Legal education is changing. As law schools diversify their student bodies, they are being more intentional about the creation of an inclusive and equitable learning environment. Law schools also are engaging in curricular and pedagogical reform to better prepare students for law practice. Incorporating experiential learning into the law school curriculum has been a significant component of these reform efforts. The development of students’ professional identity also has become a focus of preparation for practice.

In the United States millions of people live with disabilities, many of whom require assistance with activities of daily life to remain in their homes and communities. However, financial support for this assistance is limited. Many caregivers forgo working outside the home in order to provide care to a family member. And while state and federal programs provide some compensation for caregiving, caregivers frequently face problems including poverty, lack of health insurance, lack of Social Security and Medicare credits, and lack of retirement savings. Our nation’s paltry support for caregiving threatens the practical ability of people with disabilities to choose …

A One-Session, Brief Acceptance And Commitment Therapy Workshop For Chronic Pain Patients: A One-Sample Pretest-Posttest Prospective Exploratory Study, Kelly Anne Thomas Ms
Graduate Theses, Dissertations, and Problem Reports (ETD)
Chronic pain affects one in every four persons (NIH, 2010). For individuals residing in rural communities where chronic pain treatment is often not accessible (Artnak et al., 2011), a one-session brief mental health intervention is a critical healthcare need. More specifically, acceptance and commitment therapy (ACT) for chronic pain is a novel treatment approach in need of more research (Society of Clinical Psychology, 2016). This current study contributes to the gap in the literature by implementing an ACT workshop in a rural healthcare setting for individuals with chronic pain. It was hypothesized that the workshop would increase adaptive coping mechanisms …
Sham Subpoenas And Prosecutorial Ethics, Ira Robbins
Sham Subpoenas And Prosecutorial Ethics, Ira Robbins
Scholarly Articles in Law Reviews & Journals
Prosecutors are given broad freedom to conduct their investigations through-out the grand jury process; their power is not without legal and ethical limits, however. For example, courts have discretion to quash subpoenas that have been issued without a proper purpose. Unlike law enforcement officials who may use deceptive tactics throughout an investigation, prosecutors are subject to professional rules of responsibility. All lawyers are subject to some variation of Rule 4.2 of the Model Rules of Professional Responsibility—the No-Contact Rule—which prohibits a lawyer from communicating with a represented individual. Prosecutors, however, have escaped the Rule’s reach by communicating with represented individuals …

For decades, the major United States airlines have raised passenger fares through coordinated fare-setting when their route networks overlap, according to the United States Department of Justice. Through its review of company documents and testimony, the Justice Department found that when major airlines have overlapping route networks, they respond to rivals’ price changes across multiple routes and thereby discourage competition from their rivals. A recent empirical study reached a similar conclusion: It found that fares have increased for this reason on more than 1000 routes nationwide and even that American and Delta, two airlines with substantial route overlaps, have come …

The Past, Present, And Future Of Investment Treaty Conflict Management And Dispute Systems Design, Susan Franck

ABSTRACT: International investment dispute resolution is in an era of unprecedented flux. At first blush, it might appear that major transforma- tions in international law are pulling in opposite directions. On the one hand, non-adjudicative dispute resolution and "alternative" dispute resolu- tion mechanisms like mediation are gaining traction, and with the creation of a Convention on the Enforcement of Mediated Settlement, it might ap- pear to reign supreme. On the other hand, traditional rule of law mecha- nisms, namely international courts, seem to be gaining momentum with the strong advocacy of the European Union for the creation of an …

That probably seems like a bizarre Craigslist ad. It’s not real—we mocked it up for this article. Still, and startlingly, it accurately portrays what’s happening in the Waco Division of the U.S. District Court for the Western District of Texas. One judge, appointed to the Western District only three years ago, has been advertising his courtroom through presentations to patent lawyers, comments to the media, procedural practices, and decisions in patent cases as the place to file a patent infringement lawsuit. That advertising has succeeded. In 2016 and 2017, the Waco Division received a total of five patent cases. In …
Marijuana Taxation: Theory And Practice, Benjamin Leff
Marijuana Taxation: Theory And Practice, Benjamin Leff
Scholarly Articles in Law Reviews & Journals
Marijuana legalization creates a host of complex legal problems, not the least of which is how to best tax the emerging legal market. This Essay attempts to bridge the gap between tax theory and marijuana policy to make some modest claims. First, it roots the discussion of state-level marijuana taxation in the theoretical distinction between ordinary revenue-raising taxes and "Pigouvian" or regulatory taxes. It makes the somewhat controversial claim that the best taxing strategy for states is to attempt to capture as much of the marijuana legalization premium as possible without driving consumers into the illegal market and that other …

The Euclid Proviso, Ezra Rosser
Scholarly Articles in Law Reviews & Journals
This Article argues that the Euclid Proviso, which allows regional concerns to trump local zoning when required by the general welfare, should play a larger role in zoning's second century. Traditional zoning operates to severely limit the construction of additional housing. This locks in the advantages of homeowners but at tremendous cost, primarily in the form of unaffordable housing, to those who would like to join the community. State preemption of local zoning defies traditional categorization; it is at once both radically destabilizing and market-responsive. But, given the ways in which zoning is a foundational part of the racial and …

Compassionate relief matters. It matters so that courts may account for tragically unforeseeable events, as when an illness or disability renders proper care impossible while a defendant remains incarcerated, or when family tragedy leaves an inmate the sole caretaker for an incapacitated partner or minor children. It matters too, as present circumstances make clear, when public-health calamities threaten inmates with literal death sentences. It matters even when no crisis looms, but simply when continued incarceration would be "greater than necessary" to achieve the ends of justice.

Surveillance And The Tyrant Test, Andrew Guthrie Ferguson
Scholarly Articles in Law Reviews & Journals
How should society respond to police surveillance technologies? This question has been at the center of national debates around facial recog- nition, predictive policing, and digital tracking technologies. It is a debate that has divided activists, law enforcement officials, and academ- ics and will be a central question for years to come as police surveillance technology grows in scale and scope. Do you trust police to use the tech- nology without regulation? Do you ban surveillance technology as a manifestation of discriminatory carceral power that cannot be reformed? Can you regulate police surveillance with a combination of technocratic rules, policies, …

What has come to be known worldwide as the Italian model to fight COVID-19 was a series of governmental measures undertaken in early 2020 to reduce the contagion of a deadly virus ravaging the northern regions of Italy—especially Lombardy, Veneto, and Piedmont. These measures included quarantine or lockdown throughout the Italian territory, together with the revamping of hospitals, followed by economic recovery packages to address the standstill of the national economy. This Article focuses on the strengths and weaknesses of the Italian model. By highlighting the initial missteps, we can understand how this turned into a productive national and regional …
