Post-Pandemic Privacy Law, Tiffany C. Li
Post-Pandemic Privacy Law, Tiffany C. Li
Law Faculty Scholarship
COVD-19, the global pandemic that began in 2019, altered how we live our lives in just about every way imaginable. Some of those changes were obvious-for example, those who were fortunate enough to be able to work from home began working online-while other changes were more subtle. The latter category included unprecedented levels of data collection by governments and organizations purporting to collect information that would help stop the pandemic's spread. Given the deadly nature of COVID-19, few would question any public health efforts, no matter their impact on privacy. However, the lack of attention to privacy issues during the …

Privacy In Pandemic: Law, Technology, And Public Health In The Covid-19 Crisis, Tiffany C. Li
Law Faculty Scholarship
The COVID-19 pandemic has caused millions of deaths and disastrous consequences around the world, with lasting repercussions for every field of law, including privacy and technology. The unique characteristics of this pandemic have precipitated an increase in use of new technologies, including remote communications platforms, healthcare robots, and medical Al. Public and private actors alike are using new technologies, like heat sensing, and technologically influenced programs, like contact tracing, leading to a rise in government and corporate surveillance in sectors like healthcare, employment, education, and commerce. Advocates have raised the alarm for privacy and civil liberties violations, but the emergency …

Of Prosecutors And Prejudice (Or "Do Prosecutors Have An Ethical Obligation Not To Say Racist Stuff On Social Media?"), Alex B. Long
Scholarly Works
Over the past few years, there have been numerous news stories about prosecutors posting racially inflammatory content on their social media accounts. There have also been several incidents in recent years in which prosecutors have commented on matters of public concern on social media in a way that is not overtly racist but nonetheless raises legitimate concerns over the prosecutors’ integrity and appreciation of the special role that prosecutors play. Concerns over the extent to which prosecutors bring their personal biases into the courtroom have only increased in recent years and have contributed to the doubts as to the overall …
Getting To Know You: An Expanded Approach To Capital Jury Selection, Samuel P. Newton
Getting To Know You: An Expanded Approach To Capital Jury Selection, Samuel P. Newton
Articles
The Colorado Method of capital jury selection is a widely embraced strategy defense attorneys use to select jurors during voir dire, in which attorneys rank each juror exclusively on the likelihood that the juror will vote for death. The method could benefit from some expansion. Not all defense lawyers have access to Colorado-Method-based training. In innocence cases, defense lawyers should soften discussions of punishment prior to guilt since this tactic predisposes juries to vote for death. Nor do jurors' views or positions on the death penalty guarantee their eventual votes. While capital juries are already inclined to give death sentences …

Examining Incidents Of Sexual Misconduct Reported To Title Ix Coordinators: Results From New York’S Institutions Of Higher Education, Tara Richards, Taylor Claxton, Lane Kirkland Gillespie
Criminology and Criminal Justice Faculty Publications
A paucity of studies has examined incidents of sexual misconduct reported to Title IX coordinators at institutions of higher education (IHEs) or examined differences across types of IHEs. We used 2018 data from incidents of sexual misconduct (N = 3,829) reported to Title IX coordinators at IHEs in New York (N = 209) to examine the context, processes, and outcomes of reported incidents. Findings show that most incidents reported to Title IX coordinators did not prompt the IHE’s conduct process; “other” disciplinary sanctions were the favored response for responsible students, while suspensions and/or expulsions were rarely used. Further data collection …

Inmates May Work, But Don't Tell Social Security, Stephanie Mcmahon
Inmates May Work, But Don't Tell Social Security, Stephanie Mcmahon
Faculty Articles and Other Publications
This Article examines the ways in which inmates are carved out of the protections offered by the Social Security and Medicare systems. By statute, inmates are unable to receive Social Security or disability benefits while incarcerated. Additionally, in many circumstances, their labor does not constitute employment for purposes of calculating quarters of employment for benefits. Therefore, inmates may work their entire prison sentence and, yet, on release discover that they no longer have sufficient years left in their working lives to earn the benefits of Social Security for themselves or their dependents. As the United States grapples with its mass …

Algorithmic Fairness, Algorithmic Discrimination, Thomas B. Nachbar
Florida State University Law Review
There has been an explosion of concern about the use of computers to make decisions affecting humans, from hiring to lending approvals to setting prison terms. Many have pointed out that using computer programs to make these decisions may result in the propagation of biases or otherwise lead to undesirable outcomes. Many have called for increased transparency and others have called for algorithms to be tuned to produce more racially balanced outcomes. Attention to the problem is likely to grow as computers make increasingly important and sophisticated decisions in our daily lives. Drawing on both the computer science and legal …

A Comparison Of Self-Reported Anxiety And Depression Among Undergraduate Music Majors And Nonmusic Majors, Danni Gilbert
A Comparison Of Self-Reported Anxiety And Depression Among Undergraduate Music Majors And Nonmusic Majors, Danni Gilbert
Glenn Korff School of Music: Faculty Publications
The purpose of this exploratory research study was to compare anxiety and depression levels reported by music majors and nonmajors at a small, private liberal arts university. Study participants completed the Burns Anxiety Inventory and Burns Depression Checklist. Anxiety and depression levels were significantly higher among music majors, and there was a strong, positive relationship between anxiety and depression. Regardless of major, self-reports were not affected by year in school. Implications for additional mental health resources and strategies for improving music major health and self-care are discussed, along with a need for increased music faculty awareness of perceived anxiety and …

Restorative Relationships And 'Radical Help': Reimagining Welfare-To-Work Beyond The Market-Family Divide, Lynn D. Lu
Restorative Relationships And 'Radical Help': Reimagining Welfare-To-Work Beyond The Market-Family Divide, Lynn D. Lu
Publications and Research
The unprecedented global lockdown in response to the COVID-19 pandemic exposed the extreme vulnerability of “essential” yet underpaid workers, the vast inequality between the wealthy and the less fortunate, and the bottomless pit facing those without a social safety net. While the crisis has laid bare the near-universality of human susceptibility to disease and unemployment in a world in which few can safely work, it has also highlighted the disproportionate precarity experienced by low-wage and contingent workers, people of color, and non-citizens. Well before the pandemic, rampant socioeconomic and racial inequality, high underemployment and concentration of wealth, and technological advances …
