The Impact Of Student Assistance On The Granting And Service Of Temporary Restraining Orders, Ian Ayres, Brendan Costello, Elizabeth Villarreal
The Impact Of Student Assistance On The Granting And Service Of Temporary Restraining Orders, Ian Ayres, Brendan Costello, Elizabeth Villarreal
Connecticut Law Review
Temporary Restraining Orders (“TROs”) provide victims of domestic violence temporary ex parte court-ordered protection against further abuse. Because the vast majority of TRO applications are filed pro se, legal and logistical hurdles often prevent deserving applicants from receiving the legal protection to which they are entitled. Chief among these hurdles is the fact that TROs do not go into effect until they are served on respondents, yet service rates are very low.
In this Article, we study the factors that affect whether judges grant ex parte TRO applications and whether the TROs are subsequently served. In particular, we evaluate the …
Brahmin Connections: A Note On The Vocation Of The Law Professor, Carol Weisbrod
Brahmin Connections: A Note On The Vocation Of The Law Professor, Carol Weisbrod
Connecticut Law Review
The early modern Harvard Law School is known for its significance as a model for legal education in the United States. This model is understood to include the case method and a very narrow curriculum, focused on pure law. It is often noted that important figures on the law school faculty were part of the Brahmin Culture of Boston. They were members of a caste which valued a broad and serious engagement with intellectual life. This Article focuses on several individuals—Charles Eliot, James Bradley Thayer, and John Chipman Gray—to illustrate that engagement and suggests that it provided a frame which …
“Liberty And Justice For All”: Equalizing Pretrial Detention For Wealthy And Indigent Defendants, Cait Barrett
“Liberty And Justice For All”: Equalizing Pretrial Detention For Wealthy And Indigent Defendants, Cait Barrett
Connecticut Law Review
Pretrial detention is affected by many factors. One of those is wealth. While the ability to post bail is a major issue in state systems, the federal system poses a different problem: the ability to pay for mitigating conditions. This has the potential to create a disparate impact between wealthy defendants—who can afford conditions that mitigate findings of flight or danger—and indigent defendants who cannot. There are two solutions: detaining wealthy defendants to avoid disparate release or releasing indigent defendants to avoid disparate detention. This Note argues for the latter. It does so by focusing on the requirement for courts …

The Miller Trilogy And The Persistence Of Extreme Juvenile Sentences, Cara H. Drinan
The Miller Trilogy And The Persistence Of Extreme Juvenile Sentences, Cara H. Drinan
Scholarly Articles
In a series of Eighth Amendment cases referred to as the Miller trilogy, the Supreme Court significantly limited the extent to which minors may be exposed to extreme sentences. Specifically, in this line of cases the Court abolished capital punishment for minors and narrowed the instances when minors may be sentenced to life without parole. Only minors convicted of homicide who are found to be “in-corrigible” may now be subject to a death-in-custody sentence. In limiting extreme sentences for youth in these ways, the Supreme Court relied upon the social and medical science that demonstrates youth are simultaneously less culpable …

‘A Hussy Who Rode On Horseback In Sexy Underwear In Front Of The Prisoners’: The Trials Of Buchenwald’S Ilse Koch, Mark A. Drumbl, Solange Mouthaan
Scholarly Articles
Ilse Koch’s trials for her role in atrocities at the Nazi Buchenwald concentration camp served as visual spectacles and primed her portrayal in media and public spaces. Koch’s conduct was credibly rumored to be one of frequent affairs, simultaneous lovers, and the sexual humiliation of prisoners. The gendered construction of her sexual identity played a distortive role in her intersections with law and with post-conflict Germany. Koch’s trials revealed two different dynamics. Koch’s actions were refracted through a patriarchal lens which spectacularized female violence and served as an optical space to (re)establish appropriate feminine mores. Feminist critiques of Koch’s trials …
Sexual Orientation And The Disclosure Of Unwanted Sexual Experiences, Rebekah Kanefsky
Sexual Orientation And The Disclosure Of Unwanted Sexual Experiences, Rebekah Kanefsky
Electronic Theses and Dissertations, 2020-2023
Individuals who identify as lesbian, gay, bisexual, questioning, and other non-heterosexual orientations (LGBQ+) are significantly more likely to experience a sexual assault. To date, research on barriers to sexual assault disclosure (i.e., telling someone about a sexual assault) has been conducted almost exclusively on heterosexual women. Participants ages 18 to 30 participated in a cross-sectional, online study that assessed unwanted sexual experiences, disclosure of those experiences, perceptions of the police and perceptions of belonging to the LGBQ+ community. Findings demonstrated that survivors who identified as LGBQ+ took longer to initially disclose their sexual assault and had greater negative perceptions of …

An Evaluation Of The Differences Between Perpetrators In Completed And Averted School Shootings, Ashley Winch
An Evaluation Of The Differences Between Perpetrators In Completed And Averted School Shootings, Ashley Winch
Electronic Theses and Dissertations, 2020-2023
School shootings have received a substantial amount of media attention and there have been a variety of explanations proposed as to their cause. While completed school shootings have been evaluated extensively, little research has been done into school shootings that have been averted, and even fewer studies have evaluated between group differences between completed and averted school shootings. The purpose of the present study was to assess the differences in completed and averted school shootings primarily with respect to the age of the perpetrators, the number of perpetrators, and participation in leakage warning behaviors. Additional demographic variables were assessed with …
Understanding Developmental Trajectories Of At-Risk Adolescents Transitioning Into Emerging Adulthood, Cara A. Struble
Understanding Developmental Trajectories Of At-Risk Adolescents Transitioning Into Emerging Adulthood, Cara A. Struble
Wayne State University Dissertations
The primary purpose of this study was to examine change across key outcomes of substance use, psychological distress, physical health symptoms, and deviant behaviors in an at-risk sample from adolescence into emerging adulthood. A number of predictors were identified based on models of development, including the Social Interactionist Model, the Risk Amplification Model, and the role of self-efficacy. A sample of 401 (n=251 homeless adolescents) at-risk adolescents from the metropolitan Detroit area were recruited between 1997-2000 and followed for up to seven years. Multilevel modeling was used to examine baseline predictors of change in each of the four outcomes, to …

Decolonizing Vawa 2021: A Step In The Right Direction For Protecting Native American Women, Tara N. Richards, Sheena L. Gilbert, Emily M. Wright
Criminology and Criminal Justice Faculty Publications
The Violence Against Women Act (VAWA) (1994) was a hallmark legislation aimed at combating violence against women. While violence against women is a national issue that affects women of all race/ethnicities, it affects Native American women the most, as Native women experience the highest rates of violence. Violence against Native women is rooted in colonization because it decreases the power of tribal government, diminishes tribal sovereignty, and devalues Native Americans, which in turn leaves Native women more vulnerable to victimization. As such, amendments to VAWA must take particular action on violence against Native women, including actions that support decolonization. The …
