After Marriage Equality: Dual Fatherhood For Married Male Same-Sex Couples, Jessica Feinberg
After Marriage Equality: Dual Fatherhood For Married Male Same-Sex Couples, Jessica Feinberg
Faculty Publications
In most states, married male same-sex couples who conceive children via gestational surrogacy using sperm from one member of the couple and donor ova must pursue adoption in order to establish legal parentage for the member of the couple who is not genetically related to the child. This is because only a minority of jurisdictions have surrogacy laws that recognize the non-biological intended parent as a legal parent in this situation, and across the United States cisgender male same-sex couples are excluded from the longstanding non-adoptive marriage-based avenues of establishing parentage currently available to both different-sex couples and female same-sex …

Molecular Genetic Modifications In The Human Genome: Racial Discrimination As A Biological Stressor, Nicolette Dobson
UReCA: The NCHC Journal of Undergraduate Research and Creative Activity
Research titled Molecular Genetic Modifications in the Human Genome: Racial Discrimination as a Biological Stressor by Nicolette Dobson in UReCA: The NCHC Undergraduate Journal of Research and Creative Activity, 2021, pages 1-24.
Abstract
Racial discrimination enhances group separation and places individuals into stereotypical categories based on race and other factors (e.g. gender, behavior, etc.). As seen in studies on physiological diseases and psychological disorders, minority groups (e.g. African Americans) face cellular senescence at an increased risk due to health-related comorbidities and prevalent experiences of racism. This review provides an analysis of modifications within the human genome that may lead to …

Abused, Abandoned, Neglected, And Still Not Protected: The Need For An Expansion Of Juvenile Immigrants’ Rights In Nebraska, Jayden Barth
Abused, Abandoned, Neglected, And Still Not Protected: The Need For An Expansion Of Juvenile Immigrants’ Rights In Nebraska, Jayden Barth
Nebraska Law Review
Given the extremely high number of undocumented juveniles in the country at any given moment, the pathways that allow for documentation and eventual citizenship are gravely important to understand. Special Immigrant Juvenile Status (SIJS) is just one option available to immigrant children who have been abused, abandoned, or neglected, as a pathway to permanent legal resident status in the United States. Since SIJS is highly dependent on state courts and statutes, states must provide for the most efficient and effective ways for juveniles to navigate through SIJS proceedings to better protect immigrant children in the United States. This Comment considers …

To Improve the Academy: A Journal of Educational Development
As higher education shifts toward a culture of evidence-based teaching practices, future faculty are seeking opportunities to develop their pedagogical knowledge and skills. Many centers for teaching and learning (CTLs) have not proportionally grown in resources to meet the demand for graduate student and postdoctoral scholar programming (e.g., teaching certificates and pedagogy seminars). This article presents a model of a wide-ranging, coherent pipeline of educational development for graduate students and postdoctoral scholars managed by a CTL with modest staffing.

The field of alternative dispute resolution (ADR) experienced its “Big Bang” moment in 1906 when Roscoe Pound, then University of Nebraska College of Law Dean, delivered his famous address, “The Causes of Popular Dissatisfaction with the Administration of Justice.” On the seventieth anniversary of the address, Chief Justice Warren E. Burger convened a conference, now known as the “Pound Conference,” to revisit those ideas in the 1906 address and discuss ways to promote greater satisfaction with the judiciary and conflict resolution.Harvard Law Professor Frank Sander delivered the keynote address, outlining the possibility of a “multi-door courthouse” in which litigants could …

Beyond Instructional Development: An Exploration Of Using Formal Pedagogy Training To Benefit Perceived Quality Of Life And Sense Of Community In Graduate Students, Matthew Mahavongtrakul, Ashley Hooper, Daniel Mann, Brian Sato
To Improve the Academy: A Journal of Educational Development
The Association of American Colleges and Universities calls for improvements in teaching preparation in graduate programs as a transferable skill for future faculty. However, the amount of institutional and faculty support for these programs is limited. For the relatively few programs that exist, rarely do they have their outcomes assessed in a data-driven manner. This is disconcerting considering that participation in professional development can improve work-life balance, and graduate students often work long hours, suffer from mental health issues, and face increasing career competition. In this case study, we explore how two teaching development programs impacted pedagogical knowledge, perceived quality …
Spirit Of The Corporation, Russell Powell
Spirit Of The Corporation, Russell Powell
Seattle University Law Review
Christian theologians have analyzed the productive and destructive qualities of institutions, sometimes attributing to them human virtues and vices. In City of God, Saint Augustine describes a utopian vision of human community within a Christian context as an alternative to the flawed “City of Man.” Contemporary theologians and sociologists have described collective structures of human behavior in institutions as having a kind of “spirit” analogous to the individual human “spirit.” Institutions are then assumed to take on an existence separate from the individuals within them, and in fact, the “spirit” of an institution influences the behavior of individuals. In The …

Seattle University Law Review
This Article provides a contemporary theoretical framework for Berle’s insight as a basis for considering its legal and ethical implications for corporate governance. Part II attempts to unpack contemporary understandings of spirit in order to provide a helpful working definition. Part III considers the origins and essential traits of the modern business corporation in the United States. The question posed by Berle—whether corporations can or ought to have a sort of moral orientation—is discussed in Part IV, while Part V ponders potential policy shifts that might tilt the orientation of the “spirit of the corporation” toward the common good. Part …
Religious Roots Of Corporate Organization, Amanda Porterfield
Religious Roots Of Corporate Organization, Amanda Porterfield
Seattle University Law Review
Religion and corporate organization have developed side-by-side in Western culture, from antiquity to the present day. This Essay begins with the realignment of religion and secularity in seventeenth-century America, then looks to the religious antecedents of corporate organization in ancient Rome and medieval Europe, and then looks forward to the modern history of corporate organization. This Essay describes the long history behind the entanglement of business and religion in the United States today. It also shows how an understanding of both religion and business can be expanded by looking at the economic aspects of religion and the religious aspects of …

In the United States, municipal solid waste (MSW) landfills remain a potential mining source of recoverable materials, including but not limited to critical, precious, and rare earth metals found in electronic waste. This is possible due to collectible leachate that filters through MSW landfills, carrying metals, nutrients of value, and microbes—some of which may hold key metal bioleaching properties—within. The purpose of this study is to begin analyzing leachate from MSW landfills in the American Midwest to understand the composition of microbial communities within these landfills. Landfill leachate samples sourced in northern Indiana, representing the landfill process during unique times …
Shaping The Lives Of Little Ones Developmental Equipment Project, Marilyn Tyre
Shaping The Lives Of Little Ones Developmental Equipment Project, Marilyn Tyre
Occupational Therapy Program Student Theses, Dissertations and Capstones
Premature infants in the Neonatal Intensive Care Unit (NICU) may experience extensive hospitalizations due to prematurity and medical complications requiring interventions to sustain life and support physiological development. NICU staff are often focused on immediate medical concerns for these infants and may not consider the development and play needs for these long term hospitalized infants. Occupational therapists are aware of the importance of play and supporting the parental role and co-occupations between the infant and parents. This capstone paper discusses the Shaping the Lives of Little Ones Developmental Equipment Project for infants, nurses, and parents designed to provide opportunities for …

Childhood Play As A Predictor For Development Of Creative Potential In Adulthood: A Mixed Methods Study, Brittany Nicole Saviers
Occupational Therapy Program Student Theses, Dissertations and Capstones
Previous research has demonstrated the benefits of childhood play and creativity in childhood from either a qualitative or quantitative perspective; yet, questions remain regarding the predictive power of childhood play, specifically what types of toys facilitate competencies such as creative potential in adulthood. Utilizing a mixed methods convergent parallel design, the aim of this research was to explore the relationship between the types of toys frequently used during childhood and adult creative potential. Additionally, utilizing adults’ retrospective play stories, the study sought to understand the contribution of play to human development by identifying how qualitative themes ofchildhood play experiences aligned …

Clearing Opacity Through Machine Learning, Arti K. Rai, W. Nicholson Price Ii
Faculty Scholarship
Artificial intelligence and machine learning represent powerful tools in many fields, ranging from criminal justice to human biology to climate change. Part of the power of these tools arises from their ability to make predictions and glean useful information about complex real-world systems without the need to understand the workings of those systems.
But these machine-learning tools are often as opaque as the underlying systems, whether because they are complex, nonintuitive, deliberately kept secret, or a synergistic combination of those three factors. A burgeoning literature addresses challenges arising from the opacity of machine-learning systems. This literature has largely focused on …

Bangladesh hosts extensive textile manufacturing, for some of which per- and polyfluorinated alkyl substances (PFAS) have been used to impart water and dirt repellency, among other things. Textile waste emissions to the atmosphere and discharge into rivers and other bodies of water could present a significant concern for human and ecosystem health, but there is little information on PFAS in Bangladesh. To assess the presence of ionic PFAS and their precursors in air and water from Dhaka, Bangladesh, polyethylene sheets were deployed for 28 days as passive samplers for neutral PFAS in outdoor air and water, while ionic PFAS were …

As Judge And Citizen: An Ethical Path To Racial Justice, Reba Ann Page, Robert J. Torres, Jr.
Court Review: Journal of the American Judges Association
The headlines have become frighteningly familiar: a deadly pandemic is engulfing the world including our nation, our streets have become byways for mobs intent on committing racially motivated violence, and our government institutions of public safety are being used as instruments of political control. Although these are among today’s captions, this was also the state of affairs a hundred years ago.1 According to the United States Centers for Disease Control, approximately one-third of the world’s then-population was affected by the deadly global pandemic of 1918-1919. There were an estimated 50 million deaths worldwide, with about 675,000 of these occurring …

The Compassionate Court: Reforming The Justice System Inside And Outside, Jamey H. Hueston
The Compassionate Court: Reforming The Justice System Inside And Outside, Jamey H. Hueston
Court Review: Journal of the American Judges Association
There is growing scholarship and justice system attention regarding the quality and effect of court interactions on citizens who come before the bar, as well as court system employees. From this research and the impact of therapeutic court experience, the Compassionate Court is born. The Compassionate Court considers court matters from a wider perspective that factors human behavior and disabilities, as well as community and societal influences that caused conflicts, and encourages courts to formulate alternative therapeutic solutions. The Compassionate Court reflects a coherent, navigable, and humanistic judicial process no matter the severity of the matter or difficulty of the …
The Legal Exploitation Of Farm Animals: ‘Unnecessary Suffering’ In A Nation Of Animal Lovers, Megan Parker
The Legal Exploitation Of Farm Animals: ‘Unnecessary Suffering’ In A Nation Of Animal Lovers, Megan Parker
Plymouth Law Review
This article examines the necessity of farm animal suffering in the farm-to-fork process. Given the interdisciplinary nature of animal welfare, it covers a broad range of influencing factors, such as law, animal sentience science and the ethical dilemma of meat eating, including the ‘meat paradox’ and its effects on animal welfare. The current animal welfare law is outlined and the rise in veganism, thanks to social media, is discussed. The legal application of the term ‘unnecessary suffering’ is considered in detail, discussing whether the term, in its current form, is fit for purpose and the possibility of legal personhood for …

A Critical Analysis Of Uk Equality And Anti-Discrimination Law In Light Of Social Change, Focusing On The Lgbtq+ Community, Ruby Forster
Plymouth Law Review
This article aims to analyse UK equality and anti-discrimination law, mainly the Human Rights Act 1998 and the Equality Act 2010, and government policies surrounding them, in order to assess whether these frameworks have kept up with social change, particularly focusing on the LGBTQ+ community. The statutory frameworks and the effectiveness of their provisions will be examined, and the case law that has emanated from them. The Equality Act 2010 and its success in practice will be explored by assessing governmental policies and bodies like the role of the Equality and Human Rights Commission and the 2011 and 2018 ‘LGBT …

Approximately half of the freshwater discharged from the Greenland and Antarctic Ice Sheets enters the ocean subsurface as a result of basal ice melt, or runoff draining via the grounding line of a deep ice shelf or marine-terminating glacier. Around Antarctica and parts of northern Greenland, this freshwater then experiences prolonged residence times in large cavities beneath floating ice tongues. Due to the inaccessibility of these cavities, it is unclear how they moderate the freshwater associated supply of nutrients such as iron (Fe) to the ocean. Here, we show that subglacial dissolved Fe export from Nioghalvfjerdsbrae (the ‘79°N Glacier’) is …

Constraints On The Cycling Of Iron Isotopes From A Global Ocean Model, D. König, T. M. Conway, M. J. Ellwood, W. B. Homoky, A. Tagliabue
Marine Science Faculty Publications
Although iron (Fe) is a key regulator of primary production over much of the ocean, many components of the marine iron cycle are poorly constrained, which undermines our understanding of climate change impacts. In recent years, a growing number of studies (often part of GEOTRACES) have used Fe isotopic signatures (δ56Fe) to disentangle different aspects of the marine Fe cycle. Characteristic δ56Fe endmembers of external sources and assumed isotopic fractionation during biological Fe uptake or recycling have been used to estimate relative source contributions and investigate internal transformations, respectively. However, different external sources and fractionation processes …

“To Seek A Newer World”: Honors In Virtual Reality, Betsy Greenleaf Yarrison
Honors in Practice Online Archive
Honors education was never intended to be a virtual offering; it takes intimate, three-dimensional, communal, and intellectual interaction among faculty and students to tackle wicked problems. The COVID-19 crisis forced honors educators into an extreme reboot, extracting courses from comfortable working spaces and relocating them to strange new platforms for remote, computer-mediated instruction. For many faculty, the 2020 pandemic introduced online instruction for the first time. Toward this end, many novices were able to brilliantly reimagine and re-engineer their courses while others struggled. In this essay, the author points out that higher education has always adapted new technologies, asserting that …

On a below-freezing January morning, Jennifer Chavez, an automobile technician, sat in a car that she was repairing to keep warm while waiting for delayed auto parts to arrive. Without intending to, she nodded off. Her employer promptly fired her for sleeping on the job. At least, that is the justification her employer gave. But Chavez had reason to believe that her coming out as transgender motivated the termination. In the months leading up to the January incident, Chavez’s supervisor had told her to “tone things down” when she talked about her gender transition. The repair-shop owner said that the …
