The American approach to construing texts (statutes, regulations, contracts and documents generally) stresses decision through determining the “plain meaning” of the document based on the court’s reading of the text. Where the court finds plain meaning on the face of text, it generally refuses to consider additional contextual information or extrinsic evidence of meaning.

Notwithstanding its status as the dominant approach to interpretation, the plain meaning concept has not been well defined or operationalized. Litigation over insurance coverage is really a quest for meaning: Does the insurance policy cover the loss at issue? Construing the insurance policy, courts are attempting to give legal effect to what the document purports to command. But what were the intentions and expectations of insurer and insured? Do those intentions even matter? Or is only the written text of the policy relevant to the coverage result? Courts approaching these questions typically frame the interpretative choice as one of strict textualism versus a more contextual, functionalist approach.

‘The Good English’: The Ideological Construction Of The Target Language In Adult Esol, Kelsey Swift

This project problematizes hegemonic conceptions of language by looking at the construction of ‘English’ in a nonprofit, community-based adult ESOL program in New York. I use ethnographic observation and interviews to uncover the discursive and pedagogical practices that uphold these hegemonic conceptions in this context. I find that the structural conditions of the program perpetuate a conception of ‘English’ shaped by linguistic racism and classism, despite the program’s progressive ideals. Linguistic authority is centralized through the presentation of a closed linguistic system and a focus on replication of templatic language. Iconic sixties girl group the Ronettes are frequently (and justly) celebrated for anchoring the Wall of Sound and inspiring the Beatles, but in their own right, they transgressed social, gendered expectations in revolutionary ways. Framed by a notion I call the sonic feminine, a recuperative theoretical space for the revolutionarily transgressive work of female and femme artists, I argue that the Ronettes, and lead singer Ronnie Spector in particular, enacted a kind of cultural rebellion: they crafted their images to made-up heights that tease the boundaries of drag across the spaces of the stage, the recording studio, the bathroom, and …

This introductory contribution examines the ‘Global South’ as a meta category in the study of world politics. Against the backdrop of a steep rise in references to the ‘Global South’ across academic publications, we ask whether and how the North–South binary in general, and the ‘(Global) South’ in particular, can be put to use analytically. Building on meta categories as tools for the classification of global space, we discuss the increasing prominence of the ‘Global South’ and then outline different understandings attached to it, notably socio-economic marginality, multilateral alliance-building and resistance against global hegemonic power. Changing Practices For Connected Discourse: Starting And Developing Topics In Conversation, John Hellermann, Yo-An Lee

This paper investigates the actions and practices for connected discourse in English conversation. Three university students met weekly for 94 weeks to practice speaking and were video recorded. Each participant made a 10 min presentation about a topic of interest and then the three participants had a conversation. Using ethnomethodological conversation analysis (CA), we examined how participants moved from an orientation to one type of speech exchange system (the monologic presentation) to another (the ‘conversation’) and specifically, the actions and practices for getting the conversation started. Do forests and rivers possess standing to sue? Do mountain ranges have substantive rights? A recent issue of The Judges’ Journal, a preeminent publication for American judges, alerts the bench, bar, and policymakers to the rapidly emerging “rights of nature,” predicting that state and federal courts will increasingly see claims asserting such rights. Within the United States, Tribal law has begun to legally recognize the rights of rivers, mountains, and other natural features. This essay examines the infrastructural causes of digital humanities adjunct invisibility and proposes two remedies: to motivate DH adjunct self-identification by convening DH adjunct-specific prizes and bursaries; and what I call "microbenefactions": small actions by senior faculty that extend opportunities to adjuncts that cost little effort and can give adjuncts access to payment, prize-worthy work opportunities, or other benefits. The unspoken assumption is that DH skills are so much in demand that people with these skills are protected from adjuncting. The purpose of this essay is to share the voices of EdD graduates who are often underrepresented or missing in the literature. To begin, we invited EdD graduates to co-author this article about the connection among their EdD program experiences and interactions and their activism. We included our definition of activism and posed three open-ended questions. Six program graduates and one professor agreed to organize the graduates’ responses by the question topics and salient themes. The purpose of the recommendation system is to recommend a series of unobserved items for users. At present, recommendation systems based on knowledge graphs are mainly implemented in two ways: Embedding-based and path based. This study used both parental factors and students’ individual motivational factors to understand college students’ academic achievement and resilience. Students bring various strengths with them to college that may be especially important as they experience challenges, including individual motivational strategies and joint collaboration with parents in pursuing educational goals (parental shared agency). Based on cultural backgrounds and values, we hypothesized differences between parental shared agencies for White and Latinx students.
