The 1975 West Virginia Input-Output Study: Modeling A Regional Economy, Anthony Loviscek, Randy Holliday, Lucinda Robinson, Melissa Wolford Jan 2021

The 1975 West Virginia Input-Output Study: Modeling A Regional Economy, Anthony Loviscek, Randy Holliday, Lucinda Robinson, Melissa Wolford

Web Book of Regional Science

This is the second set of input-output tables for West Virginia. Both are survey-based. Data for the first tables were obtained from personal interviews with representatives of a sample of West Virginia establishments. The first tables were part of a larger, and relatively well-financed, study. The present study was conducted under tight budget constraints, and the data were obtained by a mail survey. It will come as no surprise that the mail survey was less productive than the 1965 interviews

Civil Rights, Access To Counsel, And Injunctive Class Actions In The United States, Maureen Carroll Jan 2021

Civil Rights, Access To Counsel, And Injunctive Class Actions In The United States, Maureen Carroll

Book Chapters

According to a familiar story about class actions in the United States, aggregation promotes access to counsel by increasing the amount of money from which counsel fees can be taken. Courts usually award class counsel a percentage of the monetary recovery obtained on behalf of the class, and class treatment can turn a $30 case into a $3 million case. But what about class actions that do not involve monetary relief at all? Some civil rights plaintiffs seek to stop a violation, rather than to obtain compensation for past harm, and therefore choose to pursue only an injunction or declaratory …

Stickiness And Incomplete Contracts, Julian Nyarko Jan 2021

Stickiness And Incomplete Contracts, Julian Nyarko

University of Chicago Law Review

Both economic theory and legal theory assume that sophisticated parties routinely aim to write contracts that are optimal, in the sense of maximizing the parties’ joint surplus. But more recent studies analyzing corporate and government bond agreements have suggested that some contract provisions are highly path dependent, or “sticky,” with future agreements only rarely improving upon previous ones.

Analyzing half a million contracts using automated text analysis, this Article demonstrates that the stickiness hypothesis explains the striking lack of dispute resolution clauses that can be found in agreements between even the most sophisticated commercial parties. When drafting these contracts, external …

A Fresh Start: The Evolving Use Of Juvenile Records In College Admissions, Eve Rips Jan 2021

A Fresh Start: The Evolving Use Of Juvenile Records In College Admissions, Eve Rips

University of Michigan Journal of Law Reform

Questions about criminal and juvenile records in the college application process are common and frequently fail to account for the unique characteristics of juvenile justice systems. The ways in which colleges and universities ask about juvenile records often encourage applicants to disclose information in spite of statutory protections. These questions fly in the face of the public policy underlying a range of legal safeguards that are intended to help individuals with records from juvenile systems in moving forward and receiving a second chance.

In recent years, a series of legislative and institutional changes have begun to restrict how colleges and …

Scallywag Pedagogy, Peter Mclaren, Petar Jandrić Jan 2021

Scallywag Pedagogy, Peter Mclaren, Petar Jandrić

Education Faculty Books and Book Chapters

This chapter explores the dynamic between truth and deceit in twenty-first-century transnational capitalism, emerging neo-fascist movements, and post-truth media landscapes marked by the Covid-19 pandemic and the anthropogenic bioinformational challenge. It establishes the centrality of the concept of truth in revolutionary critical pedagogy and underscores the importance of linking true words with true actions in the formation of critical praxis. Revolutionary praxis consists of the dialectical process of self and social formation, while critical educators are situated as protagonistic agents who work in and through history. Truth is therefore not about a timeless or objective state we name history. Action …

Education Faculty Books and Book Chapters

"This chapter unpacks the complex topics of school violence, school safety, and school climate as they apply to modern schools. Relevant models will be discussed that have been used by schools and communities to fashion safe and supportive learning environments, specifically in an effort to foster welcoming school campuses and thriving student development. The following sections provide an overview of the interaction of school safety and school climate and how these constructs are directly linked to student mental and emotional well-being. We then discuss a multidisciplinary approach to addressing these constructs and share an existing model that can be used …

Children’S Place And Voice In Quebec’S Child Protection Proceedings, Mona Paré, Émilie De Bellefeuille Jan 2021

Children’S Place And Voice In Quebec’S Child Protection Proceedings, Mona Paré, Émilie De Bellefeuille

Canadian Journal of Family Law

This article explores children’s participation and their right to be heard in Quebec’s child protection proceedings. While children’s participation rights are well protected in international and domestic legal instruments, they have received little attention in relation to child protection. This article aims to fill a gap in the legal literature by reporting on the results of an empirical research project examining children’s participation in judicial child protection procedures in Quebec. The participation of judges, social workers, and children in this research sheds light on practice that is clearly inspired by the Quebec’s rights- advancing Youth Protection Act (YPA) …

Centering Racial Equity: Disparities Task Forces As A Strategy To Ensure An Equitable Pandemic Response, Dawn M. Hunter, Betsy Lawton Jan 2021

Centering Racial Equity: Disparities Task Forces As A Strategy To Ensure An Equitable Pandemic Response, Dawn M. Hunter, Betsy Lawton

Saint Louis University Journal of Health Law & Policy

COVID-19 has had a stark and severe impact on health, economic stability, housing, and education in communities of color in the United States. As the pandemic has unfolded, the disproportionate number of cases, hospitalizations, and deaths due to COVID-19 among Black, Hispanic and Latinx, and Indigenous people has served as a stark reminder that the systems and structures that lead to these disparities need to be changed in order to achieve equitable outcomes.

This Article assesses efforts by cities, counties, states, and organizations to address the impact of COVID-19 on communities of color through formal task forces or working groups …

Diversity From The Perspective Of Corporate Boards And Lawyer Disciplinary Boards, Lissa L. Broome, John M. Conley Jan 2021

Diversity From The Perspective Of Corporate Boards And Lawyer Disciplinary Boards, Lissa L. Broome, John M. Conley

Saint Louis University Journal of Health Law & Policy

This Article addresses the organizing question of this symposium—whether diversifying state medical boards (SMBs) would improve their effectiveness in disciplining doctors—by drawing on the comparable experiences of corporate boards of directors and lawyer disciplinary boards. Reexamining our own qualitative study of corporate board diversity conducted several years ago, we find that almost of all of the arguments for board diversity raised in the business literature or our own interviews also tend to support diversity on SMBs. Reviewing the legal profession’s experience with the diversity question on lawyer disciplinary boards, we find that many of these arguments have also been recognized, …

Sacrificing Secrecy, Daniel S. Harawa Jan 2021

Sacrificing Secrecy, Daniel S. Harawa

Georgia Law Review

Juries have deliberated in secret since medieval times. The
historical reason for the secrecy is that it promotes impartiality,
which in turn protects a defendant’s right to a fair trial. But as
it turns out, jurors are not always impartial. Lurid examples
exist of jurors condemning defendants based on the defendant’s
race, sexuality, ethnicity, and religion.
Generally speaking, courts cannot hear evidence of what
transpired during deliberations. In 2017, however, the U.S.
Supreme Court created an exception to this rule, holding that
the Sixth Amendment requires courts to hear evidence of jurors
making racially biased statements. But this exception means …

Mitchell Hamline School Of Law Summer 2020 Covid-19 Legal Response Clinic, Natalie Netzel, Ana Pottratz Acosta, Joanna Woolman, Kate Kruse, Jon Geffen

Faculty Scholarship

This essay is a reflection on lawyering in a time of crisis. It details the Mitchell Hamline School of Law Clinical Faculty’s response to the community needs resulting from the COVID-19 pandemic by creating the COVID-19 Legal Response Clinic. It also recounts the impact of the murder of George Floyd and the long overdue national reckoning with systemic racism, sparked in our city. Additionally, against this backdrop, it examines the trauma-informed approach taken in clinical work and the classroom to help students process their own trauma and apply this approach in their work with clients.

Amid these concurrent crises in …

Looking Toward Restorative Justice For Redlined Communities Displaced By Eco-Gentrification, Helen H. Kang

Michigan Journal of Race and Law

MJEAL chose to publish Helen Kang’s piece, Looking Toward Restorative Justice for Redlined Communities Displaced by Eco-Gentrification, because it offers a unique analytic approach for analyzing the roots of environmental racism and the appropriate tools to help rectify it. She offers an argument for why restorative justice needs to be the framework and explains how we can accomplish this in the context of a whole government solution. MJEAL is excited to offer what will be an influential approach for environmental restorative justice to the broader activist and academic community.

How Do I Do This? How Universities Support Students Experiencing Grief, Jackie Hirn Jan 2021

How Do I Do This? How Universities Support Students Experiencing Grief, Jackie Hirn

Masters Theses

Grief prompts college students to ask, “how do I do this?” in many ways. This phenomenological study examined the ways in which student affairs professionals supported grieving students from four universities across the United States. It was found that grieving college students faced many challenges and barriers, including academic, emotional, financial and legal, and cultural issues. Grief is an individualized process that manifests differently in each student. To ensure student success, it was found that resource referral was vital for students, and that connections between departments were imperative to make those referrals happen. This study notes that the COVID-19 pandemic …

Designing A State Court Small Claims Odr System: Hitting A Moving Target In New York During A Pandemic, David Allen Larson Jan 2021

Designing A State Court Small Claims Odr System: Hitting A Moving Target In New York During A Pandemic, David Allen Larson

Faculty Scholarship

When I began helping the New York State Unified Court System design a pilot online dispute resolution (“ODR”) system back in October 2016, I never imagined more than four years would pass before a system was implemented. One reason our journey was so long is because our target kept moving. After completing a detailed credit card debt collection ODR platform, we had to change direction before implementation and focus instead on small claims cases. Then like the rest of the world, we suddenly had to deal with the COVID-19 pandemic. Although it took longer than anticipated, we achieved our goal …
