Analysis Of Non-Conventional Radiological Terrorism, James N. Padgett Jan 2022

Analysis Of Non-Conventional Radiological Terrorism, James N. Padgett

Theses and Dissertations

Nuclear terrorism has been a risk since the dawn of the first atomic bomb. Though state sponsored nuclear weapons development is of concern for countries, non-state sponsored terrorism with radiological material can be of even greater concern. This stems from the fact that the material is under less stringent or no safeguards and can readily change hands between different terrorist groups or innocent civilians may accidently come into contact with the material.

Within this paper an analysis of previous accidents using orphan radiological sources, malicious use of orphan radiological sources, and how these sources could be used by terrorists is …

Groundwater Exceptionalism: The Disconnect Between Law And Science, Christine A. Klein Jan 2022

Groundwater Exceptionalism: The Disconnect Between Law And Science, Christine A. Klein

Emory Law Journal

Most judges, legislators, and regulators would be hard-pressed to articulate a comprehensive legal theory of groundwater. And yet, this under-appreciated, over-used, life-sustaining resource plays an increasingly pivotal role in prominent legal controversies. In defiance of hydrologic reality, lawmakers have routinely singled out groundwater for unique treatment and decoupled it from surface water. This Article dubs such phenomenon “groundwater exceptionalism,” and identifies groundwater as an under-theorized aspect of both property law and water law. It brings to light the numerous legal doctrines infected by exceptionalism, including state water rights law, the federal reserved rights doctrine, the apportionment of interstate waters, and …

Protecting Our At-Risk Communities From The Ground(Water) Up: Cafos, The Clean Water Act, And A Framework For Offering Clarity To An Imprecise Maui Test, Shawn D. Ren

Emory Law Journal

For rural communities across the country, the problems associated with concentrated animal feeding operations (CAFOs) are nothing new. These industrial-sized operations emit a tremendous amount of waste, polluting the surrounding air, land, and water. In many regions, minority, indigent, and uneducated groups disproportionately bear the ill-effects of these inhumane operations. Under the Clean Water Act, CAFOs are explicitly included in the definition of a point source and are thus subject to the National Pollutant Discharge Elimination System (NPDES) permitting requirements, which regulates the discharge of pollutants. However, many operations do not fit within this regulatory scheme as they do not …

Preventing Tam's "Proudest Boast" From Protecting The Proud Boys: A Response To Free Speech Absolutism In Trademark Law, Katherine K. Carey

Emory Law Journal

Recent events, including the infamous Unite the Right rally in Charlottesville in 2017 and the attack on the U.S. Capitol on January 6, 2021, have brought the First Amendment, hate speech, and the resurgence of white nationalist rhetoric into the public eye. Throughout the twentieth and twenty-first centuries, while much of the Western World and the United Nations worked to restrict hate speech, the U.S. Supreme Court increasingly expanded protections for speech and expression under the First Amendment and narrowed the exceptions under which speech is not protected. In particular, under the near-absolutist interpretation of the First Amendment, hate speech …

The Surprising Virtues Of Data Loyalty, Woodrow Hartzog, Neil Richards Jan 2022

The Surprising Virtues Of Data Loyalty, Woodrow Hartzog, Neil Richards

Emory Law Journal

Lawmakers in the United States and Europe are seriously considering imposing duties of data loyalty that implement ideas from privacy law scholarship, but critics claim such duties are unnecessary, unworkable, overly individualistic, and indeterminately vague. This paper takes those criticisms seriously, and its analysis of them reveals that duties of data loyalty have surprising virtues. Loyalty, it turns out, can support collective well-being by embracing privacy’s relational turn; it can be a powerful state of mind for reenergizing privacy reform; it prioritizes human values rather than potentially empty formalism; and it offers solutions that are flexible and clear rather than …

When Beneficiaries Predecease: An Empirical Analysis, Adam J. Hirsch Jan 2022

When Beneficiaries Predecease: An Empirical Analysis, Adam J. Hirsch

Emory Law Journal

Under current law, bequests to beneficiaries who predecease the testator “lapse” to the beneficiary of the residuary, unless they are preserved for the descendants of predeceased beneficiaries under an “antilapse” statute. The beneficiaries covered by antilapse statutes vary from state to state, but in most states today the statutes apply only to blood relatives of the testator as distant as first cousins. This Article examines the public policy of antilapse statutes, assessing them by undertaking the first-ever survey of popular preferences concerning the matter. Harvesting evidence for five types of beneficiaries, the study finds that the prevailing structure of antilapse …

The Extraterritorial Reach Of Section 10(B): A Wolf Hunt Off Wall Street, Radley Gillis Jan 2022

The Extraterritorial Reach Of Section 10(B): A Wolf Hunt Off Wall Street, Radley Gillis

Emory Law Journal

Born to combat the market effects of the Great Depression, the Securities Exchange Act of 1934 protects American investors and maintains American confidence in the U.S. securities market. These objectives are largely accomplished through the imposition of liability from Section 10(b) of the Securities Exchange Act and the SEC’s Rule 10b-5. These federal laws impose civil and criminal penalties for domestic insider trading and securities fraud violations. Because Section 10(b) and Rule 10b-5 only apply domestically, when securities violations occur both within the United States and abroad, the reach of federal law becomes questionable, leaving federal courts with a complex …

Horticulture Faculty Publications and Presentations

White rust, caused by Albugo occidentalis, is one of the major yield-limiting diseases of spinach (Spinacia oleracea) in some major commercial production areas, particularly in southern Texas in the United States. The use of host resistance is the most economical and environment-friendly approach to managing white rust in spinach production. The objectives of this study were to conduct a genome-wide associating study (GWAS), to identify single nucleotide polymorphism (SNP) markers associated with white rust resistance in spinach, and to perform genomic prediction (GP) to estimate the prediction accuracy (PA). A GWAS panel of 346 USDA (US Dept. …

Decoding Nondelegation After Gundy: What The Experience In State Courts Tells Us About What To Expect When We're Expecting, Daniel E. Walters Jan 2022

Decoding Nondelegation After Gundy: What The Experience In State Courts Tells Us About What To Expect When We're Expecting, Daniel E. Walters

Emory Law Journal

The nondelegation doctrine theoretically limits Congress’s ability to delegate legislative powers to the executive agencies that make up the modern administrative state. Yet, in practice, the U.S. Supreme Court has, since the New Deal, shied away from enforcing any limits on congressional delegation. That may change in the near future. In Gundy v. United States, the Court narrowly upheld a delegation, and a dissent signaled deep doubts about the Court’s longstanding “intelligible principle” standard and offered a new framework to replace it. Subsequent events strongly suggest that the Court is poised to move in the direction contemplated by the …

The Inequalities Of Innovation, Colleen V. Chien Jan 2022

The Inequalities Of Innovation, Colleen V. Chien

Emory Law Journal

Over the last few decades, the United States has become more innovative, but the gains have been distributed unequally. In 2020, over 50% of new U.S. patents went to the top 1% of patentees, and more than 50% of all patents of U.S. origin were generated by just five states, all coastal. Less than 13% of inventors were women. The economic, geographic, and demographic concentration of innovation highlight how the intersections between two traditionally discrete topics—innovation and inequality—have become increasingly relevant. But rather than any single inequality, this Article argues, multiple inequalities—of income, opportunity, and access—have relevance to innovation. Examining …

Black Diners And Tipping: An Analysis Of Tipping Culture Amongst Black Restaurant Diners, Steven Mcintyre

Student Publications

Tipping began as a means to gain prompt service. Today the practice serves as a primary source of income within the service industry. Within that time, Black diners have achieved the perception of being poor tippers. Throughout this paper, the author will discuss how the Jim Crow era aided in tipping. Additionally, this research examines how the government intervened to ensure discrimination in the workplace was eliminated. Finally, the paper will discuss the correlation of tipping in the United States society, its relations to cultural norms, and social constructs. These topics will support the tie discrimination has to tipping. This …

Publications

Hi, I’m Dr. Curtis Peacock and I am the author of Peacock’s Perfectly Complete Collection of All Possible Musical Scales which is the first, and currently the only book to compile and produce every possible musical scale, including some that have never been discovered before. The book includes every five, seven and eight-note scale based on our modern twelve-note system that can be played on any typical modern instrument of an orchestra, concert band, jazz band or rock band. Some might think that this means there are only Western scales included, but you’ll fi nd scales included from non-Western sources …

Effects Of Cognitive Loading On Pilots And Air Traffic Controller Performance: Implications For Neural Dynamics And Cognitive Flow, Sam J. Holley, Mark D. Miller Jan 2022

Effects Of Cognitive Loading On Pilots And Air Traffic Controller Performance: Implications For Neural Dynamics And Cognitive Flow, Sam J. Holley, Mark D. Miller

Publications

The digitized environment in aviation operations has seen marked growth and expansion as new technologies arrive and are implemented. The flight deck and air traffic control functions are two areas where growth is particularly robust. Previous work has identified the effects of compounded cognitive loading and SHELL interfaces in these work environments, and the potential consequences when relief or collaborative resource management is not employed effectively. This paper examines the relationship of cognitive loading in the context of cognitive flow to identify potential areas where neural metrics might aid in a better understanding of the dynamics to determine thresholds of …

Artificial Intelligence (Ai): The New Look Of Customer Service In A Cybersecurity World, Sharon L. Burton Jan 2022

Artificial Intelligence (Ai): The New Look Of Customer Service In A Cybersecurity World, Sharon L. Burton

Publications

Cybersecurity leaders are not adequately developed to guide the re-engineering of quality customer service (QCS) workflows, designed with automation and AI, that interrelate with people through customers’ perceptions. Realizing re-engineering processes should be a team effort with well-versed leadership and stakeholders guiding the successful design through a follow-up process. Leaders must shape compelling and straightforward needs to learn and teach employees and chat boxes indispensable customer service skills demonstrating patience, self-discipline, flexibility, and resourcefulness in communication with irritated customers or difficult circumstances. Whether the analysis, design, development, and implementation struggles are vacuums in cybersecurity knowledge, skill, and abilities or a …

The Macroeconomic Impacts Of Government Debt In Pakistan, Ateeb Akhter Shah Syed, Kaneez Fatima, Junaid Kamal Jan 2022

The Macroeconomic Impacts Of Government Debt In Pakistan, Ateeb Akhter Shah Syed, Kaneez Fatima, Junaid Kamal

Business Review

This paper examines the Ricardian equivalence hypothesis for Pakistan using a vector error-correction model. The sample period extends from June 2002 to January 2020. The results are reported using variance decompositions and impulse response functions. The base model contains six variables and is estimated with 4 lags. We find support for the idea that wealth does not increase as government debt increases; Hence, it proves the fact that economic agents are rational actors and foresee current expansionary actions of the government that result in accumulation of debt as the present value of future taxation that they have to pay and …

Does Emotional Intelligence Impact Team Performance In Construction Projects? Exploring The Mediating Role Of Trust And Moderating Role Of Work Status, Ariba Abid, Aamer Hanif, Amna Khan Jan 2022

Does Emotional Intelligence Impact Team Performance In Construction Projects? Exploring The Mediating Role Of Trust And Moderating Role Of Work Status, Ariba Abid, Aamer Hanif, Amna Khan

Business Review

Emotional intelligence (EI) is an essential part of the many types of intelligences an individual possesses. The outcome of interactions in personal life as well as within the organization depend upon how high or low the Emotional Quotient (EQ) is. Organizations, nowadays, specifically design tests for hiring people with higher EQ since the emotional intelligence of a team member leaves an impact on its performance. The major goal of this research is to investigate the relationship between emotional intelligence and team performance, as well as the impact of employee work status on these two. The research also examines the mediating …

Error Handling Approaches In Programming Languages, Joey Aldrin Rees-Hill Jan 2022

Error Handling Approaches In Programming Languages, Joey Aldrin Rees-Hill

Honors Papers

Error handling is a part of nearly every computer program, but it is rarely the main focus of a program's developers. Nevertheless, correct error handling is important because it can enable a program to recover from abnormal circumstances and continue to function and serve its purpose. Programming languages offer a variety of tools and approaches for programs to detect and handle errors. I investigated the different approaches to error handling in contemporary programming languages. I found three general paradigms of error handling approaches. One paradigm was Special Return Value, in which certain return values of a function signify that an …

From Moral Panic To Permanent War: Rhetoric And The Road To Invading Iraq, Kai Philippe Jan 2022

From Moral Panic To Permanent War: Rhetoric And The Road To Invading Iraq, Kai Philippe

Honors Papers

This thesis seeks to understand the conditions in the United States post-9/11 that enabled the Bush administration to pursue a wide-ranging and all-encompassing “War on Terror,” with substantial support from the general public. I am principally focused on two significant facets of the War on Terror: the invasion of Iraq and the establishment of a permanent security state (and the interrelated creation of a new state of exception). I ask why the George W. Bush administration was so successful in generating support for both the invasion and occupation of Iraq, and for policies that violated fundamental civil liberties; I argue …

A Student’S Access To Practice-Linked Resources In An Elementary Unplugged-To-Plugged Computer Science Unit, Umar Shehzad, Jody Clarke-Midura, Victor R. Lee, Mimi Recker

Publications

This paper presents a case study of a student’s participation in an expansively-framed unplugged computer science (CS) instructional unit that leverages activities and materials not typically associated with CS: playing an “unplugged” tabletop board game and designing a paper prototype of a new game level. We use the practice-linked identity framework as a lens to characterize resources available in our instructional design and how they afforded or hindered the student’s participation across the instructional activities. Our findings highlight the importance of relational resources in influencing participation, both positively and negatively, and provide implications for the design of future CS learning …
