Howdy, Partner: Challenges With State Takeovers And Charter Partnerships In Texas School Districts, Hannah Luke Jan 2021

Howdy, Partner: Challenges With State Takeovers And Charter Partnerships In Texas School Districts, Hannah Luke

SMU Law Review

Since President Johnson passed the first federal education legislation in the 1960s, lawmakers at both the state and federal level have been searching for effective ways to hold public schools accountable. The 2015 amendments to the Elementary and Secondary Education Act gave states increased flexibility to implement their own innovative accountability measures, and with this newfound authority, Texas passed two laws: House Bill 1842 (HB 1842) in 2015 and Senate Bill 1882 (SB 1882) in 2017. The stringent measures in HB 1842 threaten struggling schools with state takeover if they consistently fail to meet standards, while SB 1882 incentivizes schools …

Hold My Beer, Hold My Price: State Post-And-Hold Regulatory Schemes Constitute Price Fixing Preempted By Federal Antitrust Law, Kathrine Maldonado Jan 2021

Hold My Beer, Hold My Price: State Post-And-Hold Regulatory Schemes Constitute Price Fixing Preempted By Federal Antitrust Law, Kathrine Maldonado

SMU Law Review

The Supreme Court has created various tests in cases involving antitrust preemption of state regulations—such as Midcal’s state immunity two-pronged analysis and Fisher’s hybrid versus unilateral restraint test—without clarifying how the various tests fit together. This has led to circuit splits not only in regard to how courts approach antitrust preemption cases but also in regard to the preemption findings of nearly identical laws in different circuits. In a departure from the Ninth and Fourth Circuits, the Second Circuit recently upheld the validity of Connecticut’s post-and-hold alcohol pricing regulation. State post-and-hold regulations effectuate illegal price fixing between competitors …

A Solution To The Murkiness Of Nonparent Visitation Rights In Texas, Morgan Tauscher Jan 2021

A Solution To The Murkiness Of Nonparent Visitation Rights In Texas, Morgan Tauscher

SMU Law Review

To protect parental rights, Texas law presumes that a child’s parent or parents are in the position to make decisions regarding the best interest of their child. However, Texas courts favor granting nonparent visitation rights, even over parents’ objections, if there is sufficient evidence presented by the nonparent to overcome the presumption. Although Texas law is well-established when considering sufficient evidence to overcome the presumption in nonparent child custody cases, courts are inconsistent about the standards and tests involved in nonparent child visitation cases. There are differences between child custody disputes and visitation disputes, such as the level of parental …

Field-Scale Soil Moisture Bridges The Spatial-Scale Gap Between Drought Monitoring And Agricultural Yields, Noemi Vergopolan, Sitian Xiong, Lyndon Estes, Niko Wanders, Nathaniel W. Chaney, Eric F. Wood, Megan Konar, Kelly Caylor, Hylke E. Beck, Nicolas Gatti, Tom Evans, Justin Sheffield Jan 2021

Geography

Soil moisture is highly variable in space and time, and deficits (i.e., droughts) play an important role in modulating crop yields. Limited hydroclimate and yield data, however, hamper drought impact monitoring and assessment at the farm field scale. This study demonstrates the potential of using field-scale soil moisture simulations to support highresolution agricultural yield prediction and drought monitoring at the smallholder farm field scale. We present a multiscale modeling approach that combines HydroBlocks a physically based hyper-resolution land surface model (LSM) with machine learning. We used HydroBlocks to simulate root zone soil moisture and soil temperature in Zambia at 3 …

Geography

Lakes in permafrost regions are dynamic landscape components and play an important role for climate change feedbacks. Lake processes such as mineralization and flocculation of dissolved organic carbon (DOC), one of the main carbon fractions in lakes, contribute to the greenhouse effect and are part of the global carbon cycle. These processes are in the focus of climate research, but studies so far are limited to specific study regions. In our synthesis, we analyzed 2167 water samples from 1833 lakes across the Arctic in permafrost regions of Alaska, Canada, Greenland, and Siberia to provide first pan-Arctic insights for linkages between …
