Challenging Racial Injustice In The Criminalization Of Homelessness In The United States: A Human Rights Approach, David Berris, Joseph Candelaria, Tamar Ezer, Lily Frances Fontenot
Articles
The criminalization of homelessness in the United States perpetuates a cycle of racial injustice and violates fundamental human rights. Longstanding discrimination in housing and law enforcement have resulted in disproportionate homelessness among Black Americans. Thus, laws and policies that criminalize life-sustaining behaviors, such as sleeping, in public further exacerbate racial disparities, punishing people for homelessness rather than addressing root causes. Criminalization results in fines that people cannot pay and criminal records, driving employment and housing out of reach and circulating individuals from the street to the criminal justice system and back. The criminalization of homelessness also directly violates international human …

Research outputs 2014 to 2021
For security and justice professionals (e.g., police officers, lawyers, judges), the thousands of peer-reviewed articles on nonverbal communication represent important sources of knowledge. However, despite the scope of the scientific work carried out on this subject, professionals can turn to programs, methods, and approaches that fail to reflect the state of science. The objective of this article is to examine (i) concepts of nonverbal communication conveyed by these programs, methods, and approaches, but also (ii) the consequences of their use (e.g., on the life or liberty of individuals). To achieve this objective, we describe the scope of scientific research on …

Comparing Students' Perspectives On A Rural University's Special District Police Department And Student's Traditional Hometown Police Departments, Angela Pierce
All Master's Theses
Understanding the public perceptions of police is not a new topic, but it is one that has not focused on that of university students. This current study aims to fill the gap in knowledge by comparing student’s perceptions of two different police departments; traditional hometown police departments and special district police. This study targeted a specific population, college students, that needs additional research to understand what factors contribute to their perceptions of police. This study gathered students’ perceptions of police using an email survey of all on-campus students in a regional state university. Using OLS regression, I was able to …

Examining How Comfortable Students Are In Contacting Campus Police At Central Washington University, Luis Gomez
All Master's Theses
The current study examined students’ willingness to contact campus police at Central Washington University. The dataset used to conduct the research study was the Fall 2019 survey collected by the LAJ department. Using Tyler's procedural justice model as a theoretical base, the current study examines students' willingness to contact the police based on key factors. The five demographic variables used were race/ethnicity, gender, sexual orientation, residency, and class standings. In addition to the demographic variables, three police attitude variables (general, demeanor, and effectiveness) were analyzed, but due to multicollinearity between these variables, the general attitudes variable was the only one …
A Content Analysis Of Institutions Of Higher Education's Sexual Assault Policies: Assessing Response To Sexual Assault In Georgia, Brianna Williams
A Content Analysis Of Institutions Of Higher Education's Sexual Assault Policies: Assessing Response To Sexual Assault In Georgia, Brianna Williams
College of Graduate Studies: Theses & Dissertations
Sexual assault is a public health concern that must be systematically addressed. The existence of a comprehensive sexual assault policy and compliance with federal regulations can guide institutions of higher education in responding to and preventing sexual assault on campus. Federal laws hold institutions accountable for providing a safe environment for students. The purpose of this qualitative content analysis was to assess compliance with federal policy and assess the response to sexual assault by IHE in Georgia. Data from the National Center for Education Statistics was utilized to identify Georgia's institutions receiving federal aid during 2018-2019. Using a proportionate stratified …
The Supreme Court And The Illegitimacy Of Lawless Fourth Amendment Policing, Ayesha B. Hardaway
The Supreme Court And The Illegitimacy Of Lawless Fourth Amendment Policing, Ayesha B. Hardaway
Faculty Publications
For more than half a century, documented police brutality has affected communities of color and the American legal system has largely failed to address it. Beginning with Rizzo v. Goode, Supreme Court decisions have allowed local police departments nearly unlimited discretion in their policies and practices. That decision and others demonstrate that the Supreme Court is misaligned with governmental initiated reforms. The Violent Crime Control and Law Enforcement Act of 1994, which allows the U.S. Attorney General and the U.S. Department of Justice (“DOJ”) to investigate law enforcement agencies’ practices and seek injunctive relief against agencies found to have engaged …

Sexual Exploitation And The Adultified Black Girl, Mikah K. Thompson

A troubling legacy of American chattel slavery is the justice system’s continued failure to provide adequate protection to African-American crime victims. This piece focuses on the law’s historic unwillingness to shield Black girls from acts of sexual violence. During slavery, lawmakers refused to criminalize rape committed against Black girls and women based not only on the fact that they were considered property but also on stereotypes about their sexuality. Even though the law now criminalizes the rape of Black girls, African-American rape survivors encounter more skepticism and hostility when they come forward with their stories compared to their White counterparts. …
Procedural Fairness In A Pandemic: It's Still Critical To Public Trust, Kevin S. Burke, Steve Leben
Procedural Fairness In A Pandemic: It's Still Critical To Public Trust, Kevin S. Burke, Steve Leben

Social science research shows that when judges apply procedural fairness (procedural justice) principles while handling cases, litigant satisfaction with the court system and willingness to comply with court orders increases. These principles call for judges to be sure people in court have a chance to be heard, are dealt with by a neutral but empathetic judge, and have a good explanation of both procedures and outcome.
The COVID-19 pandemic has disrupted normal court operations, putting additional pressures on both courts and litigants. The pandemic has also occurred when public trust in institutions generally is lower than normal. Since adherence to …

Sociology Faculty Articles and Research
Drawing upon in-depth life-history interviews with 91 North American-based former white supremacists, we examine how participants perceive homicidal violence as either an appropriate or inappropriate political strategy. Based on the current findings, participants considered homicidal violence as largely inappropriate due to moral concerns and its politically ineffective nature but also discussed how homicidal violence could be an appropriate defensive measure in RAHOWA (Racial Holy War) or through divine mandate. Capturing how white supremacists frame the permissibility of homicidal violence is a step toward better understanding the “upper limit” or thresholds for violence among members who are trying to construct and …
