Recent social unrest has highlighted differences in how crime is perceived based upon the race of the perpetrator. Decades of research suggests criminality is more easily associated with racial and ethnic minorities leading to the racialization of crime. Mutz (1994) noted there are personal factors as well as impersonal factors influencing views regarding race and crime. Research suggests the strongest impersonal influence on society’s perception is the media (Gilliam et al., 2002; Umair, 2016). The goal of this explanatory sequential mixed method study was to assess whether there were observable trends, associations, or group differences in evaluation methodology by settings and content area in published evaluations from the past ten years (quantitative), to illuminate how evaluation practitioners selected these methodologies (qualitative), and assess how emergent findings from each phase fit together or helped contextualize each other. In this study, methodology was operationalized as research tradition and method was operationalized as research design. This Article makes two contributions to the fields of policing and criminal legal scholarship. First, it sounds a cautionary note about the use of individual prosecutions to remedy police brutality. It argues that the calls for ways to ease the path to more police prosecutions from legal scholars, reformers, and advocates who, at the same time, advocate for a dramatic reduction of the criminal legal system’s footprint, are deeply problematic. It shows that police prosecutions legitimize the criminal legal system while at the same time displaying the same racism and ineffectiveness that have been shown to pervade our prison-backed criminal …

Canada and Australia each have long histories of containing Indigenous peoples and migrants. The overincarceration of Indigenous peoples continues to worsen in both countries, despite targeted reforms. Migrant detention is on the rise worldwide, with Canada and Australia’s systems understood as among the harshest. This thesis explores why Canada and Australia contain these populations by examining these practices through the lens of contemporary settler colonialism. Like most everything, containment by states has undergone rapid changes as a result of the COVID-19 pandemic. In 2018, Spanish singer Rosalía attained international popularity with her innovative flamenco-fusion album El mal querer. Within the flamenco world, the Rosalía vogue provoked vehement and ongoing polemics, involving whether or not her music should be regarded as “flamenco,” whether she had the social credentials to be accepted as an innovator, and whether it was proper for her to adopt the persona of a ghetto-girl Gypsy in her hit music video, “Malamente.” These controversies reveal much about flamenco culture, and especially about the tensions inhering to its status as both a concert art form and a traditional idiom embedded …

Non-Consensual Condom Removal In Canadian Law Before And After R. V. Hutchinson, Isabel Grant, Lise Gotell

This paper examines the phenomenon of nonconsensual condom removal (NCCR) and its relationship to sexual assault in Canada. Using empirical studies and the insights of feminist theory, we explore the nature of the harms caused by NCCR and contend that this pervasive practice constitutes sexual assault. We then critique the decision of R v Hutchinson, which held that condom sabotage does not negate subjective consent, ignoring the dignitary harms of NCCR. While lower court decisions before Hutchinson recognized that consent to sex with a condom does not include consent to sex without, courts after Hutchinson have struggled to distinguish the …

Transgender and gender non-binary (TGNB) individuals face discrimination in healthcare settings and barriers to healthcare access, resulting in health disparities. These inequities are compounded by the intersection of lower socioeconomic status and geography. To understand the differences in how states provide healthcare to TGNB individuals in poverty, we ask: What are state Medicaid programs offering TGNB residents, and how can coverage be more equitable across jurisdictions? To answer these questions, we examine medical services covered by 15 diverse Medicaid programs and compare them to the services recommended by the World Professional Association for Transgender Health (WPATH). The burden of child care in the wake of widespread K-12 school closures has disproportionately harmed women, communities of color, and lower income families -- a clear indicator that now is the time to adopt a federally-subsidized childcare system in local communities that goes beyond public schools. Current proposals must address regulatory and financial challenges to child care centers and home-based providers, allow for local government involvement and discretion, and maintain flexibility for parents with non-traditional work schedules.

The recent U.S. Supreme Court ruling in Bostock v. Clayton County is a landmark piece of case law that offers fundamental rights to LGBT persons. This essay reflects on how this case arrived at the Supreme Court and its implications for theory and praxis. The overall conclusion is that cautious optimism is warranted.

This essay reviews the basic contours of the cultural appropriation controversies as they have been waged in reference to music in both academic and vernacular circles. It discusses some of the debates that have involved white performers’ musical borrowings from African-American culture, and also musical flows outside the Euro-American mainstream. It explores relations of these ethical polemics to notions of copyright and argues that these can provide a moral guide to the propriety of many cultural interactions. It further critiques the terminological and conceptual distortions and obfuscations that have tended to plague discussions, both on scholarly and popular levels. These …

This article reviews recent LIS literature on student parent initiatives in academic libraries, with the emphasis on the United States. The lack of gender equity in the public sector is a critical issue, especially for emergency services. We explore the gendered nature of firefighting and policing at both professional and organizational levels. We assess gender equity by asking the following questions: (1) How have understandings of gender in emergency services evolved over time? (2) What are the normative implications of emergency services' lack of gender equity? When coronavirus disease 2019 (COVID-19) became a major impediment to face-to-face college instruction in spring 2020, most teaching went online. Over the summer, colleges had to make difficult decisions about whether to return to in-person instruction. Although opening campuses could pose a major health risk, keeping instruction online could dissuade students from enrolling. Taking an ecological approach, the authors use mixed modeling techniques and data from 87 percent of two- and four-year public and four-year private U.S. colleges to assess the factors that shaped decisions about fall 2020 instructional modality. Over the last 20 years, internet usage has increased substantially, providing an inexpensive source of data that may be less prone to bias and could provide a greater number of meso and macro units. However, validating big data and their usefulness has been challenging. This study uses established sources to validate Google Trends’ search interest in the “Bible” across US Designated Market Areas and “Ramadan” across nations, establishing a potential new source of religion data. We then use these measures to show that people from religiously conservative US areas and countries are more likely to disapprove of homosexuality, abortion and …

Americans’ acceptance of same-sex sexual relations and their willingness to restrict the civil liberties of sexual minorities vary substantially across both time and place even as overall trends have been towards more liberalizing stances. Yet few quantitative studies have explored both the individual and contextual religious factors shaping Americans’ views and none have applied such an analysis to examining attitudes over time. Using hierarchical ordered logistic modeling and time-year interactions with 1973–2016 General Social Survey data, we examine whether the religious characteristics of residents and the contexts in which they reside moderated Americans’ liberalizing attitudes over time. Fields closely related to empirical legal research are enhancing their methods to improve the credibility of their findings. This includes making data, analysis code, and other materials openly available, and preregistering studies. Empirical legal research appears to be lagging behind other fields. This may be due, in part, to a lack of meta-research and guidance on empirical legal studies. The authors seek to fill that gap by evaluating some indicators of credibility in empirical legal research, including a review of guidelines at legal journals. They then provide both general recommendations for researchers, and more specific recommendations aimed at three commonly …

Legal ethics has received attention mostly from scholars who view it as a field for the application of moral philosophy. However, economic analysis is also useful in the study of legal ethics, because it can illuminate the incentives that generate ethical dilemmas and controversies. This is especially true in the subfield this paper devotes its attention to, lawyer conflict of interest rules. Body-worn camera (BWC) technology has gained traction in North American police services as a tool to enhance police transparency and accountability. Intimate partner violence (IPV) has been largely associated with male perpetrators and female victims (Drijber, Reijnders & Ceelen, 2013). Although women are more likely to be victims of IPV, men are also victimized at the hands of their intimate partners (Statistics Canada, 2013). As such, academic literature has tended to focus on the experiences of women subjected to IPV while the experiences of men subjected to IPV remain under explored (Machado, Santos, Graham-Kaven, & Matos, 2017). As social awareness of the prevalence of sexual violence on university campuses has increased, it is important to understand the role of university policies in providing protection and support for the campus community and people affected by sexual violence. The purpose of this research is to analyze and compare Sexual Violence Policies (SVP) from four Canadian universities. The analysis evaluates the comprehensiveness of the policies and considers how power, and ideas of power are embedded within SVPs. Findings suggest that policies are at times comprehensive, but may be missing important information, such as including an Objectives section in the policies. …

The purpose of my research is to investigate how perceptions of retributive justice influence tax compliance. I address this objective by proposing two research questions: (1) How do taxpayers perceive the propriety of punishment for tax evasion? (2) How and when are observers’ compliance intentions influenced by perceptions of fairness disclosures about a specific retributive outcome, and the presence of a fairness-relevant disclosure?
To address the first research question, I conduct a survey of 331 adult Canadian taxpayers to ascertain the extent to which taxpayers perceive punishments for tax evasion as fair or unfair. I find that an appropriate punishment …

This national survey research project examined the experiences of Canadian correctional officers (COs) in providing essential correctional services during the COVID-19 pandemic. The study sampled COs from several provinces across Canada (N=596) to better understand how the pandemic impacted stress and wellbeing of this population by exploring seven constructs including resiliency, workplace safety, changes in role or responsibilities, work stress, COVID- 19 related stress, perceived support, and positive mental health. The transactional model of stress and coping and the biopsychosocial model of stress were used as theoretical frameworks to investigate stress responses among COs. As more and more of our lives take place online, we are developing a very public and permanent record of our past views and actions. It is increasingly common for public figures to have their current image tarnished by their mistakes and transgressions in what is often the distant past. Although factors such as the passage of time and age of the actor are typically given consideration in moral judgement, they may be swept away by identity and politics when the transgressions are viewed along partisan lines. People who have been in prison tend to struggle to find meaningful employment (Opsal, 2012). While research delves into the topic of how criminalized people attain employment (Ricciardelli & Mooney, 2017; Anazodo et al., 2017), there is little known about their experiences maintaining employment. Therefore, the objective of this study is to identify the supports and challenges to maintaining employment after release from a Canadian women’s federal prison.

Calls for change to the infrastructure of civil rights enforcement have grown more insistent in the past several years, attracting support from a wide range of advocates, scholars, and federal, state, and local officials. Much of the attention has focused on federal-level reforms, including proposals to overrule Supreme Court doctrines that stop many civil rights lawsuits in their tracks. But state and local officials share responsibility for the enforcement of civil rights and have underappreciated powers to adopt reforms of their own.
