Programmed To Protect And Serve: The Dawn Of Drones And Robots In Law Enforcement, Nanci K. Carr

No longer does the field of law enforcement rely solely on human cognition and capability as drones have become first responders, responding to emergency calls with a drone rather than a human officer. Drone technology can transform police work, just as it has package delivery and military strategy. These drone officers allow for higher law enforcement efficiency, safer communities, and even saved lives. However, they also raise civil liberty concerns given that the drones have the power to track vehicles and people without consent, and they can collect and store video records of everyday life, reducing expectations of privacy. Transportation Security Officers (TSOs) are the Transportation Security Administration’s first line of defense against terrorism in U.S. airways. The American flying public puts their safety, and their luggage, in the hands of these officers, who execute searches that range from metal detectors to physical pat-downs. Since the federal government has mandated searches and screening for airport security, passengers should be able to seek recovery from the federal government where a TSO commits certain intentional torts in the course of duty. This Article examines whether states should impose civil liability not only on commercial alcohol vendors under dram shop statutes, but also on social hosts whose intoxicated guests subsequently cause injury or death to innocent third parties. Drawing upon national drunk-driving statistics, historical development of dram shop laws, and comparative analysis of state approaches—particularly in Southeastern jurisdictions—the Article evaluates the effectiveness and limitations of existing liability frameworks. While most states recognize statutory liability for commercial establishments that serve visibly intoxicated persons or minors, many decline to extend comparable liability to social hosts serving adult guests. สารนิพนธ์ฉบับนี้มุ่งศึกษา ความท้าทายของประเทศไทยในการบังคับใช้กติการะหว่างประเทศว่าด้วยสิทธิพลเมือง และสิทธิทางการเมือง ข้อที่21 (ICCPR) ต่อเหตุการณ์ชุมนุม ในสมัยรัฐบาลพลเอก ประยุทธ์ จันทร์โอชา พ.ศ.2562-2564 โดยมีวัตถุประสงค์เพื่อศึกษาถึงการบังคับใช้กฎหมายที่เกินกว่าความจำเป็นจากเหตุการณ์การชุมนุมในห้วงเวลานี้ และมุ่งเน้นถึงความสำคัญของหลักสิทธิมนุษยชน และเสรีภาพต่อการแสดงออกทางการเมืองของประชาชน เพื่อให้เข้าใจถึงปัญหาและอุปสรรค อันเป็นความท้าทายของประเทศไทยในการปรับใช้กติการะหว่างประเทศ ว่าเพราะเหตุใดถึงไม่สามารถบังคับใช้กับประเทศไทยได้โดยสมบูรณ์ ต่อการเกิดขึ้นของสถานการณ์ความรุนแรงของผู้บังคับใช้กฎหมายที่ลิดรอนเสรีภาพ รวมถึงยังสร้างความเสียหายต่อทรัพย์สิน และชีวิตของประชาชนอย่างประจักษ์ นับเป็นการละเมิดสิทธิพลเมืองภายใต้กติการะหว่างประเทศ ดังนั้นผู้เขียนจึงนำแนวคิด ระบอบระหว่างประเทศเชิงซ้อน (International regime complex) มาศึกษาถึงปรากฎการณ์ดังกล่าว ซึ่งจากการศึกษาพบว่า กติการะหว่างประเทศว่าด้วยสิทธิพลเมืองและสิทธิทางการเมือง มิได้มีความสอดคล้องกับผลประโยชน์แห่งชาติของประเทศไทย เเละการไม่มีอำนาจศูนย์กลางในการบังคับใช้กฎหมายต่อผู้ละเมิด ส่งผลให้ประเทศไทยยังคงละเมิดกติกาดังกล่าวได้ ซึ่งการไม่ยึดโยงกับเจตนารมณ์ด้านสิทธิมนุษยชนอันเป็นจุดมุ่งหมายหลักของความร่วมมือระหว่างประเทศนี้ นับเป็นความท้าทายที่สำคัญของประเทศไทย

ในช่วงปี พ.ศ. 2562 - 2565 มีการชุมนุมเกิดขึ้นในประเทศไทย ทั้งในเขตกรุงเทพมหานคร และจังหวัดอื่น ๆ เป็นจำนวนมาก อีกทั้งยังมีการออกมาชุมนุมของกลุ่มเยาวชนที่เพิ่มสูงขึ้นรวมถึงเกิดสถานการณ์การแพร่ระบาดของโรคติดเชื้อไวรัสโคโรนา 2019 ด้วย งานวิจัยนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาแนวทางการบังคับใช้กฎหมายเกี่ยวกับการปฏิบัติของเจ้าหน้าที่ตำรวจในการควบคุมการชุมนุมสาธารณะในช่วงการแพร่ระบาดของโรคติดเชื้อไวรัสโคโรนา 2019 และ 2) เสนอแนวทางในการเพิ่มประสิทธิผลในการบังคับใช้กฎหมายในการควบคุมการชุมนุมสาธารณะในช่วงการแพร่ระบาดของโรคติดเชื้อไวรัสโคโรนา 2019 ผลการศึกษาพบว่า การบังคับใช้ พ.ร.บ.ชุมนุมสาธารณะ พ.ศ. 2558 และข้อกำหนดตามมาตรา 9 แห่ง พ.ร.ก.ฉุกเฉิน พ.ศ. 2548 ส่งผลให้เจ้าหน้าที่ตำรวจต้องใช้ดุลยพินิจของตนเองในการควบคุมการชุมนุมสาธารณะ และข้อกำหนดดังกล่าวยังตัดทอนกระบวนการต่าง ๆ เกี่ยวกับการชุมนุมโดยสงบและปราศจากอาวุธ นำไปสู่การควบคุมการชุมนุมสาธารณะในหลายพื้นที่ รวมถึงพื้นที่รับผิดชอบของสถานีตำรวจนครบาลดินแดง ซึ่งเป็นจุดสำคัญที่กลุ่มเยาวชนมักมาชุมนุมไม่เป็นไปตามหลักความสมดุลระหว่างความมั่นคงของรัฐ และความปลอดภัยของประชาชน นอกจากนี้ข้อกำหนดดังกล่าวยังทำให้เจ้าหน้าที่ตำรวจขาดกรอบอันเป็นขั้นตอนการปฏิบัติ และเสี่ยงต่อการถูกฟ้องดำเนินคดี ข้อเสนอแนะคือรัฐควรให้แนวทางการดำเนินงานที่ชัดเจนมากขึ้น เพื่อเลี่ยงการใช้ดุลยพินิจ ซึ่งเป็นอัตวิสัยส่วนบุคคลอันสามารถนำไปสู่ข้อโต้แย้งและผลทางกฎหมายอื่น ๆ ตามมา

การวิจัยนี้มีวัตถุประสงค์ 1) เพื่อศึกษาบทบาทของนิติบุคคลหมู่บ้านจัดสรรต่อการจัดบริการสาธารณะด้านการรักษาความปลอดภัยในหมู่บ้านจัดสรรด้านการรักษาความปลอดภัยในหมู่บ้านจัดสรร 2) เพื่อนำเสนอแนวทางการพัฒนาการจัดบริการสาธารณะด้านการรักษาความปลอดภัยของนิติบุคคลหมู่บ้านจัดสรร การวิจัยนี้ใช้ระเบียบวิธีการวิจัยเชิงคุณภาพ โดยวิเคราะห์ข้อมูลจากเอกสารที่เกี่ยวข้องและการสัมภาษณ์กลุ่มผู้มีส่วนได้ส่วนเสียในการจัดบริการสาธารณะด้านการรักษาความปลอดภัยภายในหมู่บ้านจัดสรร จำนวน 12 คน ผลการศึกษาพบว่า บทบาทของนิติบุคคลหมู่บ้านจัดสรรต่อการจัดบริการสาธารณะด้านการรักษาความปลอดภัย ประกอบด้วย การบริหารจัดการระบบรักษาความปลอดภัยภายในหมู่บ้านจัดสรร และการใช้จ่ายงบประมาณด้านการรักษาความปลอดภัย การบริหารจัดการระบบรักษาความปลอดภัยภายในหมู่บ้านจัดสรร ได้แก่ การกำหนดนโยบายและกฎเกณฑ์ด้านการรักษาความปลอดภัย และการว่าจ้างเจ้าหน้าที่รักษาความปลอดภัย ในขณะที่การใช้จ่ายงบประมาณด้านการรักษาความปลอดภัยเป็นไปอย่างมีประสิทธิภาพโดยยึดถือผลประโยชน์สูงสุดของสมาชิกนิติบุคคลหมู่บ้านจัดสรร และมีการเยียวยาผู้ได้รับผลกระทบจากการใช้จ่ายงบประมาณด้านการรักษาความปลอดภัย และกลุ่มผู้มีส่วนได้ส่วนเสียมีความพอใจต่อการใช้จ่ายงบประมาณด้านการรักษาความปลอดภัย ส่วนปัจจัยที่ส่งผลต่อการรักษาความปลอดภัย ได้แก่ งบประมาณด้านการรักษาความปลอดภัย การฝึกอบรมและพัฒนาทักษะของเจ้าหน้าที่รักษาความปลอดภัย และการนำเทคโนโลยีมาใช้ในการรักษาความปลอดภัย ข้อเสนอแนะ คือ ควรเปิดโอกาสให้สมาชิกนิติบุคคลหมู่บ้านจัดสรรมีส่วนร่วมในการกำหนดนโยบายด้านการรักษาความปลอดภัย

ข่าวปลอมบนสื่อสังคมออนไลน์ สามารถกระจายเนื้อหาออกสู่สาธารณะได้อย่างรวดเร็ว เพราะสื่อออนไลน์เป็นช่องทางหนึ่งที่ประชาชนสามารถเข้าถึงข้อมูลเพื่อแสดงความคิดเห็น และส่งต่อข้อมูลระหว่างกัน ด้วยเหตุนี้รัฐต่าง ๆ จึงเริ่มให้ความสำคัญกับการกำกับดูแลรวมถึงสร้างมาตรการทางกฎหมายเพื่อใช้ในการจัดการกับข่าวปลอม สำหรับประเทศไทยนั้น รัฐมีกฎหมายที่ใช้ในการจัดการกับข่าวปลอม แต่จากข้อเท็จจริง พบว่า การกำกับดูแลข่าวปลอมของประเทศไทยยังเป็นไปอย่างไม่มีประสิทธิภาพและเป็นการลิดรอนสิทธิและเสรีภาพในการแสดงออกของประชาชนเกินสมควร วิทยานิพนธ์ฉบับนี้จึงมุ่งศึกษาถึงปัญหาของมาตรการทางกฎหมายที่ใช้ในการจัดการกับข่าวปลอมบนสื่อออนไลน์ในปัจจุบัน รวมทั้งศึกษาขอบเขตของสิทธิเสรีภาพในการแสดงออก เพื่อวิเคราะห์ถึงสภาพปัญหาที่เกิดขึ้นและความจำเป็นในการมีกฎหมายต่อต้านข่าวปลอมในประเทศไทย จากการศึกษา พบว่า มาตรการทางกฎหมายที่ใช้ในการจัดการข่าวปลอมบนสื่อออนไลน์ มีปัญหาในเรื่อง ความไม่ชัดเจนของถ้อยคำตามตัวบทกฎหมาย องค์กรที่ใช้ในการตรวจสอบข่าวปลอม การตรวจสอบการดำเนินคดีข่าวปลอมและสภาพบังคับทางกฎหมายที่ใช้ในการจัดการข่าวปลอมซึ่งส่งผลเป็นการลิดรอนสิทธิและเสรีภาพในการแสดงออกของประชาชนเกินสมควร จึงได้ทำการวิเคราะห์ถึงการกำหนดนิยาม ความมีประสิทธิภาพขององค์กรที่ใช้ในการตรวจสอบและการตรวจสอบการดำเนินคดีข่าวปลอม รวมถึงสภาพบังคับทางกฎหมายที่เหมาะสม โดยคำนึงถึงขอบเขตของสิทธิและเสรีภาพในการแสดงออกเป็นสำคัญ ดังนั้น จึงได้เสนอแนวทางที่เหมาะสมในการจัดการกับข่าวปลอมในประเทศไทยว่า รัฐควรมีการกำหนดนิยามของข่าวปลอมให้มีความชัดเจนและควรต้องกำหนดสภาพบังคับทางกฎหมายในรูปแบบอื่นที่ลิดรอนสิทธิและเสรีภาพของประชาชนที่มีโทษน้อยกว่าสภาพบังคับทางอาญา รวมทั้งควรมีมาตรการทางนโยบายในการกำกับดูแลองค์กรที่ใช้ในการจัดการข่าวปลอมอย่างมีประสิทธิภาพ เพื่อให้ประชาชนมั่นใจว่าการใช้เสรีภาพในการแสดงออกของตน จะไม่ถูกจำกัดโดยรัฐโดยปราศจากความจำเป็นและไม่ได้สัดส่วน

วิทยานิพนธ์เล่มนี้มีวัตถุประสงค์เพื่อเสนอแนะแนวทางแก้ไข ปรับปรุงหลักเกณฑ์ในทางกฎหมายอาญากรณีที่แพทย์จำเป็นต้องเลือกรักษาชีวิตผู้ป่วย ผู้วิจัยมุ่งศึกษาแนวคิด ทฤษฎีที่เกี่ยวข้อง วิเคราะห์ปัญหาและผลในทางกฎหมายอาญา โดยเปรียบเทียบบทบัญญัติ แนวคิดและความเห็นของนักวิชาการของต่างประเทศ เพื่อให้ได้แนวทางในการปรับปรุงหลักเกณฑ์ในทางกฎหมายอาญาหรือกฎหมายที่เกี่ยวกับความรับผิดของแพทย์ในเรื่องความจำเป็นของแพทย์ในการเลือกรักษาผู้ป่วยที่ถูกต้องและเหมาะสม ท่ามกลางสถานการณ์ฉุกเฉินด้านสาธารณสุข บุคลากรทางการแพทย์ต้องเผชิญกับการตัดสินใจในการเลือกว่าผู้ป่วยคนใดจะได้รับการรักษาเพื่อให้ได้มีชีวิตอยู่รอดต่อไป การที่แพทย์ต้องเลือกรักษาชีวิตผู้ป่วยในภาวะวิกฤต ขณะที่ไม่มีกฎหมายรองรับอย่างชัดเจนนั้นอาจทำให้แพทย์มีความรับผิดในทางอาญา แม้ว่าแพทย์อาจอ้างได้ว่าเป็นการกระทำด้วยความจำเป็น ซึ่งเป็นเพียงเหตุยกเว้นโทษ หรือศาลอาจเห็นว่าเป็นกรณีเกินสมควรแก่เหตุ ไม่ได้สัดส่วนทำให้แพทย์ไม่ได้รับความคุ้มครองเท่าที่ควร ทั้งที่การที่ต้องกระทำเช่นนั้นเป็นผลโดยตรงจากปัจจัยภายนอกซึ่งอันไม่อาจหลีกเลี่ยงได้ ดังนั้นวิทยานิพนธ์เล่มนี้จึงเสนอแนะให้มีการยกเว้นความรับผิดในทางอาญาจากการกระทำดังกล่าว โดยกำหนดให้เป็นการกระทำด้วยความจำเป็นที่เป็นเหตุยกเว้นความผิดภายใต้เงื่อนไขว่าการเลือกรักษาต้องทำเฉพาะในสถานการณ์ฉุกเฉินทำให้มีผู้รอดชีวิตเพิ่มมากขึ้น ต้องเป็นไปตามลำดับที่กำหนดด้วยความเป็นธรรมโดยคำนึงถึงผู้ที่มีโอกาสรอดชีวิตสูงกว่า ต้องกระทำตามหลักเกณฑ์ทางการแพทย์ที่กำหนดไว้ และต้องไม่เป็นการกระทำโดยประมาท

The converging crises of COVID-19 and racist state violence in 2020 shifted public discourse about marginalization, public health, and racism in unprecedented ways. Nursing responded to the pandemic with heroic commitment and new politicization. But public engagement with systemic racism is forcing a reckoning in nursing. The profession has its own history of racism and of alliance with systems of state control with which to contend. In this article, we argue nursing must adopt an ethics of abolitionism to realize its goals for health and justice. This thesis explores American exceptionalism through the lens of American newspapers during the Revolutionary era. As American newspapers covered the revolutions in France, Haiti, and Latin America, unique narratives developed around controversial leaders like Thomas Paine, Toussaint Louverture, and Simón Bolívar. Although at first newspapers covered the events in France and Latin America with glee, their coverage gradually began to change over time, increasingly finding flaws large and small in revolutions other than their own—chaos and violence in France and Haiti, and failures in the realization of republicanism in Latin America. Associate’s degree completion has been billed as the quickest way to upskill the workforce and a ticket to the middle class (Carnevale et al., 2018; Gittell et al., 2017). Yet, over 35 million Americans have left college without a degree (Wheatle et al., 2017). Black and Hispanic students are more likely than White and Asian students to leave college before completing a degree (Shapiro et al., 2017). The use of threat assessment teams in schools is recommended as a violence prevention measure in K-12 public schools. The present study focused on the threat assessment process in the K-12 environment in Virginia and is the first to examine the association between threat assessment and school safety in tandem over time and the first to incorporate the views of K-12 threat assessment practitioners. Findings from this study demonstrate that while the number of threat assessments has increased overtime, threat assessment practitioners identified numerous concerns regarding threat assessment training, expressed doubts about fidelity to the recommended process, and revealed an …

Decades of research has established an unequivocal link between states of social connection and health status. Lack of social connection, whether construed as social isolation or loneliness, negatively influences health and is highly associated with cardiovascular disease, high blood pressure, fall risk, and premature death. Despite extensive research on social isolation and loneliness, evidence relative to the broader construct of social connection suffers. Few studies inform practice standards for community-based organizations. This study aimed to develop a multidimensional, continuous composite variable of social connection and use the composite variable to examine predictors with a socio-ecological lens.

As ecosystem engineers, beavers construct complex riparian and wetland habitats that benefit many other species, including endangered salmonids. Through their landscape alterations, beavers also promote increased groundwater recharge and provide refugia during wildfires and high flow events by impounding water and allowing it to spread across the landscape. Prior to the North American colonial fur trapping campaigns, there were between 60 and 400 million beavers in North America. By the beginning of the 20th century, beavers were extirpated from many parts of the continent, however through human efforts, their population has since rebounded to between 10 and 15 million. The …

Too many Black persons and other persons of color are dying at the hands of law enforcement, leading many to call for the defunding of police. These deaths were directly caused by excessive use of force by police officers, but were also driven by upstream and institutional factors that include structural racism, institutional bias, and a historic culture of racialized violence. Nigerian police are not trusted by the population they swore to protect because they often assault, manipulate, exploit, and humiliate citizens as a form of intimidation to achieve a personal gain, especially from those who are involved in illegal activities like prostitution. The purpose of this qualitative phenomenological study was to explore the experiences of Nigerian prostitutes and learn how they use adaptive coping strategies to cope with the stress of police victimization. The first chapter examines the effect of policing strategies on housing prices. Crime has been shown to negatively affect housing values. However, there is not much empirical evidence documenting the amenity value of how people are policed. Stop & Frisk was a particularly salient policing tactic employed in New York City until a judge ruled it to be unconstitutional. This chapter uses exogenous variation in Stop & Frisk behavior resulting from landmark events in a federal class action lawsuit as well as exposure to Operation Impact, a high intensity policing strategy, to explain variation in property sales. In response to the 2012 landmark federal Supreme Court decision, Miller v. This Article examines how increasingly ubiquitous data and information affect the role of “slack” in the law. Slack is the informal latitude to break the law without sanction. Pockets of slack exist for various reasons, including information imperfections, enforcement resource constraints, deliberate nonenforcement of problematic laws, politics, biases, and luck. Slack is important in allowing flexibility and forbearance in the legal system, but it also risks enabling selective and uneven enforcement. Increasingly available data is now upending slack, causing it to contract and exacerbating the risks of unfair enforcement.
