Regulating Competition, Both The Forest And The Trees, David B. Spence Jan 2021

Regulating Competition, Both The Forest And The Trees, David B. Spence

Emory Law Journal Online

At the heart of the ideological conflict between the American political parties lies a fundamental disagreement about regulation and the proper relationship between government and markets. That conflict is partly about the substance of regulatory policy and partly about the scope of regulatory policymaking discretion. Both of these dimensions are implicated in a series of relatively obscure disputes recently before the Federal Energy Regulatory Commission (FERC). The central question in these cases is whether it is fair and constitutional for FERC to enforce Federal Power Act prohibitions against energy market manipulation against the defendants, given that the trading at issue …

Public Benefit Corporations: There's No Public Benefit To Breaching Fiduciary Duties, Oderah Nwaeze Jan 2021

Public Benefit Corporations: There's No Public Benefit To Breaching Fiduciary Duties, Oderah Nwaeze

Emory Business Law Review

During the spring and summer of 2020, in the midst of the COVID-19 pandemic, the United States witnessed large, public protests and activism reminiscent of the 1950s and 60s. Following the death of George Floyd, a Black man, at the hands of Minneapolis police, the American public once again mobilized to fight the ills and inequities of racism and discrimination. A significant number of nonprofit organizations and government departments have been created to resolve the social and political issues that plague Americans. Even Corporate America has been called to act, given that seventy percent of consumers are interested in the …

Any engineering approach to cybersecurity must recognize that many breaches are the result of human behavior, rather than sophisticated malware. Effective cybersecurity defenses require a systematic engineering approach that recognizes the organizational, cultural and psychological barriers to effectively dealing with this problem. The U.S. Securities and Exchange Commission (SEC) defines “phishing” as, “the use of fraudulent emails and copy-cat websites to trick you into revealing valuable personal information—such as account numbers for banking, securities, mortgage, or credit accounts, your social security numbers, and the login IDs and passwords you use when accessing online financial service providers.” Once this information is …

Interlingual Morphology And Wakean Topology, Stephen Valeri Jan 2021

Interlingual Morphology And Wakean Topology, Stephen Valeri

Dartmouth College Master’s Theses

As an example of limit literature (literature that exhausts the entirety of what is possible in a given form), Finnegans Wake has been an inspiration for the theories of figures like Kristeva and Derrida to reveal the structural and linguistic operations of texts generally. In defamiliarizing the processes of word formation, the Wake compels us to attend to morphology’s structuring role in a work. My project focuses on Phillipe Sollers and Stephen Heath’s French translation of part of the concluding section of James Joyce’s Finnegans Wake to observe how the attempt to approximate Joyce’s interlingual morphology in translation contributes to …

Inventing Dental Continuing Education: History Of The Dental Forum -- Milwaukee, Kenneth J. Waliszewski

School of Dentistry Faculty Research and Publications

Life-long learning is an ancient concept. The young are unaware of it. A beginning practitioner, often blinded by ego, ignores its value. The seasoned veteran, haunted by challenges, wonders how it passed him by. History can and does often teach us lessons. In 1787, Benjamin Franklin stood up to address the American Constitutional Convention and urged his fellow patriots to sign the document. At the age of 81, he was the oldest person in the group. He acknowledged having opened his mind to contrarian viewpoints from his younger colleagues. Franklin spoke these words: “If you are convinced that you know …
