. Missing representation can harm students’ sense of belonging which can lead to feelings like solo-status or isolation. Using both critical race theory and social semiotics, this work explores the representation present within secondary agricultural textbooks. The first study utilizes photos and case studies, observing both gender and race as mutually exclusive variables and compares data to the current public-school …

Racialization Of Foreigners And Self In The Chinese Immigration Project, Xunwen Zou Jan 2022

Racialization Of Foreigners And Self In The Chinese Immigration Project, Xunwen Zou

Sociology Honors Projects

With the Western invasion and colonization during the 20th Century, China began its internalization of the Western Enlightenment values, leading the country to an identity crisis that paved the way for its race to modernity. Attempting to understand the world and itself, China developed a new racial order largely shaped by the Western discourse and distinctly different from its ancient understanding. Based on 18 semi-structured interviews, this study explores contemporary racialization in China and its application in the racial project of immigration. I found that racial understanding in China is based on a racial/cultural hierarchy. The hierarchical top, Whites/Europeans, represents …

Conceptualizations Of A Flea Market Space, Tyler D. Curran Jan 2022

Conceptualizations Of A Flea Market Space, Tyler D. Curran

Graduate Theses/Dissertations

The ubiquitous presence of flea markets is emblematic of midwestern life. They illustrate common consumption practices and distinct modes of entertainment. This study investigates how vendors within a large, midwestern flea market conceptualize and utilize the space. Additionally, this study reveals the relationship between variant conceptualizations of the market and the merchandise sold by individual vendors. Existing research identifies a tension between social and economic dimensions within flea markets. This study extends prior research by examining the specific social fulfillments vendors garner and identifying other non-economic rationalizations for participation within the market. The results are derived from ethnographic observations and …

The Longitudinal Study Of Code-Switching In English-Instructed Spanish-English Bilingual Children, Molly K. Gasior Jan 2022

The Longitudinal Study Of Code-Switching In English-Instructed Spanish-English Bilingual Children, Molly K. Gasior

Graduate Theses/Dissertations

The population of bilingual children is growing in the U.S. Code-switching, a common occurrence in bilingual language production, is the use of words in the non-target language (e.g., English) when speaking the target language (e.g., Spanish). There are different approaches within the literature about how code-switching is dealt with. The purpose of this study is to longitudinally track changes in code-switching in English and Spanish narrative retell language samples, verify how code-switching impacts the lexical measure of number of different words, and whether code-switching may be indicative of Spanish language loss. Thirty-seven Spanish-English bilingual preschoolers who attended an English immersion …

Bipolar Screening Among Spanish-Speaking Us Residents Using The Mood Disorder Questionnaire, Emanuel T. Recinos Jan 2022

Bipolar Screening Among Spanish-Speaking Us Residents Using The Mood Disorder Questionnaire, Emanuel T. Recinos

Doctor of Psychology (PsyD)

The Mood Disorder Questionnaire (MDQ) is a self-report screening instrument used to detect Bipolar Disorder (BD). Psychometric properties of Spanish translations of the MDQ are from communities where both language and cultural differences are present. A Spanish version of the MDQ not been validated among United States individuals who identify Spanish as their preferred language of communication.

Objective

We propose that the validation of a Castilian Spanish version of the MDQ is needed for cross-cultural adaptation, determining optimal cut-off scores, and as an aid to the literature on BD prevalence, specifically BD among Spanish speakers of the United States.

Methods …

The Writing’S On The Wall: Using Multimedia Presentation Principles From The Museum World To Improve Law School Pedagogy, Cecilia A. Silver Jan 2022

The Writing’S On The Wall: Using Multimedia Presentation Principles From The Museum World To Improve Law School Pedagogy, Cecilia A. Silver

Dickinson Law Review (2017-Present)

Law school pedagogy is a relic. Nearly 150 years after Christopher Langdell pioneered the case method, the typical doctrinal course remains predominantly a verbal domain, featuring lectures, Socratic dialogue, and final exams. But the visual disconnect between legal education and legal practice does students a disservice. Under the proliferating influence of laptops, iPads, smartphones, and Zoom, students now read, work, and study electronically more than they ever have before. So instead of business as usual, it’s time to embrace “visualization”—using multimedia to enhance, or even supplant, the near-exclusive reliance on language—to build a more vibrant and inclusive learning environment.

Law …

The Folk Theory Of Well-Being, John Bronsteen, Brian Leiter, Jonathan Masur, Kevin Tobia Jan 2022

The Folk Theory Of Well-Being, John Bronsteen, Brian Leiter, Jonathan Masur, Kevin Tobia

Public Law and Legal Theory Working Papers

What constitutes a “good” life—not necessarily a morally good life, but a life that is good for the person who lived it (sometimes called “prudential goodness” or “well-being” or “welfare”)? On some views, of course, a life cannot be good for the person who lived it if it was not also morally good, but we want to prescind from that question. Even scholars holding those views—such as some of the ancient Greeks or Kant, who arguably thought moral goodness was central to welfare—also recognized that a good life must have other features or attributes.

What might those attributes be, and …

Text Is Not Enough, Anuj C. Desai Jan 2022

Text Is Not Enough, Anuj C. Desai

University of Colorado Law Review

In Bostock v. Clayton County, the Supreme Court held that Title VII of the Civil Rights Act of 1964 protects gay and lesbian individuals from employment discrimination. The three opinions in the case also provided a feast for Court watchers who study statutory interpretation. Commentators across the ideological spectrum have described the opinions as dueling examples of textualism. The conventional wisdom is thus that Bostock shows the triumph of textualism. The conventional wisdom is wrong. Instead, Bostock shows what those who have studied statutory interpretation have known for decades: judges are multimodalists, drawing from a panoply of forms of …

Do Managers Learn From Analyst Participation In Conference Calls?, Amanda Aw Zhi Xin Yong, Young Jun Cho, Holly I. Yang

Research Collection School Of Accountancy

While research finds that conference calls are informative to the market and analysts, they can also be informative to managers as analysts’ questions can provide a feedback effect. Using a sample of conference call transcripts from 2002 to 2018, we find that greater analyst participation, as measured by the number of words spoken by analysts relative to the number of words spoken by managers during conference calls, is associated with higher accuracy in managers’ subsequent earnings forecasts. Cross-sectional tests show that this positive association is more pronounced when managers use more uncertain words in conference calls, when analysts use a …

Examining Responsible Leadership Through The Lens Of Corporate Social Responsibility, Teslin Ishee

CMC Senior Theses

With a new wave of Environment-Social-Governance (ESG) focused investing, many companies and investors focus on trying to do better for society and the environment. Thus, it is important to understand the factors that influence the success of socially responsible companies. In particular, understanding what type of leadership can help make companies more likely to engage in corporate social responsibility (CSR) or social impact initiatives is vital to the future of business. B Corporations, which are companies that focus on combing profit with environmental and social goals, and corporate social responsibility are examples of impact focused organizations. This thesis presents a …

An Investigation Of The Perception Of Elderspeak Among Community Dwelling Older Adults, Abby L. Teply

All Graduate Theses, Dissertations, and Other Capstone Projects

This study aimed to expand the literature on the perception of elderspeak among community dwelling older adults with secondary purposes concerning how these perceptions vary across gender and region. Participants (n = 110) were presented a written vignette that depicted a nursing assistant in an assisted living facility waking a tenant from a nap and assisting the tenant to the bathroom before lunch. The nursing assistant uses elderspeak throughout the vignette. Following the vignette, participants’ reactions to the use of elderspeak and perceptions of the nursing assistant in the vignette were assessed using a series of open-ended questions, the Positive …
