This study is an evaluation of the restorative justice pilot program funded by the New York City Council and managed by the New York City Department of Education where key stakeholders including officials at the Department of Education, school administrators, educators, school staff, and community organizations are involved in the implementation of restorative justice in schools with high suspension rates. Taking It To Heart: Trauma And Cardiovascular Risk In Court-Involved People Of Color, Tanya Erazo Sep 2020

Taking It To Heart: Trauma And Cardiovascular Risk In Court-Involved People Of Color, Tanya Erazo

Dissertations, Theses, and Capstone Projects

Research supports that racial disparities in health persist in the United States, with cardiovascular risk and cardiovascular disease remaining particularly high in low-income, communities of color (U.S. Department of Health and Human Services: Centers for Disease Control and Prevention, 2013; Winkleby, Jatulis, Frank, & Fortmann, 1992). Public health literature often focuses on sociodemographic variables when assessing for health disparities without considering trauma or forensic populations. This dissertation provides an overview of literature that examines cardiovascular disease and its relationship to trauma, particularly in low-income, communities of color, and forensic populations. Although the dissertation culminates in providing results for an investigation …

An Institution “At Arm’S Length”: Reconsidering Supervisory Power Over The Federal Grand Jury, Rebecca Gonzalez-Rivas Sep 2020

An Institution “At Arm’S Length”: Reconsidering Supervisory Power Over The Federal Grand Jury, Rebecca Gonzalez-Rivas

University of Chicago Law Review

Grand jury proceedings are shrouded in secrecy. No judge presides over them, no reporter annotates them, and when they have concluded, no juror may speak about them. While secrecy serves many important functions for the grand jury, its veil may be lifted under certain circumstances. Grand jury records may be released if they fall under a disclosure exception laid out in Federal Rule of Criminal Procedure 6(e). While some courts limit release to the exceptions laid out in the Rule, others look to an alternative source of authority.

Several courts of appeals have held that district court judges may exercise …

The Costs Of Justice In Domestic Violence Cases : Mapping Canadian Law And Policy, Jennifer Koshan, Janet Mosher, Wanda Wiegers Sep 2020

The Costs Of Justice In Domestic Violence Cases : Mapping Canadian Law And Policy, Jennifer Koshan, Janet Mosher, Wanda Wiegers

Articles & Book Chapters

Domestic violence cases in Canada present unique access to justice challenges due to complex power dynamics, structural inequality, and the fact that victims, offenders, and children must often navigate multiple legal systems to resolve the many issues in this context. The complexity of these cases has both personal and systemic impacts. Different legal systems – for example, criminal, family, child protection, social welfare, and immigration – have differing objectives and personnel with varying levels of expertise in domestic violence. Conflicting decisions by different courts and tribunals with overlapping jurisdiction may impair the safety of victims and children, and may require …

Truth, Reconciliation, And The Cost Of Adversarial Justice, Trevor C. W. Farrow Sep 2020

Truth, Reconciliation, And The Cost Of Adversarial Justice, Trevor C. W. Farrow

Articles & Book Chapters

That Indigenous people in Canada were victimized for well over a century by the residential schools system for Aboriginal children is not in question. The system, which amounted to an “assault on child and culture,” was designed to “kill the Indian in the child.” Whether the legal system – purporting to provide some form of compensation in the context of claims by survivors and their families – has provided justice is a much more open question. The costs – financial, social, health, time, and so on – associated with pursuing the resolution of residential schools claims through the justice system …

Examining The Impact And Influence Of Government Surveillance On East German And Northern Ireland Communities During The 1970s And 1980s, Cliodna Pierce

Doctoral

The aim of this thesis is to explore the ramifications of surveillance by comparing aspects of the surveilled states of the GDR and NI during the 1970sand 1980s and their effects. This study will focus on the historical techniques and commonalties exploited by both states, exploringthe influential factors underlying the acceptance of surveillance, along with their impact on individual stakeholders, communities and societies. Foucault, who plays a key role in the theoretical framework of this thesis, in Discipline and Punishprovides ananalysis of Jeremy Bentham’s panopticonsuggests, in which he perceivedthe constant threat of surveillance has an altering effect on individual behaviour, surveillanceas …

The Politicization Of Religion And The Sacralized Balkan Nations Regarding Bosnia And Herzegovina, Faruk Hadžić Sep 2020

The Politicization Of Religion And The Sacralized Balkan Nations Regarding Bosnia And Herzegovina, Faruk Hadžić

Occasional Papers on Religion in Eastern Europe

Ethnic, national, and confessional affiliation in ex-Yugoslavia add to political radicalization. As a form of political power, politicized religions are, psychologically speaking, unconscious non-faith. Due to new national-state theoretical inadequacy, (i.e., nationalism as an ideology), religion is used as an instrument of socialization and legitimization of new national-political state subjects. When nation and religion become “controversial” identification and mark others as potentially dangerous, through a policy that allegedly aims to "affirm" and "protect" its people and their faith, then in local historical and current circumstances, it essentially implies antagonism in the most dramatic conflicts. The historical revisionism and the memory …

Views That Matter: Race And Opinions On Climate Change Of Boston Area Residents, Lorena M. Estrada-Martínez, Paul Watanabe, Katsyris Rivera-Kientz

Sustainable Solutions Lab

A growing body of research finds that climate change places a disproportionate burden on communities of color in the United States. In spite of this evidence, important discussions taking place about climate change- such as how it is experienced, which policy solutions are most critical, and how we can prepare for and adapt to its impacts- often leave out the voices of the very communities most affected. In Massachusetts, for instance, numerous statewide surveys have gathered information about residents ' attitudes and beliefs about climate change, but to date, no studies have been designed to include the views of a …

Application Of Forum Theatre In Medical Humanities Education: Focusing On Empathy - A Pilot Study, Pit-Yee Voo, Ko-Huang Lue, Ming-Che Tsai, Wen-Jiuan Yen, Tsu-Ann Kuo, Hai-Lun Sun

Journal of Medical Education

Purpose: Empathy is considered an important element for medical and health professions students to develop. Inter-professional learning gives medical students the opportunity to learn together with students in other professions with whom they will work collaboratively in the future. Traditional teaching methods such as lecture, conferences, and open discussion have long been criticized as being ineffective. We applied forum theatre, a type of theatre that promotes audience participation and explores different options for dealing with a certain issue, to enhance the empathy level of medical and health professions students and to promote their inter-professional learning. Methods: This was a cross-sectional …

Gender And Parliamentary Representation In India: The Case Of Violence Against Women And Children, Sadhvi Kalra, Devin K. Joshi Sep 2020

Gender And Parliamentary Representation In India: The Case Of Violence Against Women And Children, Sadhvi Kalra, Devin K. Joshi

Research Collection School of Social Sciences

To better understand how gender impacts parliamentary representation, we analysed representative claims made by parliamentarians in India, the world's largest democracy. Applying critical frame analysis to plenary debates in the Indian Rajya Sabha, we examined four parliamentary bills addressing violence against women and children under four successive governments between 1999 and 2019. Testing six hypotheses concerning who represents and how, our study found women legislators more active in speaking on behalf of women and children than male legislators. Women parliamentarians focused more on rehabilitating victims and expanding the scope of rights and rights-holders. Women were also more vocal in contesting …

The Influence Of Empowerment On The Development Of Compassion Fatigue In Oncology Nurses, Franklin J. Wynn Sep 2020

The Influence Of Empowerment On The Development Of Compassion Fatigue In Oncology Nurses, Franklin J. Wynn

Nursing Theses and Dissertations

Compassion fatigue is a growing issue in the oncology nursing population that has implications on outcomes such as job satisfaction and intention to leave a job. With an increased need for nurses nationally, compassion fatigue needs to be further studied to identify solutions that support the retention of the oncology nursing workforce. The concept of empowerment has been favorable in leading to proactive workplace behaviors and attitudes. However, literature showed underrepresentation of this variable in relationship to compassion fatigue. A program of research in connection to these variables is provided. A comparative concept analysis on burnout and compassion fatigue is …

Faith In Trump, Moral Foundations, And Social Distancing Defiance During The Coronavirus Pandemic, Justin T. Pickett, Amanda Graham, Francis T. Cullen, Cheryl Lero Johnson, Murat Haner, Melissa M. Sloan

School of Criminal Justice Faculty Scholarship

Purpose:

Over the past several months, the coronavirus has infected more than six million Americans and killed nearly 200,000. Governors have issued stay-at-home orders, and prosecutors have filed criminal charges against individuals for defying those orders. And yet many Americans have still refused to keep their distance from their fellow citizens, even if they had symptoms of infection. The authors explore the underlying causes for those who intend to defy these norms.

Methods:

Using national-level data from a March 2020 survey of 989 Americans, the authors explore intentions to defy social distancing norms by testing an interactionist theory of foundation-based …

Addressing Sexual Violence In K-12 Education, Taylor Bowie Sep 2020

Addressing Sexual Violence In K-12 Education, Taylor Bowie

McNair Scholars Manuscripts

Sexual assault has been widely recognized as a public health crisis for decades. Since at least the late 1980s, rates of sexual violence have been steady around 25% of women experiencing it by their freshman year of college. Our past and most prevalent prevention methods have consistently shown to be useless, as rates of violence have not decreased, and the results often do not lead to increased understanding about sexual assault and violence intervention. In recent years, college campuses have started to implement a new prevention education known as the bystander model. While the literature generally agrees it has some …

Restoring The Presumption Of Innocence: Protecting A Defendant’S Right To A Fair Trial By Closing The Door On 404(B) Evidence, Aaron Diaz Sep 2020

Restoring The Presumption Of Innocence: Protecting A Defendant’S Right To A Fair Trial By Closing The Door On 404(B) Evidence, Aaron Diaz

St. Mary's Law Journal

Congress enacted the Federal Rules of Evidence to govern evidentiary procedures and “eliminate unjustifiable expense and delay.” In criminal cases, for example, Federal Rule of Evidence 404(b) seeks to prevent prosecutors from improperly introducing a defendant’s past misdeeds. Nevertheless, prosecutors often attempt to introduce a defendant’s past misconduct to suggest that a defendant has a propensity to commit crimes, which is improper character evidence. Unsurprisingly, 404(b) is one of the most litigated evidence rules and has generated more published opinions than any other subsections of the Rules. And despite efforts to amend Rule 404(b), the rule has remained virtually untouched. …

Psychosocial Needs Of Released Long-Term Incarcerated Older Adults, Lisa A. Lares Sep 2020

Psychosocial Needs Of Released Long-Term Incarcerated Older Adults, Lisa A. Lares

Loma Linda University Electronic Theses, Dissertations & Projects

More than ever, long-term incarcerated older adults are being released into their communities. Many find themselves ill prepared to function in a society that has changed significantly during their incarceration. As a result, this growing population continues to gain attention as many poorly reintegrate due to their complex physical health, mental health, and social needs. Recent data suggest that this group of formerly incarcerated older adults (FIOA) is uniquely motived to make their reintegration successful. However, little is documented to further inform and validate best practices to help them succeed in this. The purpose of this dissertation research study was …

Non-Accidental Trauma: Nature Of Subsequent Encounters And Related Outcomes, Marina Bassili Sep 2020

Non-Accidental Trauma: Nature Of Subsequent Encounters And Related Outcomes, Marina Bassili

Loma Linda University Electronic Theses, Dissertations & Projects

Physical abuse results in a wide array of adverse outcomes, and victims of child abuse often require long-term, intensive care depending on the scope and severity of their trauma. The present study is an extension of a study which examined the services provided in the hospital to children with physical abuse that resulted in hospitalization (Kazandjian, et. al., 2016). It will examine the nature of subsequent hospital encounters in pediatric victims of Non-Accidental Trauma (NAT) at the Loma Linda University Children’s Hospital (LLUCH). Researchers will investigate the short-term and long-term physical, neurological, cognitive/developmental, behavioral, and social emotional effects experienced by …
