Tightening The Legal ‘Net’: The Constitution’S Supremacy Clause Straddle Of The Power Divide, Steven Ferrey
Tightening The Legal ‘Net’: The Constitution’S Supremacy Clause Straddle Of The Power Divide, Steven Ferrey
Michigan Journal of Environmental & Administrative Law
This article analyzes Constitutional Supremacy Clause tensions in preempting state law that addresses climate change and the rapid warming of the Planet. Net metering laws, enacted in 80% of U.S. states, are a primary legal mechanism to control and mitigate climate warming. This article analyzes three recent federal court decisions creating a preemptive Supremacy Clause stand-off between federal and state law and presents a detailed state-by-state analysis of which those 80% of states’ laws could be preempted by legal challenge.
If state net metering laws affected only ordinary technologies, this issue would not be front and center with global warming. …

Iron Geochemistry Across An Estuary-To-Coastal Gradient, Lissett G. Diaz
Iron Geochemistry Across An Estuary-To-Coastal Gradient, Lissett G. Diaz
Honors Theses
Iron is a ubiquitous earth element that participates in biogeochemical processes that occur in marine sediments. Microorganisms utilize iron for many purposes, including cell growth, conserving energy, and for maintaining metabolic activity. In coastal sedimentary settings, understanding the redox reactions involving ferric iron, Fe3+, and ferrous iron, Fe2+, in its solid phase and pore-water phases, respectively, enable an appreciation of biogeochemical transformations occurring in the coastal zone. In this study, iron concentrations in sediment of ranging permeability were determined at four stations marking an estuary-coast transition zone in Singleton Swash in Myrtle Beach, South Carolina. The …

A Mixed Methods Study Of Undergraduate Research Motivations At The University Of Nebraska Omaha (Uno), Afrah F. Rasheed
Theses/Capstones/Creative Projects
Undergraduate research provides unique experiences and skill sets that are applicable in various careers. However, there has been an increasing need for greater diversity among researchers, namely undergraduate researchers, and the motivations behind undergraduate research participation need to be further explored. The purpose of this study was to identify the demographic information of undergraduate students at the University of Nebraska at Omaha (UNO), and what motivations were the most prevalent in undergraduate research at UNO. A mixed-methods approach was utilized through a quantitative portion and a qualitative portion. The quantitative portion was a web-based survey which gauged for 22 independent …
Analyzing Gene Expression Profiles Of A Virus And Its Host During Infection, Elizabeth Reisher
Analyzing Gene Expression Profiles Of A Virus And Its Host During Infection, Elizabeth Reisher
Theses/Capstones/Creative Projects
In recent years, RNA sequencing has become an important part of gene expression analysis. RNA sequencing applications are used to study many aspects of RNA structure, expression, and translation. With developing technologies, RNA sequencing is used to learn more about the biology of RNA, helping to understand more about what RNA does under different conditions, such as when the RNA’s host is under attack from a virus. New RNA sequencing technologies allow researchers to learn more about what happens to the host when there is an attack from an outside source, such as a virus. RNA sequencing also tells the …

Orthopedics Articles
Purpose: To determine whether elbow torque was associated with anatomic adaptations of the medial elbow following a season of competitive pitching.
Methods: Pitchers from 3 collegiate baseball teams were recruited during the preseason for participation. Before the season, pitchers were recorded throwing 5 "game-speed" fastball pitches from a standard distance off a mound while wearing a wearable sensor baseball compression sleeve that calculates elbow torque, arm speed, arm slot, and arm rotation. Participants subsequently underwent dynamic ultrasound imaging of the medial elbow, including measurements of the ulnar collateral ligament (UCL) and ulnohumeral joint space to assess elbow laxity. Following a …

God And Kant’S Suicide Maxim, Carlo Alvaro
God And Kant’S Suicide Maxim, Carlo Alvaro
Publications and Research
Kant’s argument against suicide is widely dismissed by scholars and often avoided by teachers because it is deemed inconsistent with Kant’s moral philosophy. This paper attempts to show a way to make sense of Kant’s injunction against suicide that is consistent with his moral system. One of the strategies adopted in order to accomplish my goal is a de-secularization of Kant’s ethics. I argue that all actions of self-killing (or suicide) are morally impermissible because they are inconsistent with God’s established nature and order. It is argued that the existence of God as the locus of moral value and duty …

Pathology Research and Scholarship
Failure to follow-up women after abnormal cervical screening could lead to cervical cancers, yet little is known about adherence to recommended follow-up after abnormal co-testing [cytology and high-risk human papillomavirus (hrHPV) testing]. We documented clinical management following cervical screening by co-testing in a diverse population-based setting. A statewide surveillance program for cervical screening, diagnosis, and treatment was used to investigate all cytology, hrHPV and biopsy reports in the state of New Mexico from January 2015 through August 2019. Guideline-adherent follow-up after co-testing required 1) biopsy within 6 months for low-grade cytology if positive for hrHPV, for high-grade cytology irrespective of …

The Report From Asfa Covid-19 Taskforce: Considerations And Prioritization On Apheresis Procedures During The Sars-Cov-2 Coronavirus Disease (Covid-19) Pandemic, Chisa Yamada, Jan C. Hofmann, Volker Witt, Gaurav K. Gupta, Jeffrey L. Winters
Pathology Research and Scholarship
Since vaccination for SARS-CoV-2 coronavirus started, the trajectory of patient numbers infected with the virus has improved once; however, variants of SARS-CoV-2 have emerged and more people have been infected; therefore, pandemic status is still far from resolution. Government and social efforts to prevent coronavirus infection continue in most states in the US and globally even after the Centers for Disease Control and Prevention declared some restriction relief for fully vaccinated people in March 2021. Healthcare institutions and various professional organizations have developed guidelines or policies to prevent the spread of these coronaviruses in the setting of apheresis. In this …
Knowing Our History: How The Structural Context Of California’S Aging Network Evolved, Sandra K. Fitzpatrick
Knowing Our History: How The Structural Context Of California’S Aging Network Evolved, Sandra K. Fitzpatrick
Humboldt Journal of Social Relations
In June 2019, Governor Gavin Newsom signed an executive order calling for the creation of a Master Plan for Aging (MPA.) The opening paragraph affirms “California’s commitment to build an age-friendly state so that all Californians can age with dignity and independence.” (California Health and Human Services Agency 2020). The MPA was released in January 2021. I was hired as the consultant MPA Historian to document the chronological sequence of services and to highlight the major strategies California has adopted to serve older adults and people with disabilities. I researched archival documents and interviewed influencers, policy makers, and community based …

The Aged Care Crisis In Australia’S Covid-19 Success Story: A Commentary, Cymbeline Buhler, Nidhi Wali, Charles Ball, Supriya Gurung, Spyros Schismenos
Humboldt Journal of Social Relations
The world took a beating from COVID-19, with no nation spared. Australia’s response to the pandemic has been recognized as particularly successful, with the comparatively small total of COVID-19 related fatalities. However, these achievements in controlling the virus and keeping the economy buoyant are contrasted by significant failures, particularly the Federal and state governments’ inability to contain the outbreak within the aged care sector. This commentary forms an understanding of the COVID-19 outbreak in Australia’s aged care sector, drawing from articles published in the ‘The Australian’ newspaper. We focus on priorities, responses and management at different levels, observing subsequent impacts, …

Humboldt Journal of Social Relations
This article describes a program, Cultivando Sabiduría (Cultivating Wisdom), that was created to honor and further ignite civic engagement in low-income, Spanish-speaking Latinx elders. Cultivando Sabiduría utilized a popular education pedagogical approach and culturally validating curriculum. Methodological and theoretical innovations aided in recognizing program participants’ strengths. Discussion is provided on the social and health benefits of volunteering and civic engagement for Latinx elders. The 177 Latinx program participants were ages 55+ years old and primarily low income with low (formal) educational levels. Program impacts included identification of the strengths of the elders in terms of civic engagement and community leadership, …
Multi-Dimensional Disaster Response For Older Adults, Donna Jensen
Multi-Dimensional Disaster Response For Older Adults, Donna Jensen
Humboldt Journal of Social Relations
During disasters older adults are particularly at risk to be negatively affected. This paper will examine the increased vulnerabilities of older adults facing disasters, specifically through the lens of the 2018 Camp Fire in Butte County, California which killed 85 people, burned over 150,000 acres, and destroyed close to 19,000 structures in the rural communities it impacted. It has been designated the “deadliest and most destructive” fire in recorded California history. While research demonstrates that older adults tend to be more resilient in disasters, they also have some vulnerabilities that make them more susceptible to death. I discuss common issues …

2021-December-01-Etsu Professor Writes About Masculinity, University Marketing And Communication, East Tennessee State University
ETSU News
Masculinity – what it means and how it came to be – has for years been a point of discussion on college campuses. More recently, the conversation has spread to the general public. The New York Times posed the question in 2019: what is “toxic masculinity?”
East Tennessee State University’s Dr. Elwood Watson is addressing these and other important questions in “Talkin’ to You, Bro!: Liberate your mind from the confusing, ambiguous messages of contemporary masculinity,” a book released earlier this fall.
The book offers a new outlook on manhood in current culture, Watson said, and aims to help men …
