Intimate Images And Authors’ Rights: Non- Consensual Disclosure And The Copyright Disconnect, Meghan Sali Jan 2022

Intimate Images And Authors’ Rights: Non- Consensual Disclosure And The Copyright Disconnect, Meghan Sali

Canadian Journal of Law and Technology

This article responds to a brand of legal realpolitik that says using property law to respond to the non-consensual distribution of intimate images (NCDII) is appropriate and even necessary, because its remedial frameworks are well developed and provide the relief that is often most sought after by targets of an assault: the immediate removal of photos from online platforms. While some targets are not considered the ‘‘authors’’ of their intimate images, most of the images that are the subject of NCDII are selfies, taken by the target themselves. In these cases, that person rightfully owns the copyright in those images …

On The Internet, Nobody Knows You Are A Dog: Contested Authorship Of Digital Evidence In Cases Of Gender-Based Violence, Suzie Dunn, Moira Aikenhead Jan 2022

On The Internet, Nobody Knows You Are A Dog: Contested Authorship Of Digital Evidence In Cases Of Gender-Based Violence, Suzie Dunn, Moira Aikenhead

Canadian Journal of Law and Technology

We examine various aspects of digital evidence at GBV trials, drawing on relevant Canadian criminal case law. First, we describe some of the unique challenges related to electronic documents generally with respect to determining authorship. Second, we review some of the historical and ongoing practices within the criminal justice system that rely on harmful gendered myths about GBV and note the potential for these myths to emerge in relation to digital evidence. Third, we discuss the duty of investigating police officers to gather the necessary available digital evidence to demonstrate authorship and note potential gaps in current investigatory practices that …

Responding To Deficiencies In The Architecture Of Privacy: Co-Regulation As The Path Forward For Data Protection On Social Networking Sites, Laurent Cre ́Peau Jan 2022

Responding To Deficiencies In The Architecture Of Privacy: Co-Regulation As The Path Forward For Data Protection On Social Networking Sites, Laurent Cre ́Peau

Canadian Journal of Law and Technology

Social Networking Sites like Facebook, Twitter and the like are a ubiquitous part of contemporary culture. Yet, as exemplified on numerous occasions, most recently in the Cambridge Analytica scandal that shook Facebook in 2018, these sites pose major concerns for personal data protection. Whereas self-regulation has characterized the general regulatory mindset since the early days of the Internet, it is no longer viable given the threat social media poses to user privacy. This article notes the deficiencies of self-regulatory models of privacy and contends jurisdictions like Canada should ensure they have strong data protection regulations to adequately protect the public. …

Does The Novel Coronavirus Use The Ocular Surface As An Entrance Into The Body Or As An Infection Site?, Remzi Karadag, Alp Kayiran, Christopher J Rapuano Jan 2022

Does The Novel Coronavirus Use The Ocular Surface As An Entrance Into The Body Or As An Infection Site?, Remzi Karadag, Alp Kayiran, Christopher J Rapuano

Wills Eye Hospital Papers

This study attempts to review whether the coronavirus disease-2019 (COVID-19) is transmitted through the ocular surface and examine the symptoms and signs of ocular disease. Considering that COVID-19 is transmitted by airborne droplets and close contact with infected individuals, we will also review the conditions to which eye clinics and ophthalmologists should pay attention to prevent the transmission of the disease. Although some researchers have argued that COVID-19 transmission cannot occur through the ocular surface, most of them are of the opinion that the ocular surface is a potential pathway of transmission. Until date, ocular signs and symptoms have been …

Fertilizer Use In Aquaculture, Bartholomew W. Green Jan 2022

Fertilizer Use In Aquaculture, Bartholomew W. Green

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Aquaculture ponds traditionally are fertilized to stimulate primary productivity, which serves as the base of the pond natural food web and provides ancillary ecosystem services. Fertilizer can be made regularly or based on some water quality variable or measure of algal productivity. Nutrients from chemical fertilizers are available sooner for phytoplankton growth compared to organic fertilizers that first must undergo microbial decomposition before nitrogen and phosphorus concentrations increase. Primary production increases with increased fertilizer application if productivity is limited by primary nutrients rather than by light. In semi-intensive and intensive production systems, natural pond productivity enhanced by targeted fertilization protocols …

Evaluation Of Settling Chamber Hydraulic Retention Time In A Sunshine Bass Biofloc Production System, Bartholomew W. Green, Candis L. Ray Jan 2022

Evaluation Of Settling Chamber Hydraulic Retention Time In A Sunshine Bass Biofloc Production System, Bartholomew W. Green, Candis L. Ray

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

High total suspended solids (TSS) concentrations that result from the high feeding rates used in biofloc technology production systems can negatively impact fish performance. Excess TSS are removed from biofloc production tanks by side-stream settling chambers. The effects on solids removal, water quality dynamics, and performance of sunshine bass (female white bass Morone chrysops x male striped bass M. saxatilis) from three settling chamber hydraulic retention times (HRTs; 18, 43, and 87 min; designated HRT18, HRT43, and HRT87, respectively) were evaluated in this 126-d study in biofloc tanks. Corresponding settling chamber flow rates were 7.2, 3.0, and 1.5 …

The Case Against Summary Eviction Proceedings: Process As Racism And Oppression, Andrew Scherer Jan 2022

The Case Against Summary Eviction Proceedings: Process As Racism And Oppression, Andrew Scherer

Articles & Chapters

This Article argues that because of the many ways in which summary eviction proceedings privilege landlords and disadvantage tenants, their very structure is patently unfair. Moreover, because of the racialized nature of landlord-tenant relations, the summary eviction process perpetuates a race-based power imbalance and is structurally racist. This Article explains why the time has come to dispense with the use of the shortcut summary eviction process. Summary eviction proceedings–truncated and expedited exceptions to normal civil process—were first devised for eviction cases in the late eighteenth and early nineteenth centuries by state legislatures comprised of white male property owners who were …

Augmented Reality In Retail And Its Impact On Sales, Yong Chin Tan, Sandeep R. Chandukala, Srinivas K. Reddy Jan 2022

Augmented Reality In Retail And Its Impact On Sales, Yong Chin Tan, Sandeep R. Chandukala, Srinivas K. Reddy

Research Collection Lee Kong Chian School Of Business

The rise of Augmented Reality (AR) technology presents marketers with promising opportunities to engage customers and transform their brand experience. While firms are keen to invest in AR, research documenting its tangible impact in real-world contexts is sparse. In this article, the authors outline four broad uses of the technology in retail settings. Next, they focus specifically on the use of AR to facilitate product evaluation prior to purchase, and empirically investigate its impact on sales in online retail. Using data obtained from an international cosmetics retailer, they find that AR usage on the retailer’s mobile app is associated with …

Saving A Species: A Look Into Novel Techniques Being Used To Conserve Wildlife, Sierra R. Cistone

Graduate Student Theses, Dissertations, & Professional Papers

Wildlife is held in public trust, and the public plays an important role in management and conservation as voters, advocates and beneficiaries of the many services and enjoyment that wildlife provides. But understanding wildlife issues, conservation and management decisions can be challenging given the often complex science around wildlife ecology and diverse public perspectives. That is why careful and accurate reporting around wildlife and environmental topics is imperative and a requirement of a well-informed electorate. This master’s portfolio is a collection of extensively reported stories around wildlife issues that are designed to be accessible to general readers to fulfill that …

He, She, They, Other: An Examination Of Gender Associations With The Chatelaine In The Anglo-Saxon Culture, Dane A. Williams Jan 2022

He, She, They, Other: An Examination Of Gender Associations With The Chatelaine In The Anglo-Saxon Culture, Dane A. Williams

Graduate Student Theses, Dissertations, & Professional Papers

The purpose of this paper is to study the chatelaine as a marker of gender attribution and overall usage within the Anglo-Saxon culture. Chatelaines are artifacts used to suspend multiple items to be employed for such purposes as grooming, tools, or keys and have been used widely from the Roman occupation of England during which it was used by all genders, to the Ninth Century when it was primarily used by women. As such, it is asserted that a single artifact should not to be solely relied upon to assign a gender identity to a burial, that these should be …

Make No Mistake: The Benefits Of An Errorless Learning Procedure In A Depressed Population, Bethany G. Gorter Jan 2022

Make No Mistake: The Benefits Of An Errorless Learning Procedure In A Depressed Population, Bethany G. Gorter

Graduate Student Theses, Dissertations, & Professional Papers

Despite evidence of verbal memory deficits in people with depression (Goodall et al., 2018), there are currently minimal studies examining the effectiveness of cognitive rehabilitation techniques in this population, and no studies examining the effectiveness of errorless learning procedures (EL). Errorless learning eliminates errors during encoding which contrasts with traditional trial-and-error, effortful learning (EF). This paper argues that because the memory deficits in depression are largely due to dysexecutive functioning (Snyder 2013) errorless learning procedures could be beneficial to this population because it helps reduce the burden on executive functioning during encoding and retrieval. Moreover, a newer modification of errorless …

Conservation In Ecuador's Sangay-Podocarpus Connectivity Corridor: A Study Of Coproductive Capacities, Gabriel Isaac Oppler Jan 2022

Conservation In Ecuador's Sangay-Podocarpus Connectivity Corridor: A Study Of Coproductive Capacities, Gabriel Isaac Oppler

Graduate Student Theses, Dissertations, & Professional Papers

Connectivity conservation, a growing topic across science, policy, and management, is considered an important supplement to protected areas. A diversity of ecological corridors is emerging to restore fragmented landscapes, preserve intact habitats, protect biodiversity, and improve resilience to climate change. Despite increasing expertise and resources for planning corridors, many initiatives face challenges mobilizing science and governance to implement corridors on the ground. In many cases, biophysical science is supplemented with social science to better understand the human elements of connectivity. Similarly, collaboration and partnership are heralded as essential for effective governance of corridors. However, less is known about how these …

The Effect Of Attentional Manipulation On Cough Reflex Sensitivity In Patients With Cough Hypersensitivity Syndrome, Jane Elizabeth Reynolds Jan 2022

The Effect Of Attentional Manipulation On Cough Reflex Sensitivity In Patients With Cough Hypersensitivity Syndrome, Jane Elizabeth Reynolds

Graduate Student Theses, Dissertations, & Professional Papers

The cough reflex is complex and requires integration of sensorimotor information from the central and peripheral nervous system. Cough motor output can be volitionally modified even when a strong urge-to-cough (UTC) is felt which reinforces the idea of cortical involvement in cough and opens the door to consider how manipulating attention or changing cognitive load may impact cough reflex sensitivity. Two prior studies have shown healthy individuals have reduced cough reflex sensitivity to inhaled tussigenic stimulants when completing a distracting task, presumably due to influence from increased cognitive load. In this prospective case series study, 13 patients with cough hypersensitivity …

Mapping Racial Capitalism: Implications For Law, Carmen G. Gonzalez, Athena D. Mutua Jan 2022

Mapping Racial Capitalism: Implications For Law, Carmen G. Gonzalez, Athena D. Mutua

Journal Articles

The theory of racial capitalism offers insights into the relationship between class and race, providing both a structural and a historical account of the ways in which the two are linked in the global economy. Law plays an important role in this. This article sketches what we believe are two key structural features of racial capitalism: profit-making and race-making for the purpose of accumulating wealth and power. We understand profit-making as the extraction of surplus value or profits through processes of exploitation, expropriation, and expulsion, which are grounded in a politics of race-making. We understand race-making as including racial stratification, …

The authors are family scholars who study the nexus of religion and family relationships ( Dollahite and Marks, 2020 ; Marks, Hatch, and Dollahite, 2018 ). We have conducted inhome, in- depth interviews (about two hours each) with 30 Jewish couples and families across several states. In this chapter we share many fi rst- person quotations about ritual and practice in Jewish families from three major branches of Judaism: Conservative, Orthodox, and Reform. A unique aspect of these quotes is that a number are from observant Jewish children, youth, and young adults, a group that has been largely overlooked in …

Four Perspectives On A Sustaibable Future In Nosara, Costa Rica, Greg Munno, Alvara Salas Castro, Tina Nabatchi, Christian M. Freitag Jan 2022

Four Perspectives On A Sustaibable Future In Nosara, Costa Rica, Greg Munno, Alvara Salas Castro, Tina Nabatchi, Christian M. Freitag

Media Studies - Open-Access Faculty Scholarship

The town of Nosara on Costa Rica’s Nicoya peninsula is home to a vibrant community of diverse residents and is adjacent to an important turtle nesting site. However, tensions between lifelong residents, more recent transplants, visitors, and developers have increased as more of the world discovers this once-isolated haven. Climate change, income inequality, and alienation from a distant government apparatus have further complicated effective land-use planning and fractured social cohesion. Using a mixed method approach of in-depth interviews (n = 67), Q methodology (n = 79), and public deliberation (n = 88), we explored residents’ priorities for the future of …

Sentience Politics : A Fishy Perspective, Culum Brown Jan 2022

Sentience Politics : A Fishy Perspective, Culum Brown

Animal Sentience

The plight of fishes has almost certainly got worse since Bentham (1789) coined the phrase “The question is not Can they reason? nor, Can they talk? but Can they suffer?” Despite the fact that fishes are increasingly recognised as sentient animals worthy of protection under animal welfare legislation in many countries around the world, fishing practices are almost universally exempt activities. The human population continues to grow, and, surprisingly, per capita intake of fish is still increasing (FAO 2020). The source of this fish is not wild stocks (catches of which have remained more or less stagnant for …

Price Premiums And Willingness-To-Pay For Misleading Food Labels, Alexa Jacobs Jan 2022

Price Premiums And Willingness-To-Pay For Misleading Food Labels, Alexa Jacobs

Research Papers

There are many food products sold with labels on them that may be misleading to the consumer. Almost every one of these labels comes with a price premium that consumers must pay if they wish to purchase those specific items. Many consumers place a value on these specific food labels and determine that paying more for a product with these labels is worth it to them, despite many consumers not understanding the true meaning of the labels. This study looks at and compares what the price premiums are for different food products at different stores in both the Carbondale, Illinois …

Carving An Indian Mosaic For Image-Based Sexual Abuse, Aanchal Kabra, Rohit Gupta Jan 2022

Carving An Indian Mosaic For Image-Based Sexual Abuse, Aanchal Kabra, Rohit Gupta

National Law School of India Review

In 2021, India crossed the threshold of the quantum of revenge porn cases, necessitating a public discourse on compartmentalizing the offence within pre-existing, yet outdated, legislations. Exacerbated by the COVID-19 pandemic, these reports come at the heels of the growing image-based sexual abuse in India, exemplified by other cases of voyeurism and sextortion. Despite the increasing statistics, image- based sexual abuse, as a systematic class of sexual crimes against women and children, remains virtually unrecognized in Indian scholarship and legislation. This paper proposes a comprehensive legislative framework for the battle against image-based sexual abuse. In doing so, it classifies each …

Faculty, Staff and Student Publications

The RE1 Silencing Transcription Factor (REST) is a major regulator of neurogenesis and brain development. Medulloblastoma (MB) is a pediatric brain cancer characterized by a blockade of neuronal specification. REST gene expression is aberrantly elevated in a subset of MBs that are driven by constitutive activation of sonic hedgehog (SHH) signaling in cerebellar granular progenitor cells (CGNPs), the cells of origin of this subgroup of tumors. To understand its transcriptional deregulation in MBs, we first studied control of Rest gene expression during neuronal differentiation of normal mouse CGNPs. Higher Rest expression was observed in proliferating CGNPs compared to differentiating neurons. …

BACKGROUND: Longitudinal patient level data available in the electronic health record (EHR) allows for the development, implementation, and validations of dental quality measures (eMeasures).

OBJECTIVE: We report the feasibility and validity of implementing two eMeasures. The eMeasures determined the proportion of patients receiving a caries risk assessment (eCRA) and corresponding appropriate risk-based preventative treatments for patients at elevated risk of caries (appropriateness of care [eAoC]) in two academic institutions and one accountable care organization, in the 2019 reporting year.

METHODS: Both eMeasures define the numerator and denominator beginning at the patient level, populations' specifications, and validated the automated queries. For …

Predicting Clinical Response To Everolimus In Er+ Breast Cancers Using Machine-Learning, Aritro Nath, Patrick A Cosgrove, Jeffrey T Chang, Andrea H Bild Jan 2022

Predicting Clinical Response To Everolimus In Er+ Breast Cancers Using Machine-Learning, Aritro Nath, Patrick A Cosgrove, Jeffrey T Chang, Andrea H Bild

Faculty, Staff and Student Publications

Endocrine therapy remains the primary treatment choice for ER+ breast cancers. However, most advanced ER+ breast cancers ultimately develop resistance to endocrine. This acquired resistance to endocrine therapy is often driven by the activation of the PI3K/AKT/mTOR signaling pathway. Everolimus, a drug that targets and inhibits the mTOR complex has been shown to improve clinical outcomes in metastatic ER+ breast cancers. However, there are no biomarkers currently available to guide the use of everolimus in the clinic for progressive patients, where multiple therapeutic options are available. Here, we utilized gene expression signatures from 9 ER+ breast cancer cell lines and …

A Structural, Cognitive, And Behavioral Model For Error Analysis Of Group B Streptococcus Prophylaxis In Pregnancy, Robert E Murphy, Jane C Ibekwe, Stella I Ibekwe, Jerrie S Refuerzo

Faculty, Staff and Student Publications

The objective of this study was to develop a structural-cognitive-behavioral model for error analysis of group B streptococcus (GBS) prophylaxis failure, classify delivery cases into this model, and examine compliance with treatment guidelines. A retrospective, cohort study was conducted of women with liveborn pregnancies greater than 24 weeks in April 2018 at a single hospital. We created a structural-cognitive-behavioral model of five assessments for adherence to GBS prophylaxis guidelines and then classified these into four distinct error stages. A descriptive analysis was performed to determine if the pregnancy had a perfect process, a GBS prophylaxis failure, or a fortuitous outcome. …

Impaired wound healing is a significant financial and medical burden. The synthesis and deposition of extracellular matrix (ECM) in a new wound is a dynamic process that is constantly changing and adapting to the biochemical and biomechanical signaling from the extracellular microenvironments of the wound. This drives either a regenerative or fibrotic and scar-forming healing outcome. Disruptions in ECM deposition, structure, and composition lead to impaired healing in diseased states, such as in diabetes. Valid measures of the principal determinants of successful ECM deposition and wound healing include lack of bacterial contamination, good tissue perfusion, and reduced mechanical injury and …
