Policy-makers, scholars, and commentators are increasingly concerned with the risks of using profiling algorithms and automated decision-making. The EU’s General Data Protection Regulation (GDPR) has tried to address these concerns through an array of regulatory tools. As one of us has argued, the GDPR combines individual rights with systemic governance, towards algorithmic accountability. The individual tools are largely geared towards individual “legibility”: making the decision-making system understandable to an individual invoking her rights. The systemic governance tools, instead, focus on bringing expertise and oversight into the system as a whole, and rely on the tactics of “collaborative governance,” that is, …
Transformative Silence And Protest, Deborah J. Cantrell
Transformative Silence And Protest, Deborah J. Cantrell
Publications
Social movement protests have become common place in the last several years. Images come easily to mind of protestors marching down streets holding signs and chanting. Just as easily, images come to mind of counter-protestors yelling back, and law enforcement engaging protestors, often trying to control them with notable force. This Article recognizes that protestors often engage with speech, silence and the law in very pragmatic, but important ways. How does a locality handle permitting for protests? Are there noise restrictions to know about? How likely will it be that law enforcement will be present and making arrests? If there …
Wage Theft Criminalization, Benjamin Levin
Wage Theft Criminalization, Benjamin Levin
Publications
Over the past decade, workers’ rights activists and legal scholars have embraced the language of “wage theft” in describing the abuses of the contemporary workplace. The phrase invokes a certain moral clarity: theft is wrong. The phrase is not merely a rhetorical flourish. Increasingly, it has a specific content for activists, politicians, advocates, and academics: wage theft speaks the language of criminal law, and wage theft is a crime that should be punished. Harshly. Self-proclaimed “progressive prosecutors” have made wage theft cases a priority, and left-leaning politicians in the United States and abroad have begun to propose more criminal statutes …
Shareholder Primacy And The Moral Obligation Of Directors, Mark J. Loewenstein, Jay Geyer
Shareholder Primacy And The Moral Obligation Of Directors, Mark J. Loewenstein, Jay Geyer
Publications
One of the most written-about and important topics in corporate law is the fiduciary obligations of corporate directors. Increasingly, critics of American capitalism have urged that corporations, and implicitly, corporate directors, act in a more socially responsible fashion and thus eschew the notion that shareholder primacy is the exclusive guide to a director’s fiduciary duty. Under this view, directors must consider the effect of their actions on “stakeholders” other than shareholders and be guided by morality—doing the right thing—when making business judgments.
When directors move away from shareholder primacy, however, decision-making becomes more difficult and problematic. This article analyzes the …

Pandemics lead to emotions that can be good, bad, and unconscious. This Article offers an interdisciplinary analysis of how emotions during pandemics affect people’s responses to pandemics, public health, financial economics, law, and leadership. Pandemics are heart-breaking health crises. Crises produce emotions that impact decision-making. This Article analyzes how fear and anger over COVID-19 fueled anti-Asian and anti-Asian American hatred and racism. COVID-19 caused massive tragic economic, emotional, mental, physical, and psychological suffering. These difficulties are interconnected and lead to vicious cycles. Fear distorts people’s decision readiness, deliberation, information acquisition, risk perception, and thinking. Distortions affect people’s financial, health, and …

The Tennessee Wine case, decided in June of 2019, had a major effect on the path of the law for an issue not argued in it. The Supreme Court affirmed invalidity of a protectionist state liquor regulation that discriminated against interstate commerce in violation of the dormant commerce clause doctrine. Its holding rejected a vigorous defense based on the special terms of the Twenty-first Amendment that ended Prohibition—an issue of interest only to those involved in markets for alcoholic drinks. However, the Court’s opinion removed serious doubts about validity of the Doctrine itself, even though the petitioner and supporting amici …

Body Appreciation As A Means To Protect Social Media Users From Body Dissatisfaction, Jennifer Yurchisin, Alyssa Dana Adomaitis, Kim K. P. Johnson, Haesung Whang
Publications and Research
When young adult women and men are exposed to idealized images in traditional media outlets, they often experience body dissatisfaction. As the use of social media increases, so do the opportunities for appearance-based comparisons. Individuals who are heavy users of social networking sites also tend to exhibit body dissatisfaction. Body appreciation is a personal characteristic that seems to counteract the negative influence traditional media exposure, and it may have a similar effect for social media exposure. The purpose of our research was to investigate the impact of body appreciation on the relationship between social network sites usage and body dissatisfaction …

Influence Of Covid-19 On Changes In Dressing Behaviours Of U.S. Adults., Diana Saiki, Jay Kandiah, Alyssa Dana Adomaitis, James A. Jones
Publications and Research
The objective of this research was to assess the impact of the currently lived COVID-19 pandemic on dressing behaviours of a cross-section of the U.S. adult population. Participants (N = 844) completed a survey via Amazon Mechanical Turk which evaluated frequency of wearing of eight dressing categories—accessories, informal dress, formal dress, protective dress, hair practices, scent products, appearance enhancement, and make-up (females) prior to and during the pandemic. Physical, emotional and psychological self-care and demographics were also collected. Overall, during the pandemic participants engaged in less dressing behaviours, dressed informal clothing (e.g., jeans, t-shirts) and incorporated protective dress. These findings …

A Twisted Generalization Of The Classical Dedekind Sum, Brad Isaacson
Publications and Research
In this paper, we express three different, yet related, character sums in terms of generalized Bernoulli numbers. Two of these sums are generalizations of sums introduced and studied by Berndt and Arakawa–Ibukiyama–Kaneko in the context of the theory of modular forms. A third sum generalizes a sum already studied by Ramanujan in the context of theta function identities. Our methods are elementary, relying only on basic facts from algebra and number theory.

Nitrogen Fixation: A Poorly Understood Process Along The Freshwater-Marine Continuum, Amy M. Marcarelli, Robinson W. Fulweiler, J. Thad Scott
Michigan Tech Publications, Part 1
N2 fixation is a major component of the global N cycle and has been extensively studied in open-ocean and terrestrial ecosystems. Yet rates and ecological dynamics remain virtually unknown for the inland and coastal aquatic ecosystems (lakes, wetlands, rivers, streams, and estuaries) that connect terrestrial and marine biomes. This is due to the diversity of these habitats as well as the traditional paradigm that N2 fixation rates were low to nonexistent, and therefore not important, in these ecosystems. We identify three major research themes to advance understanding of aquatic N2 fixation: (1) the biological diversity of diazotrophs and variability of …

Michigan Tech Publications, Part 1
Hitherto there have been many studies comparing the usefulness of OLI and ETM+ sensors for linear feature extraction. However, not too much attention has been paid to the differences in the bandwidth of the two sensors. In this study, the suitability of Landsat ETM+ and OLI sensors for automatic detection of linear features by LINE algorithm was compared. In this study, eight regions in northern, central and southern parts of Iran were selected based on the diversity of lithology, the pristine status, and lack of human activities for the comparison of the two datasets. Results revealed that LINE algorithm performed …
Inheritance Of The Deceased, Dr. Nada Salim Hamdoon
Inheritance Of The Deceased, Dr. Nada Salim Hamdoon
Faculty Peer-Reviewed Papers | بحوث هيئة التدريس المحكمة
The life of the inheritor and the death of the inherited are both a condition that must be fulfilled before the inheritance can legally be carried out. This is a crucial condition that allows us to know those who deserve to be legally inheritors from those who do not. However, there are cases where it is difficult to fulfil such a condition—the case of mass death for example. In fact, there is no any stipulation in the Iraqi legal system pertaining to Personal Status Law on how to inherit in case of mass death, therefore, the only legal recourse left …

Parallel Generalized Hebbian Algorithm For Large Scale Data Analytics, Mohanad G. Yaseen, Mohammad Naeemullah Mohammad Naeemullah, Ibarhim Adeb Mansoor Ibarhim Adeb Mansoor
Mesopotamian Journal of Big Data
In order to store and analyse large amounts of data on a parallel cluster, Big Data Systems such as Hadoop and DBMSs require a complex configuration and tuning procedure. This is mostly the result of static partitioning occurring whenever data sets are imported into the file system or transferred into it. Following that, parallel processing is carried out in a distributed fashion, with the objective of achieving balanced parallel execution among nodes. The system is notoriously difficult to configure, particularly in the areas of node synchronisation, data redistribution, and distributed caching in main memory. The extended Hebbian algorithm, abbreviated as …

Distributed Reduced Convolution Neural Networks, Mohammad Alajanbi, Donato Malerba Donato Malerba, He Liu He Liu
Mesopotamian Journal of Big Data
A Convolution Neural Network (CNN) is a popular tool in the domains of pattern recognition and machine learning. The performance of KCNN (kernel-based convolutional neural networks) is better than that of regular CNN. Although the KCNN can solve challenging nonlinear problems, doing so when dealing with a large-size kernel matrix is time-consuming and memory-intensive. The computational load and memory usage could be drastically decreased by adopting a reduced kernel strategy. But as the total amount of training data grows at an exponential pace, it becomes hard for a single worker to efficiently store the kernel matrix. Because of this, there …
Artificial Neural Networks Advantages And Disadvantages, Maad M. Mijwel
Artificial Neural Networks Advantages And Disadvantages, Maad M. Mijwel
Mesopotamian Journal of Big Data
Artificial neural networks (ANNs) are the modelling of the human brain with the simplest definition, and the building blocks are neurons. There are about 100 billion neurons in the human brain. Each neuron has a connection point between 1,000 and 100,000. In the human brain, information is stored in such a way as to be distributed, and we can extract more than one piece of this information from our memory in parallel when necessary. We are not mistaken when we say that a human brain is made up of thousands of very, very powerful parallel processors. In multi-layer artificial neural …

Many Christian churches seek to be places of belonging, yet present barriers to inclusion. The present research focuses on disability and belonging in members of the Seventh-day Adventist (SDA) Church in North America. Data from the SDA Global Church Survey (2017–2018) were used to measure attendance, perceived care, and sense of being needed. Results: Differences in attendance, leadership, and “feeling cared for” were observed. The findings of this study suggest that the SDA Church has had both successes and room for growth in terms of creating opportunities for belonging among people with disabilities. Implications for other denominations are also discussed.

It was in the late 1990’s that the original Adverse Childhood Experiences (ACEs- https:// www.cdc.gov/violenceprevention/aces/index.html) study through CDC-Kaiser Permanente was done. This groundbreaking research opened the door to the reality that childhood and household challenges, including but not limited to abuse, neglect and even divorce, can dramatically impact a person’s health and well-being throughout life. Much work has been done since 1997 to further study and subsequently reduce ACEs’ impact, but the sad truth is that although much effort has been put forth to combat adverse experiences, ACEs are still very prevalent today and even our own congregations are touched. …

The value of personal data has traditionally been understood in economic terms, but recent scholarship casts the value of data as multi-faceted, dynamic, emergent and co-created by stakeholders. The dynamics of the co-creation of value with personal data lacks empirical study. We conduct a case study of the development of a personalised e-book and find different perceptions of the value of personal data exist from the firm, intermediary and customer perspective: means to an end, medium of exchange and net benefit. The different data perspectives highlight ontological differences in the perception of what data are. This creates epistemological tension and …

BACKGROUND & AIMS: The risk of nonalcoholic fatty liver disease (NAFLD) and its progression may differ between men and women. We conducted a systematic review and meta-analysis to determine the relationship between sex and NAFLD, nonalcoholic steatohepatitis (NASH), and advanced NAFLD fibrosis.
METHODS: Studies reporting sex-stratified NAFLD prevalence among population-based samples and either NASH or advanced fibrosis among patients with biopsy-proven NAFLD were identified from MEDLINE, EMBASE, and Cochrane databases through December 2017. We calculated pooled relative risk ratios comparing women vs men for each outcome.
RESULTS: Our final analysis comprised 54 studies. Samples sizes were 62,239 for the NAFLD …
