"Everybody Knows I'M Not Lazy": Medicaid Work Requirements And The Expressive Content Of Law, Kristen Underhill Jan 2021

"Everybody Knows I'M Not Lazy": Medicaid Work Requirements And The Expressive Content Of Law, Kristen Underhill

Faculty Scholarship

In a first for the Medicaid program, the Department of Health and Human Services under President Trump allowed states to establish work requirements for program participants who are considered "able-bodied adults." These mandates were halted by litigation, and President Biden's administration is now in the process of withdrawing the waivers. But early experiences with Medicaid work requirements suggested that they can produce widespread losses of benefits. In addition to affecting access, work requirements and other conditions on public benefits can serve an expressive purpose: they provide a source of information about a state's values, goals, and beliefs about beneficiaries. Beneficiaries …

Classical Liberal Property And The Question Of Institutional Choice, Thomas W. Merrill Jan 2021

Classical Liberal Property And The Question Of Institutional Choice, Thomas W. Merrill

Faculty Scholarship

Richard Epstein’s property scholarship tracks his classical liberal theory of government. The classical liberal would permit state intervention to overcome collective-action problems but not to engage in redistribution of wealth. With respect to private law, Epstein harbors no clear preference for either the legislature or the courts as a source of limits on owners’ autonomy to overcome collective-action problems. With regard to public law, in contrast, Epstein would elevate the courts to a superior status relative to legislatures and would have courts enforce the classical liberal ideal as a matter of constitutional law. This article questions whether giving such power …

Land Of 10,000 Dying Lakes: Designing For Sustainable Water Management Through Wetland Conservation And Public Recreation, Zachary Unruh Jan 2021

Land Of 10,000 Dying Lakes: Designing For Sustainable Water Management Through Wetland Conservation And Public Recreation, Zachary Unruh

Landscape Architecture Theses

In 2017, 169 harmful algal blooms were reported nation-wide. Existing in all water body types, saltwater or freshwater, this number is increasing every year, and Minnesota is no exception. In the land of 10,000 lakes, 48 different locations have experienced a Harmful Algae Bloom at least once over the last decade. Growing not only in frequency, but also size, the presence of these Cyanobacteria blooms are killing aquatic species, lowering water quality, limiting recreational use, and in some cases producing toxins capable of killing humans and animals that come into contact with the water. Due to global warming, the average …

Governance ≠ Leadership: What Blockchain And Ai Won't Do For Corporate Lawyers, Jeffrey M. Lipshaw Jan 2021

Governance ≠ Leadership: What Blockchain And Ai Won't Do For Corporate Lawyers, Jeffrey M. Lipshaw

Suffolk University Law School Faculty Works

This is a contribution to the Journal of Corporation Law’s 2020 symposium on blockchain technology and corporate governance. The thesis is that blockchain technology is well suited to the monitoring function in corporate governance; that monitoring as the primary function of corporate governance is a particularly legal conception; and that the business conception of governance has far more to do with leadership, strategy, and operations. If the legal and business conceptions of governance tend to be ships passing in the night (at least in this somewhat exaggerated rendering), it is because prevailing economic and legal theoretical models have a difficult …

Risk Factors And Precursors To Police Suicide, Matthew J. Carpenter Jan 2021

Risk Factors And Precursors To Police Suicide, Matthew J. Carpenter

Theses and Dissertations

Police suicide has consistently remained a more likely cause of death for police officers than being killed in the line of duty for the past several years. Understanding the risk factors and precursors associated with suicide is crucial to changing this anomalousness. Prevention, early intervention, treatment, support, and reducing stigma, may help lower the number of police officers committing suicide.

Several research studies have found the rate of suicide for police officers to be double that of the general population (Chopko, Palmieri & Facemire, 2013; Violanti, 2010; Lewis, 2014; Charbonneau, 2000). The day-to-day job of policing may be stressful and …

The Role Of Social Media In Human Trafficking Victimization, Alicia Marie Terwilliger Jan 2021

The Role Of Social Media In Human Trafficking Victimization, Alicia Marie Terwilliger

Theses and Dissertations

Human trafficking is the recruitment, transportation, transfer, harboring, and receipt of people. Humans are one of the only global commodities that can be sold and used repeatedly (Jones et al., 2007), helping to make trafficking a multi-billion-dollar industry worldwide. There are several types of trafficking, including forced labor, debt bondage, organ harvesting, and sexual exploitation. Often, trafficking includes threats, the use of force, coercion, abduction, and fraud for exploitation, labor, harvested organs, or sex. Human trafficking occurs domestically and across international borders, with over 45 million victims globally (Bonilla & Mo, 2019). Every state in the United States is affected …

Enhancing Student Learning In Introductory Physics Through Funds Of Knowledge, Liang Zeng, Guang Zeng Jan 2021

Enhancing Student Learning In Introductory Physics Through Funds Of Knowledge, Liang Zeng, Guang Zeng

Physics & Astronomy Faculty Publications

Researchers have reported the funds of knowledge (FK) pedagogical approach effective in engaging minority students in learning. However, there are a lack of studies connecting FK to introductory college physics or physical science classes. By using examples from regional Mexican-American lived experiences at an Hispanic-serving institution located along the recently politicized U.S.-Mexico border, this paper provides evidence to show how physics educators can use FK to engage students in learning introductory college physics concepts.

Noise due to scattered light has been a frequent disturbance in the advanced LIGO gravitational wave detectors, hindering the detection of gravitational waves. The non stationary scatter noise caused by low frequency motion can be recognized as arches in the time-frequency plane of the gravitational wave channel. In this paper, we characterize the scattering noise for LIGO and Virgo's third observing run O3 from April, 2019 to March, 2020. We find at least two different populations of scattering noise and we investigate the multiple origins of one of them as well as its mitigation. We find that relative motion between …

Grappling With Covid-19 By Imposing And Lifting Nonpharmaceutical Interventions In Sri Lanka: A Modeling Perspective, Mahesh Jayaweera, Chamath Dannongoda, Dilum Dilshan, Janith Dissanayake, Hasini Perera, Jagath Manatunge, Buddhika Gunawardana

Physics & Astronomy Faculty Publications

The imposition and lifting of non-pharmaceutical interventions (NPIs) to avert the COVID19 pandemic have gained popularity worldwide and will continue to be enforced until herd immunity is achieved. We developed a linear regression model to ascertain the nexus between the time-varying reproduction number averaged over a time window of six days (Rts) and seven NPIs: contact tracing, quarantine efforts, social distancing and health checks, hand hygiene, wearing of facemasks, lockdown and isolation, and health-related supports. Our analysis suggests that the second wave that emerged in Sri Lanka in early October 2020 continued despite numerous NPIs. The model indicates that the …

Bringing Nature Indoors: Tetris Landscaping, Rachel Borgert Jan 2021

Bringing Nature Indoors: Tetris Landscaping, Rachel Borgert

Landscape Architecture Theses

According to the Environmental Protection Agency (EPA), the average American spends 93% of their life indoors. Almost 70% of which is at home. By being indoors there is a greater chance of being exposed to higher concentrations of airborne pollutants, commonly found in indoor atmospheres. With an increase in people working from home, homeschooling their kids and spending limited time outdoors throughout the year it has caused a negative impact on their mental and physical well-being. NASA conducted a study on indoor plants and how they eliminate indoor air pollutants called Volatile Organic Compounds (VOCs) in the atmosphere. Based off …

‘Planning for Play in Island Park’ is a design thesis based meant to identify a realistic and multifaceted response to the removal of Ash Trees (Fraxinus pennsylvanica) from Fargo North Dakota’s downtown Island Park. Within evaluating the site a clear need for playground redevelopment and expansion was identified due to it’s context within the community. Development and design of the project is rooted in providing opportunity for play to occur. Types of play are referenced from developmental psychology research and organized within the site with consideration of age. Designing for Play exists on multiple layers within the project. Directly designing …

Temporary Landscapes: Physically Distanced, Socially Together, Emily Hopfauf Jan 2021

Temporary Landscapes: Physically Distanced, Socially Together, Emily Hopfauf

Landscape Architecture Theses

Temporary landscapes are where things happen, the bread and butter of urban life. Social, political, and economic battles have been waged in the open spaces of our cities. This is where change starts and grows. Even now, during a time when daily life is filled with Zoom meetings, Black Lives Matter marches are happening. Another breed of protesters stormed the capital. While the morality of these actions are in question, things are constantly happening in the temporary which effect how we remember and use spaces. The scope of this design thesis is to understand how to leverage temporary spaces during …

Sub-Optimal Deterrence And Criminal Sanctioning Under The U.S. Clean Water Act, Joshua Ozymy, Melissa Jarrell Ozymy Jan 2021

Sub-Optimal Deterrence And Criminal Sanctioning Under The U.S. Clean Water Act, Joshua Ozymy, Melissa Jarrell Ozymy

Water Law Review

Both the U.S. Environmental Protection Agency ("EPA") and Department of Justice put forth significant resources to investigate and prosecute environmental crimes under the U.S. Clean Water Act ("CWA"). Criminal sanctions are used to raise the cost of violations relative to the benefits of criminal action to directly deter rational individuals and firms from offending and indirectly via the observation of other potential offenders. While many studies examine sanctioning in environmental law, little research explores the plausibility of any deterrent effects of criminal sanctions under the CWA. We use content analysis to explore all criminal prosecutions resulting from EPA criminal investigations, …

Physics & Astronomy Faculty Publications

We present a new analysis of the profile data from the 47 millisecond pulsars comprising the 12.5 yr data set of the North American Nanohertz Observatory for Gravitational Waves, which is presented in a parallel paper (Alam et al., hereafter NG12.5). Our reprocessing is performed using “wideband” timing methods, which use frequency-dependent template profiles, simultaneous time-of-arrival (TOA) and dispersion measure (DM) measurements from broadband observations, and novel analysis techniques. In particular, the wideband DM measurements are used to constrain the DM portion of the timing model. We compare the ensemble timing results to those in NG12.5 by examining the …
