Watch Your Language: How A School District's Failure To Provide Meaningful Communication Has Impacted Students During The Pandemic, Amy Leipziger
BYU Education & Law Journal
This article examines some of the obstacles that LEP parents have experienced with the NYCDOE during the pandemic, the impact these obstacles have had on their children’s education, and whether the NYCDOE’s refusal to provide language access amounts to a denial of a sound basic education under state constitutional law.12 I chose to focus primarily on New York City because it boasts the nation’s largest school system, with nearly 1.1 million students, and is comprised of 1,876 schools.13 A large share of these students have significant language needs. In New York state, forty-six percent of children in low-income families have …

From 2009 to 2016 the University of Michigan Law School served as the National Quality Improvement Center on the Representation of Children in the Child Welfare System (QIC-ChildRep). This seven-year, multimillion dollar project, directed by Clinical Professor Don Duquette, conducted a national needs assessment that identified a substantial consensus on the role and duties of the child’s lawyer. The needs assessment led to the QIC-ChildRep Best Practice Model, an update and expansion of the 1996 ABA Standards for Lawyers Representing Children in Child Abuse and Neglect Cases.
Released in 2016 as a300-page softcover book, CHILDREN'S JUSTICE is the final report …

Examining Incidents Of Sexual Misconduct Reported To Title Ix Coordinators: Results From New York’S Institutions Of Higher Education, Tara Richards, Taylor Claxton, Lane Kirkland Gillespie
Criminology and Criminal Justice Faculty Publications
A paucity of studies has examined incidents of sexual misconduct reported to Title IX coordinators at institutions of higher education (IHEs) or examined differences across types of IHEs. We used 2018 data from incidents of sexual misconduct (N = 3,829) reported to Title IX coordinators at IHEs in New York (N = 209) to examine the context, processes, and outcomes of reported incidents. Findings show that most incidents reported to Title IX coordinators did not prompt the IHE’s conduct process; “other” disciplinary sanctions were the favored response for responsible students, while suspensions and/or expulsions were rarely used. Further data collection …
Limited Liability Partnerships: An (Overlooked) Hole In The Shield, Lin (Lynn) Bai, Sarah Harden
Limited Liability Partnerships: An (Overlooked) Hole In The Shield, Lin (Lynn) Bai, Sarah Harden
Faculty Articles and Other Publications
There is a split of judicial authority on whether limited liability applies when the creditor is a partner of a limited liability partnership. The New York Court of Appeals narrowly interpreted the partnership statute and denied the applicability, but the California Court of Appeals upheld it. The difference has been overlooked by the legal and business communities. This paper shows that the narrow interpretation is inconsistent with the legislative intent, laden with procedural obstacles in enforcement, and inharmonious with settled legal doctrines and tenets of law-making.
