From Healthcare To Hiring: Impacts Of Social And Public Policy On Disabled Veterans In The United States, Benjamin Michael Stoflet
From Healthcare To Hiring: Impacts Of Social And Public Policy On Disabled Veterans In The United States, Benjamin Michael Stoflet
Journal of Law and Health
Part I of this paper considers the historical foundations, motivations, and evolution of veterans’ disability and employment legislation in the United States. Utilizing disability and employment as its framework, Part II then defines, describes, and critiques contemporary policies for disabled veterans in the areas of federal employment protections and uses of Alternative Dispute Resolution (ADR) within the VA’s disability decision review process. Part III discusses the roles played by disabled veterans and the federal government in policy reform, finding that both sides act as catalysts and barriers to legislative change. This paper concludes in Part IV, recommending legislation that integrates …
Due Process Junior: Competent (Enough) For The Court, Tigan Woolson
Due Process Junior: Competent (Enough) For The Court, Tigan Woolson
Journal of Law and Health
There are many reports presenting expert policy recommendations, and a substantial volume of research supporting them, that detail what should shape and guide statutes for juvenile competency to stand trial. Ohio has adopted provisions consistent with some of these recommendations, which is better protection than relying on case law and the adult statutes, as some states have done. However, the Ohio statute should be considered a work in progress.
Since appeals courts are unlikely to provide meaningful review for the substance of a juvenile competency determination, the need for procedures for ensuring that the determination is initially made in a …

Seasonal Turnover Of Avian Community Assembly In A Highly Fragmented Tumbesian Dry Forest Of Southwestern Ecuador, Vanessa E. Luzuriaga-Aveiga, Diego F. Cisneros-Heredia
Neotropical Biodiversity
Tropical dry forests are among the most threatened and yet the most biodiverse Neotropical ecosystems. However, current patterns of biological occupancy in these forests remain poorly studied. Here, we document the diversity, patterns of seasonal turnover and change of species composition over time of birds in a highly exploited but protected tropical dry forest of southwestern Ecuador, Bosque Protector Puyango. Using a combination of mist netting, song recording and direct observations, we surveyed the study site over a 2-month period of fieldwork during both the dry and rainy seasons. We then performed a literature review of the species reported in …

Neotropical Biodiversity
The northwestern region of Argentina has several gaps in ichthyogeographic knowledge and there are still bodies of water without records of the species that inhabit them. When planning mitigation projects or conservation or management actions, little knowledge of the biology of a species presents itself as a restriction. Therefore, the objective is to know the reproductive biology of the torrent catfish (H. macraei) in the Natural Protected Area La Ciénaga, San Juan, with the purpose of generating basic information as a tool for the future management of these populations. The torrent catfish, Hatcheria macraei (Girard, 1855) is a Siluriformes that …

Journal of Dentistry Indonesia
The permanent mandibular first molar is frequently involved in conventional root canal treatment due to its function and position in the oral cavity. Additional root canals mandate accurate diagnosis and conservative management to prevent any procedural errors. The first independent middle mesial canal incidence was verified in mandibular molars in 1974, with a global incidence of 10.8–27.0%. Reporting of the middle distal canal in the endodontic literature is scarce, with an incidence of 0.2–3%. The present case report describes the endodontic management of an unusual permanent mandibular first molar with three canals in the mesial and distal roots, diagnosed with …

A Response To Fallis: Does Lying Require The Intent To Deceive?, Bernardo S. Bagalay Jr., Rizzaine S. Ignacio, Mark Anthony L. Dacela
Sinaya: A Philippine Journal for Senior High School Teachers and Students
The traditional definition of lying has been challenged by contemporary philosophers who have raised multiple counterexamples in recent years. At the forefront of these counterexamples are bald-faced lies, selfless assertions, and misleading - all phenomena that fulfill the conditions of the traditional definition of lying yet are not considered conventional lies. The emergence of these cases has prompted philosophers to ask the question, “Is the intent to deceive a necessary condition for lying?” There are generally two philosophical stances concerning the topic: the deceptionists, who believe that the intent to deceive is a necessary condition for lying, and non-deceptionists, who …

Pre-K–12 schooling in the United States has historically and systemically promoted ideas of Black inferiority while safeguarding the characteristics of white supremacy culture embedded in all aspects of the education system. The notion of white dominance is evident throughout studies, policies, and reports from district, state, and federal officials who have been tasked with closing the achievement gap but instead have assigned blame to BIPOC (Black, Indigenous, and People of Color) students and families. An analysis of the history of U.S. public education reveals not a single achievement gap but multiple opportunity gaps that perpetuate the subjugation of Black students …
Quantifying Life History Energetics Of An Oviparous Elasmobranch Subject To Future Warming Water, Carolyn R. Wheeler
Quantifying Life History Energetics Of An Oviparous Elasmobranch Subject To Future Warming Water, Carolyn R. Wheeler
Graduate Doctoral Dissertations
Marine ectothermic fishes – fishes that do not regulate internal body temperature independent from the water temperature – are some of the most vulnerable organisms to rapid and alarming increases in environmental temperature occurring due to climate change mediated-ocean warming. For tropical fish species that live near their thermal maxima, this warming could be of grave consequence to individuals, populations, and whole marine ecosystems. Certain key life stages such as embryos and reproducing adults may be particularly vulnerable to warming given the excess energetic costs of these life stages, which may disallow compensation for extreme changes in temperature. One taxonomic …

Consequently, an online qualitative survey gathered data from fifty (50) senior high school students presently enrolled in the different strands and tracks in the division. To better understand students’ awareness of the needed skills, thematic analysis of Braun and Clarke (2006) was utilized. Students' qualitative …
Living By Religion, Playing By Law: Early Glimpses Of The Ban On Triple Talaq, Kalindi Kokal
Living By Religion, Playing By Law: Early Glimpses Of The Ban On Triple Talaq, Kalindi Kokal
Socio-Legal Review
The Supreme Court of India declared triple talaq, a type of Islamic divorce, as unconstitutional in 2017. Following that, in 2019, the Parliament enacted the Muslim Women (Protection of Rights on Marriage) Act, 2019, which criminalised the pronouncement of triple talaq. Triple talaq as a form of divorce continues to hold legitimacy under the uncodified religious law that Muslims in India abide by in their everyday life. What, then, is the impact of the criminalisation of this practice at the level of the community? What does intervention by the criminal justice system mean for justice in inter-personal disputes that are …

The Majesty And Dignity Of Courts: Changes In Court Dynamics With The Onset Of The Covid-19 Pandemic In India, Rahela Khorakiwala
Socio-Legal Review
The procedures and practices of courts were brought to a sudden halt with the onset of the Covid-19 pandemic. This led to the promulgation of virtual courts where previously known traditions of the courts changed in many ways. The dress code was watered down and the understanding of the majesty and dignity of courts had to be re-established. This paper documents the seismic changes that occurred in virtual courts and how the courts had to keep redefining what contempt meant in the context of virtual courts. It is argued that majesty and theatrics affect the dispensation of justice, so when …

“It Is Her Decision, Not Mine” The Problem Of Choice In Abortion Consultation Services In Norway, Franceline Anggia
Paradigma: Jurnal Kajian Budaya
Since 1978, women have been granted legal rights to self-determined abortion, from which the idea of women’s right to choose achieves its victory in the current Norwegian abortion law. Behind this notion of choice lies an assumption that perceives women as subjects of choice who should personally decide whether or not having an abortion would be the proper way to overcome difficult decisions on their pregnancies. Women’s right to choose is celebrated as an ideal concept in consultation services for women who face difficult decisions on whether or not to have an abortion. Counselors and health workers I interviewed used …

Determination Of Effectiveness Of Combined Biological And Physicochemical Treatment Of Vinasse, Mahir Mohammed Said
Tanzania Journal of Engineering and Technology (TJET)
Combined biological and Physicochemical treatment method was used to treat vinasse using microorganisms (Aspergillus niger (fungi) and Bacillus subtilis (bacteria)), coagulants (aluminium sulphate (Al2(SO4)3) and iron III chlorides (FeCl3)) and followed by filtration. Three factors; coagulant type, type of microorganism and coagulant concentration was analysed using full factorial design (2n) with replication, on their percentage removal of Chemical Oxygen Demand (COD), Biological Oxygen Demand (BOD), Total Suspended Solids (TSS) and turbidity. Pareto chart and regression analysis with a 95% confidence interval (5% significant level) were used to analyse the results using MINITAB 22 (current version). Initially, the vinasse had (COD), …
