International Law Association's Guidelines On Intellectual Property And Private International Law ("Kyoto Guidelines"): Recognition And Enforcement, Pedro De Miguel Asensio, Marketa Trimble

Scholarly Works

This section of the the chapter "Recognition and Enforcement" of the International Law Association's Guidelines on Intellectual Property and Private International Law ("Kyoto Guidelines") establishes the conditions under which the effects of judgments rendered in a country may be extended to foreign jurisdictions. It seeks to favor international coordination and legal certainty by facilitating the cross-border recognition and enforcement of judgments relating to IP disputes. The Guidelines are based on a broad concept of judgment with restrictions concerning judgments not considered final under the law of the State of origin as well as certain provisional measures. The main provision of …

Telling The Story On Your Timesheets: A Fee Examiner's Tips For Creditors' Lawyers And Bankruptcy Estate Professionals, Nancy B. Rapoport Jan 2021

Telling The Story On Your Timesheets: A Fee Examiner's Tips For Creditors' Lawyers And Bankruptcy Estate Professionals, Nancy B. Rapoport

Scholarly Works

This essay discusses how much of a lawyer’s embedded assumptions and cognitive errors can come across in something as simple as a time entry on a bill. So much can be revealed about how a lawyer views himself or herself in society and about the lawyer’s relationship with the client that it’s worth examining what we can find when we look at legal bills.

Incarcerated Activism During Covid-19, M. Eve Hanan Jan 2021

Incarcerated Activism During Covid-19, M. Eve Hanan

Scholarly Works

Incarcerated people have a notoriously difficult time advocating for themselves. Like other authoritarian institutions, prisons severely curtail and often punish speech, organizing, and self-advocacy. Also, like other authoritarian institutions, prison administrators are inclined to suppress protest rather than respond to the grounds for protest. Yet, despite impediments to their participation, incarcerated people have organized during the pandemic, advocating for themselves through media channels, public forums, and the courts. Indeed, a dramatic increase in incarcerated activism correlates with the onset of the COVID-19 pandemic.

Just as the COVID-19 pandemic highlights injustice in other areas of criminal legal practices, it reveals both …

Infected Judgment: Problematic Rush To Conventional Wisdom And Insurance Coverage Denial In A Pandemic, Erik S. Knutsen, Jeffrey W. Stempel

Scholarly Works

The COVID-19 pandemic created not only a public health crisis but also an insurance coverage imbroglio, prompting near-immediate business interruption claims by policyholders impacted by government restrictions ordered in response to the pandemic. Insurers and their representatives "presponded" to the looming coverage claims by quickly moving to denigrate arguments for coverage, engaging in a pre-emptive strike that has largely worked to date, inducing too many courts to rush to judgment by declaring-as a matter of law-that policy terms such as "direct physical loss or damage" do not even arguably encompass the business shutdowns resulting from COVID-19. Our closer examination of …

The Architecture Of Judicial Ethics, Charles G. Geyh Jan 2021

The Architecture Of Judicial Ethics, Charles G. Geyh

Articles by Maurer Faculty

In 1999, Professor Stephen Burbank wrote an article entitled The Architecture of Judicial Independence. It is a foundational piece that gave structure to what was then an understudied field. At the heart of that article is a profound insight: stable and enduring judicial systems are the product of forces in constructive tension. Thus, in the context of judicial administration, Burbank conceptualized judicial independence with reference to judicial accountability, and characterized pressure points in the relationship between them as complementary, not contradictory; and in later work, he made a similar point about the interplay between the law and policy in judicial …

Intentional Design: Exercises To Guide You Through Your Program Design And Implementation—10 Steps, 15 Exercises Packet, Girl Center Jan 2021

Intentional Design: Exercises To Guide You Through Your Program Design And Implementation—10 Steps, 15 Exercises Packet, Girl Center

Adolescents and Young People

Girls—especially the most socially and economically marginalized—are often cited as key beneficiaries of health and development initiatives. However, unless they are subject to specific, intentional recruitment efforts, they are likely to receive a disproportionately low, even negligible, share of the benefits. Good intentions aside, some “youth”, “adolescent”, or “girls’” programs do not apply targeted, evidence-based practices and therefore reach fewer girls than they intended or could. Some programs, whether intentional or not, end up directing the majority of benefits to those who are better off and not to those most in need.

The Girl Roster was developed by the Population …

Being In Centro: The Anthropology Of Schelling's Human Freedom, Michael Vater Jan 2021

Being In Centro: The Anthropology Of Schelling's Human Freedom, Michael Vater

Philosophy Faculty Research and Publications

Schelling presents the 1809 freedom essay as the idealistic flowering of a vision of system he always held. He is not disingenuous but somewhat perplexing in claiming that the system always was complete in nuce, even though not expounded completely. Tilliette captured the ambiguity nicely in designating Schelling’s oeuvre «une philosophie en devenir». This mid-career essay must be read backwards to the earliest essays republished with it—especially to their views of willing, freedom, and moral responsibility—and simultaneously forward to the late philosophy’s analysis of God’s freedom as freedom from being, even necessary being. I locate Freedom’s …

The Carbon Price Equivalent: A Metric For Comparing Climate Change Mitigation Efforts Across Jurisdictions, Gabriel Weil Jan 2021

The Carbon Price Equivalent: A Metric For Comparing Climate Change Mitigation Efforts Across Jurisdictions, Gabriel Weil

Scholarly Works

Climate change presents a global commons problem: Emissions reductions on the scale needed to meet global targets do not pass a domestic cost-benefit test in most countries. To give national governments ample incentive to pursue deep decarbonization, mutual interstate coercion will be necessary. Many proposed tools of coercive climate diplomacy would require a one-dimensional metric for comparing the stringency of climate change mitigation policy packages across jurisdictions. This article proposes and defends such a metric: the carbon price equivalent. There is substantial variation in the set of climate change mitigation policy instruments implemented by different countries. Nonetheless, the consequences of …

Does Nonattachment Predict Levels Of Experimentally Induced Social Stress And Cognitive Features Of Social Anxiety Disorder? Possible Implications For Future Treatment, Anna Gernand Jan 2021

Does Nonattachment Predict Levels Of Experimentally Induced Social Stress And Cognitive Features Of Social Anxiety Disorder? Possible Implications For Future Treatment, Anna Gernand

All-Inclusive List of Electronic Theses and Dissertations

Social anxiety disorder (SAD) is characterized by a fear of negative evaluation that often results in behaviors such as avoidance intended to mitigate the risk of making a negative impression on others or making their social anxiety known (American Psychiatric Association, 2013). Engaging in self-focused attention is a covert manner in which individuals with SAD can protectively monitor their speech, behavior, and physical symptoms of anxiety (e.g., blushing) in an effort to compensate for their perceived susceptibility to negative evaluation (Clark & Wells, 1995). Self-focused attention in social anxiety has been widely studied and found to elevate rather than alleviate …

All-Inclusive List of Electronic Theses and Dissertations

Global learning is among the declared 21st century learning outcomes of higher education deemed essential for meeting the challenges and opportunities of the global world. Since global learning is a framing theme for college student learning” (Schneider, 2015, para. 3; Kinzie et al., 2017, para. 2), it is important to find ways to make sure that institutions deliver global learning outcomes effectively through their general education. Assessment is also the key to sustaining successful and effective global learning, and it can help facilitate institution-specific strategies promoting continuous improvement. This exploratory study examined the impact of Indiana State Universitys Foundational Studies …

On “Ur-Contempt” And The Maintenance Of Racial Injustice: A Response To Monahan's “Racism And ‘Self-Love’: The Case Of White Nationalism”, Grant J. Silva

Philosophy Faculty Research and Publications

This article offers a response to Michael J. Monahan’s engagement with and criticism of Grant Silva’s article “Racism as Self-Love.” So as to demonstrate how Monahan’s idea of “ur-contempt” fits alongside the author’s project and supplements his attempt to challenge the variety of forms of moral obfuscation employed by white nationalists and other racists today, this response begins with an overview of the central critique of moral responsibility for racism that Silva’s work offers. At stake is the attempt, by unabashed white supremacist and others, to bank on historical acts of racial oppression and reap the benefits of elevated social …

Business Faculty Publications and Presentations

COVID-19 has had a substantial impact on transit workers’ lives, especially among public-facing vehicle operators. The current project examined relationships between workers’ knowledge and perceptions of their employer’s COVID-19 safety responses, job attitudes, and health. We surveyed transit workers (N = 174) between July and August 2020 and followed up 3 months later. Fifty-seven workers responded to the follow-up survey. Surveys addressed workers’ knowledge and perceptions of their employer implementing Centers for Disease Control and Prevention (CDC)-recommended COVID-19 safety responses, COVID-19 risk perceptions, job attitudes, and health factors. Employees reported knowledge of their employer implementing ~8 of 12 CDC-recommended responses. …

Blacks In Oregon, Darrell Millner Jan 2021

Blacks In Oregon, Darrell Millner

Black Studies Faculty Publications and Presentations

Periodically, newspaper or magazine articles appear proclaiming amazement at how white the population of Oregon and the City of Portland is compared to other parts of the country. It is not possible to argue with the figures—in 2017, there were an estimated 91,000 Blacks in Oregon, about 2 percent of the population—but it is a profound mistake to think that these stories and statistics tell the story of the state's racial past. In fact, issues of race and the status and circumstances of Black life in Oregon are central to understanding the history of the state, and perhaps its future …

Dual Panics: A Media Analysis Of Narratives On The Role Of Unauthorized Migration In America's Overdose Crisis, Morgan Godvin Jan 2021

Dual Panics: A Media Analysis Of Narratives On The Role Of Unauthorized Migration In America's Overdose Crisis, Morgan Godvin

University Honors Theses

Background: The realms of drug policy and immigration policy have long been fueled by misinformation, where sensationalism and panics help shore up political support. Most recently, the "border crisis" has been invoked to explain the "overdose crisis" in mass media narratives. Although the increase in migration is being blamed for illicit drug flows, drug importation occurs primarily through legal points-of-entry. The extent and excess visibility of false narratives linking overdose to migration in mainstream media is unknown.

Methods: We used the Media Cloud ecosystem to compile and characterize mainstream media content published between June 2021 and July 2021 regarding the …

Genome-Wide Sequencing In Clinical Genetic Counseling, Sydney Schulz Jan 2021

Genome-Wide Sequencing In Clinical Genetic Counseling, Sydney Schulz

University Honors Theses

Genome-wide Sequencing provides an exciting opportunity for the future of genetic counseling. However, the efficacy of GWS in covering G-C rich regions of DNA, detection of variants, coverage of the exome, reanalysis, and identifying disease origin in non-coding regions of DNA remains to be proven. GWS provides a diagnostic success rate of 36-73% in pediatric cases and 50-67% of adult rare disease and alters the path of necessary care offered by genetic counselors. Limitations significantly hamper the success of GWS in a genetic counseling setting, such as difficulties in obtaining consent for testing and data storage, the high rate of …

Determinants Of Non-Revenue Water, Haslinda Ab Malek, Mohamad Hafizi Zakaria, Muhammad Luqman Zulkifli, Nur Farahin Roslan

Malaysian Journal of Computing (MJoC)

Water is one of the most essential needs in human daily life. Water losses or Non-Revenue Water (NRW) refers to the treated water that has been produced from water plant which did not reach to the customer. This waste of water has caused the company to suffer losses and hence, burdens the people with increasing water tariff. Moreover, it becomes one of the challenges for commercial water system management because the water company must fulfil the demand from the society which keep increasing day by day. In addition, the demand for water is increasing, as the population is growing. Despite …

Gamification Of Icebreaking Activities For Mechanical Engineering Students Embarking On A Problem Based Learning Module, Kevin Delaney, Gerard Nagle, Mingzhu Chen

Conference papers

When they enter the workforce engineering graduates must be able to engage collaboratively with others to find solutions to complex engineering challenges. This involves a great deal more than simply solving technical problems traditionally taught in engineering school. The Mechanical Engineering Discipline in Technological University Dublin (TU Dublin) has helped students develop real-world engineering skills through a team based Problem Based Learning (PBL) module since 2005. This module, involving third year students, can be particularly challenging since participants can join the third year of the program from other programs or universities and many will not have known each other prior …

Conference papers

Significant efforts have been made to promote gender equality in higher education (HE) in Europe. Examples include the establishment of the Athena Swan Charter in the UK in 2005 and the 2019 launch of the Irène Curie Fellowship scheme by Eindhoven University of Technology. But which initiatives address broader diversity, equity, and inclusion (DEI) challenges in HE? And which are specifically focused on engineering education? This exploratory study aims to improve our understanding of the ways in which a set of European HE Institutions engaged in engineering education address DEI at an organisation level, and how this is communicated within …

A Combined Experimental And Computational Study Of Mechanical Properties After Balloon Kyphoplasty, Philip Purcell, Fiona Mcevoy, Stephen Tiernan, Derek Sweeney, Seamus Morris

Research Outputs: 2025-Present

Vertebral compression fractures rank among the most frequent injuries to the musculoskeletal system, with more than 1 million fractures per annum worldwide. The past decade has seen a considerable increase in the utilisation of surgical procedures such as balloon kyphoplasty to treat these injuries. While many kyphoplasty studies have examined the risk of damage to adjacent vertebra after treatment, recent case reports have also emerged to indicate the potential for the treated vertebra itself to re-collapse after surgery. The following study presents a combined experimental and computational study of balloon kyphoplasty which aims to establish a methodology capable of evaluating …

Big Data: Potential As An Ocular Epidemiology And Public Health Tool, Michael Moore Jan 2021

Big Data: Potential As An Ocular Epidemiology And Public Health Tool, Michael Moore

Doctoral

Refractive error is a significant cause of vision impairment both through the limited access to correction in some areas and the associated ocular diseases for which refractive errors are risk factors. Having timely, regular access to population level estimates of refractive error and vision impairment is necessary to adequately plan public health resources and resource appropriate interventions. A lack of access to current and regularly updated refractive error and vision impairment prevalence data has been identified as a significant limitation in predicting future population trends with many countries lacking any prevalence data or available data being outdated. This project addresses …

Understanding The Potential Of Plasma Activated Liquids For Biomedical Applications, Evanthia Tsoukou Jan 2021
