Responding To The Digital Health Revolution, James Stramm Nov 2021

Responding To The Digital Health Revolution, James Stramm

Richmond Journal of Law & Technology

This Article describes how dominant technology firms have revolutionized the healthcare industry in only a few years. Now, medical treatment and research are predicated on constant, decentralized data collection, prediction and personalization, and algorithmic judgments. The new digital health paradigm implicates issues of privacy, bias, autonomy, equity, and discrimination. Yet Big Tech has been quick to justify its new practices as an opportunity for better care, quicker discovery of cures, and ultimately, lives saved. Moreover, many medical practitioners welcome this healthcare revolution as a chance to deemphasize the importance of patient privacy and autonomy in American bioethics and prioritize the …

Pandora’S Box To Sex Offenders Or Gift To The Public? Reviewing Sex Conviction Record Check In Hong Kong, England And Wales, Tsz Yan Elizabeth Yau

SOC 605 Comparative Social Policy Research Project - Student Works

Qualitative research and literature review were conducted by interviewing two ex-sex offenders and a police officer in England for reviewing Sexual conviction record check(system) in Hong Kong, England and Wales. The major findings in the research showed the system might bring stress and labelling effect toward the ex-offenders. Many sex offenders might lack information about the system before discharge which might hinder their rehabilitation and reintegration to the society. Moreover, the protection of the system in Hong Kong could not cover some potential situations which might do harm to the victims. Five policy suggestions are made at the end of …

Communicating And Co-Producing Information With Stakeholders: Examples Of Participatory Mapping Approaches Related To Sea Level Rise Risks And Impacts, Pragati Rawat, Khairul A. Anua, Juita-Elena (Wie) Yusuf, Jon Derek Loftis, Ren-Neasha Blake

School of Public Service Faculty Publications

This chapter discusses practical approaches for using participatory mapping as a tool to visualize and communicate sea level rise (SLR) and climate change risks, to share information about the vulnerability to, and threats of, climate change, and to co-produce knowledge with stakeholders. The examples presented in this chapter are from demonstrated applications in communities in Virginia (USA) that involve participatory mapping and that utilize a web-Geographic Information System (GIS). The web-GIS is innovatively combined with other technologies and participatory processes to create low-cost high-tech approaches so that even people with little to no knowledge of GIS can interact with maps …

Frankson Musukwa (Suing On His Own Behalf And As Executive Director Of Zambia Deaf Youth And Women) & Others V. Road Transport And Safety Agency, Natasha Kapuka

SAIPAR Case Review

The facts giving rise to the Musukwa case emanate from the revolving debate on whether deaf people should be allowed to drive in the same way that able-bodied individuals have the liberty to. The Petitioners (all deaf) approached the Court seeking a ruling to the effect that S.62 of the Road Traffic Act, No. 11 of 2002 violate Articles 11(b), 22(1)(a) & 23(2) of the Constitution of Zambia. The Petitioners contended that the Respondent’s refusal to grant the 2nd Petitioner a driver’s license, and its decision to revoke the 3rd Petitioner’s license was a violation of their freedom of movement …

This Article serves as a review of recent juvenile justice law and legislative trends in Virginia. This Article will review both codified changes and relevant proposed legislation that did not pass the Legislature to more fully identify trends in juvenile justice. While this Article does not capture every proposed or codified change to Virginia juvenile justice law, it does identify and present the most significant changes and trends over the last two legislative sessions to the laws governing the entrance of youth into the criminal legal system, the treatment of Virginia’s youth directly involved in the criminal legal system, and …

Strictly Speaking, What Needs To Change? A Review Of How Statutory Changes Could Bring Strict Products Liability To Virginia, Ryan C. Fowle Nov 2021

Strictly Speaking, What Needs To Change? A Review Of How Statutory Changes Could Bring Strict Products Liability To Virginia, Ryan C. Fowle

University of Richmond Law Review

Virginia remains one of five states that refuse to adopt strict products liability. To date, the Supreme Court of Virginia has declined to follow the path Justice Traynor set out nearly a century ago, as its recent decisions confirm its resistance to strict liability. However, given the change in control of the General Assembly following the elections of 2017 and 2019, the General Assembly is in new hands and may remain that way for some time. This new legislative majority, among its plans for new policies, may soon consider establishing strict products liability by statute. In doing so, Virginia would …

Confrontation’S Multi-Analyst Problem, Paul F. Rothstein, Ronald J. Coleman Nov 2021

Confrontation’S Multi-Analyst Problem, Paul F. Rothstein, Ronald J. Coleman

Texas A&M Law Review

The Confrontation Clause in the Sixth Amendment affords the “accused” in “criminal prosecutions” the right “to be confronted with the witnesses against” them. A particular challenge for courts over at least the last decade-plus has been the degree to which the Confrontation Clause applies to forensic reports, such as those presenting the results of a DNA, toxicology, or other CSI-type analysis. Should use of forensic reports entitle criminal defendants to confront purportedly “objective” analysts from the lab producing the report? If so, which analyst or analysts? For forensic processes that require multiple analysts, should the prosecution be required to produce …

A Review Of Kentucky’S Extended-Weight Hauling Programs, P. Gayle Marks, Jon Wilcoxson, Bryan Gibson, Chris Van Dyke, Andrew Martin, Jennifer Walton, Doug Kreis

Kentucky Transportation Center Research Report

Kentucky established its Extended Weight Coal or Coal By-products Haul Road System (EWCHRS) to increase the state’s competitiveness within the coal industry and reduce financial burdens on coal haulers. A new extended-weight haul system for unrefined petroleum products will come online in 2022. To facilitate enforcement of weight limits throughout Kentucky, this report surveys literature on how overweight vehicles affect roads and bridges, describes statutes and regulations governing weight limits in the state, discusses policies and strategies used throughout the US to handle overweight vehicles, and makes recommendations for improving extended-weight policies in Kentucky. It is apparent that pavements and …

Towards A Calibrated Trust-Based Approach To The Use Of Facial Recognition Technology, Gary Kok Yew Chan Nov 2021

Towards A Calibrated Trust-Based Approach To The Use Of Facial Recognition Technology, Gary Kok Yew Chan

Research Collection Yong Pung How School Of Law

The use of facial recognition technology has given rise to much debate relating to issues concerning privacy infringements, bias and inaccuracies of data and outputs, possibilities of covert use, the lack of data security and the problem of function creep. Certain states and jurisdictions have called for bans and moratoria on the use of facial recognition technology. This paper argues that a blanket ban on facial recognition technology would be overly precautionary without fully considering the wide range of uses and benefits of the innovation. To promote its acceptance, trust in facial recognition technology should be developed in a calibrated …

Regulating Armed Private Militia Gatherings: A Constitutional State-Level Proposal To Promote Public Safety In A Post-Heller World, Sean Tenaglia

William & Mary Law Review

“Yesterday, in my view, was one of the darkest days in the history of our nation.” President Joseph R. Biden spoke these words following the January 6, 2021 riots at the U.S. Capitol Building that left five people, including a police officer, dead. The mob that stormed the Capitol sought to prevent Congress from certifying then-President-elect Biden’s Electoral College victory. In the weeks following the riot, investigators began arresting rioters associated with extremist right-wing militia groups, such as the Oath Keepers and Three Percenters. While January 6, 2021, can accurately be labeled a dark day in American history, the events …

Habeas Corpus Unbound, Sheila Wildeman Nov 2021

Habeas Corpus Unbound, Sheila Wildeman

Articles, Book Chapters, & Popular Press

Sites of incarceration present stress tests to our theories and practices of administrative law. They yield insights, too, into how law distributes power across the administrative state. While studying administrative law as prison law reveals certain distinctions between the law that rules in prisons and everyday administrative state operations, it also reveals continuities—for instance, between the surveillance and control characterizing prisons and the routine surveillance and control that police, child welfare, social assistance, mental health, and public health authorities concentrate upon Indigenous, Black, disabled, and poor people in ways that produce and reproduce subordination and disproportionate incarceration. We begin to …

Perceptions Of The Impact Of Cultural Awareness Training On Southern Municipalities And Their Communities, Charles Robert Love Ii Nov 2021

Perceptions Of The Impact Of Cultural Awareness Training On Southern Municipalities And Their Communities, Charles Robert Love Ii

Doctoral Dissertations and Projects

The overall purpose of this qualitative phenomenological study is to explore the perception of the impact of Cultural Awareness Training toward improving the negative relationship that exists between southern municipalities and their communities, especially those individuals who are culturally different from the given officer(s). In many cases, these relationships involve abuse of power which leads to mutual disrespect and a subsequently diminished relationship. A review of the literature on community-oriented policing provided vivid descriptions with clear examples regarding what is identified as relationship-based policing. Relationship-based policing seeks to get not only the community’s input, but also community involvement in establishing …

Certificates Of Confidentiality: Mind The Gap, Leslie E. Wolf, Laura M. Beskow Nov 2021

Certificates Of Confidentiality: Mind The Gap, Leslie E. Wolf, Laura M. Beskow

Utah Law Review

Certificates of Confidentiality (“Certificates”) are a federal mechanism designed to protect sensitive, identifiable research data from compelled disclosure in any legal proceeding. The 21st Century Cures Act revised the authorizing statute to address criticisms raised about the Certificates’ coverage and protections. Despite many changes that expanded the scope and reinforced the protection of Certificates, questions remain concerning the robustness of the protection Certificates afford. Here, we briefly review the legal evolution of Certificates and then examine the gaps in protections that remain and their implications. We conclude with recommendations for areas of clarification and future research.

Policy Analysis Of The Illinois Nurse Practice Act (Aprn Title Section 65/65-50), Sara Kim Nov 2021

Policy Analysis Of The Illinois Nurse Practice Act (Aprn Title Section 65/65-50), Sara Kim

Doctor of Nursing Practice Projects

Background

Physician groups claim allowing nurses to use the title "doctor" confuses patients. Nurses assert that the title is common to many disciplines, and nurses should be trusted like other professionals to identify their specialty to patients. Currently, qualified nurses in Illinois using the title "doctor" in clinical areas must introduce themselves to each patient in the following way: "Hi, I'm Dr. Smith, the nurse practitioner taking care of you today. I do not have a degree in medicine, and I am not a physician or medical doctor” (225 ILCS § 65/65-50).

Purpose

This project aimed to evaluate Illinois Nurse …

The Experiences Of Ethical Tensions When Using Harm Reduction With High-Risk Youth, Patricia I. Owens, Simon Nuttgens Nov 2021

The Experiences Of Ethical Tensions When Using Harm Reduction With High-Risk Youth, Patricia I. Owens, Simon Nuttgens

The Qualitative Report

Little is known about the ethical experiences of psychologists who work with high-risk youth using a harm reduction approach. We used interpretative phenomenological analysis (IPA) to explicitly explore this phenomenon. In this small exploratory study three participants were interviewed to glean their experiences of ethical tension. Data analysis revealed three superordinate themes (questioning, acting, and holding) within which eight subthemes are subsumed (questioning beneficence, questions from others, self-care, social change, negotiation, consultation and supervision, acceptance, and sitting with tension). The results of this research suggest that context-specific ethical tensions may arise for psychologists who work with high-risk youth using a …

Material Characterization For Microwave Absorbing And Shielding Applications, Muhammed Shafeeque Kallumottakkal Nov 2021

Material Characterization For Microwave Absorbing And Shielding Applications, Muhammed Shafeeque Kallumottakkal

Theses

The rapid advancement and widespread of microwave and RF-communication systems have contributed to an abundant rise in electromagnetic energy radiation in our living environment. Such an increase in microwave sources is due to the development and advancement in communication techniques (mobile phones, laptops, and antennas for aeronautics or automobile) and electronic warfare in the military field (radar and satellite). To address these concerns, EM absorbing materials are used to ensure public safety and the safety of military operations. Various types of EM absorbing materials made up of composite materials have been produced and studied. This thesis discusses the microwave properties …

Silica Hydride: A Separation Material Every Analyst Should Know About, Joseph J. Pesek, Maria T. Matyska

Faculty Research, Scholarly, and Creative Activity

This review describes the development, special features and applications of silica hydridebased stationary phases for HPLC. The unique surface of this material is in contrast to ordinary, standard silica, which is the material most frequently used in modern HPLC stationary phases. The standard silica surface contains mainly silanol (Si-OH) groups, while the silica hydride surface is instead composed of silicon-hydrogen groups, which is much more stable, less reactive and delivers different chromatographic and chemical characteristics. Other aspects of this material are described for each of the different bonded moieties available commercially. Some applications for each of these column types are …

The Impact Of Master's Level Status On Athletic Training Programs' Planning And Implementation Of Interprofessional Education Curricula: A Causal-Comparative, Predictive, Correlational Study, Zachary Ryan Hobson

Doctoral Dissertations and Projects

The purpose of this study was to determine if a significant difference in the extent of interprofessional education (IPE) implementation exists between recently-transitioned and established Master of Athletic Training (MAT) programs, as well as if a significant difference in the extent of IPE implementation exists between MAT programs’ didactic curriculum and clinical education. Additionally, this study evaluated if the number of years a program has been at the MAT status is predictive of successful IPE implementation. The researcher used the 10-item form of the Interprofessional Education Assessment and Planning Instrument for Academic Institutions to collect data on IPE implementation from …

A Room With A View: Experiences Of Moms Off Meth Using Heuristic Inquiry, Joey Leigh Gude Nov 2021

A Room With A View: Experiences Of Moms Off Meth Using Heuristic Inquiry, Joey Leigh Gude

Doctoral Dissertations and Projects

Methamphetamine related consequences continue to darken many families and communities. Multiple service provider types are often overburdened in dealing with the reality of methamphetamine misuse (Brownstein et al., 2012). This research explored the impact of the methamphetamine epidemic with a specific focus on mothers with methamphetamine addiction. Mothers present with a myriad of challenges, and inadequate contextual information exists to address these challenges (Alexander et al., 2018; Bathish et al., 2017; Cunningham & Finlay, 2013). This qualitative heuristic inquiry sought to illuminate experiences of methamphetamine addiction in mothers. The qualitative research questions sought to give a voice to the lived …
