Indirect Initiative And Unpopular Referendum In Missouri, Gunnar Johanson
Indirect Initiative And Unpopular Referendum In Missouri, Gunnar Johanson
Missouri Law Review
Most governments in the United States operate as a representative democracy through elected officials. Over time, advocates have successfully reformed many of our institutions to give citizens themselves more power through direct democracy. The direct election of United States Senators, the presidential primary, recall, the direct initiative, and popular referendum are all developments in the governments of the United States that place power directly in the hands of voters. Direct initiatives and popular referendums, specifically, are lingering evidence of the Progressive Era of the 1900s. Like most reforms of that time, proponents of direct initiative and popular referendum believed it …

Increasing Substantive Fairness And Mitigating Social Costs In Eviction Proceedings: Instituting A Civil Right To Counsel For Indigent Tenants In Pennsylvania, Robin M. White
Dickinson Law Review (2017-Present)
The U.S. Constitution provides criminal defendants the right to a court-appointed attorney but gives no similar protection to civil litigants. Although federal law does not supply any categorical rights to counsel for civil litigants, all 50 states have instituted the right in at least one category of civil law that substantially impacts individuals’ rights. Since 2017, several U.S. cities have enacted such a right for tenants facing eviction. In so doing, these cities responded to American families’ increasing rent burden, the recent publication of nationwide eviction data, the sociological research concerning the impact of eviction, and the lack of procedural …

China’S Belt And Road Initiative: Mission Opportunities And Challenges, Paul Lee
Great Commission Research Journal
The Belt and Road Initiative (BRI) is an infrastructure project proposed by China to improve transportation in Eurasia. This will bring both mission opportunities and challenges in the regions affected. God is perhaps giving Christians a unique opportunity for evangelism through this project which facilitates the movement of not just humans and products, but also the gospel.

The residential area in which someone lives can determine their lifestyle — from with whom they interact to where they shop, eat, and visit — as well as their life outcome, through factors such as school zoning and mortgage availability. Historically, American cities have developed along racial and socioeconomic lines as a result of federal, state, and local policies, lending practices, and explicit social pressures. No more is this clear than through the creation and use of the Home Owners’ Loan Corporation redlining data, a set of maps produced by the federal government that divided cities into neighborhoods, rated those …

Leading Legal Disruption: Artificial Intelligence and a Toolkit for Lawyers and the Law is designed to challenge lawyers with the practical implications that emerging technologies will have on delivering legal services and thinking about legal issues to navigate their digital transformation. By inviting thought leaders across the world and in different disciplines, ranging from privacy, contract law, and torts to governance and policy, this book goes beyond abstract and general philosophical observations on matters that concern practitioners. This practical approach has generated a wide range of global perspectives, which are refreshingly novel and timely for what are increasingly global issues. …

What Is A “Case”?, Lynn M. Mather
Journal Articles
This article interrogates the concept of a “case” in court, in an effort to clarify underlying concerns in debates over whether there is “too much” or “too little” litigation. One perspective on litigation takes a bottom-up view, examining the considerations and motives of disputing parties who file civil claims. This perspective includes theories about litigation and social structure, economics, dispute transformation, political participation, and psychology. An alternative top-down view examines litigation from the perspective of government, including its interest in dispute resolution, social control, and institutional capacities of courts. The article reviews and critiques existing literature on these perspectives and …

Rural Social Safety Nets For Migrant Farmworkers In Michigan, 1942–1971, Emily A. Prifogle

In the 1960s, farmers pressed trespass charges against aid workers providing assistance to agricultural laborers living on the farmers’ private property. Some of the first court decisions to address these types of trespass, such as the well-known and frequently taught State v. Shack (1971), limited the property rights of farmers and enabled aid workers to enter camps where migrants lived. Yet there was a world before Shack, a world in which farmers welcomed onto their land rural religious groups, staffed largely by women from the local community, who provided services to migrant workers. From the 1940s through the 1960s, federal, …

Legal Research & Writing: An Undergraduate Pre-Law Course Design, Rachel Kathleen Strieber
Senior Theses
The purpose of this project-based thesis is to develop an undergraduate pre-law course that teaches legal research and writing (LRW) and to design its respective description, topics, reading materials, sample syllabus document, and a sample lesson plan. The research portion of this thesis will study the pedagogy of LRW and the connection between LRW skills and the students’ success in law school and careers in law. Preparing students to excel in LRW skills prior to law school through the proposed undergraduate pre-law LRW course will yield a stronger performance in a first-year law LRW course to follow and amplify students’ …

As healthcare providers engage in the politics of reforming and humanizing our immigration and asylum “system” it is critical that they are able to refer their patients whose health is directly impacted by our immigration laws and policies to experts who can help them navigate the system and obtain the healthcare they need.

Using Random Assignment To Measure Court Accessibility For Low-Income Divorce Seekers, James D. Greiner, Ellen L. Degnan, Thomas Ferriss, Roseanna Sommers
Articles
We conducted a field experiment in which 311 low-income individuals seeking a divorce were randomly assigned to receive access to a pro bono lawyer (versus minimal help) to assist with filing for divorce. Examining court records, we found that assignment to an attorney made a large difference in whether participants filed for and obtained a divorce. Three years after randomization, 46% of the treated group had terminated their marriages in the proper legal venue, compared to 9% of the control group. Among “compliers”—participants who obtained representation only if assigned to receive it—those with lawyers were far more likely to file …

Ethnic Women In Sơn La Province, Northern Vietnam: The Entrepreneurial Landscape, Quynh T Nguyen, Louise Coventry, Scott Mcdonald, Nthati Rametse
Asia-Pacific Social Science Review
This article examines differences in the propensity to engage in entrepreneurial activities among ethnically diverse women in Sơn La Province, a disadvantaged and mountainous rural area of Vietnam. Propensity for entrepreneurialism is examined by focusing on (a) women’s use of technology, (b) experiences of financial difficulties, and (c) propensity for risk-taking. Analyzing surveys completed by 135 women, we find that plans to start a business are equally apparent among women from diverse ethnic groups. We establish a positive association between levels of entrepreneurialism (practicing entrepreneurs, intending entrepreneurs, and non-entrepreneurs) and the use of technology. However, we find no association between …
