Dissertations, Theses, and Capstone Projects
Fraud, Waste, Abuse, and Corruption present significant challenges to the efficient use of public resources and stifle government service improvement by detracting from policy development and undercutting funding for important initiatives. The purpose of this study is to better understand the aids and impediments to investigations of these offenses and provide a generalizable definition for the mission of Inspectors General, the group tasked with monitoring and addressing these offenses. This study also sought to identify the material role of software in investigations of Fraud, Waste, Abuse, and Corruption. Through a purposive sampling, 18 Inspectors General from the federal, state, and …

A Fiduciary Theory Of Prosecution, Bruce A. Green, Rebecca Roiphe
A Fiduciary Theory Of Prosecution, Bruce A. Green, Rebecca Roiphe
Articles & Chapters
Scholars have failed to arrive at a unifying theory of prosecution, one that explains the complex role that prosecutors play in our democratic system. This Article draws on a developing body of legal scholarship on fiduciary theory to offer a new paradigm that grounds prosecutors’ obligations in their historical role as fiduciaries. Casting prosecutors as fiduciaries clarifies the prosecutor’s obligation to seek justice, focuses attention on the duties of care and loyalty, and prioritizes criminal justice considerations over other public policy interests in prosecutorial charging and plea-bargaining decisions. As fiduciaries, prosecutors are required to engage in an explicit deliberative process …
Assessing The Impact Of Crisis Intervention Team (Cit) Training And Local Mental Health Resource Availability On Officer Perceptions Of Efficacy In Responding To The Mentally Ill, Chelsea Jordan Bennett
Assessing The Impact Of Crisis Intervention Team (Cit) Training And Local Mental Health Resource Availability On Officer Perceptions Of Efficacy In Responding To The Mentally Ill, Chelsea Jordan Bennett
Theses and Dissertations
Police officers are often the first responders to emergency mental health and crisis situations, with almost one-third of all mental health referrals stemming from law enforcement interaction. As a result of deinstitutionalization, a large number of mentally ill individuals have become involved in the criminal justice system and brought to police attention, resulting in unnecessary arrests and an overrepresentation of individuals with mental illness in jail populations. Recent decarceration trends have now placed the focus on diverting individuals with mental illness into treatment. However, officers often lack the proper skills, training, and knowledge of how to interact with individuals with …
Overcoming The Conflict Of Jurisdiction In Cybercrime, Abdelmonem Mohamed Magdy Khalifa
Overcoming The Conflict Of Jurisdiction In Cybercrime, Abdelmonem Mohamed Magdy Khalifa
Theses and Dissertations
This study explores the different approaches to managing the conflict of criminal jurisdiction over cybercrime with the aim of comparing the advantages and disadvantages of each approach. It argues that the most effective solution to this dilemma is to determine certain factors to be considered and evaluated by a body established for such a purpose or by the concerned states themselves in order to decide which country will take the exclusive competence over the cybercrime in accordance with the facts of each individual case and taking into account the characteristics of cybercrime. Establishment of these factors should reflect the interests …

The Effects Of Rejecting Mind-Body Dualism On U.S. Law, Matthew W. Lawrence
The Effects Of Rejecting Mind-Body Dualism On U.S. Law, Matthew W. Lawrence
William & Mary Journal of Race, Gender, and Social Justice
While neuroscience continues to make it clearer that mental processes, effects, disorders, and states can be described through physical observation, the metaphysical notion of mind-body dualism still pervades the U.S. legal system. In this Article, I discuss many areas where mind-body dualism holds fast, and others where mind-body dualism has already been explicitly or impliedly rejected. I argue that in most areas, the dualist distinction would have little to no impact on the values the law already describes. However, I argue that rejecting dualism would have an impact on fundamental rights analyses. First Amendment free speech rights, fundamental rights, and …

Using Genre Theory To Reduce Mass Shootings, Meghna Israni
Using Genre Theory To Reduce Mass Shootings, Meghna Israni
English Student Scholarship
“Suicide contagion” is a well-established phenomenon in which highly publicized suicides are followed by a spike in the general suicide rate. In recent years, scholars have proposed a similar media contagion effect in mass shootings, a claim that’s supported by a growing body of statistical and sociological evidence. The fact that increased media coverage is linked to an increase in the probability of another mass shooting suggests that news media exercise some power over mass shootings. This paper, drawing attention to the “genres” within mass shootings, explores how news media can rewrite these narratives in order to craft a more …

The Washington State Second Chance Expungement Gap, Colleen Chien, Zuyan Huang, Jacob Kuykendall, Katie Rabago
The Washington State Second Chance Expungement Gap, Colleen Chien, Zuyan Huang, Jacob Kuykendall, Katie Rabago
Faculty Publications
Every time a person is convicted of a crime, this event is memorialized in the person’s criminal record in perpetuity, setting off thousands of potential collateral consequences, including being penalized in searches for employment, housing and volunteer opportunities. To remove these harmful consequences, Washington law allows people whose criminal records meet certain conditions to vacate their records. However, the Second Chance Gap in Washington “expungements” - the share of people who aren’t accessing the vacation remedy because of hurdles in the petition process - we suspect is large. To estimate it, we used research and practice expertise to approximately model …
Borders And Boundaries: Importing Asset Recovery "Duty Free" In Transitional Justice Processes, Prosper Maguchu
Borders And Boundaries: Importing Asset Recovery "Duty Free" In Transitional Justice Processes, Prosper Maguchu
Indonesian Journal of International Law
As new conflicts emerge, transitional justice practitioners are finding it increasingly imperative to incorporate the concepts of asset recovery into transitional justice processes and mechanisms. However, for its success, the pillar of transitional justice relating to international asset recovery needs strengthening. Yet a granular understanding of this dimension remains a critical blind spot in the transitional justice and human rights conversation. This paper brings the dynamics of asset recovery as an emerging aspect of human rights law to the fore. In terms of methodology this paper relies on Sharp’s critically motivated problem-solving theory. The paper suggests that for transitional justice …

When Is Due Process Due?: The Impact Of Title Ix Sexual Assault Adjudication On The Rights Of University Students, Rachael A. Goldman
When Is Due Process Due?: The Impact Of Title Ix Sexual Assault Adjudication On The Rights Of University Students, Rachael A. Goldman
Pepperdine Law Review
As a part of the Educational Amendments of 1972, Title IX was created to address sex discrimination in sports programs receiving federal funding. However, its scope has ballooned tremendously over the years to include a variety of conduct occurring on college campuses. Currently, Title IX is the primary legislation governing sexual assault and harassment allegations stemming from universities. This Note explores the use of Title IX in universities and addresses the concerns that arise when a civil rights law becomes the primary mechanism for adjudicating allegations of criminal conduct. Specifically, this Note addresses the due process concerns that arise when …
Filling The Illinois Federal District Court Vacancies, Carl Tobias
Filling The Illinois Federal District Court Vacancies, Carl Tobias
Pepperdine Law Review
President Donald Trump repeatedly argues that appellate court appointments constitute his major success. The President and the United States Senate Republican Party majority have established records by approving fifty very conservative, young, and capable appellate court jurists. However, their confirmations have exacted a toll, particularly from the many federal district courts which address seventy-nine unfilled positions in 677 judicial posts. One constructive illustration has been the three Illinois tribunals which confront five pressing openings. The Administrative Office of the United States Courts classifies three as “emergencies,” because the vacant seats have been protracted and involve substantial caseloads. Despite this circumstance, …

Chronic Traumatic Encephalopathy And The Built Environment, Dak Kopec, Kendall Marsh
Chronic Traumatic Encephalopathy And The Built Environment, Dak Kopec, Kendall Marsh
Architecture Faculty Research
© 2020, Faculty of Engineering, Universitas Indonesia. All rights reserved. Traumatic Brain Injuries (TBIs) are often connected to the development of Chronic Traumatic Encephalopathy (CTE), a degenerative brain disease commonly found in athletes, military veterans, and others that have a history of repetitive brain trauma. This formative exploratory study looked at person-centred design techniques for a person with CTE. The person-centred design method used for this study was based on a two-tiered reductionist approach; the first tier was to identify common symptoms and concerns associated with CTE from the literature. This information provided specific symptoms that were addressed through brainstorming …
Why Do Officers Support Community Policing? A Cross-Departmental And Cross-Temporal Comparison, Mary Shupard, Erin M. Kearns
Why Do Officers Support Community Policing? A Cross-Departmental And Cross-Temporal Comparison, Mary Shupard, Erin M. Kearns
Criminology and Criminal Justice Faculty Publications
Community policing is often seen as a way to repair fractured relationships between law enforcement and the public. Despite its relationship-building promise and widespread department-level adoption, individual officers show varying levels of support for community policing which can harm policy implementation. Why are some officers more supportive of community policing than others? Prior research suggests that demographic factors such as the officer's gender, race, age, and education can explain this variance. Across these studies, however, there are several contradicting or non-replicating findings. Conflicting findings may result from differences by department or differences in methodology or temporal variance – but most …
The Effect Of Acute Interpersonal Racial Discrimination On Smoking Motivation And Behavior Among Black Smokers, Patricia F. Calixte-Civil
The Effect Of Acute Interpersonal Racial Discrimination On Smoking Motivation And Behavior Among Black Smokers, Patricia F. Calixte-Civil
USF Tampa Graduate Theses and Dissertations
In comparison to White smokers, Black smokers are more likely to report both discrimination and less success in smoking cessation. No previous study has tested the causal relationship between actual experienced racial discrimination and smoking variables associated with cessation. The goal of this study was to test the casual influence of interpersonal racial discrimination on smoking motivation (i.e., the urge to smoke cigarettes, cessation self-efficacy, and smoking behavior) using a controlled experimental design. We used a virtual ball-playing game to create a laboratory model of racial discrimination. A 2x2 between-subjects factorial design (inclusion/exclusion vs. ingroup/outgroup) was used to randomly assign …

Domestic Law Responses To Transnational Cyberattacks And Other Online Harms: Internet Dreams Turned To Internet Nightmares And Back Again, Clive Walker, Ummi Hani Binti Masood
Notre Dame Journal of International & Comparative Law
Since its utilization has become widespread, the potential of the Internet has often been overshadowed by the harms it’s capable of bringing upon society. Regulation has not yet properly addressed the harms presented to individuals’ cybersecurity and the U.K. has focused and set objectives at a national security level, while ignoring the effects of attacks on individual citizens. This Article considers whether it is possible to create a domestic legal response to transnational cyberattacks and the appropriateness of law to address the threats, as they exist. The law must be efficient, effective, and fair, which are all aims it may …
