Re-Conceptualizing The International Human Right To Health: An Analysis Of The Trends In Developing And Developed Countries’ Responses To Substance Use Disorders, Leonard Mukosi
San Diego International Law Journal
This Article juxtaposes addiction paradigms seen in the United States of America and Zimbabwe, two countries with diametrically dissimilar political, economic, and social systems. Thus, an insight is provided by this Article into how developing and developed countries are transitioning from punitive to curative approaches in addressing the problem of drug addiction. Positing that addiction is a health condition, this Article recognizes the optimum realization of the addict’s right to health is best met if the required international standards of health are implemented nationally to insure, treat, and evaluate addiction like other chronic illnesses.

Beyond Wildlife Crime: Towards The Concept Of ‘Mundane Fauna Crime’, Orlando Goodall
Beyond Wildlife Crime: Towards The Concept Of ‘Mundane Fauna Crime’, Orlando Goodall
School of Law, Humanities and Social Sciences
Research and theorisation on crimes against non-human species in rural regions have been conducted with less conceptual refinement than crimes against anthropocentric victims. The dominant conception of ‘wildlife crime’ predominantly advanced by the rational choice school of criminology is a nebulous ‘chaotic concept’. This article disaggregates crimes against common and relatively abundant species from that capacious categorisation and offers the original concept of ‘mundane fauna crime’ as a more precise alternative. The original concept aims to supersede the wildlife crime terminology using realist social relations theory and to offer researchers a rational abstraction to advance aetiological explanations. The additional category …
Deported Veterans: The Unintended Consequences Of “Good Moral Character”, Jonathan Deras
Deported Veterans: The Unintended Consequences Of “Good Moral Character”, Jonathan Deras
Master's Theses
The purpose of this research is to argue that U.S. immigration policy, specifically the 1996 IIRIRA (also known as IIRAIRA), needs to change regarding the legal treatment of immigrant U.S. military veteran deportees due to the following concepts. The first concept is to articulate how the criminalization of immigration, and how the military system intersects to facilitate the Deportation of U.S veterans. A key concept in this analysis is the standard of “good moral character” set by the U.S. government that enlistees need to meet to be accepted into the military; this standard is also used against immigrant veterans during …

Parental Responsibility Of Children Crime In Indonesian Criminal Adat Law, Ahmad Irzal Fardiansyah, Sigid Suseno, Mien Rukmini, Lies Sulistiani

Children who are in conflict with the law cannot be separated from the responsibilities of parents as the first party in the childs environment. The relationship between parents and children is a harmonized relationship from a strong emotional connection on the basis of blood relations. This situation makes parents unable to release and be released responsibility for their childrens behavior. When children are faced with the law, policies to take over the responsibility of supervising children from parents, by denying that parents actually have the opportunity to deal with the problems of children who are dealing with the law are …

Covid-19 And Preventing Harm To Vulnerable Children, Jessica K. Heldman, Margaret A. Dalton, Robert C. Fellmeth
Covid-19 And Preventing Harm To Vulnerable Children, Jessica K. Heldman, Margaret A. Dalton, Robert C. Fellmeth
San Diego Law Review
Although COVID-19 mercifully seems to affect children less severely than adults, children are far from immune from the impacts of the virus. Public health orders closing schools and businesses, cancelling events, and keeping children at home have been disruptive and distressing to many children and families. But for children who rely on government entities for protection, care, custody, and services, the effects of the public health orders can be devastating. COVID-19 and the response to it has serious implications for the safety, well-being, and development of these vulnerable children—those within the child welfare, juvenile justice, and special education systems. All …
More Than A Mask: Stay-At-Home Orders And Religious Freedom, Dorit Rubinstein Reiss, Madeline Thomas
More Than A Mask: Stay-At-Home Orders And Religious Freedom, Dorit Rubinstein Reiss, Madeline Thomas
San Diego Law Review
COVID-19 has changed our legal universe. Many states are responding by issuing stay-at-home orders, and as cases rise, may have to prohibit gatherings again. One issue states and courts have to grapple with is the relationship between stay-at-home orders and religion. Stay-at-home orders that require closing down churches may be challenged as violating the First Amendment’s guarantee of religious freedom. Under our current jurisprudence, these cases may be handled under a highly deferential standard or under strict scrutiny—depending on the specific order in question, as well as on whether the state has a Religious Freedom Restoration Act (RFRA). We recommend, …

Prisons And Pandemics, Camila Strassle, Benjamin E. Berkman
San Diego Law Review
This Article focuses on how to balance public health, public safety, and incarcerated people’s legal rights when implementing a program for early release from confinement. Ethical, epidemiological, and legal arguments all point to a need for an immediate reduction in the incarcerated population. However, this leaves open several points of reasonable disagreement about how to manage early release. These include how to set priorities for processing and releasing individuals across the country. For example, officials could prioritize screening individuals who are housed in facilities that have been hit hard by infection; or by screening individuals who have a safe place …

Peer Influence In Initiation To Heroin Use, Barbara J. Costello, Bradley J. Anderson, Michael Stein
Sociology and Anthropology Faculty Publications
Much research on heroin initiation shows that most people use heroin initially with friends or family. However, there is little research examining why those who use heroin would initiate others to its use, and conversely, whether and why one might try to prevent initial heroin use in others. Following recent work on peer influence on crime and delinquency, we test the hypothesis that those with higher levels of self-control are less likely to initiate others to heroin use and are more likely to try to prevent others from using for the first time. The sample included 370 persons entering an …

On a Wednesday afternoon a sixteen-year-old boy is hanging out after school with four of his friends. He is your average sixteen-year-old; he has a girlfriend who works at Wendy’s, and his current worry is about passing his driving test. He smokes some weed from time to time with his friends, but he has a clean criminal record. After complaining about being broke and deciding they have nothing better to do, the five friends elect to break into a seemingly vacant home in order to steal some items for resale. He is already thinking about what he will buy with …

An Ecological Approach To Improving Reentry Programs For Justice-Involved African American Men, Precious Skinner-Osei, Peter Claudius Osei
An Ecological Approach To Improving Reentry Programs For Justice-Involved African American Men, Precious Skinner-Osei, Peter Claudius Osei
Journal of Prison Education and Reentry (2014-2023)
This article is a re-analysis of a previous study (please see https://doi.org/10.1080/10911359.2017.1402724). Considering the previous findings, in addition to the recent discussions around criminal justice reform, race, policing, and mental health in the United States, the data were reanalyzed using an updated version of QSR NVivo. The new findings revealed that reintegrating justice-involved African American men back into society requires reentry programs to utilize a different approach. Reentry programs must be constructed under the notion that the process involves multiple interrelated components that interact with larger systems outside the individual or organization's immediate control or organization advocating for them. …

Writing-to-learn benefits students in polishing their communication skills and understanding of statistical concepts cultivating a deeper understanding of statistics. A series of writing-to-learn activities were given to introductory statistics students at a community college in the Rocky Mountain region of the United States. Historically, research on the teaching and learning of statistics has been performed on undergraduates while overlooking the experiences of community college students in learning statistics. A total of 79 students completed the feedback instrument over the course of three semesters (Summer 2017, Fall 2017, and Spring 2018). The feedback instrument included three Likert scale questions, two open-ended …

Research outputs 2014 to 2021

The Portrayal Of African Immigrants: A Framing Analysis Of Newspaper Coverage, Oluwatosin Arowosola
Theses
Immigration has been an interesting subject to the public and a prominent issue that cannot be ignored. Issues such as immigration policies and reforms, fear of immigrants bringing crime, immigrants taking jobs from native-born families, and many more. With the growth of African immigrants increasing in the United States (Pew Research, 2017), and new immigration policies put in place in 2017 during the first year of President Trump’s presidency, this study investigates how African immigrants are portrayed in The New York Times Newspaper. Using Framing theory, this study employed the content analysis method and examined newspaper articles published from 2017 …
