The Wandering Officer, Ben Grunwald, John Rappaport
The Wandering Officer, Ben Grunwald, John Rappaport
Public Law and Legal Theory Working Papers
“Wandering officers” are law-enforcement officers fired by one department, sometimes for serious misconduct, who then find work at another agency. Policing experts hold disparate views about the extent and character of the wandering-officer phenomenon. Some insist that wandering officers are everywhere—possibly increasingly so—and that they’re dangerous. Others, however, maintain that critics cherry-pick rare and egregious anecdotes that distort broader realities. In the absence of systematic data, we simply do not know how common wandering officers are or how much of a threat they pose, nor can we know whether and how to address the issue through policy reform.

Innovation Institutions And The Opioid Crisis, Daniel J. Hemel, Lisa Larrimore Ouellette
Innovation Institutions And The Opioid Crisis, Daniel J. Hemel, Lisa Larrimore Ouellette
Public Law and Legal Theory Working Papers
The US has recently—and belatedly—come to recognize opioid addiction as a public health crisis. What has gone mostly unrecognized is the degree to which this crisis is intertwined with US intellectual property law and related elements of US innovation policy. Innovation institutions—the legal arrangements that structure incentives for production and allocation of knowledge goods—encouraged the development and commercialization of addictive painkillers, restricted access to opioid antidotes, and (perhaps most importantly) failed to facilitate investments in alternative, nonaddictive treatments for chronic pain. Although innovation policy does not bear all the blame for the opioid wave that has washed over communities across …

Marijuana Use Among Adults In The United States: Comparing Correlates Of Use, Assessing Impact Of Education, And Evaluating Use And Health Amid Justice-Involved Populations, Corey Pomykacz
Electronic Theses and Dissertations, 2020-2023
Over the past two decades, there have been significant changes in state-level policies (i.e., decriminalization, medicalization, legalization) in the U.S. regarding marijuana use. Prior research has found a relationship between marijuana policies and decreased perceived risk as well as increased prevalence of use. In light of these historical shifts, the public health implications of marijuana use deserve increased attention by researchers so that we can discern patterns of use, evaluate risk, and inform intervention. This dissertation has three aims: (1) investigate how correlates of use prevalence versus use frequency vary; (2) offer a theoretical explanation as to why more education …

Association Of Working Therapeutic Alliance And Psychopathy In Civilly-Confined Sex Offenders, Kearie Ann Newman
Association Of Working Therapeutic Alliance And Psychopathy In Civilly-Confined Sex Offenders, Kearie Ann Newman
Walden Dissertations and Doctoral Studies
Over the past decade, researchers have focused attention on the therapeutic alliance (TA) and its impact in treatment outcomes. The literature on TA has been focused primarily on its impact on the client’s participation, the accomplishment of goals, and treatment completion. However, very little of this research includes individuals who have psychopathy. Therefore, the purpose of this quantitative survey study was to explore the relation between the level of psychopathy (high versus low) and TA ratings of 16 therapists and 64 clients in the population of convicted civilly-confined male sex offenders. Bordin’s theory grounded the study. Data were gathered from …

Elementary Content Teacher Perceptions Regarding Their Ell Instructional Practices, Collier Wesley Owens
Walden Dissertations and Doctoral Studies
Instructional practices of elementary content teachers of English language learners (ELLs) and their alignment with improved ELL academic performance need to be explored. The purpose of this case study was to explore the instructional practices of elementary teachers of ELLs and how those practices are perceived by the teachers to be aligned with improved ELL academic performance. The study is grounded in Ladson-Billings’ theory of culturally relevant pedagogy which holds that student academic achievement and cultural identity should be affirmed. The research questions focused on exploring instructional practices used by teachers to support ELL learning and the teachers’ perceptions regarding …
Effects Of Prerelease And Reentry Programs On Male Recidivism In The Midwest, Tenisha N. Mack
Effects Of Prerelease And Reentry Programs On Male Recidivism In The Midwest, Tenisha N. Mack
Walden Dissertations and Doctoral Studies
AbstractThe purpose of this qualitative case study was to determine the effectiveness of prerelease and reentry programs on recidivism from the perspective of male ex-offenders. The prison population in the United States in 2.3 million according to the Bureau of Justice Statistics. Most ex-offenders recidivate in the first 3 years. Prerelease and reentry programs are responsible for successful reintegration for many ex-offenders. However, this study revealed that a holistic approach to rehabilitation pre-and postrelease contributed to a better quality of life for ex-offenders, their families, and communities. The operant conditioning and social cognitive theories provided the theoretical foundation for this …
Impact Of Interviewers’ Personal Bias On Hiring Of Law Enforcement Applicants, Richard W. Diffley
Impact Of Interviewers’ Personal Bias On Hiring Of Law Enforcement Applicants, Richard W. Diffley
Walden Dissertations and Doctoral Studies
Individuals posing a risk to the community who pass preemployment interviews represent a problem for law enforcement departments and their communities. The purpose of this phenomenological study was to explore the shared experiences of participants regarding hiring biases that may exist among individuals tasked with interviewing law enforcement applicants. Argyris’s organizational learning theory provided the framework for the study. Data were collected from semistructured interviews with 4 participants who had experience interviewing applicants for placement in a law enforcement department.Data were analyzed to identify themes.Biases included participants’ interpretation of applicants’ appearance, body language, ability to handle stress/pressure, preparedness for the …
The District Of Columbia And Gun Control Laws: Homicides And Social Impacts, Richard Ghislain Mbakop
The District Of Columbia And Gun Control Laws: Homicides And Social Impacts, Richard Ghislain Mbakop
Walden Dissertations and Doctoral Studies
Abstract
The District of Columbia has one of the toughest gun laws in the United States, yet the city has one of the highest homicide rates in the nation and much of this gun violence is concentrated in the southeastern part of the city. The framework for the study was comprised of (a) the psychological theory based on many arguments, such as labeling weapons as symbols of male superiority and power, and (b) the social contract theory. Finding the perceptions about the relationship between gun control laws and homicide rates in Washington D.C. was the essential aim of the study. …
Exploring The Dual Role Of Consumer And Provider In Substance Use Peer Support Workers, Christian Scannell
Exploring The Dual Role Of Consumer And Provider In Substance Use Peer Support Workers, Christian Scannell
Walden Dissertations and Doctoral Studies
Peer support is built upon the premise that shared life experiences will benefit both the helper and the receiver. In the substance abuse field, this relationship has been linked to an increase in practical knowledge, empowerment, hope, and community connectedness. However, the research on peer support is primarily geared toward the effectiveness of the intervention for the consumer. Less is known about the role of this relationship in the recovery of the workers themselves. The purpose of this generic qualitative study was to explore the experience of recovery in substance abuse peer support workers. A recovery framework and the helper …

The Kids Are Airight: Teen Sexting, Child Pornography Charges, And The Criminalization Of Adolescent Sexuality, Blaire Bayliss
The Kids Are Airight: Teen Sexting, Child Pornography Charges, And The Criminalization Of Adolescent Sexuality, Blaire Bayliss
University of Colorado Law Review
"Sexting" is a term that refers to the exchange of sexually explicit or sexually suggestive messages or images between individuals using electronic messaging. Teenage sexting is a controversial legal topic because the act of taking nude or semi-nude pictures of a minor technically constitutes child pornography under federal law, even when those pictures were self-portraits taken by the minor in question. This Comment argues that the prosecution of sexting under federal child pornography law constitutes the criminalization of adolescent exploration of sexuality and that states should adopt their own sexting-specific laws to address teenage sexting in a manner that respects …
Boynton V. Virginia And The Anxieties Of The Modern African-American Customer, Amber Baylor
Boynton V. Virginia And The Anxieties Of The Modern African-American Customer, Amber Baylor
Faculty Scholarship
In 1958, Bruce Boynton was arrested for ordering food in a Whites-Only diner and charged with criminal trespass. Sixty years later, African Americans continue to face arrest and threat of arrest in commercial establishments based on discriminatory trespass claims. When store owners or employees decide to exclude would-be patrons from their establishment for discriminatory reasons, both overt and implicit, they rely on the police to enforce this form of discrimination. This article considers the legacy of Boynton v. Virginia, particularly the resonance of Boynton’s unaddressed claim, that the state enforcement of discriminatory trespass allegations is an Equal Protection violation.

New Brunswick Needs A Public Inquiry Into Systemic Racism In The Justice System: Nova Scotia Shows Why, Naiomi Metallic

First Nations across New Brunswick have been demanding a public inquiry since the deaths of Chantel Moore and Rodney Levy at the hands of police barely a week apart from each other, and less than two months after the failed prosecution of the man alleged to have hit and killed Brady Francis. There are serious problems in the province’s justice system.
Mi’gmaq and Wolastoqiyik peoples are demanding more than just an investigation into the police conduct in Moore’s and Levy’s deaths; what is sought is a full examination of how New Brunswick’s justice system fails First Nations peoples in the …
Evidence, Rollie Thompson
Evidence, Rollie Thompson
Articles, Book Chapters, & Popular Press
“Evidence” is what, in our adversary system, the parties attempt to place before the neutral factfinder in order to prove their case (or disprove their opponent's case). We follow the principle of party-presentation: parties determine what specific items of evidence are offered for proof, while the impartial judge or decision maker will determine which items are “admissible” evidence, in accordance with principles of law. At the end of the trial or hearing, the fact-finder (jury, judge, tribunal, decision maker) will determine which of those admissible items of evidence are believed or not, in formulating “fact-guesses” or “findings of fact”.
