Murky Materiality & Scattered Standards: In Favor Of A More Uniform System Of Sst Disclosure Requirements, Megan Ganley
Murky Materiality & Scattered Standards: In Favor Of A More Uniform System Of Sst Disclosure Requirements, Megan Ganley
Fordham Law Review
The Securities and Exchange Commission (SEC) requires corporations to disclose their business in or with state sponsors of terrorism (SSTs). The SEC solicits these disclosures with varying standards arising under several different mechanisms. These mechanisms include the requirements of the materiality standard, the provisions of Regulation S-K, targeted inquiry in individually issued comment letters, and affirmative requirements mandated under specific legislation. Each of these mechanisms requires disclosure of slightly different information regarding SSTs with varying degrees of exactitude. This Note examines the SEC’s current SST disclosure framework, considering the benefits, as well as the criticisms, of these disclosure mandates. This …

Who Tells Their Stories?: Examining The Role, Duties, And Ethical Constraints Of The Victim’S Attorney Under Model Rule 3.6, Ksenia Matthews
Fordham Law Review
In U.S. criminal proceedings, the prosecution typically presents the victim’s story. However, as part of the victims’ rights movement, victims are striving to make their voices heard and tell their stories in their own words. Yet, despite the growing role victims occupy in criminal proceedings and the rights afforded to victims by the Crime Victims’ Rights Act and its state counterparts, victims still remain nonparties in criminal proceedings. As victims increasingly retain private lawyers to help navigate criminal proceedings and represent their interests, it is important to understand how these lawyers fall within the traditional two-party adversary system. Limited by …

An Investigation Of Anti-Black Racism Libguides At Arl Member Institutions, Gemmicka Piper, Mahasin Ameen, M. Sara Lowe
Communications in Information Literacy
This study sought to analyze anti-Black racism LibGuides created by ARL member institutions to determine strengths and weaknesses of the guides based on LibGuides best practices. Institutional and LibGuide author demographic information were also gathered to determine correlations or trends, if any. Rubric evaluation of LibGuides found that guides were strongest in areas related to guide design, materials included on the guides, and links to resources. Guides were weakest in areas related to the framing of social justice and pedagogy. Results from this study have the potential to inform the structure and revision of social justice LibGuides at a time …

The use of neural scaffolds with a highly defined microarchitecture, fabricated with standard techniques such as electrospinning and microfluidic spinning, requires surgery for their application to the site of injury. To circumvent the risk associated with aciurgy, new strategies for treatment are sought. This has led to an increase in the quantity of research into injectable hydrogels in recent years. However, little research has been conducted into controlling the building blocks within these injectable hydrogels to produce similar scaffolds with a highly defined microarchitecture. ``Magnetic particle string'' and biomimetic amphiphile self-assembly are some of the methods currently available to achieve …
Detecting Gsr Indicative Particles On Decayed Bones Using A Novel Field Kit, Sven Engling
Detecting Gsr Indicative Particles On Decayed Bones Using A Novel Field Kit, Sven Engling
Student Theses
Decomposed human remains are complex forensic puzzles, escalating in difficulty as the remains’ age obscures evidence, like trauma. Research has shown that scanning electron microscopes with energy dispersive X-ray spectrometers (SEM-EDX) are capable of detecting and identifying gunshot residue (GSR) particles on bones. However, SEM-EDX work is time consuming, expensive, and not accessible to every forensic department. Therefore, a preliminary field test capable of detecting GSR indicative particles, like lead, could save departments money and assist in trauma identification. This study examines the viability of using either the 3M Lead Check Test swabs or a sodium rhodizonate solution as part …

Development And Validation Of A Method For The Determination Of Designer Benzodiazepines In Hair By Liquid Chromatography Tandem Mass Spectrometry (Lc-Ms/Ms), Laura C. Defreitas
Student Theses
In recent years, new designer benzodiazepines have become a challenge in forensic toxicology. These substances are analogues of the classic benzodiazepines, but their pharmacology is not well known, and many of them have been associated with overdoses and deaths. As a result, there has been a surge in efforts to develop ways to accurately test for these compounds in different biological matrices. This study focused to develop and validate a method for determining 17 new designer benzodiazepines in hair by liquid chromatography tandem mass spectrometry (LC-MS/MS). Hair samples were decontaminated, pulverized, and 20 mg of the sample was incubated in …

The Impact Of Covid-19 On The Thai Probation Department, Thanaphon Nunphong
Student Theses
The COVID-19 pandemic had a crucial impact on the Thai criminal justice system. While it may be true that the Department of Probation has proposed preventive and responsive measures in response to COVID-19, relatively little is known about the practical applications of these measures as well as the impact of COVID-19 on probation personnel, probationers, and parolees. The goal of this study is to explore the policies and practices of Thai probation agencies as they respond to the COVID-19 pandemic. This study surveyed probation officers in Thailand (N = 534; 60.6% Female) in March to April 2021, focusing on …

Impact Of Blood Collection Tubes In Cannabinoid Quantitative Analysis, Tega E. Obruche-Akponah
Student Theses
In forensic toxicological cases, sample stability and storage are pivotal for obtaining adequate analytical results. Currently, limited information is available about the impact of different preservatives and anticoagulants present in the blood tubes used in the collection of blood samples containing cannabinoids. This study investigated the impact of sodium fluoride (gray top) and sodium citrate (blue top) blood collection tubes on the concentrations of tetrahydrocannabinol (THC), cannabidiol (CBD), cannabinol (CBN) and 5 THC metabolites (THC-OH, THC-COOH, THC-diOH, THC-glucuronide, THCCOOH-glucuronide) in whole blood samples, stored at room temperature, 4ºC and -20ºC for up to 3.5 months. The samples were extracted using …
The Influence Of Demographic Information On Public Attitudes Towards Individuals Who Commit Sexual Offenses, Emily Bogdan
The Influence Of Demographic Information On Public Attitudes Towards Individuals Who Commit Sexual Offenses, Emily Bogdan
Student Theses
Research exploring the factors that shape public attitudes towards individuals who commit sexual offenses is needed to inform policy and reduce stigma that these individuals face as they reenter society. Prior research has explored demographic factors of those who offend and have been victimized, but few have studied how these variables may interact with one another to shape attitudes toward people who commit sexual offenses. The current study explores whether offender gender, victim gender, and victim age shape the public’s attitudes towards these individuals. Participants were presented with a vignette describing the offense and then they were asked to respond …
Support For Militant U.S. Foreign Policy: The Role Of Authoritarianism And International Xenophobia, Brandon M. Garcia
Support For Militant U.S. Foreign Policy: The Role Of Authoritarianism And International Xenophobia, Brandon M. Garcia
Student Theses
Right-Wing Authoritarianism (RWA) has been studied extensively in the domestic socio-political context, but its potential impact on foreign policy is still poorly understood. The current study replicated the putative two-factor model of the construct (Authoritarian Aggression/Submission and Conventionalism) and examined the associations of each factor with perceptions of overall danger to the U.S. posed by other countries and with the support for more militant U.S. foreign policy. As expected, both RWA factors correlated with self-reported levels of political conservatism (r = 0.32, r = 0.33; p < .001) Additionally, Authoritarian Aggression and Submission (but not Conventionalism) were correlated with increased perceived danger from foreign countries (r = .35; p < .001) and increased support for a more militant U.S. foreign policy (r = .25; p < .001). Participants higher in RWA were more likely to view the world as a hostile and threatening place, and in turn support more aggressive military action in response to those fears.
Waiting To Tell: Factors Associated With Delays In Reporting Sexual Violence, Lahiz P. Tavarez
Waiting To Tell: Factors Associated With Delays In Reporting Sexual Violence, Lahiz P. Tavarez
Student Theses
In the United States (U.S.), 20% of women have experienced completed or attempted rape and 43.6% of women have experienced some form of contact sexual violence. Many instances of sexual violence go unreported to law enforcement – only 34% are reported to the police. Reporting can lead to more favorable outcomes for survivors since it is likely to increase access to medical care and mental health services and is an important step in order to hold perpetrators accountable, prevent future victims, and reduce the likelihood of longer psychological distress for the survivor. Delays in reporting are more prevalent in cases …
Effects Of Improper Ammunition Storage, Victoria S. Andre
Effects Of Improper Ammunition Storage, Victoria S. Andre
Student Theses
Firearms are commonly used by law enforcement, hunters, and civilians either for protection, sport or criminal activity. Ammunition is used in traditional firearms such as rifles and handguns, and consists of a cartridge case, propellant, a bullet (projectile), and primer. The two types of priming systems within the cartridge that are commonly used today are rimfire and centerfire cartridges. There are several types of malfunctions that can occur with ammunition. Improper ammunition storage is one major factor that plays a role in ammunition failure. One form of improper ammunition storage is where the storage environment being used abruptly changes due …
Dosage Matters: What Is Dosage, Doyoung Kim
Dosage Matters: What Is Dosage, Doyoung Kim
Student Theses
To reduce recidivism, many correctional programs and interventions have been introduced to offenders. Though, the rate of recidivism remains exceedingly high. To improve program outcomes, it is important to match the dosage of a program to risk levels. However, there is not a standardized definition and measurement of program dosage. This thesis extends the study on identifying the definition and measurement of dosage and the effectiveness of the programs by conducting a systematic review of prior research. The results indicate that as a treatment dosage, treatment duration was more frequently used compared to treatment intensity to reduce recidivism rate of …

Understanding The Multiple Small Magnitude Induced Seismic Soil Fatigue Potential On Hazard Assessments, Merissa L. Zuzulock, Oliver Denzil S. Taylor, Norbert H. Maerz
Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works
Soils under spacio-temporally clustered events loading are susceptible to soil fatigue as pore pressure dissipates and the soil is unable to recover. This potential for damage from soil fatigue is identified through an induced seismic fatigue equation provided in this paper. The objective of this paper is to present an induced seimic equation for soils under spacio-temporally clustered impulse loading to identify potential hazards to the subsurface that supports critical infrastructure. It further illustrates the use of the equation as determined from a comparison of three varying soil profiles with resulting data that shows a need to establish new critieria …

Numerous geochemical anomalies exist at the K-Pg boundary that indicate the addition of extraterrestrial materials; however, none fingerprint volatilization, a key process that occurs during large bolide impacts. Stable Zn isotopes are an exceptional indicator of volatility-related processes, where partial vaporization of Zn leaves the residuum enriched in its heavy isotopes. Here, we present Zn isotope data for sedimentary rock layers of the K-Pg boundary, which display heavier Zn isotope compositions and lower Zn concentrations relative to surrounding sedimentary rocks, the carbonate platform at the impact site, and most carbonaceous chondrites. Neither volcanic events nor secondary alteration during weathering and …

Data from 790 older school-age (Mage = 10.2 years, SD = 1.2 years) girls (N = 427) and boys from Barranquilla, Colombia (N = 449) and Montréal, Canada (N = 331) were used to replicate findings reported by Valdivia et al. (2005). This prior study revealed contextual variations in the association between two measures of social behavior, specifically aggression and withdrawal, and two measures of effective functioning with peers, specifically sociometric preference and friendship. The Montréal participants were primarily from families with European backgrounds. The ethnicity of the participants from Barranquilla can be described as Latinx/Caribbean. Multilevel analyses provided evidence …
Black Deaths Matter: The Race-Of-Victim Effect And Capital Punishment, Daniel S. Medwed
Black Deaths Matter: The Race-Of-Victim Effect And Capital Punishment, Daniel S. Medwed
Brooklyn Law Review
The racial dimensions of the death penalty are well-documented. Many observers assume this state of affairs derives from bias—often implicit and occasionally explicit—against black defendants in particular. Research points to an even more alarming factor. The race of the victim, not the defendant, steers cases in the direction of death. Regardless of the perpetrator’s race, those who kill whites are more likely to face capital charges, receive a death sentence, and die by execution than those who murder blacks. This short Essay adds a contemporary gloss to the race-of-victim effect literature, placing it in the context of the Black Lives …

Copying Copyright: Adopting A Fair Use Defense In Patent Law In Times Of Public Health Crisis, Kellie C. Van Beck
Brooklyn Law Review
Epidemics have devastated humankind for centuries. Given the simultaneous rise of advanced disease prevention and treatment and the great potential for mass public uptake, it is unsurprising that the U.S. pharmaceutical industry has grown to $775 billion in annual sales revenue. It is clear that the commercialization of important public health measures is not without controversy. Of particular debate is that vaccine and other drug manufacturers monopolize their products and control them through patent laws. Yet there is a strong dichotomy between the importance of patents and the need for public access to innovations. This is not to say that …

Karmel’S Dissent: The Sec’S Use And Occasional Misuse Of Section 21(A) Reports Of Investigation, James J. Park
Brooklyn Journal of Corporate, Financial & Commercial Law
Section 21(a) of the Securities Exchange Act gives the SEC the option of publishing a report of its findings after conducting an investigation. Typically, the SEC issues such reports about once a year to highlight major compliance and enforcement issues. This Article examines the SEC’s use of Section 21(a) investigative reports with special attention to its 1979 report in Spartek, where Commissioner Roberta Karmel filed a famous dissent. In that opinion, she argued that the report effectively sanctioned conduct over which the SEC did not have jurisdiction and that Spartek did not have sufficient notice of its regulatory obligations. While …
Mutual Fund Stewardship And The Empty Voting Problem, Jill E. Fisch
Mutual Fund Stewardship And The Empty Voting Problem, Jill E. Fisch
Brooklyn Journal of Corporate, Financial & Commercial Law
When Roberta Karmel wrote the articles that are the subject of this symposium, she was skeptical of the potential value of shareholder voting and the emerging involvement of institutional investors in corporate governance. In the ensuring years, both the increased role and engagement of institutional investors and the heightened importance of shareholder voting offer new reasons to take Professor Karmel’s concerns seriously. Institutional investors have taken on a broader range of issues from diversity and political spending to climate change and human capital management, and their ability to influence corporate policy on these issues has become more significant. The broadened …

Federalized Corporate Governance: The Dream Of William O. Douglas As Sarbanes-Oxley Turns 20, Joan Macleod Heminway
Brooklyn Journal of Corporate, Financial & Commercial Law
The federalization of U.S. corporate governance has been a topic of conversation among policymakers from the very beginning of federal securities law in the New Deal era. Among the early proponents of a federalized system of corporate governance oversight was William O. Douglas—perhaps best known as the longest-serving U.S. Supreme Court justice, but who also was a former commissioner and chair of the U.S. Securities and Exchange Commission. Reflecting on Douglas’s federal corporate governance ideas, Professor Roberta Karmel wrote a law review article for the Delaware Journal of Corporate Law, published in 2005, commenting on the extent and nature of …
Looking Forward: Professor Roberta Karmel’S Prescient Views On The Transformation Of Self-Regulatory Organizations And Of The Securities Market Structure At The Turn Of The Last Century, James A. Fanto
Brooklyn Journal of Corporate, Financial & Commercial Law
This essay examines Professor Roberta Karmel’s scholarship on the transformation of self-regulatory organizations (SROs) and the securities market structure, a transformation that occurred at the turn of the last century. It explains how she examined the events from the perspective of a lawyer who had a rich knowledge of the history of the SROs, the securities markets, and their regulation and how she provided a practical understanding of the way these markets worked. It points out that, rather than offering an overarching theory that would explain all of these developments and that would guide regulators and legislators in SRO and …
