The Corruption Of Copyright And Returning It To Its Original Purposes, Michelle M. Wu Jan 2021

The Corruption Of Copyright And Returning It To Its Original Purposes, Michelle M. Wu

Georgetown Law Faculty Publications and Other Works

Since its inception, Copyright has had two purposes: the private interest of the author in being paid for her work and the public interest served by the dissemination of these works. Within the last two decades, though, some industries have systematically undermined both of those interests, redirecting the benefits of copyright towards themselves instead of the intended beneficiaries. This paper looks at the book, music, and entertainment industries, examines how copyright has been used to suppress the uses it was intended to foster, and explores ongoing and proposed avenues for course correction.

Trademarks As Surveillance Transparency, Amanda Levendowski Jan 2021

Trademarks As Surveillance Transparency, Amanda Levendowski

Georgetown Law Faculty Publications and Other Works

We know very little about the technologies that watch us. From cell site simulators to predictive policing algorithms, the lack of transparency around surveillance technologies makes it difficult for the public to engage in meaningful oversight. Legal scholars have critiqued various corporate and law enforcement justifications for surveillance opacity, including contract and intellectual property law. But the public needs a free, public, and easily accessible source of information about corporate technologies that might be used to watch us. To date, the literature has overlooked a free, extensive, and easily accessible source of information about surveillance technologies hidden in plain sight: …

Para-Ethnographic Study: The Project And Its Methodology, Gregory Shaffer Jan 2021

Para-Ethnographic Study: The Project And Its Methodology, Gregory Shaffer

Georgetown Law Faculty Publications and Other Works

This paper explains the methodology that I use for my work, and it comes from the Preface of my book Emerging Powers and the World Trading System: The Past and Future of International Economic Law. This approach has an important ethnographic dimension when ethnography is viewed in a broad (but non-traditional) sense of participant observation of a field. The object of the study is the flow of norms and institutional practices in the field of international trade law, and, to a lesser extent, the related fields of international investment and intellectual property law. It is not a traditional ethnography …

Icelandic Folklore And The Cultural Memory Of Religious Change, Eric Shane Bryan Jan 2021

Icelandic Folklore And The Cultural Memory Of Religious Change, Eric Shane Bryan

English and Technical Communication Faculty Research & Creative Works

This book attempts to understand the origins and development of religious belief in Iceland and greater Scandinavia through the lenses of five carefully selected Icelandic folktales collected in Iceland during the nineteenth century. Each of these five stories has a story of its own: a historical and cultural context, a literary legacy, influences from beliefs of all kinds (orthodox and heterodox, elite or lay), and modalities (oral or written) by which the story was told. These factors leave an imprint -- sometimes discernible, sometimes not -- upon the story, and when that imprint is readable, the legacies and influences upon …

The full utilization of connected vehicles (CVs) is highly anticipated to become a reality soon. As CVs become increasingly prevalent in our roadway network, connected technologies have enormous potential to improve safety. This study conducted a microscopic simulation to quantify the benefits of CVs in improving freeway safety along a 7.8-mile section on Florida’s Turnpike (SR-91) system. The simulation incorporated driver compliance behavior in a CV environment. The simulation was implemented via an existing VISSIM network model partially developed by the Florida Department of Transportation (FDOT). In addition, the study analyzed how CVs would assist in detour operations as a …

A Microscopic Simulation Approach For Developing Ramp Metering Activation Guidelines For Weekends, Sarah T. Kasomi Jan 2021

A Microscopic Simulation Approach For Developing Ramp Metering Activation Guidelines For Weekends, Sarah T. Kasomi

UNF Graduate Theses and Dissertations

Traffic congestion is one of the major concerns in urban motorways. Agencies are implementing various Transportation Systems Management and Operations (TSM&O) strategies to reduce traffic congestion on roadway networks. Ramp metering is a TSM&O strategy that utilizes signals installed at freeways’ on-ramps to dynamically manage traffic entering the freeway. RMSs have been effective at alleviating recurring congestion. Recurring congestion, however, constitutes less than half of all congestion. More than half of all congestion is due to non-recurring events such as incidents, work zones, adverse weather conditions, special events, etc., that adversely affect the performance of a highway. Non-recurring congestion on …

An Investigation Of The Moderating Effects Of Household Composition And Developmental Age On Food Insecurity Impacting Mental Health, Monique Villamor, Monique V. Villamor

UNF Graduate Theses and Dissertations

The current study examined how developmental stages of adulthood (emerging, middle, and late) and household composition (living with or without children) influence the experiences of food insecurity in regard to food-related protective strategies and mental health consequences. Using a moderated moderation analysis, the impact of age conditional on the effects of household composition aimed to quantify how food-related protective strategies predicted levels of food insecurity thus leading to anxiety and depression. Results indicated developmental stages and household composition are non-significant moderators across three models. However, middle-adult participants demonstrated increased susceptibility to severe food insecurity, further contributing to literature on midlife …

Retributive Justice, Capital Punishment, And Jurors In Northeast Florida, Joseph S. Hamrick Jan 2021

Retributive Justice, Capital Punishment, And Jurors In Northeast Florida, Joseph S. Hamrick

UNF Graduate Theses and Dissertations

Jacksonville is nationally recognized as being a city that disproportionately places defendants on death row. The author, who has been both a prosecutor and an appellate attorney representing inmates on death row in Jacksonville, believes that the high number of death sentences being issued in this city, at the recommendation of juries, is driven by a strong retributive intuition held by a significant part of Jacksonville’s society. This thesis evaluates the views of three philosophers who played influential roles in the resurgence of retributive theory in the latter half of the twentieth century in America, in seeking to identify and …

Child Support And Joint Physical Custody, Raymond C. O'Brien Jan 2021

Child Support And Joint Physical Custody, Raymond C. O'Brien

Scholarly Articles

Child custody has evolved to the point where, at a minimum, states provide a mediated process by which parents may formulate parenting plans with court-appointed assistance. At a maximum state legislatures and courts increasingly consider joint physical custody awards. While joint physical custody safeguards the fundamental rights of parents, it nonetheless prompts practical concerns in awarding child support. Today, child support begins with state statutory guidelines, but the guidelines often fail to adequately address the economic consequences of two complete residences, one supported by a parent with fewer economic resources, and the fact that oftentimes the child drifts from one …

Liberalism And Disagreement In American Constitutional Theory, J. Joel Alicea Jan 2021

Liberalism And Disagreement In American Constitutional Theory, J. Joel Alicea

Scholarly Articles

For forty years, American constitutional theory has been viewed as a clash between originalists and non-originalists. This depiction misunderstands and oversimplifies the nature of the debate within constitutional theory. Although originalism and non-originalism describe important differences between families of constitutional methodologies, the foundations of the disagreement among theorists are the justifications that they offer for those methodologies, not the methodologies themselves. Once the debate is refocused on the justifications that theorists offer for their constitutional methodologies, it becomes clear that the debate within constitutional theory is ultimately a debate about liberalism as a political theory. Specifically, it is a debate …

Securities Regulation And Social Media, Seth C. Oranburg Jan 2021

Securities Regulation And Social Media, Seth C. Oranburg

Scholarly Articles

Federal securities regulation originally divided corporate finance into two neat categories, public and private. In 1933, private financing was limited to “sophisticated” investors but otherwise lightly regulated. Public financing became heavily regulated. In 1982, the SEC introduced Reg D, which introduced the concept of “general solicitation” to clarify the distinction between public and private offerings. Reg D is well understood to prohibit newspaper advertisements and permit direct solicitations to venture capital investors. This enabled great wealth consolidation in regions like Silicon Valley while effectively banning general solicitations in private offerings.

Now, social media communication challenges the definition of “general solicitation.” …

The Miller Trilogy And The Persistence Of Extreme Juvenile Sentences, Cara H. Drinan Jan 2021

The Miller Trilogy And The Persistence Of Extreme Juvenile Sentences, Cara H. Drinan

Scholarly Articles

In a series of Eighth Amendment cases referred to as the Miller trilogy, the Supreme Court significantly limited the extent to which minors may be exposed to extreme sentences. Specifically, in this line of cases the Court abolished capital punishment for minors and narrowed the instances when minors may be sentenced to life without parole. Only minors convicted of homicide who are found to be “in-corrigible” may now be subject to a death-in-custody sentence. In limiting extreme sentences for youth in these ways, the Supreme Court relied upon the social and medical science that demonstrates youth are simultaneously less culpable …

Blind Direct Walking Distance Judgment Research: A Best Practices Guide, Crystal Massoglia Jan 2021

Blind Direct Walking Distance Judgment Research: A Best Practices Guide, Crystal Massoglia

Dissertations, Master's Theses and Master's Reports

Over the last 30 years, Virtual Reality (VR) research has shown that distance perception in VR is compressed as compared to the real world. The full reason for this is yet unknown. Though many experiments have been run to study the underlying reasons for this compression, often with similar procedures, the experimental details either show significant variation between experiments or go unreported. This makes it difficult to accurately repeat or compare experiments, as well as negatively impacts new researchers trying to learn and follow current best practices. In this paper, we present a review of past research and things that …

Investigating The Impact Of Rock Bridges On The Mechanical Behavior Of Jointed Rock Mass Using Lattice Spring-Based Synthetic Rock Mass (Ls-Srm) Approach, Mariam Salem Alebayat

Doctoral Dissertations

"Rock bridges were defined as a segment of intact rock that separates from discontinuities. Numerous studies are focused on developing methods to quantify their significance in rock mass strength and deformability behavior. This thesis aimed to enhance understanding of the effect of rock bridges on jointed rock masses in both laboratory and slope scales. For this purpose, the lattice spring base Synthetic Rock Mass (LS-SRM) method was adopted to conduct the numerical models, distinguished in computational efficiency, and simulates the brittle failure and roughness of discontinuities.

A robust approach was developed to optimize the calibration procedure to avoid the complex …
