Should Consistency Be Part Of The Reform Prosecutor’S Playbook?, Kay Levine
Should Consistency Be Part Of The Reform Prosecutor’S Playbook?, Kay Levine
Hastings Journal of Crime and Punishment
In this piece, I explore the value of consistency in a prosecutor’s office that is committed to racial justice, fiscal responsibility, and strategies to reduce the size of the carceral state. I argue that consistency of process, rather than consistency of outcome, is the principal value that leadership ought to embrace in furtherance of its reformist goals. In prioritizing consistency of process, the office would design a “prosecutorial calculus” to guide line prosecutors’ case management decisions (i.e., it would identify the factors that should influence whether and what to file, how to handle pre-trial release, and what to offer as …

Rural Futures Institute: Publications
In March 2019, a bomb cyclone produced a historic blizzard as well as flooding that impacted many counties in Nebraska. Given that, did rural Nebraskans experience extreme weather events or natural disasters in 2019? To what extent were they harmed by these weather events? What personal impacts did they experience? How concerned are they about weather events? This paper provides a detailed analysis of these questions. This report details 1,979 responses to the 2020 Nebraska Rural Poll, the 25th annual effort to understand rural Nebraskans’ perceptions. Respondents were asked a series of questions about weather events. Comparisons are made among …

Importance: Trauma is the leading cause of death for US individuals younger than 45 years, and uncontrolled hemorrhage is a major cause of trauma mortality. The US military's medical advancements in the field of prehospital hemorrhage control have reduced battlefield mortality by 44%. However, despite support from many national health care organizations, no integrated approach to research has been made regarding implementation, epidemiology, education, and logistics of prehospital hemorrhage control by layperson immediate responders in the civilian sector.
Objective: To create a national research agenda to help guide future work for prehospital hemorrhage control by laypersons.

This project involves the research and comparison of seven cities’ climate action plans, each from its own region within California. The areas selected roughly represent major California regions, each with unique characteristics that will impact the characteristics of the climate action plan’s framework and contents. This analysis will identify similarities in framework and content among each plan, highlighting organizational differences, some generalized observations, and the consistency of topics covered and not covered within the plans. This project reviews the California Office of Planning & Research’s General Plan Guidelines Chapter 8, the California Office of Emergency Services’ California Adaptation Planning Guide, …
The Detention-To-Deportation Pipeline And Local Policies Of Resistance: A Case Study Of Santa Clara County, California, Matt Bakker Phd
The Detention-To-Deportation Pipeline And Local Policies Of Resistance: A Case Study Of Santa Clara County, California, Matt Bakker Phd
Societies Without Borders
Deportation has reached record levels in the United States over the last decade. A major reason for this is that the federal government began using integrated databases and biometric surveillance technologies to identify deportable migrants whenever they come into contact with law enforcement officials. Implementing this enforcement technology in all jurisdictions across the country, the federal government undermined local inclusionary policies and brought state and local police into the work of federal immigration enforcement. This article examines efforts in one locality – Santa Clara County, California – to limit cooperation with this federal deportation machine. Drawing on documentary evidence and …

The First Amendment’S Real Lochner Problem, Genevieve Lakier
The First Amendment’S Real Lochner Problem, Genevieve Lakier
University of Chicago Law Review
One of the most common criticisms of contemporary free speech law is that it is too Lochnerian. What critics usually mean by this is that First Amendment doctrine, by extending significant constitutional protection to advertising and other kinds of commercially oriented speech, makes the same mistake as the Supreme Court made in Lochnerv New Yorkand other late nineteenth-and early twentieth-century Due Process Clause cases: namely, it grants judges too much power to second-guess the economic policy decisions of democratically elected legislatures.
This Article challenges that argument—not to reject the idea that contemporary free speech law resurrects Lochner, but instead to …

Analyzing Political Marketing In Indonesia: A Palm Oil Digital Campaign Case Study, Fajrina Khairiza, Bevaola Kusumasari
Forest and Society
Social media in political marketing is an emerging area of research. This study explains how social networks are constructed in a digital campaign, identifying key actors, and messages involved in modern political marketing. A hotly contested palm oil campaign in Indonesia serves as a case study to analyze and visualize the messaging content found in digital campaigns. Social Network Analysis (SNA) was used to map the social network sites in Twitter and to track social interaction patterns in the #SawitBaik campaign. The results confirmed that state institutions, non-governmental institutions, news media, and individuals were key actors in the digital campaign. …

ETSU Today [magazine]
At East Tennessee State University, we are accustomed to dealing with hardship. It has been a defining part of our past. When tested by economic crises, wars, and threats to our very existence, our leaders, our faculty and staff, our students, our alumni, and our neighbors have met the challenge. ETSU not only survived, but it prevailed and prospered. It will continue to do so. From the very earliest days, our leaders faced uncertainty. Only eight days after the beginning of classes at East Tennessee State Normal School, our founding President, Sidney Gilbreath, was troubled. Faculty had already been on …
Surveillance Technology Toward A Dystopian Future, Sandy Hernandez
Surveillance Technology Toward A Dystopian Future, Sandy Hernandez
University Honors Program Senior Projects
There is a continual debate between individuals who attempt to measure the individual’s right to privacy against the government’s right to know as an exchange to provide for the security of all citizens. Questions that demand an answer are whether the individual’s right to privacy outweighs the government’s duty to provide security; and if security is considered more important, can there even be a right to privacy. When questioning the right to privacy and state surveillance, there are three key goals. First, to investigate whether the human right to privacy should exist, considering the continued threat of terrorist attacks and …
Pretrial Detention In The Time Of Covid-19, Jenny E. Carroll
Pretrial Detention In The Time Of Covid-19, Jenny E. Carroll
Faculty Scholarship
It is hard to overstate the impact of COVID-19. When it comes to the criminal justice system, the current COVID-19 crisis has shone a light on pre-existing flaws. Long before the first confirmed case in Seattle or elsewhere, America’s jails and prisons were particularly susceptible to contagions, exacerbated by problems from overcrowding to over policing to lack of reentry programs. This Essay focuses on one aspect of the challenges the criminal justice system faces in light of COVID-19 and beyond—that of a pretrial detention system that falls more harshly on poor and minority defendants, has swollen local jail populations, and …

Ultimately, this study helped identify a connection between the two. Finally, the final chapter of this paper …
The Power Of A Clean Slate, J.J. Prescott, Sonja B. Starr
The Power Of A Clean Slate, J.J. Prescott, Sonja B. Starr
Articles
Tens of millions of Americans have criminal records, including about 20 million with felony convictions. Conviction records automatically trigger countless collateral legal consequences, such as occupational restrictions that bar employers from hiring qualified candidates. Moreover, research overwhelmingly shows that bearing a criminal record raises significant barriers to employment, housing, and various other opportunities. These persistent obstacles can overwhelm an individual’s efforts at reintegration and can aggravate poverty, inequality, and racial disparities in our society. And because factors like unemployment and housing instability contribute to crime risk, these effects in turn make society less safe.

Analyzing The Response To Covid-19 In Pennsylvania State Correctional Institutions, Elizabeth A. Rousseau
Student Publications
To evaluate the effects of the COVID-19 outbreak on the Pennsylvania prison system, I collected data from the Pennsylvania Department of Corrections, the Pennsylvania Department of Health, and the Marshall Project. I supplemented the data with opinion pieces and journal articles discussing the specific issues that this pandemic imposes upon prisons in the United States. In sum, population data collected from the Department of Corrections showed that only a few State Correctional Institutions saw a steady decrease in population over the 25 day study period from from June 18th through July 13th (Pennsylvania Department of Corrections, 2020). Combining testing data …

The objective of this research lies within a community's effects upon, reactions to, and perceptions towards safety in their inhabited landscapes during various periods of the day. Through cognitive and spatial research, we can construct bridges between individuals' perceptions and reality. This study pertained to a student population sample and their views of public safety on the University of Arkansas campus in Fayetteville, Arkansas. Questions were asked as to why they felt unsafe, and where they felt the most unsafe (or safe). The student perceptions were compared to reported crimes on the University of Arkansas campus to ascertain gaps in …
The Relationship Between Leadership Practices And Organizational Commitment Of Telecommunicators, André Lanier
The Relationship Between Leadership Practices And Organizational Commitment Of Telecommunicators, André Lanier
Graduate Theses and Dissertations
The performance of 9-1-1 telecommunicators can mean the difference between life and death for the person on the other end of a phone. Effective leadership is critical to the success of the public safety answer point (PSAP) and the organizational commitment of the 9-1-1 telecommunicator. Bass and Riggio’s (2006) Full Range of Leadership Theory (FLRT) is the basis for the current study. The FRLT covers leadership styles from laissez-faire to transformational (Matikainen, 2019).
The purpose of conducting the study was to identify and describe the 9-1-1 telecommunicator’s organizational commitment based on the PSAP leadership categories. The study made use of …

Federal Right To Try Act: Heightened Informed Consent And Price Regulation Measures Will Improve Quality, Autonomy, And Exploitation Issues, Brenda Lin
UC Law Business Journal
This Note will examine the federal Right to Try Act, which was enacted on May 30, 2018. The federal statute followed the passage of Right to Try legislation in thirty-eight states, including California. Much controversy has surrounded “Right to Try” as an alternative to preexisting pathways to investigational drug treatments, such as traditional clinical trials and the FDA-regulated Expanded Access program, also commonly known as “Compassionate Use.”
This Note will examine those criticisms, evaluate the federal Right to Try Act, and propose amendments through the lenses of health care quality, patient autonomy, and long-term scientific innovation. Some controversy stems from …

Mistreating Central American Refugees: Repeating History In Response To Humanitarian Challenges, Bill Ong Hing
Mistreating Central American Refugees: Repeating History In Response To Humanitarian Challenges, Bill Ong Hing
UC Law Journal of Race and Economic Justice
In the 1980s, tens of thousands of Central Americans fled to the United States seeking refuge from civil unrest that ravaged their countries. In a largely geopolitical response, the Reagan administration labeled those fleeing Guatemala and El Salvador as “economic migrants,” detained them, and largely denied their asylum claims. The illegal discrimination against these refugees was exposed in a series of lawsuits and through congressional investigations. This led to the reconsideration of thousands of cases, the enlistment of a corps of asylum officers, and an agreement on the conditions under which migrant children could be detained.
Unfortunately, the lessons of …

See This Empty Cage Now Corrode: The International Human Rights And Comparative Law Implications Of Sexually Violent Predator Laws, Michael L. Perlin, Heather Ellis Cucolo
Articles & Chapters
From every perspective, our sexually violent predator (SVPA) laws are a miserable failure. In this paper, we present a new approach: a turn to international human rights law as a source of rights for the population in question, and a consideration of the matter from the perspective of comparative law.
To briefly summarize, many nations have enacted laws that both mirror and contradict early developments in United States civil commitment jurisprudence. In these nations, though, challenges to community containment and preventive detention laws have been more successful when based upon international human rights law. Also, registry notification is generally far …
