The extent of the working area of the Regional District Court is equal to the provincial administration area consisting of Regency/city, while its position is in the provincial capital. This condition raises the legal gap in the eradication of corruption crimes, because on the one hand so the extent of the working area of the Court of Tipikor, causing many things corruption to be held, on the side will also require a large cost and a lot of judges power, and ideally will take a long time in the process of examination of a case. The study used qualitative research …

Analytic Jurisprudence In Time, Dan Priel

Articles & Book Chapters

Friedrich Nietzsche had this to say about philosophers:

"You ask me which of the philosophers’ traits are really idiosyncrasies? For example, their lack of historical sense, their hatred of the very idea of becoming, their Egypticism. They think that they show their respect for a subject when they de-historicize it, sub specie aeterni – when they turn it into a mummy. All that philosophers have handled for thousands of years have been concept-mummies; nothing real escaped their grasp alive. When these honorable idolators of concept worship something, they kill it and stuff it; they threaten the life of everything they …

Is Environmentalism The Right Strategy To Decarbonize The World?, Marco Marini, Ornella Tarola, Jacques-Francois Thisse Dec 2020

Is Environmentalism The Right Strategy To Decarbonize The World?, Marco Marini, Ornella Tarola, Jacques-Francois Thisse

Fondazione Eni Enrico Mattei Working Papers

We study how the supply of environmentalism, which is defined by psychic benefits (costs) associated with the purchase of high-environmental (low-environmental) qualities, affects the way firms choose their products and the ensuing consequences for the global level of pollution. Contrary to general belief, a high supply of environmentalism does not give rise to a better environmental outcome because it endows firms with more market power which they use to maximize profits. By contrast, standard policy instruments such as a minimum quality standard or the use of greener technologies leads to a better ecological footprint.

Peer Influence In Initiation To Heroin Use, Barbara J. Costello, Bradley J. Anderson, Michael Stein Dec 2020

Peer Influence In Initiation To Heroin Use, Barbara J. Costello, Bradley J. Anderson, Michael Stein

Sociology and Anthropology Faculty Publications

Much research on heroin initiation shows that most people use heroin initially with friends or family. However, there is little research examining why those who use heroin would initiate others to its use, and conversely, whether and why one might try to prevent initial heroin use in others. Following recent work on peer influence on crime and delinquency, we test the hypothesis that those with higher levels of self-control are less likely to initiate others to heroin use and are more likely to try to prevent others from using for the first time. The sample included 370 persons entering an …

Why Do Greater Forest Tenure Rights Not Enthuse Local Communities? An Early Observation On The New Community Forestry Scheme In State Forests In Indonesia, Arsad Ragandhi, Agus Heruanto Hadna, Setiadi Setiadi, Ahmad Maryudi Dec 2020

Why Do Greater Forest Tenure Rights Not Enthuse Local Communities? An Early Observation On The New Community Forestry Scheme In State Forests In Indonesia, Arsad Ragandhi, Agus Heruanto Hadna, Setiadi Setiadi, Ahmad Maryudi

Forest and Society

The Indonesian Ministry of Environment and Forestry recently issued a 35-year permit-based social forestry, called Izin Pemanfaatan Hutan Perhutanan Sosial (IPHPS), which was implemented in forestlands managed by the State Forest Corporation (SFC). IPHPS is a unique scheme because social forestry permits were previously granted on forestland unencumbered with rights. It provides more secure tenure rights (long-term permits), greater decision-making authority, and improved profit-sharing arrangements compared with the SFC’s co-management model. However, IPHPS has not attracted widespread interest from local communities. This paper aims to identify and to analyse factors that explain local communities’ low interest in the policy. Results …

Implementation Of Social Forestry Policy: A Review Of Community Access, Budi Budi, Hariadi Kartodihardjo, Bramasto Nugroho, Rina Mardiana

Forest and Society

The issuance of social forestry licence and the achievement of benefits to the community in the post-licensing stage are still obstacles and difficulties for the community which is demanding the community access. The research aims to analyze the access of the community of social forestry licence holders in the pre-licence and post-licensing stages through field studies in forest community of Beringin Jaya Lampung and people’s forest plantation of Hajran Jambi qualitatively. In the pre-licence stage, the two license holder communities have the same access to all members who will be involved, information, facilitator, and government authorities. In the post-licensing stage, …

Soil Seed Banks Of Tree Species From Natural Forests, Restoration Sites, And Abandoned Areas In Chiang Mai, Thailand, Patsavipich Rungrojtrakool, Pimonrat Tiansawat, Arunothai Jampeetong, Dia Panitnard Shannon, Sutthathorn Chairuangsri

Forest and Society

Soil seed banks have been used for investigation of natural regeneration of forests. In this study, we compared seed density and species composition of soil seed banks of trees among natural forests, restored forests of different ages, and abandoned agricultural land. The soil seed banks were collected from a natural forest (NF), 12-year-old and 17-year-old restoration sites (RF12y and RF17y), and 17-year-old abandoned site (AA) at Ban Mae Sa Mai, Chiang Mai, Thailand. A seedling emergence technique was used to assess seed density and species of emerged seedlings was identified. We found 5-8 tree species at each site. Seed densities …

Work-Family Spillover And Depression: Are There Racial Differences Among Employed Women?, Ariane L. Rung, Evrim Oral, Edward S. Peters Dec 2020

Work-Family Spillover And Depression: Are There Racial Differences Among Employed Women?, Ariane L. Rung, Evrim Oral, Edward S. Peters

School of Public Health Faculty Publications

The intersection of work and family life can be a source of burden (negative) and a source of growth (positive). Negative work-to-family and family-to-work spillover have been linked to poor mental health, while positive work-to-family and family-to-work spillover have been linked to improved health outcomes. Less is known about these relationships in racial subgroups. Louisiana, USA, has a large proportion of African Americans, providing a unique population in which to study these relationships. The objectives of this study were to examine, among a sample of women in southern Louisiana in 2017, levels of work-family spillover by race and how the …

Does Age Of Second-Language Acquisition Improve Intellectual Processing Abilities?, Sanum Shafi Dec 2020

Does Age Of Second-Language Acquisition Improve Intellectual Processing Abilities?, Sanum Shafi

Theses - ALL

Past research on bilingual education indicates that the onset-age of second language learning is negatively associated with both second language proficiency and the cognitive benefits of being bilingual. However, there is inconsistency in the bilingual education field as to whether bilingual speakers benefit from enhanced intellectual processing abilities compared to monolingual speakers. The critical period hypothesis states that during childhood development a certain window of time exists in which second language acquisition skills are strongest. This hypothesis provides the theoretical foundation for my research study. In the current study, I synthesize evidence on the associations between onset-age of second language …

The Affective Politics Of Democratic Erosion: Explaining Mass Support For Executive Aggrandizement, Aykut Ozturk Dec 2020

The Affective Politics Of Democratic Erosion: Explaining Mass Support For Executive Aggrandizement, Aykut Ozturk

Dissertations - ALL

During the last two decades, executive aggrandizement has emerged as one of the chief threats to democratic regimes. In various countries, ranging from Turkey and Hungary to Venezuela, elected incumbents used their democratic mandates to gradually dismantle democratic institutions. Similar patterns of executive aggrandizement have been visible even in an advanced democracy, the United States of America. Executive aggrandizement is facilitated by the consistent electoral support that incumbents with authoritarian agendas enjoy. In order to understand this threat to the future of liberal democracies, we first need to explain why voters support leaders eroding democratic rights and freedoms in their …

Mindful Inquiry - A Deweyan Assessment Of Mindfulness And Education, David John Wolken Dec 2020

Mindful Inquiry - A Deweyan Assessment Of Mindfulness And Education, David John Wolken

Dissertations - ALL

Mindfulness-based interventions are becoming an increasingly popular means for helpingstudents deal with the multidimensional challenges they face in contemporary educational settings. While potentially helpful, an uncritical employment of mindfulness in education can paradoxically function to reify the very neoliberal social conditions leading to the need for mindfulness in the first place. I assess this trend in educational theory and practice through John Dewey’s pragmatic philosophy. I show that the potential for both mindfulness and Dewey’s theory of mind and inquiry to support critical, sustainable social change is truncated by an uncritical retaining of the modern paradigm of mind that defines …

#Metoo: Networked Celebrity Advocacy As Capital Performance, Li Chen Dec 2020

#Metoo: Networked Celebrity Advocacy As Capital Performance, Li Chen

Dissertations - ALL

Celebrity advocacy scholars have studied how social movements utilize celebrity appeal to attract media and public attention for decades. Some researchers have found that celebrity advocacy failed to achieve exceptional performance in the legacy media age. Moreover, only a very few top-class celebrities have successfully attracted legacy media attention regarding advocating social causes. This dissertation introduces the concept of networked celebrity advocacy to illustrate a new route on networked social media. Employing theories of capital and the framework of social network analysis, I test networked celebrity advocacy in the case of the #MeToo movement on Twitter. This dissertation analyzes the …

Library Philosophy and Practice (e-journal)

The reality of ethnic identity becomes an interesting phenomenon when used in political communication practices, especially in democratic government systems, because it can be a differentiator for its users in forming a political image or identity. Using a qualitative research method with a case study approach, this research succeeded in revealing that the attributes of political communication by Regent Dedi Mulyadi through verbal and nonverbal messages and his political communication strategy were the practice of managing impressions to form a certain political identity. To achieve this goal, the use of social media is an important political communication strategy. The construction …

Healing Through Ancestral Knowledge And Letters To Our Children: Mothering Infants During A Global Pandemic, Noralis Rodriguez-Coss, Miriam G. Valdovinos, Rupal Parekh

Critical Race and Ethnic Studies Faculty Scholarship

The struggle for work–life balance amongst women in academia who are both mothers and scholars continues to be apparent during a global pandemic highlighting the systemic fissures and social inequalities ingrained in our society, including systems of higher learning. Women of color professors on the tenure track are vulnerable to the intersecting ways capitalism, sexism, and racism exacerbate the challenges faced by motherscholars, making it imperative to explore these nuances. While motherscholars may share advice about navigating family leave policies or strategizing scholarship goals, no one could have prepared us for our motherscholar roles during a pandemic. We were, in …

Why Inclusion Isn’T Coming, It Is Already Here: Catholic Schools And Inclusive Special Education, Michael N. Faggella-Luby, Max Engel Dec 2020

Why Inclusion Isn’T Coming, It Is Already Here: Catholic Schools And Inclusive Special Education, Michael N. Faggella-Luby, Max Engel

Journal of Catholic Education

Catholic school personnel are increasingly recognizing that many of their students, including students with disabilities, need and benefit from inclusive educational practices. These oftentimes ad hoc practices are motivated by the Catholic identity and mission of the school, as well as the diverse educational needs of students. This article responds to these recognized realities, arguing that Catholic Social Teaching (CST) and the practical reality of academically diverse students requires understanding disability as being unique to each student, though within categories recognized in the Individuals With Disabilities Act (IDEA) that serve as starting points for interventions. CST and the recognition of …

Contextualized Discipleship: A Catalyst System For The Xxi Century, David Rangel Dec 2020

Contextualized Discipleship: A Catalyst System For The Xxi Century, David Rangel

Doctor of Ministry Projects and Theses

The reality for the Christian churches in the U.S. is that congregations are declining in attendance. Local churches are being closed every year, and the people called Christians are decreasing in their discipleship practices more than in previous years. However, the reason for this disgraceful reality is not because people have stopped attending church; rather, it is because there are now fewer Christians. Unfortunately, churches in their effort to make disciples prefer to buy a curriculum that, in the end, does not reflect the needs and realities of their own context. More than ever, the Christian industry in the U.S. …
