Traversing A Tightrope Between Ecumenism And Exclusivism, Retief Müller Mar 2021

Traversing A Tightrope Between Ecumenism And Exclusivism, Retief Müller

University Faculty Publications and Creative Works

During the first few decades of the 20th century, the Nkhoma mission of the Dutch Reformed Church of South Africa became involved in an ecumenical venture that was initiated by the Church of Scotland’s Blantyre mission, and the Free Church of Scotland’s Livingstonia mission in central Africa. Geographically sandwiched between these two Scots missions in Nyasaland (presently Malawi) was Nkhoma in the central region of the country. During a period of history when the DRC in South Africa had begun to regressively disengage from ecumenical entanglements in order to focus on its developing discourse of Afrikaner Christian nationalism, this venture …

Using An Ethos Of Care To Bridge The Digital Divide: Exploring Faculty Narratives During A Global Pandemic, Kari Goin Kono, Sonja Taylor Mar 2021

Using An Ethos Of Care To Bridge The Digital Divide: Exploring Faculty Narratives During A Global Pandemic, Kari Goin Kono, Sonja Taylor

University Studies Faculty Publications and Presentations

Prior to the COVID-19 emergency, some faculty resisted the move to digital learning formats due to concerns for student equity or that engagement would suffer. The purpose of this study was to understand how faculty adapted their courses during the rapid shift to remote and online learning in the spring of 2020, and to understand the role of equity in their experiences. Faculty narratives revealed that elements such as flexibility, reducing coursework to essential content, and personalization—all stemming from an ethos of care - were effective in mitigating the equity issues that surfaced during the emergency transition to universal remote …

The Library Of Babel For Prior Art: Using Artificial Intelligence To Mass Produce Prior Art In Patent Law, Lucas R. Yordy Mar 2021

The Library Of Babel For Prior Art: Using Artificial Intelligence To Mass Produce Prior Art In Patent Law, Lucas R. Yordy

Vanderbilt Law Review

Artificial intelligence is playing an increasingly important role in the invention and innovation processes of our society. To date, though, much of the academic discussion on the interaction of artificial intelligence and the patent system focuses on the patentability of inventions produced by artificial intelligence. Little attention has been paid to organizations that are seeking to use artificial intelligence to defeat the patentability of otherwise patent-worthy inventions by mass producing prior art. This Note seeks to highlight the consequences of allowing mass-produced, AI-generated prior art to render valuable inventions unpatentable. Specifically, this Note concludes that AI-generated prior art decreases the …

Living Carriers In The East: Chinese Cargadores In Nineteenth-Century Manila, Jely A.; Galang Mar 2021

Living Carriers In The East: Chinese Cargadores In Nineteenth-Century Manila, Jely A.; Galang

Philippine Studies: Historical and Ethnographic Viewpoints

Although the history of the Chinese in the Philippines is generally well known, what has not been probed is the way working-class Chinese lived and conducted their trades amid restrictive colonial policies. Using previously unexplored archival materials, thisarticle examines the lives and circumstances of Chinese cargadores (stevedores and transporters) within the urban and commercial milieus of Manila during the nineteenth century. Chinese cargadores were regarded as highly dependable workers, but were treated, because of their ethnicity and numerical strength, as both marginal and dangerous, needing to be strictly regulated and disciplined by the Spanish colonial state.KEYWORDS: CHINESE • MANUAL LABORERS …

Kanak Mukherjee (1921-2005): Women Of Struggle, Women In Struggle, Tricontinental: Institute For Social Research, Elisabeth Armstrong

Study of Women, Gender, & Sexuality: Faculty Publications

The twentieth century was marked by national liberation struggles that emerged in Africa and Asia, as well as in Latin America where neo-colonial structures had subordinated the formally independent countries. The achievements of the Russian Revolution in 1917 inspired the peasantry and the working class across the Global South. The fight for equality and liberation under the leadership of working people are ongoing in the anti-imperialist struggles of our time. Women, in a myriad of ways, powerfully shaped and continue to shape all of these struggles.

In the Women of Struggle, Women in Struggle series of Tricontinental: Institute for Social …

Analysis Of Recent Trends In Continuous Sign Language Recognition Using Nlp, Vijayshri Nitin Khedkar, Sonali Kothari Dr, Aarohi Prasad, Arunima Mishra, Varun Saha, Vinay Kumar

Library Philosophy and Practice (e-journal)

Oralism is an ideology and practice that advocates communication that is based solely on speech. This practice is encouraged from a pretty early age in our country. As a consequence, the hard of hearing are constantly forced to negotiate with schools, colleges, organisations, workspaces, and families that don’t acknowledge the need and preference for sign language over oral languages. This results in inconsideration of an entire community for admissions, jobs and general social position. We aim to close that communication gap a little and take a step towards fighting the stigma associated with Sign Language. The aim is to provide …

Fiduciary Law And The Law Of Public Office, Ethan J. Leib, Andrew Kent Mar 2021

Fiduciary Law And The Law Of Public Office, Ethan J. Leib, Andrew Kent

William & Mary Law Review

A law of public office crystallized in Anglo-American law in the seventeenth and eighteenth centuries. This body of law—defined and enforced through a mix of oaths, statutes, criminal and civil case law, impeachments, and legislative investigations—imposed core duties on holders of public executive offices: officials needed to serve the public good, not their own private interests; were barred from acting ultra vires; could often be required to account to the public for their conduct in office; and needed to act with impartiality, honesty, and diligence. Officeholding came to be viewed as conditional, with officers removable for misdeeds. These substantive duties …

Settled Law, G. Alexander Nunn, Alan M. Trammell Mar 2021

Settled Law, G. Alexander Nunn, Alan M. Trammell

Faculty Scholarship

“Settled law” appears frequently in judicial opinions — sometimes to refer to binding precedent, sometimes to denote precedent that has acquired a more mystical permanence, and sometimes as a substantive part of legal doctrine. During judicial confirmation hearings, the term is bandied about as Senators, advocacy groups, and nominees discuss judicial philosophy and deeper ideological commitments. But its varying and often contradictory uses have given rise to a concern that settled law is simply a repository for hopelessly disparate ideas. Without definitional precision, it risks becoming nothing more than empty jargon.

We contend that settled law is actually a meaningful …

The Island Heritage / El Patrimonio De La Isla, Susana Castillo-Rodriguez Mar 2021

The Island Heritage / El Patrimonio De La Isla, Susana Castillo-Rodriguez

Languages and Literatures

In 1926, Philip. J. Fisher published “The Island Heritage. Episodes from the Missionary History of Fernando Poo, West Africa. A Play for Young People”. This book has remained unknown until present. There is one copy at Archives and Special Collections, SOAS Library (London).

This play is of enormous interest not just for it has been mentioned above but also because:

  1. It is a vivid narration of the settlement of Protestant missionaries in Clarence, based on historical facts and personal experience collected first hand by Philip. J. Fisher as he interviewed some of the protagonists in the play.

  2. It is the …

Swot Analysis Applications: An Integrative Literature Review, Mostafa Ali Benzaghta, Abdulaziz Elwalda, Mousa Mohamed Mousa, Ismail Erkan, Mushfiqur Rahman

Journal of Global Business Insights

A strengths, weaknesses, opportunities, and threats (SWOT) analysis has become a key tool used by businesses for strategic planning. Scholars have conducted SWOT research for over six decades. However, a collective understanding of SWOT analysis remains vague. This study accessed, analyzed, and synthesized the SWOT literature, allowing for new theoretical perspectives and frameworks to emerge. Using an integrative literature review, this study reviewed SWOT studies historically, providing a greater understanding of the SWOT analysis in different sectors and the different approaches used in SWOT studies. Furthermore, it fills the knowledge gap in the strategic planning context and indicates meaningful implications …

Reckoning: A Dialogue About Racism, Antiracists, And Business & Human Rights, Erika George, Jena Martin, Tara Van Ho Mar 2021

Reckoning: A Dialogue About Racism, Antiracists, And Business & Human Rights, Erika George, Jena Martin, Tara Van Ho

Faculty Scholarship

Video of George Floyd's death sparked global demonstrations and prompted individuals, communities and institutions to grapple with their own roles in embedding and perpetuating racist structures. The raison d'être of Business and Human Rights (BHR) is to tackle structural corporate impediments to the universal realization of human rights. Yet, racism, one of the most obvious of such barriers, has been a blind spot for BHR. While the field has contended with gender inequality, there have only been tokenistic nods to intersectional harms caused by business activities. The failure to address racism seriously undermines both the promise of BHR generally and …

Inequalities In Private Tutoring Of English: A Phenomenological Qualitative Study Based On Bangladeshi Higher Secondary Students, Monjurul M. Islam 8965323, Dr. Shams Hoque, Kazi Enamul Hoque

The Qualitative Report

This phenomenological qualitative study analyzes the lived experiences of eleven Bangladeshi higher secondary students in mainstream schools to provide insight into their thoughts, feelings, beliefs, values, and assumptions of private tutoring in English (PT-E). The study also focused on PT-E that contribute to inequalities between students who have access to private tutoring and those who do not. Each participant participated in a one-to-one in-depth semi-structured interview. Using phenomenological analysis, 321 significant statements and three themes emerged. The data show that unequal practice, discrimination due to financial capability, and social psyche for PT-E that influences students to widen the negative impacts …

The Use Of Online Data Sources In A Qualitative Analysis Learning Project, Sunny R. Winstead, Christopher J. Alterio

The Qualitative Report

Our purpose in writing this article is to describe the use of online data sources (such as blogs and microblogs) in a qualitative analysis learning project for graduate occupational therapy students. The project was designed to meet the following learning objectives: (1) increase students’ understanding and appreciation for qualitative research principles and methods, (2) increase students’ ability to use thematic and narrative analysis procedures with authentic data sets, and (3) increase students’ ability to apply qualitative findings to occupational therapy practice. This article describes the project’s theoretical rationale, components, objectives, implementation, and informal outcomes, along with a discussion of strengths …

If The Music Hadn’T Stopped, Or Reflections On The Great Kerfuffle: Historicism’S Continuing Grasp For Truth, John Henry Schlegel Mar 2021

If The Music Hadn’T Stopped, Or Reflections On The Great Kerfuffle: Historicism’S Continuing Grasp For Truth, John Henry Schlegel

Journal Articles

I was pretty indifferent to my undergraduate education, but I hated law school because it was full of things one couldn’t do. One couldn’t use a statute analogically, couldn’t take into account realpolitik when analyzing cases, couldn’t rethink legal education from the bottom up, and it was pretty much “out there” to count votes when predicting case outcomes. Six years later, when in 1973 I came to teach at Buffalo, I experienced a quite different world; there were all sorts of possibilities. The great intellectual kerfuffle that went by many names—structuralism, post-structuralism, postmodernism, even Marxism and Critical Legal Studies (CLS)—burned …

Ethical, Legal, And Social Issues (Elsi), Andrea Jerkovic´, Alexander Siedschlag Mar 2021

Ethical, Legal, And Social Issues (Elsi), Andrea Jerkovic´, Alexander Siedschlag

Publications

This chapter introduces the concept of ethical, legal, and social issues – known as ELSI – as it is relevant to security science research and security science-informed practice. After defining ethical, legal, and social issues, the chapter addresses main ELSI domains and discusses how to address those in security science. Arguments are illustrated using examples from domains such as critical infrastructure protection and novel coronavirus pandemic (COVID-19) response. Subsequently, the chapter demonstrates the relevance of ELSI analysis in security science for risk assessment and vulnerability analysis. It argues for a comprehensive approach to ELSI assessment and consideration in security science …

Selling A Resume And Buying A Job: Stratification Of Gender And Occupation By States And Brokers In International Migration From Indonesia, Andy Scott Chang Mar 2021

Selling A Resume And Buying A Job: Stratification Of Gender And Occupation By States And Brokers In International Migration From Indonesia, Andy Scott Chang

Research Collection School of Social Sciences

This study examines how state and commercial actors construct gender, occupation, and nationality hierarchies in guest worker programs by comparing the migratory procedures for female domestic workers and male industrial operators from Indonesia. Based on 19 months of multi-sited ethnography and 86 interviews in Indonesia, Taiwan, and Singapore, I introduce the notion of multilateralism to theorize the stratification of global migration processes. In multilateral labor markets, governments, brokers, employers, and migrants in multiple countries contend for labor and employment. The homecare market is governed under the rubric of “selling a resume,” whereby Indonesian regulators and labor suppliers pass on recruitment …

Male-To-Female Sexual Violence In Rural Communities: A Sociological Review, Walter Dekeseredy Dr. Mar 2021

Male-To-Female Sexual Violence In Rural Communities: A Sociological Review, Walter Dekeseredy Dr.

Dignity: A Journal of Analysis of Exploitation and Violence

The extant sociological literature on male-to-female violence in rural communities reveals that the bulk of the empirical work on this problem focuses mainly on non-lethal physical assaults, such as beatings. Much more research on sexual violence is sorely needed. The main objective of this review is twofold: (1) to describe the current state of international sociological knowledge about male sexual violence against adult women and (2) to suggest new directions in research and theory.

Introduction To The Special Issue On “Grassroots And Inclusive Innovations: Conceptualizing Synergies And Complementarities”, Wee Liang Tan, Partha Gangopadhyay, Oscar Hauptman

Research Collection Lee Kong Chian School Of Business

The paper provided a review of the state of the field of grassroots and inclusive innovations, suggested and proposed ways forward for research. It also provided a summary of the articles in the special issue and discussed their contributions. With the extant literature, and the modest contribution of the special issue, the paper postulates that grassroots innovation and inclusive innovation activities are complementary. One the one hand, the inclusive innovations actors and processes facilitate and accelerate grassroots innovation. On the other hand, the knowledge of local context and culture enables effective diffusion of external ideas. The paper also highlights the …

Measuring Semantic Relatedness: A Proposal For A New Textual Tool, Katherine A. Cohen Mar 2021

Measuring Semantic Relatedness: A Proposal For A New Textual Tool, Katherine A. Cohen

Vanderbilt Law Review

Judicial decisions, statutes, constitutions, sentencing guidelines, and ERISA-related documents have at least one thing in common: at a molecular level, the laws are all composed of words. The scientific study of linguistics, particularly the field of semantics, analyzes what words mean and how they are connected with each other. And yet, thus far, the legal field has taken little notice of academic and technological breakthroughs in the field of linguistic semantics. This Note seeks to highlight the potential utility of linguistic semantic tools in interpreting legal texts. Specifically, applying algorithms to a free online lexical database allows anyone with a …

Beginning Band: Cognitive Development Based Instruction, Kayla Price

Theses

This project focuses on how to facilitate a more efficient beginning band experience for students based on the average state of cognitive development for their age group. The primary focus is presenting an alternative to immediately starting students in a traditional band method book when they first begin band classes. The aim of the project is to study the cognitive development of the average sixth grader to best determine what instructional approach would best suit their processing abilities before introducing the band method book. Furthermore, the study exposes the fallacies of the traditional band method book system and suggests and …

Exploring The Limits Of Strategic Thought: Evaluating How Different Communication Modalities Affect The Nature Of Strategic Decision-Making Using Cognitive Hierarchy, Stephen D. Donnel Mar 2021

Exploring The Limits Of Strategic Thought: Evaluating How Different Communication Modalities Affect The Nature Of Strategic Decision-Making Using Cognitive Hierarchy, Stephen D. Donnel

Theses and Dissertations

This research examines and quantifies the degree to which both information communication modality and the situational complexity affect individuals' ability to process the provided information and determine an effective strategy. Human subject testing herein consists of benign benevolent intervention involving the presentation of a series of strategic situations. For each situation, a participant attempts to identify their best response for a two-player, normal-form game with complete information. In each such game, players seek to maximize their own utility while considering their own actions, their opponent's actions, and each player's respective preferences over outcomes resulting from the possible combinations of actions. …

An Examination Of Potential Training Regression Recognition Algorithms For Pilot Training Next, Alex R. Gaines Mar 2021

An Examination Of Potential Training Regression Recognition Algorithms For Pilot Training Next, Alex R. Gaines

Theses and Dissertations

The initiative to reduce the Air Forces serious pilot shortage lead to the Pilot Training Next (PTN) program. Under PTN, student pilots progress at an individual rate while making increased use of simulator-based training resources. A previous thesis used data from the first PTN class to conceptualize and prototype a student training flight scheduler. This scheduler did not consider training events required to bring students back to achieved levels of performance if in fact that student performance had regressed. This thesis examines three classes of PTN student data to determine whether student regression in training progression can be detected. A …

Automated Sentiment Analysis For Personnel Survey Data In The Us Air Force Context, Julia M. Haines Mar 2021

Automated Sentiment Analysis For Personnel Survey Data In The Us Air Force Context, Julia M. Haines

Theses and Dissertations

When surveys are distributed across the Air Force (AF), whether it be an employee engagement survey, a climate survey, or similar, significant resources are put towards the development, distribution and analysis of the survey. However, when open ended questions are included on these surveys, respondent comments are generally underutilized, more often treated as a source for pull-quotes rather than a data source in and of themselves. This is due to a lack of transparency and confidence in the accuracy of machine-aided methods such as sentiment analysis and topic modeling. This confidence reduces further when the text has special context, such …
