Impact Of Legal Representation On An Unaccompanied Child’S Immigration Case Outcome, Victoria Celia Castillo
Impact Of Legal Representation On An Unaccompanied Child’S Immigration Case Outcome, Victoria Celia Castillo
Walden Dissertations and Doctoral Studies
Many of the unaccompanied children entering the United States by crossing the border from Mexico remain alone without legal protections, leaving them vulnerable to detention and deportation. The problem addressed in this study is the lack of availability and accessibility to legal representation for an unaccompanied child’s immigration proceedings. The theory of intersectionality by Kimberlé Crenshaw guided the study, as this theory is used to understand how multiple social identities, such as race and gender, intersect at the micro-level of individual experience to expose interlocking systems of privilege and oppression. For this nonexperimental quantitative study, secondary data from the Transactional …
Revisiting A Jurisprudence Of Obligation, Ariel Evan Mayse, Kenneth A. Bamberger
Revisiting A Jurisprudence Of Obligation, Ariel Evan Mayse, Kenneth A. Bamberger
Touro Law Review
Through his landmark exploration of obligation as the conceptual touchstone of what he describes as the “Jewish jurisprudence of the social order,” Robert Cover offered an alternate language for legal regimes grounded in a rhetoric of individual rights. The present essay revisits Cover’s account of the socially embedded nature of law and juridical process, taking seriously both its claims, as well as the cautions of its critics. The essay thus neither abandons the concept of rights as key to jurisprudence nor seeks to present a naïve or romantic characterization of Jewish legal thought, and proceeds wary of the pitfalls inherent …
Unearthing The Old South/West: Histories Of Racial Capitalism In Modernist Border Narratives, Bailey Moorhead
Unearthing The Old South/West: Histories Of Racial Capitalism In Modernist Border Narratives, Bailey Moorhead
Electronic Theses and Dissertations
“Unearthing the Old South/West” examines four works of modernist historical fiction which accentuate competing regimes of racial capitalism through South/Western border settings. Following the trend in New Southern and Western Studies to break with exceptionalist and essentialist considerations of these regions, my analysis challenges white-centric narratives of the U.S. South and West and questions their popular portrayals as culturally distinct spaces. Viewing the U.S. as a site of ongoing settler colonialism, imperialist conquest, and international trade reliant upon labor exploitation, I develop the idea that South/Western borders form a microcosm for larger structures of systemic oppression throughout the nation by …

Utility Scale Agrivoltaics Development Proximate To Michigan Communities With 100% Renewable Energy Goals, Kabanda Herve Christian Sheja
Dissertations, Master's Theses and Master's Reports
This report aims to assess the potential of agrivoltaics (combined solar and agricultural systems) for development geographically proximate to the six Michigan (MI) communities that have set 100% renewable energy (RE) goals. I focus on one major research question: What is the total acreage of low-impact sites available for utility-scale (USS) agrivoltaics development proximate (within county boundaries) to MI communities with 100% RE goals? SAM is used to estimate land acreage required for a 10 MW agrivoltaic system development. ArcGIS Pro is used to determine the total acreage of low-impact sites proximate to MI communities with 100% RE goals.
Proximate …

The Role Of Inclusion In Climate Vulnerability Assessment And Equitable Adaptation Goals In Small American Municipalities, Elena Lioubimtseva
Open Access Publishing Support Funded Articles
Equity and inclusion considerations are important prerequisites of effective climate adaptation planning, especially at a local scale. This study examines how climate adaptation plans of small American cities and counties consider equity in their climate vulnerability assessments and adaptation planning goals and how consideration of equity in existing adaptation plans relates to the inclusion of diverse categories of stakeholders. Data analysis is based on the content of 23 local climate adaptation plans of small urban and rural municipalities across the United States with populations of less than 300 thousand people. Correlations between conceptualization of vulnerability dimensions, inclusion of 9 categories …

Demographic And Neurocognitive Predictive Factors Impacting On Expressed Vocational Interests, Tamar Runyan
PCOM Psychology Dissertations
This study examined multiple demographic and neurocognitive variables to determine which ones were predictive of expressed range of occupational interests and occupational interest types. This study used archival data from an outpatient community training clinic that included the Strong Interest Inventory (SII), tests of intellectual functioning, and tests of executive functioning. It was hypothesized that demographic variables (age, gender, years of education, and socioeconomic status) and cognitive variables (intelligence and executive functioning) would be predictive of the expressed range of occupational interests; and that there would be differences in career interests by gender and race/ethnicity. Multiple regressions and chi-square tests …

Community Development Practitioner Methods To Support People With Disabilities, Allison E. Lourash
Walden Dissertations and Doctoral Studies
There are numerous programs in the United States (US) that provide services and supports for people with disabilities with significant monetary costs and poor outcomes. Current research lacked information regarding how use of strengths-based approaches by community development practitioners supports people with disabilities and builds social capital. The purpose of this qualitative single case study was to explore community development practitioners’ use of strengths-based approaches to support people with disabilities in their communities. The conceptual framework of social capital was used for the study. The research question involved how community development practitioners identify and provide methods to support people with …

Use Of An Intelligent Tutoring System And Academic Performance In An Online College Course For Pre-Nursing Students, Mark Schmidt
Walden Dissertations and Doctoral Studies
The efficacy of intelligent tutoring systems (ITS) for undergraduate college level courses was not well established and specifically, the Pearson Dynamic Study Modules (PDSM) program had not been investigated locally. The purpose of this quantitative study was to determine whether the use of an ITS designed with a cognitive learning approach; the PDSM, would enhance pre-nursing student academic performance. The multiple attribute decision making and the human plausible reasoning theories grounded the study. A non-experimental quantitative research design was used to determine whether there was a difference in the assessment scores of pre-nursing students in a college level anatomy and …

An Anatomy Of Nepal's Remarkable Export Decline, Rishi Sharma
An Anatomy Of Nepal's Remarkable Export Decline, Rishi Sharma
Himalayan Research Papers Archive
This paper documents and breaks down a remarkable decline in Nepal's exports over the 2000-2019 period. This decline is due to a collapse in the country's top export products and is largely uniform across destinations and products. Furthermore, it is not on account of the poor global performance of the sectors Nepal was specialized in but is something more specific to Nepal. Industry-level statistics show that gross output increased in major exporting industries while value-added grew slower or declined. The increase in gross output together with the decline in exports implies a movement towards producing for domestic consumption using more …

In solidarity with the protests’ student activists at universities across the United States and Canada organized into the Black Liberation Collective and held the first #StudentBlackoutOut day of protests on university campuses on November 15 followed by …
This Land Is Your Land: The Dark Canon Of The United States Supreme Court In Natural Resources Law, Oliver A. Houck
This Land Is Your Land: The Dark Canon Of The United States Supreme Court In Natural Resources Law, Oliver A. Houck
Natural Resources Journal
This article treats four Supreme Court opinions that have had a lasting impact, largely negative, on public lands and resources. They rest on highly selective statements of fact, and dubious footing with precedent and statutory law. As a quartet they make the protection of natural resources extremely difficult. Resources that, in law, belong to us all. The first case, Southern Utah Wilderness Association, opened up a designated Wilderness Area too off-road vehicle use, where these uses are explicitly prohibited by law. In this opinion Justice Scalia managed, inter alia, to turn congressionally-mandated management plans into (unenforceable) wish lists, and find …
Borders And Water Conflicts: Mitigating Conflicts With Love And Cooperation, Peter J. Longo, Anthony B. Schutz, James M. Scott
Borders And Water Conflicts: Mitigating Conflicts With Love And Cooperation, Peter J. Longo, Anthony B. Schutz, James M. Scott
Natural Resources Journal
Borders are political constructs, not constructs derived from laws of nature. Borders carry more potential for conflict than any other matter in political relations. In international relations, wars have been fought over borders and territory. But, territory does not necessarily entail a dispute about the geographic location of a border. Trans-boundary natural resources disputes emerge because the laws of nature do not bend to this peculiar human construct. As much can be seen in international and intra-state water conflicts, where political boundaries provide individuals with a tribal identity that eclipses the power of natural resources to tie people together in …
Confronting The Local Land Checkerboard, Daniel B. Rosenbaum
Confronting The Local Land Checkerboard, Daniel B. Rosenbaum
University of Richmond Law Review
Fractured public land is hidden in plain sight. In communities across the country, a patchwork assortment of local governments share splintered ownership over surplus public properties, which can be found scattered in residential neighborhoods and alongside highways, in the shadows of development projects and in the scars of urban renewal. The ripple effect of this fragmentation extends across the spectrum of local governance. It creates needless costs and bureaucratic headaches at a time of acute fiscal distress for cities and counties. It contributes to an inequitable imbalance of local power between formal and informal landowners in a community. And curiously, …
Unservice: Reconceptualizing The Utility Duty To Serve In Light Of Climate Change, Heather Payne
Unservice: Reconceptualizing The Utility Duty To Serve In Light Of Climate Change, Heather Payne
University of Richmond Law Review
Many facets of utility monopoly regulation are approaching a minimum of eight decades as part of our legal landscape. A bedrock principle of state utility regulation is the duty to serve, which demands that utilities provide nondiscriminatory service to all those within their geographic territory for the specific service for which they have been granted a monopoly. Within its exclusive territory, a utility is required “to serve all present and reasonably to be anticipated future users.” Each state has adopted some form of this for its regulated monopolies, although formulations differ. This Article argues that in light of climate change …

All For One And One For All: One Market-Oriented Culture, Four Ceo Leadership Styles, Chris Linden Brown
Theses and Dissertations
The value of a market-oriented culture as one that sustainably satisfies customers, engages employees, and provides profitable growth is well-established. Market-oriented firms are more profitable, more innovative, and deliver higher customer and employee satisfaction than their competitors. However, we still know little of how leaders of such operations create and sustain their organizations’ market orientation. This research, positioned at the intersection of leadership and marketing strategy, draws on interviews with 66 CEOs and senior executives across a variety of firms and industries to generate insights into how these leaders developed their market-oriented approach and to identify the behaviors they engage …
Interpersonal Psychotherapy For Depressed Adolescents: A Systematic Review Of Quantitative Studies Exploring Effectiveness, Concomitant Findings, And Mediating And Moderating Variables, Luke Rex
Theses and Dissertations
Depression is one of the leading causes of illness and disability among adolescents. According to the National Institute of Mental Health (2022), almost one-fifth of adolescents ages 12 to 17 years in the United States had at least one major depressive episode in 2020, representing 4.1 million people, and over half did not receive any treatment. An interpersonal approach to therapy for adolescents known as Interpersonal Psychotherapy for Depressed Adolescents (IPT-A), developed by Dr. Laura Mufson, has been regarded as having well-established efficacy in treating depressed adolescents. This systematic review of quantitative studies (without meta-analysis) was conducted to (a) examine …
