The Seneca Falls Dialogues Journal
This paper is designed to elicit dialogue on the impact of the #Blacklivesmatter (BLM) movement and be a call to action in the wake of murder and sustained oppression of the Black body in America. The paper focuses on the intersectionality of the BLM movement using art, “racial” analysis, creative pedagogy, and the theatre of the oppressed. Included is a monologue of a mother whose child has been murdered by a “peace officer” that leads the audience on an emotional journey. In addition, sobering statistics of documented murders of Black transgender women are presented, as are the health effects of …

Intersectionality And Feminist Pedagogy: Lessons From Teaching About Racism And Economic Inequity, Lisa J. Cunningham, Pao Lee Vue, Virginia B. Maier
Intersectionality And Feminist Pedagogy: Lessons From Teaching About Racism And Economic Inequity, Lisa J. Cunningham, Pao Lee Vue, Virginia B. Maier
The Seneca Falls Dialogues Journal
This paper utilizes Rochester, NY, as a case study to argue that approaching race intersectionally and across disciplines creates a stronger model of feminist pedagogy. It is based on our work in the classroom and on the Fisher Race Initiatives—a series of three interactive workshops we created on our campus to create change in the aftermath of the Michael Brown shooting in Ferguson, MO, and in the subsequent rise of the #BlackLivesMatter movement. Our goals were to promote dialogue on race, to expose participants to factual information on race, and to emphasize the intersectional causes of poverty in the Rochester …

Drug Conviction And Employment Restriction: Experiences Of Employees With Drug-Related Criminal Histories, Liana Bernard
Drug Conviction And Employment Restriction: Experiences Of Employees With Drug-Related Criminal Histories, Liana Bernard
Dissertations and Theses
It has been established that there are numerous barriers to obtaining and maintaining employment following a criminal conviction, including background checks, which occur as part of most selection processes. Barriers to obtaining and maintaining employment may be higher for individuals with drug-related criminal histories as they may face particularly severe negative stereotypes. This study examines the experiences of individuals with drug-related criminal histories' integration into the workplace and society. Additionally, because stereotypes about individuals with drug-related criminal histories are contradictory to those of individuals with stable employment, I examine how these individuals are impacted by reductions in the stigma that …

Amadeusz: Inequities In The Enactment And Implementation Of Records Suspensions, Ardavan Eizadirad, Tina-Nadia Gopal Chambers
Journal of Law and Social Policy
AMADEUSZ IS A NON-PROFIT ORGANIZATION IN ONTARIO that provides access to education, community supports, mentorship, and exceptional care for young adults ages eighteen to thirty-five who are or have been incarcerated. Using case studies of three participants from Amadeusz, we centre the lived experiences of racialized persons with a criminal record, outlining the challenges to accessing, and being approved for, a record suspension. Although the record suspension program is intended to assist with reintegration, the case studies show that the high monetary cost for the record suspension application, extensive waiting periods of five or ten years to qualify, consideration of …
An Abortion Law Preformed, Joanna N. Erdman
An Abortion Law Preformed, Joanna N. Erdman
Journal of Law and Social Policy
This article engages the transcribed testimony of Carolyn Egan and Janice Patricia Tripp in R v Morgentaler as a critical moment of lawmaking. There is something revealing, often amusing, and sometimes devastating, when a lawyer asks a non-lawyer, in this case, a social worker: “What is the law?” The article focuses on those moments in their testimony when Egan and Tripp answered questions about the 1969 abortion law that made the law itself, its rules and procedures, the subject of examination, and in doing so, constructed new meanings of the law and social action in relation to it in the …
Prison Rape Elimination Act, 2003: Individual Factors For Victimization And Offending, Bailey Saldana
Prison Rape Elimination Act, 2003: Individual Factors For Victimization And Offending, Bailey Saldana
Theses
The Prison Rape Elimination Act of 2003 was passed in order to provide a set of guidelines for reporting and reacting to prison rapes (PREA, 2020). This project uses secondary data from the Survey of Inmates in State and Federal Correctional Facilities to identify factors associated with prison rape victimization. Rates of institutional violence have not decreased as have the rates of violence outside of institutions (Wooldredge, 2020; Morgan & Truman, 2020). One area of institutional violence research that is lacking is prison rape research. As more research is done on prison rape victimization, this project extends on this body …

Playing With Fire: The Medieval Judicial Ordeals And Their Downfall, Aaron Larson
Playing With Fire: The Medieval Judicial Ordeals And Their Downfall, Aaron Larson
Swarthmore Undergraduate History Journal
Trials by ordeal in the Middle Ages prove to be some of the most complex secular trials in all of history. Both trial by fire, and trial by water looked to call God's judgment into play, hoping that He would make the decisions of guilt or innocence. God is all-knowing. He is all-powerful. Therefore He has all of the relevant information to determine the fates of those who go through the ordeals. Despite this, the theologians in the medieval Church looked to lessen clerical involvement in the ordeals. In 1215, the Fourth Lateran Council met, and the ordeals ceased to …
Life After Sentence Of Death: What Becomes Of Individuals Under Sentence Of Death After Capital Punishment Legislation Is Repealed Or Invalidated, James R. Acker, Brian W. Stull
Life After Sentence Of Death: What Becomes Of Individuals Under Sentence Of Death After Capital Punishment Legislation Is Repealed Or Invalidated, James R. Acker, Brian W. Stull
Akron Law Review
More than 2500 individuals are now under sentence of death in the United States. At the same time, multiple indicators—public opinion polls, legislative repeal and judicial invalidation of deathpenalty laws, the reduction in new death sentences, and infrequency of executions—suggest that support for capital punishment has significantly eroded. As jurisdictions abandon or consider eliminating the death-penalty, the fate of prisoners on death row—whether their death sentences, valid when imposed, should be carried out or whether these individuals should instead be spared execution—looms as contentious political and legal issues, fraught with complex philosophical, penological, and constitutional questions. This article presents a …
The Continuing And Unlawful Exclusion Of Qualified Ex-Offenders From Jury Service In Ohio, Jordan Berman
The Continuing And Unlawful Exclusion Of Qualified Ex-Offenders From Jury Service In Ohio, Jordan Berman
Akron Law Review
Whether an Ohioan with a felony conviction can be considered for jury service may well depend on where he or she lives in the state or the judge presiding at trial, rather than the dictates of Ohio law. By statute, Ohio permits those with felony convictions to serve on juries upon the completion of any parole or community control sanctions that may have been imposed. This article is not concerned with this settled law but rather the dramatic unevenness of its implementation, as Ohio courts of common pleas, and even individual judges, vary widely in whether they abide by or …
Sentencing By Ambush: An Insider's Perspective On Plea Bargaining Reform, Justice Michael P. Donnelly
Sentencing By Ambush: An Insider's Perspective On Plea Bargaining Reform, Justice Michael P. Donnelly
Akron Law Review
The vast majority of cases in our state criminal justice system are resolved not by proceeding to trial but through negotiated plea agreements. These are contracts between the government and the accused in which both sides are negotiating for some form of benefit in the ultimate resolution. In this article, Justice Donnelly exposes what he sees as a flaw in the system in the manner in which trial court judges oversee this process of negotiation. In a significant number of cases, the state induces defendants to enter into a guilty plea with no certain sentence, amounting to an illusory agreement …

Equipping School Counselors For Antiracist Healing Centered Groups: A Critical Examination Of Preparation, Connected Curricula, Professional Practice And Oversight, Kara P. Ieva, Jordon Beasley, Sam Steen
Teaching and Supervision in Counseling
This paper highlights the potential for school counselors to promote antiracist practices and racial healing engagement utilizing small group counseling to ultimately eliminate inequities in schools. However, counselor educator programs, founded on middle to upper class white ideals, worldviews, and narrowly focused theoretical frameworks, currently function in ways that fail to equip future school counselors with the group facilitation knowledge, skills, and dispositions necessary for equitable practice in schools across the nation using case illustrations and a broad current literature review, the authors conceptualize the rationale for more competencies beyond group course assignment, clinical requirements (e.g., CACREP standards, 2016), practice, …

The Case For A Core Anti-Racist Course For Counselors In Training, Ileana A. Gonzalez Ph.D., Raven K. Cokley Ph.D.
Teaching and Supervision in Counseling
Historically, counseling programs in the United States have been rooted in whiteness and white supremacy. Despite this historical context, counseling programs fail to teach students about the varied ways that anti-Blackness and systemic racism show up in society, classrooms, and clinical settings. Given the systemic murders of Black folks by the state, the health disparities highlighted by the COVID-19 pandemic, and the refusal of white voters to abandon white supremacist patriarchy in the 2020 presidential election, the counseling field must reconsider how it prepares trainees to embrace anti-racism in their personal and professional lives. The purpose of this article is …
Do Patrol Beat And Police Officer Attributes Predict Citizen Complaint?, Eduardo Guajardo
Do Patrol Beat And Police Officer Attributes Predict Citizen Complaint?, Eduardo Guajardo
Theses and Dissertations
Citizen complaints against police officers have been the highlight of national news media and outlets. Complaints of use of force are not the only ones that arise from citizens’ complaints; other complaints such as discourtesy and demeanor are issues that police officers face and answer to their internal affair’s investigative units. The aim of this study is to examine what ascribed (e.g., age, gender, and marital status) and career-related achieved (e.g., certification, education, experience, and training) characteristics of police officers influence citizens’ complaints in terms of type, frequency, and severity. Contextual factors such as patrol beat, used as a moderating …
Everyday Aesthetics, Space, And The Sensory: Fear Of Crime And Affect In Inner Sydney, Murray Lee, Jonathan Jackson, Justin R. Ellis
Everyday Aesthetics, Space, And The Sensory: Fear Of Crime And Affect In Inner Sydney, Murray Lee, Jonathan Jackson, Justin R. Ellis
Qualitative Criminology (QC)
"In this paper we explore pre-conscious aesthetic and sensorial aspects of affect in fear of crime. Drawing on data from focus groups undertaken in inner Sydney, Australia, we link the sensory and aesthetic preconditions of fear of crime to its affective, behavioural and cognitive elements. We argue that fear is grounded in the structural, personal and inter-subjective components of individual’s lives and their interaction with physical and social environments, which then influence how individuals cognitively understand their own risks and react behaviourally to these emotional responses. By bringing alive the importance of environmental cues and the cultural and structural positions …
A Measure Of Expectancies For Alcohol Analgesia: Preliminary Factor Analysis, Reliability, And Validity, Lisa Renee Larowe
A Measure Of Expectancies For Alcohol Analgesia: Preliminary Factor Analysis, Reliability, And Validity, Lisa Renee Larowe
Dissertations - ALL
Rates of alcohol consumption are substantially higher among persons with pain, and recent research has focused on elucidating bidirectional pain-alcohol effects. Expectancies for alcohol analgesia could influence the degree to which alcohol confers acute pain-relieving effects, and may amplify the propensity to respond to pain with drinking behavior. However, no validated measures of expectancies for alcohol analgesia are available. The goal of this project was to examine psychometric properties of a measure of Expectancies for Alcohol Analgesia (EAA) across two samples (current alcohol users with and without chronic pain). Study 1 included 200 moderate-to-heavy drinkers with no current acute/chronic pain …

Criminology and Criminal Justice Faculty Publications
Objectives: This experiment addressed whether, when administering a survey to police managers, it is best to measure organizational justice using attitudinal questions tapping into perceived importance or behavioral self-reports. Methods: We administered a survey to a national probability sample of police executives using a split-ballot experimental design, where respondents randomly received items measuring either (a) the perceived importance of organizational justice or (b) the self-reported usage of organizational justice. Results: Perceived importance of organizational justice was not significantly associated with the perceived quality of relationships with subordinates. However, actual usage of organizational justice was, increasing the perceived quality of relationships …

INTRODUCTION: HIV prevalence among criminal justice (CJ)-involved adults is five times higher than the general population. Following incarceration, CJ-involved individuals experience multilevel barriers to HIV prevention. Pre-exposure prophylaxis (PrEP) is a widely available, daily medication efficacious in preventing HIV. Little is known about PrEP knowledge, acceptability, initiation and sustained use among CJ-involved persons or about how these outcomes vary by multilevel factors. The Southern Pre-Exposure Prophylaxis Study (SPECS) will investigate barriers and facilitators for PrEP initiation and sustained use among CJ-involved adults, building a foundation for PrEP interventions for this underserved population.
METHODS AND ANALYSIS: SPECS uses a mixed-methods sequential …
