A Virtue Ethics Approach To Professional Identity: Lessons For The First Year And Beyond, Patrick Emery Longan, Daisy Hurst Floyd, Timothy Floyd
A Virtue Ethics Approach To Professional Identity: Lessons For The First Year And Beyond, Patrick Emery Longan, Daisy Hurst Floyd, Timothy Floyd
Articles
We have been teaching, writing, and speaking about professional identity formation for many years. Over that period, we have arrived by various routes at a virtue ethics approach to professional identity formation. In this article, we will share our approach and include lessons for the first year of law school and beyond.
Our commitment to a virtue ethics approach did not emerge overnight. It evolved over the years and comes from our varied experiences. Pat Longan's path emerged from his experience as a teacher and scholar of professional responsibility who was asked in 2002 to develop a stand-alone course on …
Role Of Forensic Chemistry And Analytical Intrumentation In The Identification Of Designer Drugs, Mariah A. Barko
Role Of Forensic Chemistry And Analytical Intrumentation In The Identification Of Designer Drugs, Mariah A. Barko
Honors Theses
This thesis describes the overall issues that designer drugs are causing in society today. There are three main types of structural differences between designer drugs and the parent drug they are created from. The substances can be direct or indirect regioisomers with the same atomic components as the parent drug or isobaric compounds containing different atomic components than the parent drug. These substances are slowly becoming classified as stimulants, sedatives, dissociative, psychedelics, or synthetic cannabinoids, and scheduled into one of the classes set in place by the Controlled Substances Act of 1970, appropriately once enough information is known about them. …

Knowledge Is Power: A Study Of Juvenile Justice Facilities And Educational Programs, Molly Anne Latham
Masters Theses & Specialist Projects
The Juvenile Justice System is established to maintain public safety, as well as rehabilitate youth that have involved themselves in criminal activity. The overall goal is to create a better future for these individuals and transform them into law-abiding citizens for the good of society. In order to understand where the system has failed in doing this, we must first examine what opportunities and programs these individuals have to help them succeed. The current study will employ a secondary analysis of a cross-sectional survey through which the United States Bureau of the Census (1995) collected data on the characteristic of …
An Exploration Of The Resources And Services Offered To D/Deaf And Hard Of Hearing Inmates In Massachusetts Jails And Prisons, Gabrielle Carpinella
An Exploration Of The Resources And Services Offered To D/Deaf And Hard Of Hearing Inmates In Massachusetts Jails And Prisons, Gabrielle Carpinella
Criminology Student Work
d/Deaf and Hard of Hearing individuals have faced substantial discrimination when it comes to education, healthcare, and employment. This paper argues that discrimination in our criminal justice system is likely no exception. Previous research has shown that d/Deaf and Hard of Hearing inmates are treated unequally while serving time in prison (Vernon, 2010). Rather than using proactive measures to provide appropriate resources within prison, correctional facilities within the U.S. tend to be reactive to the claims of d/Deaf and Hard of Hearing inmates once they are released from prison. There is no literature that I am aware of that has …

The Ethics Of Interrogation: How Unethical Interrogations Lead To False Confessions And What It Means For The Criminal, Janelle Havens
The Ethics Of Interrogation: How Unethical Interrogations Lead To False Confessions And What It Means For The Criminal, Janelle Havens
Criminology Student Work
Forensic interrogation is a vital step in the process of criminal investigations in order to extract information about suspects and the crime at hand. However, tunnel vision, artificial time constraints, lack of thorough training, and noble-cause corruption can influence how an investigator decides to interrogate a suspect or witness. When these influences are exerted on an investigator, the need to secure an arrest and conviction overpowers the need for justice - this results in false confessions and wrongful convictions. This is otherwise known as “the end doesn't justify the means” mindset. This causes investigators to engage in unethical interrogations, whether …

Policing And The Illusion Of Public Input, Tony Cheng
Policing And The Illusion Of Public Input, Tony Cheng
Yale Graduate School of Arts and Sciences Dissertations
Decades of scholarly, policy, and financial investment in police-community reform have coalesced around fulfilling the elusive promise of increasing public input in policing. And yet, policing in America today is currently undergoing a crisis in public legitimacy. By continuing to understand the gaps between the promise and practice of community initiatives as revealing police’s operational shortcomings rather than organizational priorities, we fail to sufficiently theorize and account for the core problem of police-community relations. This book argues that the core problem is an enduring illusion of public input in policing. The illusion exists because police shape the very channels through …

Where Should We Land?: Flyover Districts As Proper Venue For Crimes Committed In Air On Domestic Flights, Megan E. Mccarthy
Where Should We Land?: Flyover Districts As Proper Venue For Crimes Committed In Air On Domestic Flights, Megan E. Mccarthy
JCLC Online
This Essay explores the recently resolved circuit split between the Ninth, Tenth, and Eleventh Circuits regarding the proper venue for crimes committed on an airplane during flight. In 2019, the Ninth Circuit held that the proper venue for trying an assault that happened midflight was the district over which the airplane was flying when the assault occurred. While flyover districts may seem like a surprising and inconvenient choice for venue, flyover districts are the only constitutionally proper venue for point-in-time offenses that occur on airplanes during flight. Furthermore, using current aviation tracking protocols and GPS technology, courts can pinpoint the …

Valuation Blunders In The Law Of Eminent Domain, Richard A. Epstein
Valuation Blunders In The Law Of Eminent Domain, Richard A. Epstein
Notre Dame Law Review
In dealing with the valuation problem, I will bracket these estimation issues in order to look to different and disturbing types of difficulties in the valuation enterprise. The law of eminent domain starts with the implicit assumption that the government is in general a good actor whose motives and laudable and whose behavior does not need excessive judicial oversight. Hence the general norm of judicial deference often applies to valuation decisions. In the cases that I shall review, as well as others, a general pattern emerges, whereby all doubtful valuation questions that arise dealing with key problems are at best …

Policy Analysis Of The Effectiveness Of De-Escalation Training, Kennedy Culbreath
Spring Showcase for Research and Creative Inquiry
The objective of this research is to examine the effectiveness of de-escalation training on the rates of excessive force towards mentally ill and minority individuals. A systematic review of studies conducted to assess the impact of this policy on stated outcomes indicates that the policy is an effective means of reducing excessive rates outcomes between police officers, mentally ill, and minority citizens. In addition, the policy has also reduced the rate of assaults and increased confidence and skills in the medical field which contributes to the policy's effectiveness.

Algorithms In Business, Merchant-Consumer Interactions, & Regulation, Tabrez Y. Ebrahim
Algorithms In Business, Merchant-Consumer Interactions, & Regulation, Tabrez Y. Ebrahim
West Virginia Law Review
The shift towards the use of algorithms in business has transformed merchant-consumer interactions. Products and services are increasingly tailored for consumers through algorithms that collect and analyze vast amounts of data from interconnected devices, digital platforms, and social networks. While traditionally merchants and marketeers have utilized market segmentation, customer demographic profiles, and statistical approaches, the exponential increase in consumer data and computing power enables them to develop and implement algorithmic techniques that change consumer markets and society as a whole. Algorithms enable targeting of consumers more effectively, in real-time, and with high predictive accuracy in pricing and profiling strategies. In …

Illegal Discharge: Exploring The History Of The Criminal Enforcement Of The U.S. Clean Water Act, Dr. Joshua Ozymy, Dr. Melisssa L. Jarrell
Fordham Environmental Law Review
The criminal prosecution of defendants that violate federal clean water laws has been ongoing for roughly four decades. Yet, we continue to have a poor understanding of how federal prosecutors use the U.S. Clean Water Act (“CWA”) to charge and prosecute criminals and the outcomes of those prosecutions. We use content analysis to analyze 2,588 federal criminal prosecution case summaries, 1983-2019, to gain a better historical understanding of how the CWA has been used as a prosecutorial tool, to bring out the major themes in the prosecutions, and quantify sentencing outcomes. Findings from the 828 CWA prosecutions undertaken during this …
