Initial Development Of The Escala De Fortaleza En Jóvenes Para Padres, David Moran
Initial Development Of The Escala De Fortaleza En Jóvenes Para Padres, David Moran
Counseling & Human Services Theses & Dissertations
National statistics indicate substantial mental health and academic challenges experienced by a sizable proportion of Hispanic children and adolescents in American school settings. School counselors can provide culturally responsive supports to this population and would benefit from contextually grounded, ecologically valid assessments that focus on the positive development of Hispanic children and adolescents. To address this instrumentation gap, this study sought to develop initial items for the Escala de Fortaleza en Jóvenes para Padres in both English and Spanish. A qualitative approach was implemented to explore the perceptions of Hispanic parents/caregivers of their child or adolescent’s resiliency. Eight Hispanic parents …
"The Face Of The Agency": Interviews With Death Investigators In South Louisiana, Natalie H. King
"The Face Of The Agency": Interviews With Death Investigators In South Louisiana, Natalie H. King
LSU Master's Theses
According to the American Board of Medicolegal Death Investigators, “the role of the medicolegal death investigator is to investigate any death that falls under the jurisdiction of the medical examiner or coroner, including all suspicious, violent, unexplained and unexpected deaths” (American Board of Medicolegal Death Investigators [ABMDI], n.d.). As such, a death investigator has a job that is highly intense and stressful at a level similar to that of doctors, nurses, emergency medical technicians (EMTs), and firefighters. The majority of the literature written about death investigators focuses on procedural issues, while there seemingly is a lack of literature focused on …

The Church And Michael Brown: The Influence Of Christianity On Racialized Political Attitudes In Ferguson, Missouri, Tyler Chance
The Church And Michael Brown: The Influence Of Christianity On Racialized Political Attitudes In Ferguson, Missouri, Tyler Chance
Dissertations
This study examines whether the Christian faith played a pacifying or inspiring role in racialized politics following the death of Michael Brown and subsequent uprisings in Ferguson, Missouri. To evaluate the role of religion in responding to racialized crisis, the author examines both the attitudes of individual citizens and the actions of faith leaders. Using data gathered from two exit-polls conducted by the author in Ferguson and the surrounding area during the period between the death of Michael Brown and the decision not to indict the officer who killed him and then again after the grand jury decision, the author …
Courts Beyond Judging, Michael C. Pollack
Courts Beyond Judging, Michael C. Pollack
BYU Law Review
Across all fifty states, a woefully understudied institution of government is responsible for a broad range of administrative, legislative, law enforcement, and judicial functions. That important institution is the state courts. While the literature has examined the federal courts and federal judges from innumerable angles, study of the state courts as institutions of state government — and not merely as sources of doctrine and resolvers of disputes — has languished. This Article remedies that oversight by drawing attention for the first time to the wide array of roles state courts serve, and by evaluating the suitability of both the allocation …
No Rest For The Weary: A Survey Of Virginia's 2020 General Assembly Regular And Special Sessions, Samantha R. Galina
No Rest For The Weary: A Survey Of Virginia's 2020 General Assembly Regular And Special Sessions, Samantha R. Galina
Richmond Public Interest Law Review
This has been possibly the most historic year in the Virginia General Assembly in decades. During the regular session alone, 3,857 bills were introduced, spanning thousands of pages covering topics as vast as criminal justice reform to election laws to natural resource protection.1 As if that wasn’t enough, the General Assembly reconvened for a Special Session in August to address the COVID-19 pandemic, related budgetary changes, and a myriad of police conduct-related bills in response to the killing of George Floyd and the national Black Lives Matter movement. This article will provide a summary of some of the major bills …

The Virginia Values Act: A Landmark Civil Rights Legislation Leapfrogs Virginia Into A Leader On Equality, Sarah Warbelow, Cathryn Oakley
Richmond Public Interest Law Review
After more than 25 years of Republican political control, Virginia passed thirteen pieces of pro-equality legislation in 2020, the most sweeping of which was the Virginia Values Act. That legislation modernized Virginia civil rights law, bringing the state into line with the overwhelming majority of other states in addressing discrimination. In addition to adding nondiscrimination protections for lesbian, gay, bisexual, transgender, and queer (LGBTQ) people in existing law - which included housing, public employment, and credit it created all-new protections from discrimination in employment and places of public accommodation on the basis of race, color, religion, national origin, sex, pregnancy, …
Decriminalization In Virginia: Marijuana In The 2020 General Assembly Session, Jenn Michelle Pedini, Cassidy Crockett-Verba
Decriminalization In Virginia: Marijuana In The 2020 General Assembly Session, Jenn Michelle Pedini, Cassidy Crockett-Verba
Richmond Public Interest Law Review
Cannabis is regulated in over one-third of the United States and it has finally made its way to Virginia. While it is not yet legal in the Commonwealth, it has been decriminalized. This is when the criminal penalties are removed but civil penalties (often fines) remain. This is a step in the right direction but activists know that this is not enough for the communities that continue to be harmed by a failed war on drugs. The legislation in Virginia will not fix the issue of over-policing in Black and Brown communities but activists believe that it will put Virginia …
Unallot A Lot: Virginia's Human Services Budgeting In The Time Of Coronavirus, Valerie L'Herrou, Cassie Cunningham, Salaam Bhatti
Unallot A Lot: Virginia's Human Services Budgeting In The Time Of Coronavirus, Valerie L'Herrou, Cassie Cunningham, Salaam Bhatti
Richmond Public Interest Law Review
Virginia’s 2020 General Assembly budgeting process for fiscal year (“FY”) 2021-2022 was upended by the global pandemic which, after a rosy economic forecast for the Commonwealth, sent revenue expectations tumbling, and necessitated a nearly complete rewrite of the budget immediately upon its enactment by the legislature. Social services, an important aspect in the economic health of the Commonwealth, seemed poised to have greater support from the new Democratic majority in both houses of the state legislature as well as the governor’s mansion. But this may or may not have been true, even before the impact of COVID-19.
Benevolent Sexism In Judges, Jeffrey J. Rachlinski, Andrew J. Wistrich
Benevolent Sexism In Judges, Jeffrey J. Rachlinski, Andrew J. Wistrich
San Diego Law Review
Previous research suggests that judges make more favorable rulings for female litigants in family court cases and in criminal sentencing. Although such trends might arise from real differences between men and women, they might also arise from stereotypes that cause judges to favor mothers over fathers and to show leniency towards female defendants. We test for benevolent sexism among hundreds of sitting trial judges with two experiments in which we presented judges with hypothetical cases in which we only varied the gender of the litigants. In a family court case, we found judges were more apt to grant a request …
Face It: Only Congress Can Preserve Privacy From The Pervasive Use Of Facial Recognition Technology By Police, John Zens
San Diego Law Review
This Comment implores Congress to limit the development of law enforcement FRT databases. In Part II, the Comment describes facial recognition technology, examining its development and uses. This section describes how law enforcement compiles databases of faces. It concludes by exploring potential future applications of the technology. Part III discusses the privacy rights angle, answering why the American population should be concerned about—and why legislators should act to prevent—unchecked FRT-equipped law enforcement.
Part IV addresses the current statutory framework that governs law enforcement’s use of FRT. In this section, the Comment points out the general lack of enacted legislation regarding …
Obstruction Of Justice: Redesigning The Shortcut, Ellen S. Podgor
Obstruction Of Justice: Redesigning The Shortcut, Ellen S. Podgor
BYU Law Review
When one looks to accomplish consistency and predictability in the criminal justice system — important goals tied to achieving deterrence — the architecture of obstruction of justice remains important. It is insufficient to suggest that we have consistency in sentencing by using federal sentencing guidelines, when the charging process is undermined by its failure to provide uniformity. Achieving a consistent charging framework for federal obstruction of justice needs to be individualized, remain true to the contextual setting, and provide consideration for the specific processes of a trial, sentencing, or impeachment. But it also needs to have a structure that is …

Why Are Women Lawyers Underrepresented In Criminal Justice?, Maryam Ahranjani
Faculty Scholarship
When the ABA’s Criminal Justice Section (CJS) created the Women in Criminal Justice Task Force (TF) in 2019, we knew that women lawyers in the criminal sector were underrepresented in the workforce, but we did not know why. Thus, the TF set out to investigate the challenges facing women criminal lawyers in hiring, retention, and promotion. By assembling a group of women with diverse lived and professional experiences, cochairs Professor Carla Laroche and Tina Luongo sought to elevate women’s voices previously not heard by CJS and develop and promote strategies to achieve full inclusion of those voices in CJS, the …

2l Student Jhaton White Makes History As Cardozo Law Review's First Black Editor In Chief, Benjamin N. Cardozo School Of Law
Cardozo News 2021
When 2L student Jhaton White found out last week that he had been elected as the first Black Editorin-Chief of the Cardozo Law Review, he said, “my dad called me a legend and compared me to Barack Obama. He still hasn’t stopped and It’s kind of sweet. My mom was really excited as well. We hugged, she told me how proud she is to be my mother and that she knew I would get the position. We also had a quick dance party in the kitchen, then I had to jump on Zoom and join Volume 42’s election process.”

The Influence Of Defendant Race/Ethnicity And Police Body-Worn Cameras On Traffic Case Processing, Jessica Huff, Michael D. White, Kathleen E. Padilla
Criminology and Criminal Justice Faculty Publications
The current study evaluates the impact of defendant race/ethnicity and police body-worn cameras (BWCs) on dismissals and guilty pleas in traffic violations. Despite the frequency of traffic violations and the potential for racial/ethnic bias in these incidents, researchers have yet to examine the outcomes of these violations in court. Research is also needed to assess the potential for BWCs to provide evidence and reduce charging disparities and differential pleas for minority defendants. Traffic violations processed in the Tempe, Arizona Municipal Court before and after BWC deployment were examined using logistic regression. Black and Hispanic defendants were less likely to have …

Blue Rage: A Critical Cultural Analysis Of Policing, Whiteness, And Racial Surveillance, Wesley T. Johnson
Blue Rage: A Critical Cultural Analysis Of Policing, Whiteness, And Racial Surveillance, Wesley T. Johnson
USF Tampa Graduate Theses and Dissertations
This dissertation is an interpretive project deploying critical media analysis and interpretive qualitative methods to examine televisual and cinematic performances of policing. I use interpretive qualitative inquiry to explore blue rage, policing, and whiteness. By highlighting the racial surveillance which undergirds policing, I analyze blue rage as a critical race concept that addresses the affective policing of racial resentment and racial solidarity among law enforcement. My media analyses demonstrate the ways that whiteness is operationalized through law and order and criminal justice. Analyzing cinematic and televisual depictions of the police and racist surveillance, I address policing—as a profession, as a …
Physical Health And Delinquency, Katy Hancock
Physical Health And Delinquency, Katy Hancock
Faculty & Staff Research and Creative Activity
While physical health can impact a variety of outcomes, little research has looked at health and delinquency. Through a lens of GST, this study examines whether health moderates the relationships between strain and delinquency and drug use. Data from the 2011 NSDUH were analyzed; results indicated that, for certain strains, very good and excellent health predicted lower risks of committing some types of delinquency and poor/fair health predicted the higher risk. For youth in “no parent” homes in very good health and from some youth with chronic illness, however, the risk of delinquency increased. The overall results dictate the expansion …

Going Beyond The Blue: The Utility Of Emergency Medical Services Data In Understanding Violent Crime, Julie Hibdon, Cody E. Telep, Jessica Huff
Going Beyond The Blue: The Utility Of Emergency Medical Services Data In Understanding Violent Crime, Julie Hibdon, Cody E. Telep, Jessica Huff
Criminology and Criminal Justice Faculty Publications
National victimization data suggest less than 50% of violent crime incidents are reported to the police. Official reports of crime to police, however, are often the only type of data used for the analysis of violence problems, the identification of geographic concentrations of violent crime, and the selection of targets for police and prevention resources. Yet, the question remains, are estimates of violent crime prevalence and location distorted from a unilateral reliance on police data? Here, we examine whether emergency medical service (EMS) data collected by the fire department are spatially concentrated in the same way as police data and …

Defining And Addressing The Intersection Of Sports, Media, And Social Activism, Kaylee Layne Crafton
Honors Theses
Athletes have used their sports platforms and the elevated statuses of fame to share their political views and seek change for centuries. However, our society is now at a time in which athlete activism seems to be at its peak due to constant societal shifts and the quick, widespread dissemination of news through various forms of media. This study sought to answer one primary question: When can athletes share their views about racial equality and social justice? For Americans, the “when” in which athletes can speak up is often a divisive issue. This study analyzed how major sports leagues and …
Screening Of Pregnant Women With Opioid Use Disorder: Identifying Factors Impacting Implementation Of Screening Recommendations Using The Theoretical Domains Framework, Tara R. Foti
USF Tampa Graduate Theses and Dissertations
Background: Prenatal opioid exposure is a growing problem in the United States with high and increasing rates of opioid use and opioid use disorder during pregnancy. Almost 23% of pregnant women enrolled in Medicaid programs filled an opioid prescription during pregnancy in 2007, marking a 21.1% increase since 2000. Maternal opioid use during pregnancy is associated with a variety of poor maternal, pregnancy and infant outcomes, including overdose, pregnancy-associated death, prematurity, low birth weight and Neonatal Opioid Withdrawal Syndrome. To optimize prenatal care and pregnancy-associated outcomes, the Alliance for Innovation in Maternal Health, in collaboration with The American College of …
