The Myanmar Shwe: Empowering Law Students, Teachers, And The Community Through Clinical Education And The Rule Of Law, Stephen A. Rosenbaum, Britane Hubbard, Kaylee Sharp-Bauer, David Tushaus

Student Publications

Myanmar’s attorneys, judges, law officers, and law teachers are slowly emerging from the isolated world they inhabited during decades of military authoritarianism. Almost a decade ago, the country triumphantly burst into an era of “disciplined” democracy under the leadership of Aung San Suu Kyi, de facto head of state. Yet, the legal education system continues to be marked by hierarchical and bureaucratic practices, infrastructural and pedagogical neglect, and low confidence in the formal justice sector. The authors—two American law professors and practitioners and two students—discuss the direction of legal education in Southeast Asia and how clinical legal education (CLE) methodologies …

A Need For Change; Critical Issues Facing Kentucky's Correctional System, Candace Harper Jan 2021

A Need For Change; Critical Issues Facing Kentucky's Correctional System, Candace Harper

Integrated Studies

Abstract

Protecting the public, rehabilitating offenders, and reducing recidivism while increasing desistance are essential goals for the Department of Corrections. In order to maximize the effectiveness of the department, several areas need evaluation, and improvement. The focus on reducing recidivism should begin with reconsideration of the methods used to measure an offender's progress and success. The theory that the current measurement of recidivism is unreliable data needs to be investigated and other methods of measurement should be considered. Another aspect that needs inspection is how Post-Traumatic Stress Disorder can affect the positive progression that evidence-based programming provides, and how PTSD …

The Ineffectiveness Of The War On Drugs, Tristen Miller Jan 2021

The Ineffectiveness Of The War On Drugs, Tristen Miller

Integrated Studies

The War on Drugs does not improve health and public safety, but rather serves as a tool of institutional racism and militarism. Despite increased spending on drug enforcement efforts, rates of incarceration and overdose deaths remain high. Through analyzing research done on arrest records in areas such as the state of California; Seattle, Washington; and New Haven, Connecticut, the disparity in arrests of black and white Americans becomes apparent. Additionally, analyzing the effectiveness of War on Drugs policies in Afghanistan, Colombia, and Mexico, reveals ulterior motives for American military intervention. Military intervention and incarceration have proven ineffective at addressing the …

Political Partisanship And Male High School Students Who Carry Handguns, John Page, Wayne L. Davis Jan 2021

Political Partisanship And Male High School Students Who Carry Handguns, John Page, Wayne L. Davis

Lincoln Memorial University Journal of Humanities and Social Sciences

Handguns play a significant role in criminal activity. About 66% of all murders and 40% of robberies involve firearms. Because there are about than 470 residents for each full-time police officer in America, the police cannot effectively protect individual citizens. According to the differential association theory, criminality is a product of shared values, motives, drives, rationalizations, and attitudes that can be influenced by perceptions of the legal code. Democrats and Republicans have different views on reducing social harm via gun-control legal codes, and each political party creates its own unique ambience. Indeed, because each political party believes that its gun-control …
