Nationalism, Populism, Religion, And The Quest To Reframe Fundamental Rights, Susanna Mancini, Michel Rosenfeld May 2021

Nationalism, Populism, Religion, And The Quest To Reframe Fundamental Rights, Susanna Mancini, Michel Rosenfeld

Cardozo Law Review

The article examines how nationalism and populism have increasingly utilized religion to challenge the principles of institutional secularism, which is foundational to liberal constitutional democracies. It argues that these forces exploit the interplay between religion and secularism to undermine pluralism and promote exclusionary agendas. The analysis highlights the tension between institutional secularism, which seeks to separate state and religion, and the contemporary repoliticization of religion, which threatens the pluralistic ethos essential to liberal constitutionalism.

Positive Rhetoric, Prejudiced Policy: The Contradiction Of Islamophobia In American Government After 9-11., Molly Bilz

College of Arts & Sciences Senior Theses

Following the tragic terrorist attacks on September 11, 2001, local and national leaders responded to the security crisis by uniting the country under the American ideals of freedom and democracy while condemning the Islamic terrorist group responsible. With beliefs rooted in historical American and European prejudice, Western scholarship promoted a “clash of civilizations” between Islam and the West wherein the cultures’ supposed irreconcilable differences would inevitably lead to warfare. Simultaneously, many Americans grew suspicious of Muslims after the attacks, including government officials. As hate crimes against Muslim and Middle Eastern Americans soared in the U.S., government leaders used positive rhetoric …

Exploring The Role Of Adverse Childhood Experiences (Aces) Among Gendered Racial/Ethnic Groups Of Justice-Involved Youth, Linsey A. Belisle

UNLV Theses, Dissertations, Professional Papers, and Capstones

Justice-involved youth are exposed to adverse childhood experiences (ACEs) at higher rates than youth in the general public, highlighting the importance of addressing childhood trauma and adversity in juvenile justice settings. A majority of ACEs research has focused on the general population and has demonstrated the long lasting negative impact of ACEs, on mental health, physical health, and engagement in health risk behaviors. Both gender and racial/ethnic differences have been identified in ACEs literature, suggesting that not all groups in society have the same likelihood of experiencing ACEs. Additionally, ACEs may also impact individuals from racial/ethnic or gender groups differently, …

Disbanding Police Agencies, Anthony O'Rourke, Rick Su, Guyora Binder May 2021

Disbanding Police Agencies, Anthony O'Rourke, Rick Su, Guyora Binder

Journal Articles

Since the killing of George Floyd, a national consensus has emerged that reforms are needed to prevent discriminatory and violent policing. Calls to defund and abolish the police have provoked pushback, but several cities are considering disbanding or reducing their police forces. This Essay assesses disbanding as a reform strategy from a democratic and institutionalist perspective. Should localities disband their police forces? One reason to do so is that discriminatory police departments are often too insulated from democratic oversight to be reformed. But can localities succeed in disbanding and replacing their forces with something better? Unfortunately, the structural entrenchment of …

San Antonio, Listen Up: Utilizing Collective Intelligence To Inform Local Public Policy, Carson Autri Bolding

Communication Honors Theses

Oftentimes, city residents, those most impacted by policy, are excluded from the policy-making process. Collective intelligence provides a theoretical framework that policy-makers can use to better incorporate residents’ voices into the policy-making process and to generate innovative policy solutions to address local issues. In this context, collective intelligence is the idea that when people from different backgrounds work together, they have the capacity to build something bigger and better. This project aims to showcase the potential of using collective intelligence in the policy-making process through a hypothetical case study of how it can be used to address the housing affordability …

Rules And Standards In Justice Scalia's Fourth Amendment, Robert M. Bloom, Eliza S. Walker May 2021

Rules And Standards In Justice Scalia's Fourth Amendment, Robert M. Bloom, Eliza S. Walker

University of Richmond Law Review

When looking at Justice Scalia’s approach to the Fourth Amendment, most would say he was an originalist and a textualist. Justice Scalia himself would like to explain, “I’m an originalist and a textualist, not a nut.” Although originalism and textualism were often prevalent in his Fourth Amendment decisions, even more important to his decision-making was his disdain for judicial activism. To limit judicial discretion, Justice Scalia frequently opted to impose bright-line rules rather than vague standards. This is apparent not only within his jurisprudence as a whole, but also specifically in his Fourth Amendment decisions.

This Article examines Justice Scalia’s …

Drones And Data: A Limited Impact On Privacy, David Sella-Villa

University of Richmond Law Review

These discussions of drones and privacy have left the antecedent question unexamined—precisely how do drones impact privacy? This Article is the first to clearly define the operational parameters of drones that impact privacy in a unique way. From this precise definition, we learn that drones operate in very few spaces that allow them to capture data inaccessible to other technologies. In short, how drones operate has a limited impact …

Central Appalachia Severance Taxation And Policies For Future Economic Growth, Nathan Frisbie

Honors Theses

Central Appalachia is a region in the United States that has been referred to as a paradox by researchers who have studied it. The area is rich with natural resources, yet the region lacks economic development. The mineral extraction industry has been the center of the economy for over a hundred years. The reliance on the industry has caused Central Appalachia to fall behind in several categories. The region has unusually high concentrations of poverty and low high school graduation rates. The revenue from the taxation of coal is the primary source of income for many of the rural counties. …
