Section 230 of the Communications Decency Act (“CDA”) has been held to give online service providers acting as interactive computer services sweeping immunity for content posted on their platforms. The intention behind the creation of Section 230 was not to immunize online service providers from all liability. Rather, Section 230 was enacted to protect online intermediaries acting as “Good Samaritans” – those who made “good faith” efforts to restrict unlawful or harmful content, but due to the breadth of the internet and advancements in technology over or under-filtered content on their platforms. Research shows that the LGBTQ population is disproportionately affected by hate crimes and those against transgender individuals are especially violent. Given the considerable underreporting of these crimes, better insight into the victimization experiences and reasons for underreporting is necessary to improve the safety of the transgender community and secure necessary services for these victims. The current study takes a community-based participatory research (CBPR) approach by creating and utilizing an Advisory Board made up of service providers in the transgender community in Los Angeles, to assist in the development of a survey instrument and focus group questions and provide venues for …

Federal courts have grappled with the issue of whether or not to include in-and-out traders in federal securities class action lawsuits. One set of courts has excluded in-and-out traders on the grounds that they could not prove loss causation, while another set of courts has included in-and-out traders because of the possibility that they could prove that they had suffered a loss. In Mineworker’s Pension Scheme versus First Solar, Inc., the Ninth Circuit recently addressed what should be the correct standard for loss causation. While the Ninth Circuit’s decision resolved its own intra-circuit split, the Court’s decision widened an already …

Background
Instability remains the most common complication after revision total hip arthroplasty (THA). The purpose of this study was to determine whether there was a difference in aseptic revision rates and survivorship between dual-mobility (DM) and constrained liners (CL) in revision THA.
Methods
We reviewed a consecutive series of 2432 revision THA patients from 2008 to 2019 at our institution and identified all patients who received either a CL or DM bearing. We compared demographics, comorbidities, indications, dislocations, and aseptic failure rates between the two groups. Bivariate and multivariate regression analyses were used to determine risk factors for failure, and …

Non-Consensual Condom Removal In Canadian Law Before And After R. V. Hutchinson, Lise Gotell, Isabel Grant

This paper examines the phenomenon of non-consensual condom removal (NCCR) and its relationship to sexual assault in Canada. Using empirical studies and the insights of feminist theory, we explore the nature of the harms caused by NCCR and contend that this pervasive practice constitutes sexual assault. We then critique the decision of R v Hutchinson, which held that condom sabotage does not negate subjective consent, ignoring the dignitary harms of NCCR. While lower court decisions before Hutchinson recognized that consent to sex with a condom does not include consent to sex without, courts after Hutchinson have struggled to distinguish the …

If there is no hierarchy of rights in Canada, then why does freedom of religion so often seem to lose in cases of conflicts with other rights? This article discusses five recent Canadian cases (involving same-sex marriages, controversial medical practices, the wearing of a niqab, and a Christian university’s sexual conduct policy) in order to expose how the courts regularly characterize freedom of religion as being conceptually equal to other rights, before ruling against freedom of religion on the facts of the particular cases. Type two diabetes mellitus is a chronic medical condition encountered by physicians providing medical care to adult and pediatric patients. This autobiographical case report discusses type two diabetes from the perspective of positive and negative interactions with the healthcare system in managing diabetes mellitus, especially for a physician of color and underrepresented in medicine. Bias and assumptions occur for some people diagnosed with diabetes mellitus or presumed to have the disease based on age, body habitus, comorbidities, lived environment, race, and ethnicity. Chondrosarcomas are the second most common primary bone malignancy. Chondrosarcomas are characterized by the production of cartilaginous matrix and are generally resistant to radiation and chemotherapy and the outcomes are overall poor. Hence, there is strong interest in determining mechanisms of cancer aggressiveness and therapeutic resistance in chondrosarcomas. There are metabolic alterations in chondrosarcoma that are linked to the epigenetic state and tumor microenvironment that drive treatment resistance. Our team has designed a spacecraft and mission for exploring the moons of Mars. The Lithological and Ultraviolet Photometry Assessment (LUPA) excursion vehicle is capable of crew habitation, autonomous rendezvous, and in-vacuum sample collection all in support of a parallel Mars surface mission to be carried out in the year 2040. Our project's key focus areas revolve around orbital mechanics, space vehicle propulsion analysis, scientific exploration, and the management of various interconnected spacecraft subsystems.

Background: Dementia care at home often involves decisions in which the caregiver must weigh safety concerns with respect for autonomy. These dilemmas can lead to situations where caregivers provide care against the will of persons living with dementia, referred to as involuntary treatment. To prevent this, insight is needed into how family caregivers of persons living with dementia deal with care situations that can lead to involuntary treatment.
Objective: To identify and describe family caregivers’ experiences regarding care decisions for situations that can lead to involuntary treatment use in persons living with dementia at home.

Abstract. Plankton form the base of the marine food web and are sensitive indicatorsof environmental change. Plankton time series are therefore an essentialpart of monitoring progress towards global biodiversity goals, such as theConvention on Biological Diversity Aichi Targets, and for informingecosystem-based policy, such as the EU Marine Strategy Framework Directive.Multiple plankton monitoring programmes exist in Europe, but differences insampling and analysis methods prevent the integration of their data,constraining their utility over large spatio-temporal scales. Aim: The aim of this integrative review was to synthesize studies that explore barriers to pain management in the Emergency Department.
Background: Pain remains one of the main reasons a person seeks help from the Emergency Department. However, patient's pain levels continue to be under-assessed and under-treated in Emergency Departments.
Design: Integrative Review Data Sources: A systematic review of Medline, PubMed, CINAHL, and Google Scholar electronic databases was performed. The articles were searched using the keywords, and the inclusion/exclusion criteria. Eleven studies published between 2011 and 2021 were found.
