"For Better Or Worse": Imagining Innovation In Smart City Municipal Design, Kevin M. Kochever Jan 2022

"For Better Or Worse": Imagining Innovation In Smart City Municipal Design, Kevin M. Kochever

Master's Theses

The smart city concept recently (ca. 2010) emerged as a corporate-led system-as-a-service (SaaS) tool to meet city needs of accessibility and efficiency. I looked at three Western cities—Reykjavík, San José, and Toronto—to discover what it meant for city managers to meet municipal needs by embracing smart initiatives. Senior-level city managers, consultants, and technologists invoked vocabularies of smartness and innovation, adopting Internet of Things (IoT) and artificial intelligence (AI) as tools to facilitate human resource and service efficiency needs. I found persistent ambiguity in how city managers described and measured outcomes for city smartness. I also found stakeholders used smartness to …

Left Ventricular Dysfunction In Outpatients With Frequent Ventricular Premature Complexes, Kyoung-Min Park, Sung Il Im, Sung Ho Lee, Hye Bin Gwag, Youngjun Park, Seung-Jung Park, June Soo Kim, Young Keun On

The Texas Heart Institute Journal

Frequent ventricular premature complexes (VPCs) and VPC QRS duration are risk factors for left ventricular (LV) dysfunction. To determine which clinical characteristics and electrocardiographic features are associated with LV dysfunction (ejection fraction,

We identified 412 consecutive outpatients (mean age, 54.7 ± 16.8 yr; 227 women [55.1%]) who were diagnosed with frequent VPCs and had no structural heart disease from January 2010 through December 2017. Available transthoracic echocardiograms and 24-hour Holter monitoring data were evaluated to correlate the occurrence of VPCs and symptoms.

Typical VPC-related symptoms (palpitations or dropped beats) were observed in 251 patients (61.1%). Electrocardiograms revealed VPCs with a …

The Texas Heart Institute Journal

Combining left ventricular assist device (LVAD) implantation and longitudinal sleeve gastrectomy may enable patients with morbid obesity to lose enough weight for heart transplant eligibility. In a retrospective study, we evaluated long-term outcomes of patients with body mass indexes ≥35 who underwent LVAD implantation and longitudinal sleeve gastrectomy during the same hospitalization (from January 2013 through July 2018) and then adhered to a dietary protocol. We included 22 patients (mean age, 49.9 ± 12.5 yr; mean preoperative body mass index, 43.3 ± 6.2). Eighteen months after gastrectomy, all 22 patients were alive, and 16 (73%) achieved a body mass index …

Duncan NRI Faculty and Staff Publications

Neuroimaging in the preclinical phase of Alzheimer’s disease provides information crucial to early intervention, particularly in people with a high genetic risk. Metabolic network modularity, recently applied to the study of dementia, is increased in Alzheimer’s disease patients compared with controls, but network modularity in cognitively unimpaired elderly with various risks of developing Alzheimer’s disease needs to be determined. Based on their 5-year cognitive progression, we stratified 117 cognitively normal participants (78.3 ± 4.0 years of age, 52 women) into three age-matched groups, each with a different level of risk for Alzheimer’s disease. From their fluorodeoxyglucose PET we constructed metabolic …

Background: Brain imaging and genetics are fields acquiring data at increasing speed, but more information does not always result in a better understanding of the underlying biology. We developed the ProcessGeneLists (PGL) approach to use genetics and mRNA gene expression data to generate regions of interest for imaging studies.

Methods: We applied PGL to past suicide attempt (ATT): We averaged the mRNA expression levels of genes (n = 130) possibly associated with ATT (p ≤ 10-3 in a published genome-wide association study, GWAS) in each brain region studied in the Human Allen Brain Atlas (6 ex-vivo brains, 158 to 946 …

The genetic basis for the emergence of creativity in modern humans remains a mystery despite sequencing the genomes of chimpanzees and Neanderthals, our closest hominid relatives. Data-driven methods allowed us to uncover networks of genes distinguishing the three major systems of modern human personality and adaptability: emotional reactivity, self-control, and self-awareness. Now we have identified which of these genes are present in chimpanzees and Neanderthals. We replicated our findings in separate analyses of three high-coverage genomes of Neanderthals. We found that Neanderthals had nearly the same genes for emotional reactivity as chimpanzees, and they were intermediate between modern humans and …

The Bi-Partisan Enabling Of Presidential Power: A Review Of David Driesen's The Specter Of Dictatorship: Judicial Enabling Of Presidential Power (2021), Jed Handelsman Shugerman Jan 2022

The Bi-Partisan Enabling Of Presidential Power: A Review Of David Driesen's The Specter Of Dictatorship: Judicial Enabling Of Presidential Power (2021), Jed Handelsman Shugerman

Faculty Scholarship

In "The Specter of Dictatorship: Judicial Enabling of Presidential Power," David Driesen questions the unitary executive theory and other doctrines of unchecked executive power. He offers primarily a critique of purposivism, a mix of original public meaning and more recent history illuminating those purposes: the Founders’ anti-tyranny purpose and then the rise of European tyranny from Nazi Germany to contemporary Hungary, Turkey, and Poland.
/="/">
/="/">This review first focuses on Driesen’s approach to Congress: He identifies the broad congressional delegation of powers to the president as a source of expansive executive power, but he does not entertain that doctrines …

Removal Of Context: Blackstone, Limited Monarchy, And The Limits Of Unitary Originalism, Jed Handelsman Shugerman Jan 2022

Removal Of Context: Blackstone, Limited Monarchy, And The Limits Of Unitary Originalism, Jed Handelsman Shugerman

Faculty Scholarship

The Supreme Court's recent decisions that the President has an unconditional or indefeasible removal power rely on textual and historical assumptions and a "removal of context." This article focuses on the "executive power" part of the Vesting Clause and particularly the unitary theorists' misuse of Blackstone. Unitary executive theorists overlook the problems of relying on England's limited monarchy: the era's rise of Parliamentary supremacy over the Crown and its power to eliminate or regulate (i.e., make defeasible) royal prerogatives. Unitary theorists provide no evidence that executive removal was ever identified as a "royal prerogative" or a default royal power. The …

Social Justice As Desistance: Rethinking Approaches To Gender Violence, Deborah M. Weissman Jan 2022

Social Justice As Desistance: Rethinking Approaches To Gender Violence, Deborah M. Weissman

Faculty Publications

Part I of this Article describes most domestic violence intervention programs (DVIPs) as they currently function with regard to gender violence. It critiques the structure of these programs, their close partnership with criminal legal system actors, perceived deficiencies, and it identifies missed opportunities to provide meaningful intervention strategies with those who have harmed. It demonstrates the ways that laws, regulations, and policies governing DVIPs constrain most programs from moving beyond established practices informed by punitive approaches to address the structural conditions that situate gender violence within a political economic framework.

Part II begins with a brief overview of the research …

Indigenisation Of Nigerian Librarianship Through Indigenous Knowledge: Exploring Its Possibilities, Abdulakeem Sodeeq Sulyman,, Basirat Omolara Amzat, Muritadho Abiodun Taiwo Jan 2022

Indigenisation Of Nigerian Librarianship Through Indigenous Knowledge: Exploring Its Possibilities, Abdulakeem Sodeeq Sulyman,, Basirat Omolara Amzat, Muritadho Abiodun Taiwo

Library Philosophy and Practice (e-journal)

Knowledge cannot be separated from the people holding it and the best way to make it appreciated is to present it in a way that represents the beliefs, customs and norms of its origin. This submission makes this paper attempts to find the perfect word between indigenisation and decolonisation as a way of developing Indigenous Librarianship in Nigeria. It settles for indigenisation because indigenisation focuses on the exploitation of the native, local resources to create, share, transform and retain knowledge. It ponders on the historical antecedents of Librarianship in Nigeria to proof that the Nigerian library practices were purely nurtured …

Not Child’S Play: A Constitutional Game Of Pass The Story In Dobbs, Shurtleff, And Kennedy, John V. Orth, Paul T. Babie Jan 2022

Not Child’S Play: A Constitutional Game Of Pass The Story In Dobbs, Shurtleff, And Kennedy, John V. Orth, Paul T. Babie

Faculty Publications

This Article suggests that in the effort to find fixed standards for rights, working with vague, indeterminate, silent text, the Supreme Court engages in a constitutional game of pass the story. No one outcome concludes the story; it merely adds another chapter, to which the next set of judges will add their own installment. The quest for standards never ends. The Court’s decisions in Dobbs v. Jackson Women’s Health Organization, Shurtleff v. City of Boston, and Kennedy v. Bremerton School District are merely the latest installments in stories that began with the founding. And as with any such story, …

A Silver Lining To Russia’S Sanctions-Busting Clause, Michael Bradley, Irving De Lira Salvatierra, W. Mark C. Weidemaier, Mitu Gulati Jan 2022

A Silver Lining To Russia’S Sanctions-Busting Clause, Michael Bradley, Irving De Lira Salvatierra, W. Mark C. Weidemaier, Mitu Gulati

Faculty Publications

In 2018, Russia began inserting an unusual clause into euro and dollar sovereign bonds, seemingly designed to circumvent future Western sanctions. The clause worked by letting the government pay in roubles if sanctions cut off access to dollar and euro payment systems. The clause received little scrutiny at the time, perhaps because Russia used a state-owned bank, rather than a global investment bank, as underwriter. But with the invasion of Ukraine and the ensuing sanctions imposed by the United States and other governments, the relevance of the clause has become clear. This Essay examines how the market reacted to the …

Preliminary Damages, Gideon Parchomovsky, Alex Stein Jan 2022

Preliminary Damages, Gideon Parchomovsky, Alex Stein

Vanderbilt Law Review

Historically, the law helped impecunious plaintiffs overcome their inherent disadvantage in civil litigation. Unfortunately, this is no longer the case: modern law has largely abandoned the mission of assisting the least well-off. In this Essay, we propose a new remedy that can dramatically improve the fortunes of poor plaintiffs and thereby change the errant path of the law: preliminary damages. The unavailability of preliminary damages has dire implications for poor plaintiffs, especially those wronged by affluent individuals and corporations. Resource-constrained plaintiffs cannot afford prolonged litigation on account of their limited financial means. Consequently, they are forced to either forego suing …

The Expanding Universe Of Bilateral Labor Agreements, Adam Chilton, Bartosz Woda Jan 2022

The Expanding Universe Of Bilateral Labor Agreements, Adam Chilton, Bartosz Woda

Coase-Sandor Institute for Law & Economics Research Paper Series

In the seventy-five years since the end of World War II, pairs of countries have entered into over a thousand bilateral labor agreements (BLAs) to regulate the cross-border flow of workers. These agreements have received little public or academic attention. This is likely, in part, because there is limited data or easily available information on BLAs. This Article hopes to change that by introducing three new resources: (1) a dataset documenting the formation of over 1,200 BLAs; (2) a corpus including the texts of over 800 BLAs; and (3) a dataset coding whether over 500 BLAs mention twenty topics that …

Creation And Evaluation Of The Illinois Cancer Risk Index As A Predictor Of Four Common Cancers, Lei Guo, Margaret E. Wright, Meridith C. Osias, Mahdi Vaezi, M. Courtney Hughes

Faculty Articles, Papers, and Other Scholarship

Introduction

Nearly half of all cancer deaths in the US are attributed to 4 common cancers: lung, colorectal, breast, and prostate. Illinois residents experience higher rates of cancer death from all 4 cancers compared with the US overall. We developed the Illinois Cancer Risk Index (ICRI), which incorporates many predictors of these cancers into a single summary measure, to identify Illinois counties that would benefit most from public health intervention.

Methods

We identified 90 county-level predictors of 4 common cancers, used multicollinearity testing to reduce this number to 61, and applied factor analysis to extract and analyze 4 factors representing …

Housewives To Heroines: Continuing Education For Women At The University Of Kentucky, 1964-1988, Allison L. Elliott Jan 2022

Housewives To Heroines: Continuing Education For Women At The University Of Kentucky, 1964-1988, Allison L. Elliott

Theses and Dissertations--Educational Policy Studies and Evaluation

Beginning in the early 1960s, the movement for the continuing education for women (CEW) brought together a seemingly unlikely alliance of American activists, educators, philanthropists, and government agencies. Fueled by philanthropic funds, accelerated by the quest for “womanpower” to bolster national defense, and aligned with regional workforce needs as well as the personal goals of individual women, CEW programs pioneered new models of academic advising and student support that continue to influence higher education practitioners today. By studying the experiences of both administrators and students involved with CEW at the University of Kentucky, this study sheds light on how one …

The Language Of Power: An Investigation Of How The Macropolitics Of Education Policy Affects The Micropolitics Of Schooling English Learners, Catherine E. Vannatter

Theses and Dissertations--Education Sciences

The population of English Learners (ELs) continues to increase across the United States, and these students persistently perform below their native English-speaking peers in measures of academic achievement. Federal government leaders passed the Every Student Succeeds Act (ESSA) in 2015, which modified how state and local educational agencies identify, instruct, assess, and reclassify ELs and revised what funding EL programming could receive. In this multiphase study, I investigated how the macropolitics of federal and state policy became enacted in the micropolitics of a mid-sized school district in Kentucky. Through an initial phase of document review followed by a mixed methods …

Validation Of An Early Childhood Emotional And Social Competence Instrument Using A Rasch Partial Credit Model, Nan Li

Theses and Dissertations--Education Sciences

The release of the Every Student Succeeds Act (ESSA) started a new chapter of education in the United States. The ESSA emphasizes the importance of preschool education; the act states that more resources will be devoted to preschool education, which lays the foundation for children’s school learning process. The goal of the act is to make sure children enter kindergarten education with equal preparatory. School, family, and researchers are paying more attention to developing preschool children’s social and emotional competency before entering Kindergarten. For understanding preschool children’s social and emotional skill development situation, instrument is the mostly widely adopted method …

An Investigation Into The Relationship Between Teacher Grit, Technology Self-Efficacy, And Technology Integration, Joshua Jeremiah Shiloh Marsh Jan 2022

An Investigation Into The Relationship Between Teacher Grit, Technology Self-Efficacy, And Technology Integration, Joshua Jeremiah Shiloh Marsh

Theses and Dissertations--Education Sciences

The use of educational technology applications has grown tremendously in the last decade. Instructors are now equipped with hardware and software applications previously unavailable, such as mobile and interactive technologies. These tools can have tremendous impact on students’ learning and teacher practices. Teachers can improve their assessment capabilities through technology integration, provide better learning opportunities for students with learning disabilities, and promote deeper learning practices. Due to these benefits, budgets at the federal, state, and local levels of the United States now have specific allocations regarding technology-related purchases. Nevertheless, barriers remain regarding the effective integration of technologies in public schools. …

Retention Of First-Generation College Students At A Four-Year Regional Public Institution, Matthew Andrew Schumacher Jan 2022

Retention Of First-Generation College Students At A Four-Year Regional Public Institution, Matthew Andrew Schumacher

Theses and Dissertations--Educational Policy Studies and Evaluation

Every year a significant number of college students stop out of college and fail to persist and complete their degree. First-generation college students are more likely to exit college without a degree than continuing-generation students. The purpose of this quantitative, archival, nonexperimental study was to explore how first-generation college student demographic, academic background, college academic, and student engagement factors were related to and predict first-year to second-year retention at a mid-sized, public regional university. The factors explored were gender, age, race/ethnicity, income status, high school GPA, ACT, cumulative GPA, first term attempted hours, housing, participation in a Living Learning Community, …

A Survey Of Elementary Educators' Self-Efficacy Related To Stem Education, Elizabeth Mckenzie Johnson Jan 2022

A Survey Of Elementary Educators' Self-Efficacy Related To Stem Education, Elizabeth Mckenzie Johnson

Theses and Dissertations--Science, Technology, Engineering, and Mathematics (STEM) Education

While the call for STEM and engineering design has increased since the release of the Next Generation Science Standards, the implementation of STEM in elementary grades has been slow. A variety of factors play a role in why educators, schools, or districts make the informed decisions they do regarding curriculum and instruction. Identifying strengths and challenges elementary educators face in implementing STEM into the curriculum can guide schools and districts in creating supports for increasing STEM in the elementary grades. This study sought to create and test a survey instrument for use with elementary educators in a large urban district …

Acrylonitrile Induction Of Rodent Neoplasia: Potential Mechanism Of Action And Relevance To Humans, Tetyana Kobets, Michael J. Iatropoulos, Gary M. Williams

NYMC Faculty Publications

Acrylonitrile, an industrial chemical, is a multisite carcinogen in rats and mice, producing tumors in four tissues with barrier function, that is, brain, forestomach, Zymbal’s gland, and Harderian gland. To assess mechanism(s) of action (MoA) for induction of neoplasia and to evaluate whether the findings in rodents are indicative of human hazard, data on the potential key effects produced by acrylonitrile in the four rodent target tissues of carcinogenicity were evaluated. A notable finding was depletion of glutathione in various organs, including two target tissues, the brain, and forestomach, suggesting that this effect could be a critical initiating event. An …
