Closing The Health Justice Gap: Access To Justice In Furtherance Of Health Equity, Yael Cannon
Closing The Health Justice Gap: Access To Justice In Furtherance Of Health Equity, Yael Cannon
Georgetown Law Faculty Publications and Other Works
A massive civil “justice gap” plagues the United States. Every day, low-income Americans—and disproportionately people of color—go without the legal information and representation they need to enforce their rights. This can cost them their homes, jobs, food security, or children. But unmet civil legal needs in housing, employment, and public benefits, for example, are not simply injustices—they are well-documented drivers of poor health, or social determinants of health. Those marginalized by virtue of both race and socioeconomic status are particularly harmed by inaccessibility to justice and also by chronic health conditions and lower life expectancy. When a tenant walks into …

Does Start-Up Ny Promote Firm Formation?, Woosung Kim
NAKHARA (Journal of Environmental Design and Planning)
This paper explores the impact of START-UP NY policy throughout simulations by using the agent-based model. In 2013, Governor Cuomo introduced the policy START-UP NY (New York), designed to create more jobs by helping people start or move their qualified businesses into tax-free zones. Measuring the impact of START-UP NY, however, is difficult because the data are not yet available for causal inference purposes. The agent-based model developed for this paper is designed to simulate the impact of START-UP NY on the local economy of Tompkins County by conducting the Cobb-Douglas function into the model using the data from the …

Remote Pilot Situational Awareness With Augmented Reality Glasses: An Observational Field Study, Jeffery Coleman, David Thirtyacre
Remote Pilot Situational Awareness With Augmented Reality Glasses: An Observational Field Study, Jeffery Coleman, David Thirtyacre
International Journal of Aviation, Aeronautics, and Aerospace
With the use of small unmanned aerial systems (sUAS) proliferating throughout industry and public safety, it is imperative to ensure safety of flight. The Federal Aviation Administration (FAA) published regulations for commercial use of sUAS in 2016 and included the requirement to maintain visual line-of-sight with the aircraft at all times. However, due to the nature of the sUAS ground control stations (GCS), remote pilots time-share between observing the aircraft and interacting with the display on the GCS. Time-sharing between the aircraft and GCS can be seen as similar to the cross-check a pilot uses when flying a manned aircraft. …

Law Of The Gun: Unrepresentative Cases And Distorted Doctrine, Eric Ruben
Law Of The Gun: Unrepresentative Cases And Distorted Doctrine, Eric Ruben
Faculty Journal Articles and Book Chapters
There is a familiar saying, “If all you have is a hammer, everything looks like a nail.” The so-called Law of the Hammer takes a distinctive form in adjudication. If all judges see is one repeating fact pattern for a given area of law, they might perceive it as archetypical and build the law around it. If that fact pattern does not accurately reflect the field, however, the result can be analytical distortion in terms of both the choice of doctrine and its implementation.
This Article uses Second Amendment jurisprudence to illustrate this phenomenon. It reveals how District of Columbia …
Covid-19: Legal Framework For Vaccine Distributions And Mandates, Dana B. Taschner, Ashley Atwood
Covid-19: Legal Framework For Vaccine Distributions And Mandates, Dana B. Taschner, Ashley Atwood
SMU Science and Technology Law Review
The COVID-19 pandemic has created heightened turmoil for at-risk populations, solidified laws allowing the use of mask mandates, raised legal issues surrounding vaccine mandates, and presented the new issue of a vaccine passport. As a nation, we have failed to implement vaccination schemes that properly protect vulnerable populations. Specifically, the homeless population has been overlooked, creating an additional layer of hardship, and contributing to greater community spread. This article contemplates the various methods by which an equitable vaccination scheme could have been achieved and the division of powers that created complications.
Additionally, the legality of vaccine mandates is discussed, and …
The Communitarian Deficit In The Usa: Three Telling Cases, Amitai Etzioni
The Communitarian Deficit In The Usa: Three Telling Cases, Amitai Etzioni
SMU Science and Technology Law Review
Liberal communitarianism suggests that the balance between individual rights and the common good must be adjusted as historical conditions change. Much attention has been paid to violations of rights, e.g., by the police, for good reasons. This Article examines three new technologies that undermine public safety, a key common good, and asks whether they should be banned. The 2020 pandemic revealed that scores of millions of Americans objected, not merely to government mandates to take measures that are likely to spare fellow Americans a severe disease or death, but even to respond to moral calls, especially wearing a mask. This …
