The Prison Litigation Reform Act And The Physical Injury Requirement In The Context Of Transgender Inmates, Hunter Kravitz

Cardozo International & Comparative Law Review

The note examines the impact of the Prison Litigation Reform Act (PLRA) on transgender inmates, focusing on its physical injury requirement, which disproportionately bars access to justice for those with mental or emotional injuries. It highlights the ethical and constitutional concerns arising from the PLRA's application, particularly its unequal treatment of transgender inmates, and advocates for reforms to ensure equitable access to justice.

Readiness Of The Administrative Team To Respond To An Active Shooter On A Campus, Erin K. Newberry Apr 2021

Readiness Of The Administrative Team To Respond To An Active Shooter On A Campus, Erin K. Newberry

Doctor of Education (Ed.D)

Philanthropic efforts and community responses to mass school shootings have generated an evolutionary change to the legislation surrounding school safety. An in-depth review of major school-related active-shooter incidents indicated a prioritized need for change across school campuses. Recent laws in the state of Florida created the eminent responsibility of site-based administrative teams in collaboration with the local sheriff’s office, to effectively implement and participate in synergistic crisis planning. While school safety has been at the pinnacle of community leaders’ political platforms for over 20 years, researchers have almost exclusively concentrated on identifying the role of the School Resource Officer (SRO) …

Changing The Way We See Modern Policing: Abolition Or Reform, Kathryn Miller, Marbré Stahly-Butts, Mecole Jordan-Mcbride, Kate Levine, Benjamin Tucker, Kumar Rao

Cardozo Journal of Equal Rights & Social Justice

The symposium examines the historical and systemic roots of mass incarceration in the United States, tracing its origins to the 13th Amendment, Black Codes, convict leasing, and the war on drugs. It critiques the prison industrial complex as a system of oppression rooted in racism, capitalism, and heteropatriarchy, and advocates for transformative reforms to dismantle policing and incarceration. The analysis emphasizes the need to move beyond superficial reforms and instead adopt abolitionist approaches that address the root causes of systemic violence and inequality.

Why So Long? Examining The Nexus Between Case Complexity And Delay In Florida’S Death Penalty System, Corey Daniel Burton Apr 2021

Why So Long? Examining The Nexus Between Case Complexity And Delay In Florida’S Death Penalty System, Corey Daniel Burton

Theses and Dissertations

Over the last few decades, there has been greater recognition that increased time on death row is a significant problem in the United States that is getting worse. Beginning with the U.S. Supreme Court’s denial of certiorari in Lackey v. Texas (514 U.S. 1045, 1995), numerous defendants have attempted to assert Eighth Amendment claims of cruel and unusual punishment on the grounds that the length of their death row confinement combined with their subsequent execution is unconstitutional. Although such claims have been unsuccessful in the U.S. Supreme Court, other federal courts have examined the issue. In 2014, the Central District …

Protecting The Children Of Indian Country: A Call To Expand Tribal Court Jurisdiction And Devote More Funding To Indian Child Safety, Adam Crepelle Apr 2021

Protecting The Children Of Indian Country: A Call To Expand Tribal Court Jurisdiction And Devote More Funding To Indian Child Safety, Adam Crepelle

Cardozo Journal of Equal Rights & Social Justice

The article argues that the legal framework governing Indian country, particularly the Supreme Court's decision in *Oliphant v. Suquamish Indian Tribe*, has failed to protect Indian women and children from violence, perpetuating a crisis of sexual assault, child abuse, and murder. It contends that affirming tribal sovereignty and expanding tribal jurisdiction over non-Indians are essential to addressing these issues and ensuring the safety and well-being of Indian children.

Racial Equality And Inequality In America And Lessons From Other Countries, William Y. Chin Apr 2021

Racial Equality And Inequality In America And Lessons From Other Countries, William Y. Chin

Cardozo Journal of Equal Rights & Social Justice

America, a mighty global hegemon supreme in military matters, regards itself as second to none, and where it leads, it expects other countries to follow. But on matters of race, America could follow the examples of countries that have taken the lead in experimenting with racial equality efforts and initiatives. From Brazil's "redemption through reading" prison program to the High Court of Australia's return of land to indigenous inhabitants, much could be learned from the lessons of other countries. That there is still much to learn about racial equality is evident from the police killing of George Floyd, a Black …

Cardozo Journal of Equal Rights & Social Justice

The note argues that criminalizing runaway youth through the use of arrest warrants and court involvement is harmful and counterproductive. It advocates for a shift in approach, emphasizing the need to prioritize the voices and well-being of runaway youth, eliminate punitive measures, and provide supportive services to address the root causes of their behavior.

Cybersecurity Legislation And Ransomware Attacks In The United States, 2015-2019, Joseph Skertic

Graduate Program in International Studies Theses & Dissertations

Ransomware has rapidly emerged as a cyber threat which costs the global economy billions of dollars a year. Since 2015, ransomware criminals have increasingly targeted state and local government institutions. These institutions provide critical infrastructure – e.g., emergency services, water, and tax collection – yet they often operate using outdated technology due to limited budgets. This vulnerability makes state and local institutions prime targets for ransomware attacks. Many states have begun to realize the growing threat from ransomware and other cyber threats and have responded through legislative action. When and how is this legislation effective in preventing ransomware attacks? This …

Public Health And History: Vaccination Regulation In The Northeastern States, Kate Campbell

Student Research

In 1905 Henning Jacobson went before the United States Supreme Court in Jacobson v. Massachusetts and argued that his constitutional right to liberty was infringed upon when compulsory vaccination laws were introduced. When mandatory vaccination laws were introduced in Cambridge, Massachusetts there was another deadly smallpox epidemic racing through the northeastern states. Government officials believed that the best way to control the disease and ultimately stop the spread was through government intervention. The Supreme Court ultimately ruled that as a citizen of the United States it is often times necessary to give up some forms of liberty in order to …

How To Look Like A Lawyer, Ann Juliano Apr 2021

How To Look Like A Lawyer, Ann Juliano

Faculty Publications

Law schools often claim that they are teaching students “how to think like a lawyer.” What is less touted, however, is that students are learning how to look like a lawyer. They receive this message from multiple sources (faculty, alumni, peers, the career office) concerning a variety of situations: class, interviews, moot court, trial team, symposia and conferences. For law students who are first generation, these sources may be the only avenue (apart from the entertainment industry) of determining how to look like a lawyer. For law students who are transgender or gender non-binary, dress code advice dispensed along men/women …

Novel Method For Probabilistic Evaluation Of The Post-Earthquake Functionality Of A Bridge, Vesna Terzic, William Pasco Apr 2021

Novel Method For Probabilistic Evaluation Of The Post-Earthquake Functionality Of A Bridge, Vesna Terzic, William Pasco

Mineta Transportation Institute

While modern overpass bridges are safe against collapse, their functionality will likely be compromised in case of design-level or beyond design-level earthquake, which may generate excessive residual displacements of the bridge deck. Presently, there is no validated, quantitative approach for estimating the operational level of the bridge after an earthquake due to the difficulty of accurately simulating residual displacements. This research develops a novel method for probabilistic evaluation of the post-earthquake functionality state of the bridge; the approach is founded on an explicit evaluation of bridge residual displacements and associated traffic capacity by considering realistic traffic load scenarios.

This research …

Re-Spatializing Gangs In The United States: An Analysis Of Macro- And Micro-Level Network Structures, Ryan J. Roberts Apr 2021

Re-Spatializing Gangs In The United States: An Analysis Of Macro- And Micro-Level Network Structures, Ryan J. Roberts

Graduate Program in International Studies Theses & Dissertations

Despite the significant contributions from location-based gang studies, the network structure of gangs beyond localized settings remains a neglected but important area of research to better understand the national security implications of gang interconnectivity. The purpose of this dissertation is to examine the network structure of gangs at the macro- and micro-level using social network analysis. At the macro-level, some gangs have formed national alliances in perpetuity with their goals and objectives. In order to study gangs at the macro-level, this research uses open-source data to construct an adjacency matrix of gang alliances and rivalries to map the relationships between …

It's All About Pasta: Protectionism, Liberalization, And The Challenge For Quality And Sustainability Of Made In Italy, Fernanda Giorgia Nicola Dr., Gino Scaccia

Scholarly Articles in Law Reviews & Journals

This article traces the evolution of the regulation of Italian pasta from the beginning of the twentieth century until today. We show how during Fascism the production of wheat became a national battle, and pasta turned out to be the traditional product promoted by Mussolini's propaganda. During the 1960s, new regulations of Italian pasta made exclusively with durum wheat contributed to strengthening the Italian industry during the nation's economic boom. Spaghetti became a global symbol of the Dolce Vita, linking Italian pasta to a fashionable and aesthetically desirable way of life. The Italian Parliament adopted a law that obligated the …

Advertising To Children And The Long-Term Effects Of Obesity On Health Equity, Joirdon Karl Nicholas Apr 2021

Advertising To Children And The Long-Term Effects Of Obesity On Health Equity, Joirdon Karl Nicholas

Honor’s College Freeman Research Journal

America spends more money on health than people anywhere else in the world and ranks 11th in the world of developed nations in terms of performance. Americans live shorter less healthier lives and the trends are not improving especially in minority communities. In my research, Americans are focused on the wrong things when they think about health. Health is not defined by seeing a physician or taking medicines. Health should be defined as life circumstances, from the cultures we come from, and the neighborhoods we live in. Advertising to children that leads to obesity has generational impact especially in minority …

The purpose of this quantitative descriptive study was to examine the churches serving North Carolina in a rural, suburban, and inner-city setting to determine if there is any correlation in leadership's perception …

Teachers' Perspectives Of Restorative Disciplinary Practices, Asma Anwar Apr 2021

Teachers' Perspectives Of Restorative Disciplinary Practices, Asma Anwar

Electronic Theses and Dissertations

In this phenomenological qualitative study, the perceptions of middle school teachers regarding the implementation of restorative practices with their students with disabilities were examined. Exclusionary suspensions have been overwhelmingly employed to handle student discipline, and students with disabilities experience these harsh punishments at higher rates than their general education peers. However, an increasing number of school districts have started to utilize alternative therapeutic methods, such as restorative practices, to handle conflict and build relationships. The researcher’s goal was to understand better the lived experiences of teachers when implementing these practices and understand the challenges they faced while building connections with …

Public Safety Agencies And Uav Technology: A Review Of Uses, Lacey L. Weynand Apr 2021

Public Safety Agencies And Uav Technology: A Review Of Uses, Lacey L. Weynand

Student Publications

This study utilizes a systematic review of some of the scholarly literature available on drone usage within Southern California, specifically in Los Angeles and Chula Vista. I ask: how do public safety agencies use drone technology? The review will cover cases from existing scholarly literature, as well as policy reports and books from the Google Scholar database. A systematic review was the best methodology to begin fully investigating my research question, since the scope could have been so large that individual data points would have been difficult to find and instead requires a macro-level review. This data will provide a …

No Rest For The Weary: A Survey Of Virginia's 2020 General Assembly Regular And Special Sessions, Samantha R. Galina

Richmond Public Interest Law Review

This has been possibly the most historic year in the Virginia General Assembly in decades. During the regular session alone, 3,857 bills were introduced, spanning thousands of pages covering topics as vast as criminal justice reform to election laws to natural resource protection.1 As if that wasn’t enough, the General Assembly reconvened for a Special Session in August to address the COVID-19 pandemic, related budgetary changes, and a myriad of police conduct-related bills in response to the killing of George Floyd and the national Black Lives Matter movement. This article will provide a summary of some of the major bills …
