The Hidden Harms Of Privacy Penalties, Mary D. Fan
The Hidden Harms Of Privacy Penalties, Mary D. Fan
Articles
How to frame privacy penalties to protect our personal information is an important question as demands for legislation and proposals proliferate. The predominant assumption in calls for a comprehensive consumer privacy regime is that regulation and penalties arm the consumer David against Goliath businesses. Missing in the focus on powerful companies is attention to the potential harms of expanding privacy penalties for small-fry individuals and entities, especially from disfavored or marginalized groups. This article is the first to illuminate the regressive risks of privacy penalties, showing how broad privacy penalties can become tools for harassment of small businesses and individuals …
Unravelling Inventorship, Toshiko Takenaka
Unravelling Inventorship, Toshiko Takenaka
Articles
Inventorship, who made an invention, is one of the most important concepts under the U.S. patent system. Incorrect inventorship determinations result in patent invalidity not only because U.S. Constitution requires granting patents to true inventors, but also first-inventorto- file novelty inherited many aspects of first-to-invent novelty which depended on inventorship whether to include prior inventions as prior art. Correcting inventorship may result in sharing patent exclusivity with competitors, which forfeits profits necessary to recover expensive development costs. However, the standard to determine inventorship has been called muddy by judges and commentators because neither the Patent Act nor case law provide …
Revitalizing Conservation And Management Of The American Crocodile (Crocodylus Acutus) In The Dominican Republic, Robert Greco
Revitalizing Conservation And Management Of The American Crocodile (Crocodylus Acutus) In The Dominican Republic, Robert Greco
UNF Graduate Theses and Dissertations
Crocodilian populations declined globally during the 20th century because of overhunting and habitat loss. Some crocodilian populations have recovered recently through legal protections and habitat restoration, but the status of many crocodilian populations are still unknown because of a lack of recent data. The American crocodile (Crocodylus acutus) population in the Dominican Republic (DR) is one of these data-deficient populations, with country-wide surveys not carried out since the 1980s. From May through July 2021 we surveyed areas within DR where C. acutus is still likely residing. Our surveys yielded no crocodile sightings in Monte Cristi, suggesting that …
Gender Differences In Academic Self-Concept, Perfectionism, And Math Performance Among First-Year Stem And Non-Stem Students, Jessica Lewis
Gender Differences In Academic Self-Concept, Perfectionism, And Math Performance Among First-Year Stem And Non-Stem Students, Jessica Lewis
UNF Graduate Theses and Dissertations
The primary goal of this research was to compare academic self-concepts and adaptive and maladaptive perfectionistic tendencies as they relate to differences in mathematics performance of first-year undergraduate students’ gender and major (STEM or non-STEM). One hundred and ninety-nine first-year undergraduate students completed self-reported questionnaires including the Frost Multidimensions Perfectionism Scale, the academic self-concept scale of the Personal and Academic Self-Concept Scale (PASCI), and a math performance measure consisting of practice SAT questions. This study utilized correlational, multivariate analyses of variances (MANOVA), and multiple regression techniques. MANOVA results revealed a main effect of gender on all variables and a marginally …
Baby, We Were Born This Way: The Case For Making Sexual Orientation A Suspect Classification Under The Equal Protection Clause Of The Fourteenth Amendment, Jennifer R. Covais
Baby, We Were Born This Way: The Case For Making Sexual Orientation A Suspect Classification Under The Equal Protection Clause Of The Fourteenth Amendment, Jennifer R. Covais
Touro Law Review
Currently, the Equal Protection clause of the Fourteenth Amendment of the U.S. Constitution provides minimal constitutional safeguards against discrimination based on sexual orientation. Laws that treat queer Americans differently than their straight counterparts are presumptively constitutional if those laws bear a rational relationship to any legitimate government interest. Consequently, states may limit same-goods and services of certain businesses, and qualify for government programs. The Supreme Court established enhanced equal protection guarantees for classifications based on race, ethnicity, and national origin which are deemed suspect classifications. These classifications will only survive judicial review if the government proves the law is necessary …
End Of Life, Elder Abuse, And Guardianship: An Exploration Of New York’S Surrogate Decision-Making Framework, Tristan Sullivan-Wilson, Esq., Deirdre Lok, Esq., Joy Solomon, Esq.
End Of Life, Elder Abuse, And Guardianship: An Exploration Of New York’S Surrogate Decision-Making Framework, Tristan Sullivan-Wilson, Esq., Deirdre Lok, Esq., Joy Solomon, Esq.
Touro Law Review
The best end of life care is always that which aligns with the wishes and values of the incapacitated person. For individuals with the capacity to execute advance directives, these documents and conversations with appointed surrogates are the clearest way to make care values known. However, the time, access, and ability to engage in advance planning is not an opportunity equally afforded. For those without advance directives and now involved in a guardianship proceeding, the party petitioning or otherwise involved in the case should consider addressing end of life decision-making directly in the guardianship hearing when major medical decision-making power may …
Safeguarding The Public: Why Workers’ Rights Education Should Be Required Learning For Nurses, Esperanza N. Sanchez
Safeguarding The Public: Why Workers’ Rights Education Should Be Required Learning For Nurses, Esperanza N. Sanchez
Touro Law Review
Nurses are integral to the delivery of quality health care in this country. They set aside their own needs and fears to provide care and other social services to people across a multitude of settings, taking on the burdens and stresses of others. However, our profit-driven health care system incentivizes employers to maximize productivity at reduced costs by asking nurses to do more with less. Nurses are expected to endure harsh working conditions, proven to be harmful to the nurses’ health and well-being, despite evidence showing that poor working conditions can lead to poor patient outcomes.
There are numerous worker …
How Covid-19 Put The Spotlight On The Emtala, Ikra Kafayat
How Covid-19 Put The Spotlight On The Emtala, Ikra Kafayat
Touro Law Review
There was a time when those that were unable to afford medical care risked being denied treatment in emergency situations. Before Congress passed Emergency Medical Treatment & Labor Act (EMTALA), patients were being transferred to different hospitals, without being screened, because they did not have insurance and could not afford the treatment. Hospitals are no longer allowed to transport patients without properly screening and stabilizing them. Patients can bring a suit against a hospital if they believe the hospital violated EMTALA, however, in certain circuits the patient will need to prove that hospital had an “improper motive” for failing to …
20 Ways To Fight Housing Discrimination, Ian Wilder
20 Ways To Fight Housing Discrimination, Ian Wilder
Touro Law Review
When looking at the continuing size of the problem of discrimination it is easy to be paralyzed into inaction by the sweeping scope of the undertaking. A good remedy is to find actions that an individual can take to move toward justice. Though Dr. King is often quoted as stating that “the arc of the moral universe is long, but it bends toward justice,” that bend in the arc is caused by legions of activists pulling the future toward justice. Robert Kennedy noted in his opposition to apartheid in South Africa that “a million different centers of energy and daring …

Theft, Extortion, And The Constitution: Land Use Practice Needs An Ethical Infusion, Michael M. Berger
Touro Law Review
There are many ways in which property owners/developers interact with regulators. To the extent that texts and articles deal with the ethical duties of the regulators, they tend to focus on things like conflicts of interest. But there is more. This article will examine numerous other ways in which regulators may run afoul of ethical practice in dealing with those whom they regulate
Compulsory Licensing Of Patents In Times Of Public Health Emergency, Kelsey Truglio
Compulsory Licensing Of Patents In Times Of Public Health Emergency, Kelsey Truglio
Touro Law Review
In March 2020, the United States shut down to avoid the continued spread of the COVID-19 virus as it spread globally. In December 2020, the first COVID-19 vaccines were granted emergency usage authorization in the United States. Wealthy nations were able to quickly purchase and hoard vaccines for public distribution, leaving many third-world countries and developing nations struggling to continue to survive the pandemic without vaccination.
Compulsory licensing should be allowed on otherwise patented or patentable new technology in times of global health emergency, regardless of which entity creates the technology. This will enable governments of countries spanning all wealth …

Inferences Training Affects Memory, Rumination, And Mood, B. Perlman, N. Mor, Y. Wisney Jacobinski, A. Doron Zakon, N. Avirbach, Paula T. Hertel
Psychology Faculty Research
Making negative inferences for negative events, ruminating about them, and retrieving negative aspects of memories have all been associated with depression. However, the causal mechanisms that link negative inferences to negative mood and the interplay between inferences, rumination, and memory have not been explored. In the current study, we used a cognitive-bias modification (CBM) procedure to train causal inferences and assessed training effects on ruminative thinking, memory, and negative mood among people with varying levels of depression. Training had immediate effects on negative mood and rumination but not after recall of a negative autobiographical memory. Note that training affected memory: …
Psychiatric And Neuropsychological Sequelae Of Herpes Simplex Encephalitis, Carla F. Cabrera, Charles J. Golden
Psychiatric And Neuropsychological Sequelae Of Herpes Simplex Encephalitis, Carla F. Cabrera, Charles J. Golden
Archives of Assessment Psychology
Herpes simplex encephalitis (HSE) is caused by the herpes simplex virus (HSV), often from the Type 1 (HSV-1) viral infection. This neurotropic double-stranded DNA virus impairs the integrity and permeability of the blood-brain barrier, allowing the virus to enter the brain. In several studies, HSV-1 impacts the temporal lobe, frontal lobe, and limbic system, leading to brain damage. While significant progress has occurred in understanding this infection, clinicians should be vigilant for acute and chronic complications associated with HSE, such as autoimmune encephalitis, differential diagnoses, and psychological disorders. A growing body of literature focuses on the evidence of an association …
Revisiting The Need For Age-Based Norms In Personality Assessment Using The Cleveland Adaptive Personality Questionnaire, Amir M. Poreh, Jennifer B. Levin
Revisiting The Need For Age-Based Norms In Personality Assessment Using The Cleveland Adaptive Personality Questionnaire, Amir M. Poreh, Jennifer B. Levin
Archives of Assessment Psychology
The need for age-based norms in personality assessment is of great interest given the trend of adjusting for demographic variables in neurocognitive evaluations. We examined the need for age-based norms using the Cleveland Adaptive Personality Questionnaire (CAPQ; Poreh & Levin, 2019) in 1,646 individuals ages 25 to 95 years (M = 44.5, SD = 16.1). Results showed that scores on the CAPQ clinical scales linearly declined across the lifespan in conjunction with a linear increase in measures of social desirability. Power analysis indicated that the CAPQ Avoidant scale produced the most significant effect, followed by a moderate effect for the …

Assessing Aggressivity With The Comprehensive System-Revised, Part I: The Rorschach Gacono & Meloy Extended Aggression Scores: An Updated Review, Carl B. Gacono, Jason M. Smith
Archives of Assessment Psychology
Determining a patient's aggressivity is a function of assessing multiple factors, including personality vulnerabilities, past behaviors, and potential future circumstances. Evaluating the nature and predominance of aggressive drive, impulse control, affect lability, inhibitory mechanisms, cognitive deficits, and conscious and unconscious attitudes (e.g., use of devaluation; the presence of internal identifications and imagery) is essential. All of these issues have correlates in the Comprehensive System (CS; Exner, 2003; also CS-R; Fontan & Andronikof, 2022) and supplemental Rorschach data (primitive defenses: Cooper et al., 1988; Lerner & Lerner, 1980; object relations phenomena: Kwawer, 1980; extended aggression scores: Gacono & Meloy, 1994). Pre-Oedipal …

Assessing Aggressivity With The Comprehensive System-Revised, Part Ii: The Gacono Aggressivity Cluster (Gac), Carl B. Gacono, Jason M. Smith
Archives of Assessment Psychology
The coding of Rorschach aggressive imagery, while essential, is not sufficient for assessing aggressivity. This evaluation requires an analysis of multiple personality domains and functions, such as nature and predominance of aggressive drive, impulse control, affect lability, inhibitory mechanisms, cognitive deficits, and conscious and unconscious attitudes (e.g., use of devaluation; internal identifications & imagery; Finney, 1955; Rose & Bitter, 1980). As personality attributes correlate with Rorschach variables and indices, the Rorschach contributes to identifying and confirming the nature and quality of an individual’s vulnerabilities. Ultimately, however, a determination of an individual's aggressivity must be considered not only through the lens …
Nurses, Politics And Policy: Moving A Critical Initiative Forward Through Education, Inspiration And Motivation For Political Activity, Elizabeth Clark
Nurses, Politics And Policy: Moving A Critical Initiative Forward Through Education, Inspiration And Motivation For Political Activity, Elizabeth Clark
Yale School of Nursing Digital Theses
Texas has the highest rate of uninsured and underserved residents in the United States. Texas also is one of the most restricted states for advanced practice registered nurses (APRN) to practice. As shown in other states, one means of obtaining full practice authority for APRNs is by gaining more of a nursing presence in the legislature. This project created a program to educate, motivate and inspire Texas nurses for political involvement. The project was completed in collaboration with the Texas Nurses Association. 78 nurses participated in surveys focusing on nurses’ attitudes and opinions, knowledge level, mental preparedness for political involvement …
Assessing Risk For Right Heart Failure After Left Ventricular Assist Device Implantation, Mary-Ann Lombardi Cyr
Assessing Risk For Right Heart Failure After Left Ventricular Assist Device Implantation, Mary-Ann Lombardi Cyr
Yale School of Nursing Digital Theses
The lives of more than six million people in the United States are negatively impacted by the diagnosis of Advanced Heart Failure. Financial burden, repeated hospitalizations, and declining quality of life account for poor outcomes. Implantation of a left ventricular assist device (LVAD) has offered the promise of improved financial, clinical, and functional outcomes for those awaiting or ineligible for heart transplantation. Right Heart Failure (RHF), however, threatens positive outcomes as it remains the leading cause of mortality and morbidity following LVAD placement. Despite extensive research, there is no comprehensive tool for RHF risk assessment and stratification for this population. …
Creating A Welcoming, Inclusive, And Affirming Primary Care Environment For Lesbian, Gay, Bisexual, Transgender, Queer, Questioning, Intersex And Asexual Patients, Samantha Korbey
Yale School of Nursing Digital Theses
The LGBTQIA+ community has long faced disparities in healthcare which have had significant consequences including increased cancer risk factors and poorer health outcomes when compared to the cisgender, heterosexual community. Interventions are needed to increase the knowledge and cultural competency of providers, to create welcoming and safe spaces for LGBTQIA+ patients, and to encourage disclosure of sexual orientation and gender identity (SOGI).
The purpose of this DNP project was to adapt, implement, and evaluate an evidence-based model for creating an affirming, inclusive, culturally competent, and safe primary care environment for LGBTQIA+ patients within a family practice center. This quality improvement …

Yale School of Nursing Digital Theses
Novice Advanced Practice Registered Nurses in Federally Qualified Health Centers are expected to assimilate to the autonomous clinician role rapidly and meet the threshold of clinical expertise required for their new role. Mentorship is widely demonstrated in the literature as an important resource during onboarding and transition. Mentorship and social support facilitate appropriate novice Advanced Practice Registered Nurse role transition and attainment. This project employs a literature review, surveys and interviews of Advanced Practice Registered Nurses and the implementation of a transition-to-practice program in a federally qualified health center. Results of this project indicate that a structured transition-to-practice program can …
Enhancing The Assessment Of Suicidal Ideation In The Long-Term Care Environment: A Quality Improvement Project, Carissa Ann Tufano
Enhancing The Assessment Of Suicidal Ideation In The Long-Term Care Environment: A Quality Improvement Project, Carissa Ann Tufano
Yale School of Nursing Digital Theses
Abstract Despite high rates of depression and risk factors for suicide, there is a knowledge deficit and lack of protocol surrounding the assessment of suicidal ideation in the long-term care setting. Although studies examining suicide in the long-term care setting are lacking, the prevalence of suicidal ideation is high. This DNP quality improvement project addressed this problem by creating a suicide assessment and management inservice for frontline clinical staff at a skilled nursing facility in Connecticut. The inservice integrated use of an adapted suicide assessment algorithm and a suicide screening tool, the P4 Screener. A SAMHSA toolkit was utilized as …
The Application Of Poka-Yoke To Administration Functions Within An Organisation., Craig Dixon Woodward
The Application Of Poka-Yoke To Administration Functions Within An Organisation., Craig Dixon Woodward
School of Engineering, Computing and Mathematics Theses
Poka-yoke is a quality assurance technique developed by Shigeo Shingo in the 1960s. It is based on the theory that errors and defects have a cause and effect relationship. A defect is purely the effect of an error and by employing poka-yoke devices within processes to remove errors, defects can also be eliminated. The use of poka-yoke has made a significant contribution to organisations' ability to effectively control their core manufacturing processes but little attention has been given to the mistake-proofing of the surrounding administration or support processes. This thesis provides a definition of "administration" and justifies the need for …
Machine Learning-Based Exploration Of Blood-Based Biomarkers For Alzheimer’S Disease Diagnosis, Chima Stanley Eke
Machine Learning-Based Exploration Of Blood-Based Biomarkers For Alzheimer’S Disease Diagnosis, Chima Stanley Eke
School of Engineering, Computing and Mathematics Theses
Alzheimer’s disease (AD) is a neurodegenerative disease with typical clinical symptoms in the form of progressive cognitive impairment and memory loss. To facilitate early diagnosis of AD and a greater understanding of the mechanisms underlying its clinical expression, the use of biomarkers is necessary. Furthermore, it is believed that biomarkers provide a more objective and accessible means of diagnosis. Currently, established biomarkers include neuroimaging markers, such as those based on positron emission tomography (PET), and biochemical markers such as cerebrospinal fluid (CSF) markers. However, neuroimaging is expensive and may not be widely available and CSF testing is invasive. Blood-based biomarkers …
Graphene Based Electrochemical Biosensors For The Detection Of Blood Biomarkers Of Alzheimer’S Disease, Jagriti Sethi
Graphene Based Electrochemical Biosensors For The Detection Of Blood Biomarkers Of Alzheimer’S Disease, Jagriti Sethi
School of Engineering, Computing and Mathematics Theses
Alzheimer’s disease (AD) is a neurodegenerative disorder that affects millions of people around the world with no available treatments to cure, reverse or even slow down the disease progression. Detection of AD in the early stages, before the massive neuronal loss, is key to developing disease-modifying treatments and preventive strategies. The current AD diagnosis is largely based on evaluation tests such as Mini-Mental State Examination (MMSE), imaging techniques such as Magnetic Resonance Imaging (MRI), Positron Emission Tomography (PET), and postmortem autopsies. It is expensive and only available at the later/severe stages when the brain of the patient is already damaged …
Nurses’ Role In Reducing Mental Health Stigma In Health Care, Angel Vivian Mbome
Nurses’ Role In Reducing Mental Health Stigma In Health Care, Angel Vivian Mbome
Walden Dissertations and Doctoral Studies
Many patients with mental illness around the world face mental health-related stigma. Compared to other health care workers, nurses express the highest level of stigmatizing attitudes toward mentally ill patients. The purpose of this project was to change staff nurses’ attitudes in a long-term care facility by educating them on mental health stigma. The practice-focused question guiding this study was whether educating staff nurses on mental health stigma changed nurses’ attitudes and behavioral intentions towards people with mental illness. This project was guided by the constructivist theory of learning. Seventeen staff members voluntarily participated in a 30-minute nursing staff education …
Pink Bamboo Ceiling: Barriers And Breakthroughs For Asian American Women Leaders, Mele W. Kramer
Pink Bamboo Ceiling: Barriers And Breakthroughs For Asian American Women Leaders, Mele W. Kramer
Walden Dissertations and Doctoral Studies
AbstractAsian Americans are the most diverse and fastest-growing minority group in the U.S. and have the highest average level of education of all minority and dominant groups in America making up 6.2 % of the labor market. However, Asian Americans overall hold one percent of the executive leadership roles in Fortune 500 organizations. Low leadership representation leaves this demographic without a decision-making voice and without power in society. The purpose of this qualitative study was to learn about the lived experiences of Asian American women (AAW) leaders and potential leaders as it pertains to race, gender, and stereotypes in the …

Links Between Screen Time, Montessori Preschool Exposure, And Working Memory, Paula Lyn Larsen Mamani
Walden Dissertations and Doctoral Studies
A high-quality, foundational education offers lifelong benefits for young children. The problem is that working memory in pre-school-aged children is declining and could be impaired by the extraneous cognitive load imposed during engagement with screen media apps and/or preschool programs. Although the pedagogical practices associated with Montessori preschool programs have been found supportive of cognitive load germane to learning and improved working memory, they have not been fully considered in relation to preschoolers' screen media use. The cognitive load created by screen media apps could affect their usefulness as learning tools. The purpose of this quantitative study was to discover …

A Qualitative Study Exploring How Male U.S. Veterans Experience Empathy, Elda Marina Stepp
Walden Dissertations and Doctoral Studies
AbstractThis qualitative study explored the lived experiences of male U.S. combat veterans with empathy and how this features in their transition back into society. Davis’s cognitive and emotional empathy served as the conceptual framework to expand further on this topic. Seven male U.S. combat veterans who had deployed at least once in their military career and lived as civilians for the past 10 to 15 years were interviewed through Zoom. Recruiting methods included social media, veteran meeting places, and snowballing approaches. Results from interpretative phenomenological analysis of the interview data included six main themes: feelings of compassion before deployment, feelings …
