Fighting Climate Change With The Charter: An Inquiry Into The Effects Of Litigating The Right To A Healthy Environment, Kevin Patrick Berk Mar 2021

Fighting Climate Change With The Charter: An Inquiry Into The Effects Of Litigating The Right To A Healthy Environment, Kevin Patrick Berk

LLM Theses

This thesis examines whether the litigation of the legal right to a healthy environment can adequately advance the values of its supporters. This question is answered through examining scholarly arguments in favour of the right, promotional material from Environmental Non-Governmental Organizations (ENGOs) litigating the right, court documents, as well as the results of a select number of interviews with senior members of Canadian ENGOs. It is ultimately argued that the intervention of lawyers and the interpretation of judges will narrow the intended scope of the right. Additionally, it is argued that the act of choosing to litigate implicitly affirms the …

Access To Environmental Justice: Ngo Environmental Advocacy On Mining-Related Environmental Issues In Mongolia, Ulziilkham Enkhbaatar Mar 2021

Access To Environmental Justice: Ngo Environmental Advocacy On Mining-Related Environmental Issues In Mongolia, Ulziilkham Enkhbaatar

LLM Theses

In this thesis, I apply the theory of environmental justice to determine how NGOs use substantive and procedural environmental rights to advocate for mining-affected nomadic communities in Mongolia. Environmental NGOs often possess legal and scientific expertise pertinent to resolving and mitigating environmental risks and demanding justice for environmental damages on behalf of the mining-affected local communities. Based on the environmental justice theories, I have constructed a theoretical framework to examine how NGOs access and implement environmental justice tools, both domestically and internationally. Using a multi-methods research approach, including documentary analysis and qualitative interviews with NGO experts and lawyers, I was …

The Regulation Of Paralegals In Ontario: Increased Access To Justice?, Lisa Danielle Trabucco Mar 2021

The Regulation Of Paralegals In Ontario: Increased Access To Justice?, Lisa Danielle Trabucco

PhD Dissertations

The legal profession throughout most of Canada enjoys the privilege of self-regulation and a (purported) monopoly over legal practice. In Ontario, the Law Society must regulate so as to facilitate access to justice and protect the public interest. Critics argue that self-regulation is anti-competitive it allows the profession to control the market for legal services, increasing the cost of services and restricting access to them and serves professional interests over the public interest. The Ontario government introduced paralegal regulation to enhance access to justice. Regulation would increase consumer choice and the competence and affordability of non-lawyer legal service providers. The …

Refugee Camps: In Search Of The Locus Of The Accountability Of The United Nations High Commissioner For Refugees (Unhcr) Under International Law, Zachary Lomo Mar 2021

Refugee Camps: In Search Of The Locus Of The Accountability Of The United Nations High Commissioner For Refugees (Unhcr) Under International Law, Zachary Lomo

PhD Dissertations

In this dissertation, I investigate the question how, and to what extent, can the office of the United Nations High Commissioner for Refugees (UNHCR) be held accountable, under international law, for its contribution to the harms to the environment and lives of refugees resulting from refugee encampment in refugee camps that it helps create, fund, and manage? Using data from primary and secondary sources and borrowing from certain theoretical paradigms and schools of thought, I theorise about the policy-context; the decision-making processes that produce refugee encampment; the locus of accountability for the injurious consequences of refugee encampment in refugee-hosting states …

Self-Determination As Resistance To Legal Violence: Jurisdiction, Property, And The Geographies Of Conflict In Unistoten And Xolobeni, Daniel Luke Huizenga Mar 2021

Self-Determination As Resistance To Legal Violence: Jurisdiction, Property, And The Geographies Of Conflict In Unistoten And Xolobeni, Daniel Luke Huizenga

LLM Theses

Indigenous peoples struggles of the right to self-determination are often framed as claims against a unified state. However, explanation of the forces inhibiting the expression of Indigenous self-determination should not settle with an understanding of the imposing power of the state. As I show, the realization of self-determination is undermined by the cumulative effects of legal practices and knowledges that contribute to the division of collective autonomies and disruption of their governance practices. In this transnational and comparative work on the emerging right to consent to resource extraction in South Africa and Canada, I argue that we might understand these …

How are our cities using nature-based solutions to confront the challenges posed by a warming climate, the loss of biodiversity and major resource depletion? This article discusses the opportunities and benefits of applying the concepts of regreening and rewilding of cities. The article engages with key sources and summarizes the background and development of regreening and nature-based solutions and important policies, concerns and perspectives of international and national organizations. It introduces the integration of nature-based solutions (NBS) as a strategy in urban planning with the aim to strengthen urban resilience and to slow down the biodiversity decline. Rewilding areas in …

Undoing Mastery: With Ambivalence?, Jess Linz, Anna J. Secor Mar 2021

Undoing Mastery: With Ambivalence?, Jess Linz, Anna J. Secor

Geography Graduate Research

In this commentary, we respond to Derek Ruez and Daniel Cockayne’s article ‘Feeling Otherwise: Ambivalent Affects and the Politics of Critique in Geography’. We do so by picking up ambivalence—or more precisely, ambivalence about ambivalence—as a tool with which Ruez and Cockayne leave us. We find this tool somewhat difficult to grasp, but we understand this as part of its design. Ambivalence undoes the subject’s mastery. In doing so, we find that an airing of ambivalence gives other kinds of entangled, indeterminate, and unknowing relations room to breathe.

Young Children’S Information-Seeking Practices In Center-Based Childcare, Sarah C. Barriage Mar 2021

Young Children’S Information-Seeking Practices In Center-Based Childcare, Sarah C. Barriage

Information Science Faculty Publications

Many children in the USA spend a significant amount of time in center-based childcare. However, research has yet to explore their information practices in this setting. This study investigates young children’s perceptions of the concept of information and their own information-seeking practices within the context of their day care classroom. The participants included 13 children between three and five years of age. Data was collected using participant observation, semi-structured interviews, child-led photo tours, and photo-elicitation interviews. The findings indicate that the children did not perceive the concept of information in a manner consistent with adult understandings of the term, and …

Mapping Brexit: Analysis Of The Results Of The 2016 Eu Membership Referendum, Jessica Long

Honors Program: Senior Projects (Public)

The 2016 EU Membership Referendum, also known as Brexit, resulted in the United Kingdom deciding to leave the European Union (EU). This paper uses mapping techniques to examine the results of the Brexit. Results of the referendum show that most voters within the United Kingdom (UK) voted along regional entities. The major regional entities examined within the paper include England, Wales, Scotland, and Northern Ireland. Within these regions, national identity, age, and economic status had a major influence on a voter’s decision to Leave or Remain in the EU. Demographics were mapped and examined at multiple levels to better understand …

Effectiveness Of A Social Work Informed Casework Training Curriculum For Paraprofessionals In Non-Profit Social Service Agencies, Mindy L. Mccormick

Social Work Doctoral Dissertations

This work presents a comprehensive study of the effectiveness of a social work informed casework training curriculum specifically developed for use with paraprofessionals, those without a four-year degree, working in a social service agency. Many studies have been written outlining the benefits of paraprofessional support in social service agencies, but little exists in how to properly train and support those paraprofessionals in their job roles. This study was designed to evaluate a new training curriculum to be utilized in meeting that need within the field. Multiple inferential analyses were conducted using pre-/post-test scores of 143 participants working in a national …

When Peril Responds To Plague: Predatory Journal Engagement With Covid-19, Ryan M. Allen

Education Faculty Articles and Research

Purpose

The academic community has warned that predatory journals may attempt to capitalize on the confusion caused by the COVID-19 pandemic to further publish low quality academic work, eroding the credibility of scholarly publishing.

Design/methodology/approach

This article first chronicles the risks of predatory publishing, especially related to misinformation surrounding health research. Next, the author offers an empirical investigation of how predatory publishing has engaged with COVID-19, with an emphasis on journals related to virology, immunology and epidemiology as identified through Cabells' Predatory Reports, through a content analysis of publishers' websites and a comparison to a sample from DOAJ.

Medical College Documents

Gene therapy (GT) has been reported to improve bone marrow function in individuals with Fanconi anemia (FA); however, its clinical application is still in the initial stages. We conducted this systematic review, following the Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) guidelines, to assess the long-term safety and clinical outcomes of GT in FA patients. Electronic searches from PubMed, Web of Science, Cochrane Library, and Google Scholar were conducted and full texts of articles meeting our inclusion criteria were reviewed. Three clinical trials were included, with a total of nine patients and mean age of 10.7 ± 5.7 …

Gas Stations And The Wealth Divide: Analyzing Spatial Correlations Between Wealth And Fuel Branding, Jean-Carl Ende Mar 2021

Gas Stations And The Wealth Divide: Analyzing Spatial Correlations Between Wealth And Fuel Branding, Jean-Carl Ende

Dissertations and Theses

The gasoline refining and sales industry has many peculiarities. One such oddity is a difference in sales, distribution and pricing between branded and unbranded gasolines. Although fuels leave the refinery a uniform commodity, branding determines entirely different marketing and pricing schemes, with entirely different volatility and risk premiums. In order to determine if this volatility is felt evenly across all wealth demographics, this study uses t-tests and CART models to analyze income, home value and other wealth-based indicators in the areas surrounding gas stations, to determine if there is a correlation between branding and wealth. The results show the wealth …

Math Escape Rooms: A Novel Approach For Engaging Learners In Math Circles, Janice F. Rech, Paula Jakopovic, Hannah Seidl, Greg Lawson, Rachel Pugh Mar 2021

Math Escape Rooms: A Novel Approach For Engaging Learners In Math Circles, Janice F. Rech, Paula Jakopovic, Hannah Seidl, Greg Lawson, Rachel Pugh

Journal of Math Circles

Engaging middle and high school students in Math Circles requires time, planning and creativity. Finding novel approaches to maintain the interest of a variety of learners can be challenging. This paper outlines a model for developing and implementing math escape rooms as a unique structure for facilitating collaborative problem solving in a Math Circle. These escape rooms were designed and hosted by undergraduate secondary mathematics education majors. We provide possible structures for hosting escape rooms that could translate to a range of settings, as well as reflections and lessons learned through our experiences that could inform practitioners in other settings.

Translating Land Justice Through Comparison: A Us-French Dialogue And Research Agenda., Megan Horst, Nathan Mcclintock, Adrien Baysse-Lainé, Ségolène Darly, Flaminia Paddeu, Coline Perrin, Kristin Reynolds, Christophe-Toussaint Soulard

Urban Studies and Planning Faculty Publications and Presentations

In this discussion piece, eight scholars in geography, urban planning, and agri-food studies from the United States (US) and France engage in a bi-national comparison to deepen our collective understanding of food and land justice. We specifically contextualize land justice as a critical component of food justice in both the US and France in three key areas: access to land for cultivation, urban agriculture, and non-agricultural forms of food provisioning. The US and France are interesting cases to compare, considering the differences and similarities in their colonial and agricultural histories, persistent and systemic race and class-based inequities in land access, …

Our Campaign Finance Nationalism, Eugene D. Mazo Mar 2021

Our Campaign Finance Nationalism, Eugene D. Mazo

Pepperdine Law Review

Campaign finance is the one area of election law that is most difficult to square with federalism. While voting has a strong federalism component—elections are run by the states and our elected officials represent concrete geographical districts—our campaign finance system, which is rooted in the First Amendment, almost entirely sidesteps the boundaries of American federalism. In so doing, our campaign finance system creates a tenuous connection between a lawmaker’s constituents, or the people who elect him, and the contributors who provide the majority of his campaign cash. The recent explosion of outside spending in American elections by wealthy individuals and …

Language And Cultural Issues In Uzbek Vocabulary, Lolakhon Khamidovna Nigmatova

Scientific reports of Bukhara State University

Abstract. In the article had been noted the harmony, stability and reflection of language and culture in the educational vocabulary. In order to teach the native language and inculcate the national and spiritual values and culture of the Uzbek people passed down from generation to generation to the younger generation, the role of dictionaries is very important. The creation of educational dictionaries with a history of several thousand years still remains an urgent task in the XXI century. It is not secret that in developed countries, the focus on the intellectual and spiritual upbringing of a person, the development of …

Nationalism, Patriotism, And Support For The European Union, Leonie Huddy, Alessandro Del Ponte, Caitlin Davies Mar 2021

Nationalism, Patriotism, And Support For The European Union, Leonie Huddy, Alessandro Del Ponte, Caitlin Davies

Political Science Faculty Articles and Research

Does attachment to a nation enhance or dampen support for the European Union (EU)? Using the 2003 and 2013 ISSP national-identity modules, we isolate and provide multi-item measures of two distinct types of national attachment—nationalism and patriotism. We find that they are positively related yet have divergent effects. We validate the measures showing that nationalism increases, and patriotism decreases, support for nationalistic policies (anti-immigration and protectionism) as expected. We then test the effects of nationalism and patriotism on EU attitudes and find that nationalism increases, and patriotism decreases, opposition to the EU. The presence of a neo-nationalist political party enhanced …
