Transforming Crime Victims’ Rights: From Myth To Reality, Robyn Holder, Tyrone Kirchenghast, Paul Cassell
Transforming Crime Victims’ Rights: From Myth To Reality, Robyn Holder, Tyrone Kirchenghast, Paul Cassell
Utah Law Faculty Scholarship
Rights for crime victims have been decried as myths; entitlements that have little enforceability. At the same time, they have been criticised as undermining the legal rights of the accused person. In this Guest Editors Introduction to the Special Issue, Making Rights Real, we suggest that victims’ rights are in transition. Rights may be set out in legal instrument but, we argue, it is through the practices of people in their myriad settings that are part of that shift to realising rights in action. We describe ways in which we see victims’ rights being realised in different parts of the …

Statistics show that policing disproportionately affects communities of color; police are more likely to use force against Black and brown people.1 Data from non-violent encounters (e.g., reason for the stop, type of force used, and presence of witnesses) is rarely collected or disregarded altogether.2 Video evidence can publicize police violence. Bystander video during George Floyd’s murder led to arrests and a global racial reckoning because it depicted the reality of police encounters for people of color. Although technological advancements have led to positive developments for civilian safety (e.g., body cameras and in-car videos), data collection consistency and accountability …

Santiago de Chile, September 18, 1845: General Diego José Benavente (1790-1867) read a speech about his involvement in the independence movement at the University of Chile. The attendants to his address included Manuel Bulnes, President of the Republic; Manuel Montt, Minister of Education; Andrés Bello, Rector of the University; and heads of the state institutions. In front of them, Benavente asserted that if independence heroes were alive, “cuánta ser[ía] su satisfacción y complacencia al ver la nación independiente [. . .] gozando profunda paz bajo la égida de sus instituciones [y marchando] hacia la realización de los altos fines que …

Tackling Ai Bias With Gans, Noam Stanislawski
Tackling Ai Bias With Gans, Noam Stanislawski
Cybersecurity Undergraduate Research Showcase
Throughout the relatively short history of artificial intelligence (AI), there has been a significant concern surrounding AI’s ability to incorporate and maintain certain characteristics which were not inherently modeled out in its coding. These behaviors stem from the prominent usage of neural network AI, which can inherit human biases from the input data it receives. This paper argues for two possible avenues to combat these biases. The first is to rethink the traditional framework for neural network projects and retool them to be usable by a Generative Adversarial Network (GAN). In a GAN’s zero-sum game, two network techniques can combat …

Training Needs Of Counseling Trainees In Corrections: A Survey Of Clinical Directors, Frank Dicataldo, Brett Dejesus, Don Whitworth
Arts & Sciences Faculty Publications
As the mental health treatment needs of adults and adolescents within the criminal justice system has garnered increasing attention, the training of mental health professionals has increasingly focused on serving individuals in forensic and correctional settings. We surveyed 55 clinical directors of mental health programs in forensic and correctional settings in a New England state. Respondents reported that Clinical Mental Health Counselors (CMHCs) broadly participated in assessment, treatment and supervision within these programs. Counseling experience emerged as the most important knowledge/experience domain for prospective job applicants and CMHCs were rated as providing a large share of the treatment within these …
The Intersection Of Race And Algorithmic Tools In The Criminal Legal System, Vincent M. Southerland
The Intersection Of Race And Algorithmic Tools In The Criminal Legal System, Vincent M. Southerland
Faculty Articles
A growing portion of the American public—including policymakers, advocates, and institutional stakeholders—have accepted the fact that racism endemic to the United States infects every stage of the criminal legal system. Acceptance of this fact has resulted in efforts to address and remedy pervasive and readily observable systemic bias. Chief among those efforts is a turn toward technology—specifically algorithmic decision-making and actuarial tools. Many have welcomed the embrace of technology, confident that technological tools can solve a problem—race-based inequity—that has bedeviled humans for generations. This Article engages that embrace by probing the adoption of technological tools at various sites throughout the …

Preserving Due Process: Require The Frye And Daubert Expert Standards In State Gang Cases, Fareed Nassor Hayat
Preserving Due Process: Require The Frye And Daubert Expert Standards In State Gang Cases, Fareed Nassor Hayat
New Mexico Law Review
Police officers are almost universally offered and admitted as experts in gang prosecutions. Without being subjected to the stringent requirements of Frye and Daubert expert standards, criminal Defendants’ due process rights are violated. Once admitted, police officers are permitted to testify to the psychology, customs, motivations, social structures and subjective mental states of individual gang members and gang organizations. Police gang expert testimony should only be admitted after the underlying criminal matter has been proven beyond a reasonable doubt, and even then, only if the police gang expert testimony abides by clearly defined rules of evidence. This article advocates for …
The Disruption Of Covid-19: How A Virtual World Creates Opportunity For Improvement In The Criminal Justice System’S Treatment Of Complainants Of Sexual Violence, Leah Roberston
Law in a Post-Pandemic World
This paper argues that the COVID-19 pandemic has normalized video conferencing within the legal system such that survivors ought to be able to routinely testify outside of the court environment. Though there have always been high rates of sexualized violence, the onset of the pandemic has led to increased rates of sexualized violence, which could lead to greater numbers of trials prosecuting perpetrators. However, only a small amount of complainants turn to the court as a form of justice. This is likely due to the inhumane conditions inflicted on complainants during the trial process. The pandemic has revealed that the …
Sub-Optimal Deterrence And Criminal Sanctioning Under The U.S. Clean Water Act, Joshua Ozymy, Melissa Jarrell Ozymy
Sub-Optimal Deterrence And Criminal Sanctioning Under The U.S. Clean Water Act, Joshua Ozymy, Melissa Jarrell Ozymy
Water Law Review
Both the U.S. Environmental Protection Agency ("EPA") and Department of Justice put forth significant resources to investigate and prosecute environmental crimes under the U.S. Clean Water Act ("CWA"). Criminal sanctions are used to raise the cost of violations relative to the benefits of criminal action to directly deter rational individuals and firms from offending and indirectly via the observation of other potential offenders. While many studies examine sanctioning in environmental law, little research explores the plausibility of any deterrent effects of criminal sanctions under the CWA. We use content analysis to explore all criminal prosecutions resulting from EPA criminal investigations, …
George Floyd And Empathy Stories, Binny Miller
George Floyd And Empathy Stories, Binny Miller
Scholarly Articles in Law Reviews & Journals
In this essay, I explore the stories that lawyers tell on behalf of clients in the context of empathy, and also consider the power of proximity, particularly physical proximity, in forging deep connections with clients. Empathy has played a key, if sometimes silent, role in the endeavor of giving clients "back their lives," whether in case theory or in lawyering more generally. A renewed focus on empathy-informed by Bryan Stevenson's idea of proximity-can more securely ground lawyers in the lived experience of their clients.I use the context of the murder of George Floyd and the subsequent trial of Derek Chauvin …
Race-Based Adjustment In Egfr Algorithms: An Integrative Literature Review, Leah E. Utt
Race-Based Adjustment In Egfr Algorithms: An Integrative Literature Review, Leah E. Utt
Honors Undergraduate Theses
Background: There is a 3-fold risk of developing end stage kidney disease in Non-Hispanic African Americans compared to Non-Hispanic White Americans (Centers for Disease Control and Prevention, 2017). Estimated glomerular filtration rate (eGFR), one of the fundamental algorithms for coordinating treatment for kidney disease which factors in age, race, gender, and levels of creatinine, may pose an issue in this vulnerable population. Currently African Americans receive a correction factor between 1.21 and 1.16 to their eGFR to adjusting the value higher, potentially impacting appropriate kidney disease classification, and delaying beneficial interventions (National Kidney Foundation, 2020).
Methods: A systematic literature search …
Interpersonal Conflict And Work-Related Stress Among Correctional Officers, Katarzyna Sowa-Lapinskas
Interpersonal Conflict And Work-Related Stress Among Correctional Officers, Katarzyna Sowa-Lapinskas
Walden Dissertations and Doctoral Studies
Increasingly, research has been conducted on the penal system, yet few researchers have focused on correctional staff. Due to the nature of their work, correctional officers (COs) experience a high degree of stress that is inmate related, occupational, organizational, and psycho–social. The purpose of this generic qualitative study was to explore the work experiences of COs in rural correctional facilities in Alaska and to learn how correctional staff perceive and mitigate work-related stress stemming from interpersonal conflict. The theoretical framework for this study was Lazarus and Folkman’s transactional theory of stress and coping. Data were collected using semistructured interviews conducted …

Algorithms In Business, Merchant-Consumer Interactions, & Regulation, Tabrez Y. Ebrahim
Faculty Scholarship
The shift towards the use of algorithms in business has transformed merchant–consumer interactions. Products and services are increasingly tailored for consumers through algorithms that collect and analyze vast amounts of data from interconnected devices, digital platforms, and social networks. While traditionally merchants and marketeers have utilized market segmentation, customer demographic profiles, and statistical approaches, the exponential increase in consumer data and computing power enables them to develop and implement algorithmic techniques that change consumer markets and society as a whole. Algorithms enable targeting of consumers more effectively, in real-time, and with high predictive accuracy in pricing and profiling strategies. In …

Hiv/Aids And Substance Use Among Older Adults, Jamerlia E. Wyatt
Walden Dissertations and Doctoral Studies
HIV/AIDS and substance abuse among older adults is a significant national and worldwide problem. As older HIV-positive adults continue to age, they will have problems with managing their HIV/AIDS, comorbidity disorders, and quality of life, which can lead to substance abuse. The purpose of this descriptive, phenomenological study was to explore the socio-risk behaviors, specific treatment preferences, and daily lived experiences of adults aged 50 years and older living with HIV/AIDS and substance use in a large northeastern urban city. The conceptual framework used to ground this qualitative study was Engel's biopsychosocial model. The purposeful sampling method was used to …
Influence Of Personality Traits On Trooper Retention In The Southeast United States, Amethyste Marie Sanchez
Influence Of Personality Traits On Trooper Retention In The Southeast United States, Amethyste Marie Sanchez
Walden Dissertations and Doctoral Studies
Evidence suggests an issue with trooper retention at state law enforcement agencies in the Southeast United States. A current literature gap exists in understanding how personality affects long-term employment at law enforcement agencies in the Southeast United States. The purpose of this quantitative study was to determine whether there are personality traits that influence the retention of a trooper in the Southeast United States for 5 or more years. The personality traits tested were taken from the 16 Personality Factor 6th Edition Security Selection Report and included emotional adjustment, integrity/control, intellectual efficiency, and interpersonal relations. The theoretical basis for this …
Reentry Challenges Of Formerly Incarcerated African American Adult Men In Louisiana, Marquita Higgins
Reentry Challenges Of Formerly Incarcerated African American Adult Men In Louisiana, Marquita Higgins
Walden Dissertations and Doctoral Studies
Although African Americans make up most of the habitual offender population in Louisiana state prisons, there is a dearth of information about the reentry challenges of formerly incarcerated African American men in Louisiana and how they perceive those challenges to impact their reentry into the community after imprisonment. The purpose of this qualitative phenomenological research study was to better understand how formerly incarcerated African American men in Louisiana perceive their challenges when they transition back into their communities and how they make sense of those challenges in relation to recidivism. The theoretical framework for the study was critical race theory. …

Biofeedback training can be used to produce resonance breathing that is synchronized with heart rate and optimizes heart rate variability (HRV). This intervention was expected to alleviate physiological and subjective stress responses. Studies reviewed confirm that higher …
Effects Of Mediation On Employee Efficiency In Human Services Centers And In Other Organizations That Serve Vulnerable Populations, Mariya Mironova
Effects Of Mediation On Employee Efficiency In Human Services Centers And In Other Organizations That Serve Vulnerable Populations, Mariya Mironova
Department of Conflict Resolution Studies Theses and Dissertations
Social workers and other professionals who offer caring services to vulnerable populations are oftentimes exposed to stressful environments. Employee burnout, vicarious traumas, and other stressors jeopardize worker’s efficiency. According to previously conducted research studies, organizational and interpersonal conflicts may be effectively addressed through mediation. However, the studies do not address the use of mediation for the resolution of workplace disputes in centers of human services. This study explores effects of mediation on worker’s efficiency in such centers, and this study proposes that mediation positively affects worker’s efficiency. The proposed methodology for testing this proposition involves a single case study with …

Eliminating Silos: Developing System Design For Information Sharing In Violence Prevention, Jacqueline Kulaga
Department of Conflict Resolution Studies Theses and Dissertations
The 21st century has brought about changing social perspectives on victimization and offender accountability related to sexual violence. States across the United States have established, and continue to develop, legislation and protocols to address such violence. While there has been a great shift in combating this form of violence, it is essential to create structures to enhance services for victims as well as create recommendations for those who work to hold offenders of these violent crimes accountable. This dissertation was conducted using a qualitative content analysis (QCA) of documents from the Palm Beach County Sexual Assault Response Team (PBC SART), …
Restorative Justice And The Impact Of Community Engagement, Tanya Moss
Restorative Justice And The Impact Of Community Engagement, Tanya Moss
Department of Conflict Resolution Studies Theses and Dissertations
Restorative justice provides an innovative approach for addressing misdemeanor juvenile offenses. Diversion programs such as the Ribault Neighborhood Accountability Board utilizes community volunteers to guide juvenile offenders through the restorative justice process. There is however a lack of current research on the engagement of youth offenders and community volunteers that elucidates the relational dynamics between these two groups. This qualitative study uses Interpretative Phenomenological Analysis to address this research deficit by exploring the lived experiences of 12 youth offenders and their engagement with community volunteers, focusing on the following research questions: 1) how do youth offenders make meaning of their …
